don't even do it. we're looking pretty good this morning. we have some interesting developments in the weather department. the interesting part is we're not going to get out of this cooler than normal pattern for five to seven days. it's a tale of two sides of the bay. if you live inland you're living it. at the coast down right cold this morning. we'll talk about why the cold air continues to pump into the bay area even though it's mid july and finally when the weather will warm up. answers coming up. let's check with mike, what we're facing on the road. >> we're facing a little less construction in the south bay 880 has off ramps clear, northbound 101 around 85, construction zone there as you're coming up out of morgan hill. that should be cleared over the next maybe 20 minutes or so. we should see all those crews cleared. speed sensor showing the true tail. golden gate bridge shows fog and misty conditions. watch roads and especially off ramps.

an accident at lincoln avenue. listen to this. three-quarters of a million dollars just to shuffle papers. turns out this is what the highest paid employee in the state did last year. "today in the bay's" bob redell joins us with the details. >> good morning. not what he was hired to do but that's what he ended up doing. you might recall last week when we reported that the highest person in the state was a prison doctor, is a britnprison doctor last year took home $770,000. turns out he hasn't been able to practice medicine in the corrections system for the last year and a half because of alleged incompetence. he has essentially been on mail room duty at the high desert prison in susanville since last 2009 while still being allowed to take home a fat paycheck. why has this happened? the state wants to fire him and actually did at one point but he was rehired on appeal.

when he was reinstated they owed him not only his base pay of $235,000 but back pay of $540,000 for the two years he wasn't working fight the termination. you put those two figures together and come up with three-quarters of a million dollars in take home pay for 2010. even though he is still, quote, a prison doctor, the "times" reports they won't let him practice medicine because they don't trust his skills. on two occasions he should have sent patients with heart problems to the hospital but he didn't. one patient died under his care which supervisors plame his substandard skills. he also has a history of mental illness. the "times" did try to reach out to him but his attorney refused comment only saying they believe they are trying to get him to quit by having him shuffle papers. if you want to see how the state of california is spending your tax dollars in other ways,

incidentally students at stanford university puts out a website that let's you search how the state is spending your money especially when it comes to employee wages, pension costs that sort of thing. can you search by department. the website is cacs.org. california common sense, google that and get to the webs. reporting live in the newsroom, bob redell, "today in the bay." amazing. 5:04. the man accused of killing two people on fisherman's wharf has an appointment with the judge. a mental competency hearing is scheduled at 9:00 this morning in a san francisco courtroom. wu is accused of killing two rival employees from a store on fisherman's wharf. they killed them because the store sold similar items to his and were taking his business. ten most wanted criminals list, police looking for

jonathan "john john" walker. the 20-year-old joined the list after killing 19-year-old robert o'brian and injuring another man at a bay view home in january. walker is the prime suspect for two fatal shootings in vallejo. they say walker is armed and dangerous and has not left the bay area. he's 6' tall and weighs 200 pounds. he has self tattoos which are include hearts and ribbons and wings with ribbons. new documents reveal jaycee dugard was the fifth identified victim of kidnapper philip garrido. they released papers shows previous victims had also been attacked in south lake tahoe. the first known attack happened in 1972 and stretched throughout the decade. the district attorney says law enforcement new garrido committed these crimes while searching for dugard but he never became a suspect. philip garrido pled guilty for kidnapping and assaulting dugard

and is serving a 431-year prison sentence. his wife nancy was given a 36-year term. police reaching out to the immigrant community trying to build a better relationship. chief chris moore will attend a community meeting tonight to address issues on violent crimes in san jose. also talk about a growing distrust of the police department by immigrants. the meeting be held at sacred heart community service in san jose. it starts tonight at 6:00. following developing news from oakland where the city park commission will weigh in on a controversial dog park. if the park that has even dog lovers fighting against each other. "today in the bay's" christie smith live in oakland with more on the story. good morning. >> good morning to you. well, you know, on the one hand you have dog lovers who are trying to push the city of oakland forward. it's a large city and it only has five dog parks. on the other hand, you have some neighbors here who say one of these locations being looked at

is completely wrong because it would put dogs front and center near an entrance to popular lake merritt. both locations being considered are near the lake. the newer alternative would be near children's fairy land tucked away in a grove of trees at a cost of $40,000 according to the chronicle. the original plan, which has preliminary approval already is near mcarthur and lakeshore, grand lake theater area. the problem there is the neighbors complain it's valuable space used for sports and lounging, very rare open space. i mentioned oakland has five dog parks. san francisco, by comparison, has 17. oakland also has a strict no dog rule in city parks. oakland dog lovers say they really don't want to go with a plan at this point because it would mean more delays for dogs wanting to romp and catch a tennis ball in peace. you can weigh in at the meeting at 4:30 today at lake side park

garden center at 666 well view avenue here in oakland. reporting live in oakland, christie smith, "today in the bay." >> thank you very much, christie, 5:07. students will have to save more for college this fall. students will see another 12% heek on top of a 10% hike in november. the trustees approved that increase yesterday. enrollment will be increased by 10,000 students stayed wide. full time student will now pay almost $5500 a year for school. immediately following the tuition hike, the cfu trustees made a controversial move. they approved a $400,000 a year salary for the new president of san diego state university. that is $100,000 more than the previous university president made. three trustees voted against the new salary including lieutenant governor gavin newsom. jerry bruin wrote, i fear your approach is setting a pattern for public service we cannot

afford. all right. 5:08. let's check in with meteorologist christina loren with a check of the cooler forecast in the area. >> you can afford your pg&e bill. it's been rather high at my place so i'm taking this break with stride. we're looking good. this is something i want to show you. this is a graphic i built for you yesterday. showed you where that low pressure system was. take a look at how much it's moved in the past 24 hours. there it is, really hasn't moved at all. as a result of this slow-moving low we're going to see cooler conditions today. and it looks like it's going to take quite sometime to get out of this very, very mild pattern for this time of year. back behind that area of low pressure, now we've got another pulse on its way into the bay area. the two combined will keep that on-shore flow fully in effect. that means for us foggy start, cool start, temperatures of 15 to 20 degrees below their seasonal averages for mid july. some people are really embracing this weather. 59 in concord, you're going to

a san jose-based chain of supermarkets cook in trouble for violating workers right. former employees are planning to announce legal action against the market. they claim their basic rights have been violated. they have paid fines before for violating wage and hour laws. pueblo employees 3,000 workers throughout california. another day of negotiations over the debt limit will begin at the white house in the next couple of hours. president obama and his gop rivals appear to be at an impasse. they continue to meet to try to work things out. the debt limit debate is one of the many things affecting the markets this morning. nicole lapin live at cnbc headquarters with our news before the bell. good morning, nicole. >> a very good morning to you, laura. futures are higher this morning as stocks closed lower for a third straight day. investors shrugging off the latest fed meetings which suggested some officials were considering more stimulus plans if the economy continues to slow but the fed isn't ready to take

action yet. markets focused on europe's debt crisis as moody's cut ireland's bonds to junk status. asia rose overnight after reported its economy grew faster than expected this spring. europe was higher. a lot of the attention is going to be on capitol hill as you rightly know as fed chairman ben bernanke is testifying on the economy. to recap the market action yesterday the dow fell 58 points, 12,446 is where we closed. nasdaq composite lost 20 to 2781. the treasury department will announce today that as of january 1st, banks will no longer sell paper savings bonds of you're going to have to buy bonds electronically through the treasury website now. could save the government $70 million over five years, not a lot but we'll take it. paper bonds won't completely disappear. can you buy them using your tax refund. charles schwab will let investors invest directly in

overseas markets. it will launch next year allowing you to buy in 12 foreign markets. converting dollars to other currencies, euro, yen, whatever you're thinking about will execute the stock trade. other discounts like fidelity and etrade, laura that offer similar services. those are the latest headlines out of cnbc. >> can we add a service adding a couple of zeros at the end. that would be nice. >> i always hoped they would do something like that. >> when you hear of it, you let me know. >> i will. >> thank you very much, nicole. it is 5:17 right now. ambitious recycling plan in one bayary county, sonoma work ongoing a plan to make 100% recyclable. two-thirds of waste is recycled, reused or diverted from landfills. the plan reaches 80% 2015 and 90% by 2020. the county says it will achieve

goals by recycling and reusing construction and demolition debris as well as creating a com posting center. we can always do our part. 5:17 right now. what about when it comes to the forecast. let's check in with christina loren, cooler out there. >> especially if you want to get outside and do some com posting later today. the weather will be quite nice, especially inland. however, if you're waking up with us at the coast this morning, it's going to be cold. you'll need the jacket in places like san francisco, half moon bay today, probably won't break out of the 50s. you've got this really stubborn pattern, two areas of low pressure now will continue to pump that cool marine air into the bay area kicking up the on-shore flow. as a result our temperatures will be 15 to 20 degrees below average. the same goes for tomorrow, really no change until the weekend when we start to gradually rise in temp. even with high pressure regaining control, it's not doing to warm up all that much. as a matter of fact, we're only expecting temperatures to reach

the 80 degree mark as we head through sunday. really not a lot of warmth on the way. 70 in redwood city, 71 los gatos, 72 today in san jose. as we head throughout the remainder of the week and into the weekend, we're getting pretty close to that now. as you can see not a lot of warmth on the way, 76 sunday, up to 80 on monday. 83 degrees tuesday. does look like as we head through the latter portion of next week finally our temperatures will regain where we're supposed to be, averages as we head through sunday, monday, and tuesday. that's when things will start to feel more summer-like back here. back to you. >> not too hot. >> thank you very much. more than two years later and no definitive answer from the baseball commissioner about bringing a's to san jose. bud selig at the all-star game last night where he was asked if he made a decision about the plan. he said he's still reviewing the options. more than two years ago selig organized a blue ribbon panel to

only active living service members to receive the medal of honor. yesterday president obama honored leroy petri by putting the honor around his neck. he will be in the hall of heroes. he lost a hand when he grabbed a large grenade tossing it back to enemy lines saving the lives of his fellow servicemen. today's induction will be held at the pentagon. netflix is raising prices by a lot. scott mcgrew says that has netflix customers figuring what they are going to cut. >> my extremely informal poll says a lot of people are not going to agree to that 60% price hike and will make changes to their rental plan instead. under the price hike which goes into effect in september for current customers, the one dvd out at a time plan with streaming jumps from $9.99 a month to just under $16 a month. if you decide to get rid of dvds or get rid of streaming, do just one or the other, you can

actually save money. the price will be $7.99 a month. now, if you go to streaming only, that means you could use some of the money you save to get seven movies a month from dvd machines, assuming you return them on time. some machines have new release dvds much sooner than netflix so there's an advantage there, too. this is great news for coin star, which owns red box. so why is netflix raising prices? the company needs to come up with billions of dollars to pay movie studios for the rights to stream all those movies. you may have noticed much of what's on netflix, watch it now, are kind of b movies. some of the best movies come from the agreement with starz. that agreement expires soon. also the company couldn't come to an agreement with sony, so all the sony studio movies came off of netflix watch it now as well. >> it's interesting, do you get a guarantee if i'm going to pay 60% more -- >> cool movies, you get those on

infant prepares to appear in court. people of san bruno were at fault for the deadly explosion. wednesday july 139, this is "today in the bay." good morning, thanks for joining us. i'm laura garcia-cannon halfway through the workweek. let's check with meteorologist christina loren. good morning. although we're in the middle of july, it doesn't feel like it out there. we have fog so thick we have reduced visibility. right now pretty good visibility except san francisco, six miles even in the city. all that means as we head through the next couple of hours, just a matter of time before we get down to a quarter of a mile or less that traditionally happens this time

marla tellez joins us live in san mateo with an update on the case this morning. good morning. >> reporter: good morning, laura. that is absolutely correct. we are awaiting official word from the san mateo d.a. in redwood city. official word is they have decided not to file charges against deshon marman. this has not been confirmed yet. this is a talker of a story we reported a month ago when marman was arrested at sfo. marm marman was arrested. he was pulled off for refusing to pull up sagging pans. he was arrested for battery of a police officer, resisting arrest and trespassing. just yesterday more than 100 people rallied at san francisco city hall, including his mother donna doyle in support of her son who plays football for the university of new mexico. she says this is a race issue and she wants her son's record cleared and an apology from the

airlines. >> this is awesome that you are taking the time out of day to come out and support my baby. >> us airways says it does not have a dress code but expects passengers to dress in an appropriate manner that does not offend passengers. the naacp does not buy this, certainly after video shows the airline allowed a scantily clothed man flying without any sort of problems. now, on the flip side of this and doing some research this morning, i actually found a facebook page has been created that's called "pull up your pants deshon marman" so clearly against the 20-year-old. which way will be san mateo d.a. decide to go. we're awaiting confirmation that it has decided not to file charges against the 20-year-old. >> it will be interesting,

interesting to hear about social media getting involved as well. thank you. 5:33 right now. pacific gas and electric company says it does not intend to blame victims for the san bruno explosion they suffered. in response to more than 100 lawsuits seeking damages as a result of the gas pipeline. the original filing suggested a third party may have been responsible, therefore pg&e should not be held responsible. a resident said the amend filing still contains the original language that could hold victims responsible for damages. the teenager accused of shooting and killing an infant in east palo alto will be in court today to enter a plea. 17-year-old fabian saragosa will be tried as an sult in the death of three-year-old garcia. the teen was retaliating for a gang beating when he opened fire

"today in the bay's" bob redell joins us live in the newsroom on this investigation with more. >> reporter: good morning, laura. he's supposed to be treating in the high desert prison in susan villa couple of miles northeast of us. since late 2009, he's just been shuffling papers while still taking home this enormous paycheck of the "l. a. times" reports his bosses have barred him from practicing medicine in the prison because of alleged incompetence. and they can't fire him so instead they placed him on mail room duty. it's not like the state happened tried to get rid of him. they did fire him once but he was rehired on the appeal. when he was rehired the state

weather system we've been having this whole year. >> a year of extremes, so i, for one, not surprised by these changes. the good news is we could have temperatures in the triple denlgs right now. we'll take the 70s, although very, very uncommon for this time of year. you can see we've got two areas of low pressure really intensifying that on-shore flow. this one hasn't moved all that much over the next 24 hours. right now starting to produce showers in the pacific northwest. that's doing to drag a little front through our area today. we've got another pulse back behind that that will continue that on-shore flow all the way through sunday. temperatures well below seasonal averages. if you want to make outdoor plans this weekend, you might be doing so with a jacket on in mid july. this is what we're looking at today. fog formation, see that marine layer this morning, very, very vivid satellite imagery showing you where our temperatures are headed as a result of that heavy cloud cover. 58 in livermore right now as we round out the day at 4:00 p.m.

>> reporter: hey, good morning, laura. feels a little like deja vu. we're talking about this every morning. here is what's changed a little bit unfortunately, the tone. things more contentious, personal and still no closer to any agreement. that in spite of a dire warning by president obama yesterday saying if they don't reach some type of agreement by the august 2nd deadline, things like social security checks, veterans checks, disability checks, some 70 million checks may not go out to the people that need them. house speaker john boehner called that a veiled threat and said it's the president's problem. mitch mcconnell says he would try to really make this the president's problem saying they would give the president the authority to raise the debt ceiling in exchange for him suggesting spending cuts. they would only do it, though, through 2012 when republicans hope to defeat him in an election. it's a controversial plan, a lot of people talking about it in

washington. they are going to be talking again for eastern time this afternoon, laura. >> thank you for the update. it is 5:44 right now, a rocky seaside climb turned deadly from sunnyville. police on the big island said the man from sunnyvale died after being swept onto the ocean. he was climbing on a rocky clip when a wave knocked him into the ocean and carried him about 100 yards out to sea. rescuers found him face down in the water. they tried to give him cpr by later died at the hospital. he was the second bay area man swept out to sea in hawaii over the weekend. the family of 44-year-old david potts will return home to san anselmo tomorrow. potts fell into a blow hole vacationing in maui. he and his brother were hiking when he fell in. >> david, watch out, it's a big one.
