>> might have to grab a jacket taking the dog for a walk on july 13th. we'll have your full forecast "today in the bay." good morning to you and thanks so much for joining us woenlgs morning. it's 6:00. i'm laura garcia-cannon. time to check in with meteorologist christina loren. she has a look at our forecast. >> good morning to you. pretty much wherever you're waking up, inland or immediate coast, you will likely encounter drizzly fog this morning. in fact, we're actually measuring that drizzly fog in places like san francisco. we've got this unusual cooldown cooler today, cooler than yesterday. i do know when summer like weather will come to the bay area. that's in the forecast at 6:01. >> fog or drizzle through livermore, expect that as well. out of the alt monday pass, early for this slow but just under 20 minutes for this drive. we'll watch and see how that builds. a live look at the san mateo

bridge to demonstrate what we're talking about causing an issue for visibility, slicker roads, visibility will be an issue for your windshields as well. you'll probably have to use wipers as well. laura, back to you. >> thank you very much. we have breaking news. moments ago san mateo district attorney's office spoke with "today in the bay" and confirmed they will not press charges against the college athlete pulled off a plane after he refused to pull up his pants. marla tellez joins us live from redwood city where we just received word on that decision. good morning, marla. >> reporter: good morning. especially over the last month this is a story that has people talking. as you just reported, nbc bay area, we just hung up the phone. they confirmed with nbc bay area that his office has decided not to pursue criminal charges against 20-year-old deshon

marman. it was june 15th, almost one month ago when marman was pulled off a us airways plane for allegedly refusing to pull up his sagging pants. marman says because his hands were full of carry-on items he couldn't do as he was told. all the boarded passengers were asked to get off the plane and marman was arrested on suspicion of battery of a police officer, resisting arrest and trespassing. yesterday about 150 people rallied at san francisco city hall to show their support for the university of new mexico football player. the crowd including his mother, who no doubt will be out later, said this yesterday. >> we won't tolerate being judged by our cover. it's not okay. >> reporter: now, all along donald doyle has asked us airways to apologize to her son, so we'll see if that happens.

all along the airline said they do not have a dress code but ask passengers to dress in a manner that will not offend other passengers. d.a.'s office has decided not to file criminal charges against 20-year-old deshon marman. laura, the question remains, his mother has pleaded all along that her son's record gets cleared. we'll see if that happens as well. >> thanks so much, marla. a man accused of killing two people on fisherman's wharf will see a judge. a competency hearing scheduled for wu in a san francisco courtroom. he's accused of killing two employees of a rival story on fisherman's wharf. police say he killed the workers because their store sold similar items to his and he thought they

were taking his business. a parolee accused of several fatal shootings is on ten most wanted criminals list. list, police looking for jonathan "john john" walker. the 20-year-old joined the list after killing 19-year-old robert o'brian and injuring another man at a bay view home in january. walker is the prime suspect for two fatal shootings in vallejo. they say walker is armed and dangerous and has not left the s.(áu9f&er has several tattoos îich victim of kidnapper philip yesterday the eldorado district attorney released papers showing previous victims had also been k

and is serving 431 years in in. his wife nancy was given a 36-year term. a breaking news story we brought yesterday, a 17-year-old girl injured but said to be okay after her allegedly drunken mother crashed into a san mateo fire station. this is video of the crash. the front end almost completely crashed. the girl was taken to the hospital in the ambulance, treated and released at the hospital. her mother, 36-year-old, faces dui and child endangerment charges. she's in the hospital but not seriously injured. we're following breaking news from oakland where they they will weigh in on a controversial dog park, a park that has dog lovers fighting each other.

has 17 dog parks. oakland has some pretty strict no dog rules in city parks. the parks commission is expected to weigh in on a location or drop the idea all together. the commission meets at 4:30 near lake merritt at 666 bellevue. reporting live in oakland, christie smith "today in the bay." thank you, christie. students will have to pay more for college this fall. students will see another 12% tuition hike on top of a 10% hike. the trustees approved that increase yesterday. enrollment will be increased by 10,000 students stayed wide. full time student will now pay almost $5500 a year for school. immediately following the tuition hike, the cfu trustees made a controversial move. they approved a $400,000 a year salary for the new president of san diego state university. that is $100,000 more than the

previous university president made. three trustees voted against the new salary including lieutenant governor gavin newsom. governor jerry brown wrote a letter to the board saying, i fear your approach to compensation is setting a patent for public service we cannot afford. 6:09, want to check in with meteorologist christina loren. certainly misty out there. how long will we see that. >> the next few mornings at least as low pressure has taken full control of the weather pattern, really kicked in that on-shore flow. as a result this morning foggy conditions across the board no matter where you're waking up. you'll likely find mostly cloudy sky until 11:00 a.m. still looking good in san jose, 10 miles, ten miles in livermore. starting to drop, though, in san francisco and oakland. basically this isn't ground

level. this is what you need to know for your drive. hovering a little above the highway here, four miles of visible. that's pretty good in oakland. otherwise 10 miles or better in the north bay. right now looks like san francisco, oakland getting socked in. not bad yet of course mike and i watching that all morning low. 56 in san mateo, 57 in novato, 57 in napa versus 58 degrees in livermore. we don't have a lot of differentiation in terms of our low temperatures. these are our lows for the morning. 56 in san mateo, 61 in sunnyvale. the reason why, that cloud cover is serving as a blanket trapping in daytime heat yesterday, what daytime heat we did pick up. that's why we have numbers uniform this morning. traditionally a big separation between the coast and inland. 70 in napa, 60 in san francisco, take quite sometime for fog to clear. 6 in santa cruz and 71 in los

gatos. stay tuned, i'm going to let you know as soon as i know about the clearing. it's going to start to clear at 11:00 today or noon. get to that forecast coming up. mike, over to you. >> all right, christina. i'd like to jump to the live shot of the bay bridge. this has changed dramatically in the last couple of minutes. the lane between the hov and fasttrack, they have suddenly shown slowdown. a lot of times not all the toll lanes are open. we've seen that building, maybe an indication the volume is steady enough, turn metering lights on any minute. get you back out to the maps, show you an issue developing for the east bay looking towards the value. northbound 238 just off of 580, moving to the center divide. out of lanes, enough to show a little slowing over the last couple of minutes there as well. watching for potential slowing 580 and 238 which takes you to 880. a live look at 880 itself,

turns out he hasn't been allowed to practice medicine in the california corrections system for the past year and a half. the "l. a. times" reporting that the doctor has essentially been on, quote, mail room duty at the high desert state prison in susanville since late 2009 while he was still being allowed to take home a fat paycheck. apparently they don't want him to practice medicine. why has he ended up in this situation? the state wants to fire him and did at one point but he was rehired on appeal. when he was reinstated, the state not only owed him his base pay of $235,000 but back pay of roughly $540,000 for the two years he wasn't working while fighting his termination. you put those two figures together and come up with three-quarters of a million dollars roughly for take-home pay in 2010. even though he's still employed as, quote, a prison doctor, the "times" reports the state won't let him practice medicine

because they don't trust his skills. for instance on two occasions he should have sent two patients to an outside hospital emergency room and didn't in another case a patient died under his car. he also has a history of mental illness. the times reports there are other prison doctors who received huge sums in back pay after fired and reinstated or put on probation. we've got this website up for you, cacs.org, a brand-new website put together by students at stanford university. basically it tracks how the state of california is spending tax dollars. do on there and search by department and see what different types of employees are making. if you want to get on that website again, cacs.org or google california common sense. >> be interesting to see how long he's had that position and who appointed him there as well. thank you very much. it's 6:17 right now. san jose-based chain of

meteorologist christina loren. >> no one says meteorologist like you, laura garcia-cannon. you're exec right. it's so dense in spots it's creating that mist, that foggy drizzle to be more scientific. as you can see right now on the golden gate bridge we are completely socked in. this the one and only bridge socked in at this point. we're going to keep watching all morning like. mike and i will be busy. foggy conditions anticipated for the next few mornings, really thick fog at least through friday. that's because we have another area of low pressure back behind the one that's really kicked in that on-shore flow. this guy is now going to perpetuate what on-shore flow we already have for the next few days. that means much cooler than average weather continues across the bay area. take a look at how much cooler than average we were yesterday. 66 degrees in danville. normally 89. saving on pg&e bill there.

been talking about across the bay area, going to take a while for the sun to break through. check the forecast with meteorologist christina loren right now. right now, want to talk a little traffic with mike. >> good morning. going to take a while to break through the back-up at the toll plaza. actually, doesn't break through, show you the line at the plaza. no problem for east shore freeway. look at this, have cash lanes backing up. just a couple minutes ago they turned metering lights on, now all lanes filling in. an unusual pattern a couple of minutes ago when they turned on the lights, there's the normal pattern. approaching the toll plaza, the map shows that portion of the maze shows a slowdown around the signal light there once the lights turned on. a good drive approaching this area but then the slowdown that kicked off on schedule, 10 miles an hour with spots on highway 4. look at that, 48 now coming down

huge price hike for netflix customers. scott mcgrew has the details. >> good morning. my extremely informal poll say a lot of people aren't going to agree to the 60% price hike, they will make changes to their rental plan. under the price hike for current customers, one dvd out at a time with streaming jumps from $9.99 month to just under $16 a month. if you decide to get rid of dvds or get rid of streaming, do just one or the other, you can actually save money. the price will be $7.99 a month. now, if you go to streaming only, that means you could use some of the money you save to get seven movies a month from dvd machines, assuming you return them on time. some machines have new release dvds much sooner than netflix so there's an advantage there, too.

"today in the bay's" marla tellez with the latest developments. good morning. >> good morning, laura, yeah. that is certainly the big news of the morning. the san mateo county d.a. is confirming that his office has decided not to file charges against 20-year-old deshon marman. of course he was pulled off that us airways flight back in june, june 15th, almost a month ago for refusing to allegedly pull up his sagging pants. joining me live is the d.a. himself, thank you for your time this morning. this news just came out this morning. why did your office come to this decision? >> our conclusion was after reviewing all the facts of this incident that this was a case

that we don't think belong in a courtroom and we think a jury would tell us that if we did take it in the courtroom. with the all congestion in the courts we don't need to clog up the courts with a case that's presented here. >> a statement your office released, we believe the officers on scene acted appropriately and professionally, we do not believe criminal charges are warranted. so you do believe the officers were in the right. >> i believe the police officers and sheriff's deputies out there trying to resolve this situation conducted themselves entirely appropriately. we continue to believe that. not all cases need to be in the criminal courts. this is one of those, doesn't need to be there. >> deshon's mother donna doyle, as well as dozens of protesters who rallied at san francisco city hall yesterday, they say this is certainly a race issue, but you have a point to brink up about that. >> well, i won't draw a conclusion, i'll merely state a

fact and everybody can draw from it, a fact, perhaps, his mother does not know. that is that the employee of the airline, who was the one who got into the initial confrontation with him about the pants is an african-american woman who has worked for the airline for many years and is a professional. everybody can draw their own conclusions. i don't see race as playing any roll in this at all. >> can you talk about how the situation should have been handled. >> all i can say to you, an airline like any other business has a right to refuse service to anybody. the old restaurant sign, no shoes, no shirt, no service. they did work for a long time for an hour with him, including sheriff's deputies, please, let's resolve this, for over an hour. mr. marman chose to not want to deal with that either way. both sides could have relaxed a little bit and treated it differently. that's part of the reason we don't think it belongs in court. we think 12 members on a jury

would say, you know what, everybody could have just -- including mr. marman, could have done this a little bit differently and we don't need to have somebody labeled a criminal over this. >> when you first reported this about a month ago, the statement from deshon marman was that he regretted that he didn't just, nfc, do as he told right away. that plays along with that. in terms of your investigation, did you speak to several witnesses to gather facts? >> our detective from the sheriff's office interviewed everybody in the case, including passengers that happened to be watching it, the pilot, all the officers and flight attendants who were involved. we have statements from all of them. >> okay. san mateo district attorney steve wagstaffe thank you for your time this morning. no criminal charges will be filed against 20-year-old deshon marman in this case. laura. >> thank you very much. you heard it here first, 6:35. following developing news from oakland where the city park commission will weigh in today

on a controversial dog park. it's a park that even has dog lovers fighting against each other. "today in the bay's" christie smith has more on the story. good morning, christie. >> good morning, laura. you ask opponents and they say all the geese around lake merritt leave enough of a mess. they certainly don't need dogs adding to that in a high-profile location. that's when a second location was floated. it would be tucked away behind the trees over near children's fairy land. that got dog lovers saying if they were moved to a potential second location it would add more delays for dogs that just want to play and catch tennis balls at the dog park. it's astro park, on macarthur and lakeshore. it's now used for sports and things like eating lunch. plan b near an old horse stable near fairy land. one walker this morning said

you can get this signal, it is foggy this morning. but it's clearing out a little bit quicker than we thought in some spots. as a matter of fact, the north bay not seeing clouds touch the ground just yet. we'll take a look at the fog forecast in just a moment, up and running. low pressure firmly in control. you can see this counterclockwise spin. this the weathermaker. today it's going to drag a front through the area, as soon as it gets moving to the east, a pulse behind it. i do think that will happen. this guy is going to kick up the secondary of low pressure. for us that means on-shore flow will continue for the next few days. but once this front comes through, and it's going to take a couple of days to come through, we're going to start to warm up finally. let's get fog fighting imagery ready to go. ten miles of visibility in the south bay. however, marine layer so deep over the south bay right now generating drizzle. livermore same situation, four miles in oakland, seven miles in san francisco. still that cloud deck hovering above the surface in the north

bay. we'll let you know the minute that changes, as we are now in high time for that fog, typically between six and seven. 58 in livermore, 58 in gilroy, 61 degrees right now in san jose as we head throughout this afternoon temperatures will climb but not by much. only 71 degrees in los gatos, 60 in san francisco and 70 in santa rosa. the further you are away from the coast the better weather for the second half of the day. 73, though, even in gilroy. if you head throughout the remainder of the week, temperatures stay below average, 73 degrees. that's it for saturday. that's good news, if you're someone that wants to make outdoor plans in the areas that are inland, 73 on saturday. however, at the coast it's going to be foggy, it's going to be cold and overcast all weekend long. so if you're looking for that vitamin d head inland. 76 by sunday. finally the 80s come back monday into tuesday. all right. let's check your drive. some people see out there this morning, mike inouye.

that show up on the phone bill. they are hidden in there, averaging from $1.99 to $19.99. they can add up. fcc says 15 to 20 million american households have been victims of this. only about 5% know they can be victims of this. it's confusing. here is how companies get away with it. they use fake words for charges, service fees, other fees, calling plans, monthly fees. those can be anything from long distance service you didn't authorize to horoscopes you didn't authorize. they show up on your land line bill, which right now is illegal but fcc continues to fine companies for doing it. now there are no law from the books for wireless companies. a huge concern. what can you do. you need to look at your bill, make sure you recognize companies listed there, know what services you receive, look

for charges for calls you didn't place, services you didn't authorize and confirm the rates you've negotiated with the company if you have ordered a service. congress talking about it, hopefully coming up with some rights for consumer protections, right now in the hands of the bill. >> thank you very much. 6:45 right now, chalk up another win for joe montana. montana's proposal for building a luxury hotel, upscale restaurant and sports bar across the street from the proposed niners stadium took a big step forward. they approved to exclusively work with him for the next 18 months. they are convinced it will turn santa clara into a vacation. >> what town of the vote. >> it's always good to win. a long way from the process.

be heading over any bridges, you can expect that dense fog could hamper your commute, might slow you down a little bit. allow extra time. you don't want to go racing out the door with low visibility. fog continues tomorrow, friday, through the weekend as we have another area of low pressure now that's going to push over us. both systems cross to the north but both will drag front through the area. increase on-shore flow, cool days through friday. high pressure way out here in the eastern pacific. finally starts to regain control of the weather pattern. that means we'll start to see temperatures gradually warm up. even all the way through tuesday they will be below their seasonal averages, which is 88 degrees in places like fairfield this time of year. only 73 today, 72 livermore, 71 in fremont. not a great beach day. 60 in san francisco. talking about 68 in santa cruz, half moon bay 59 cold degrees today. 70 degrees by thursday.

new this morning, a live look outside. that's the cloud cover we're talking about across the bay area. even if you head inland, you'll find cooler temperatures today, by the coast. what about the morning commute, let's check in with mike. >> that's fine as far as speed not good should be slowing for another few minutes. looking at the maze, a slow drive across the upper deck, typical because of the volume of traffic. watch, the clouds will affect visibility. affecting your drive out of the city, orange circle. an accident eastbound 80 and 7th. not yet cleared from the roadway but should be soon. no slowing here. a quick look at the toll plaza

>> reporter: good morning, laura. three-quarters of a million dollars to shuffle papers. not a bad gig if you can get it. the doctor got it and we've been paying for. he was supposed to treat prisoners in susanville. they have barred him from practicing medicine since 2009 because of incompetence. they can't fire him so they placid him on mail room duty. it's not like they didn't try to get rid of him. they fired him once but he was rehired on appeal. the state not only owed him his base pay of $235,000 but back pay of $540,000 for the two years he wasn't working while fighting his termination. you put those two figures together and come up with three-quarters of a million dollars in take home pay for 2010. making him the highest paid employee in the state last year. even though he is still, quote, a prison doctor, the "times" reports they won't let him practice medicine because they don't trust his skills.

supervisors once revoked his clinical privileges because a patient died under his care. in two other instances he should have sent two patients with heart problems to an outside er but he dependent. he also reportedly has a history of mental illness. the "times" reports there are three other prison doctors who received huge funds in back pay after fired and reinstated or put on probation. if you want to see how else the state is spending tax dollars there's incidentally a new website by students at stanford university. the website is called california common sense. can you go on there and search what different types of employees make by department and such. that website is c afternoon cs.org or google california common sense. laura. >> so interesting. thank you very much. well, if you want to rent sha shaw shank redemption" it will cost you more. >> netflix prices jumping big starting with current customers.

from $9.99 a month for one movie at a time plus streaming to almost $16. now, netflix has to raise billions of dollars to pay for hollywood studios for the right to stream movies. it's going to make billions the only way it knows how, that is by raising prices. shares in netflix up better than 2%. wall street loves this idea. customers hate it. pop star justin bieber wants a new effort to stop teens from texting and driving. he is a driver. he invests in a company that claims to have technology to start this. phone guard has yet to issue any kind of software, stocks are a penny. hopefully mr. bieber knows what he's getting into. finally rupert murdoch is with drawing from the big satellite deal in new england over this hole issue about phone hacking. >> thank you for putting that justin bieber song in all of our heads this morning.
