it's still july but 40s and 50s this morning. by lunch time sunshine inland with coastal clouds returning. by 4:00 we're going to be watching the north bay because we could see rare shul showers north of santa rosa. 60s and 70s inland. a look at the forecast coming up. mike, how is that monday morning commute? >> okay but not a good monday morning for a couple of folks. first one coming into the south bay out of the east bay. out of milpitas, southbound 880 at dixon landing road. we're not sure of the information we're getting is that the accident is cleared but look at this live shot off to the shoulder. still have the flatbed tow truck. pulling the cable out there, there is a car that went down the ditch. not affecting traffic but we'll track it and another incident south. i'll tell you about that coming up. >> busy on a monday morning. thank you. 5:01. richmond police have their hands full investigating an overnight double homicide. this comes after another shooting just last week that killed three people.

today in the bay's christie smith is live in richmond. some are worried about the uptick in violence and what may come next. >> reporter: we're talking about four people shot overnight, two of them killed, and this follows a string of shootings here in richmond. and street level violence. a lot of neighbors say at this point they are feeling helpless. this latest shooting happened about 10:15 last night on bissel avenue. a man and woman in their 30s shot outside an apartment, shot and killed, found laying on the sidewalk. another woman was also shot. she is expected to survive. police are looking into whether this might be tied to a shooting that happened 30 minutes earlier a few miles away a. 23-year-old man was shot. he is expected to survive. days earlier there was a shoot-out in a richmond home. that left three people dead near triangle court. richmond housing authority operates the subsidized housing

there and neighbors say they are concerned about backlash. they want private zurt security patrol. the the city plans to upgrade lighting in the area. some neighbors are saying that's not enough. i have calls in to the watch commander. at this point no arrests into this latest shooting overnight. but we're told that a spokesperson for the richmond police department is on her way here and should be here in the next 30 minutes, as soon as we hear from her, we'll bring that information to you. reporting live in richmond, christie smith, "today in the bay." >> the worry is certainly understandable. thank you, christie. >> this morning many questions over whether justice is served in a bay area sexual assault case. it involve as san jose stepfather who badly beat a house guest who molested his step-daughter. some wonder whether he is being punished too harshly for some say almost any father would do.

miguel faces life in prison, the man who molested his step-daughter stands to get out in 22 years. that's because the district attorney filed maximum felony charges against cerda and his brother. they are charged with torture, battery and making criminal threats. the d.a. says it's because the men did not act immediately and planned the beating. rodriguez pleaded to the charges. he will be sentenced to 22 years. pg&e is planning a revision on the pipe line from last september. officials want the pipe moved. pipe line 132 extends from san bruno through south san francisco up to san bruno mountain. right now the pipe runs through the backyards of dozens of homes in the city. officials want pg&e to move the pipe when it begins a major replacement project. the utility is working with the city on a solution and says recent tests of the pipe line

didn't show major dangers. >> 5:04. the man fatally shot by a san francisco police officer in the bay view district may have been involved in a fatal shooting in washington. this comes as anger is reaching a boiling point in the neighborhood, and new investigations into the shooting are under way. "today in the bay's" bob redell has an update. >> reporter: one community activist we spoke with is planning a news conference to call for more police accountability after a man was shot and killed here late saturday afternoon along this sidewalk. we're at third and oak dale in the bay view district. his name was reportedly kenny harding, a 19-year-old man who was recently released from prison on parole for a sex crime. and he was a person of interest in a deadly shooting last wednesday in seattle in which

three people were wounded and a young woman was killed. she was a bystander who wasn't involved in the dispute. flash forward later to late saturday, two san francisco police officers stopped harding around here in the bay view for a muni fare violation because he reportedly didn't have a valid bus transfer ticket. when they started questioning him officers say he started to run away, while firing several shots back at them. at least one of the officers fired back and wounded him at this location which was about a block away from where they initially stopped him. cell phone video has surfaced that shows sfpd with guns drawn on harding as he lays wounded on the sidewalk bleeding. a crowd of people surround the officers yelling at them accusing them of shooting an unarmed man, questioning where's the gun. but in another amateur video you can see a gun on the ground near the scene. police were able to get it back. they say that's the gun that harding used to shoot at them. he later died.

people protested the shooting later that night in the mission district calling for an investigation into this officer-involved shooting. sf homicide, internal affairs, the d.a. and the office of citizens complaints have begun investigations of their own. we could learn more details about what happened here saturday afternoon. sfpd also plans a news conference today. reporting live in san francisco, bob redell, "today in the bay." >> thanks, bob. a lawsuit could be filed as early as today challenging the laws that kill redevelopment agencies throughout the state. the league of california cities and the city of san jose are among those expected to file the lawsuit against the sate. they say the california legislature not only killed redevelopment agencies but also added a, quote, poison pill that will prevent the agencies from coming back to life. basically it states the agencies cannot sell debt to help build projects. san jose's redevelopment agency

has paid for projects such as the hp pavilion and convention center by selling debt. good morning. it is now 5:07. if you have business to take care of at your local court house you want to do it as soon as possible. california's budget crisis is trickling down to court houses. the state courts are preparing to absorb $350 million of cuts this fiscal year. longer waits to file divorce cases or to resolve legal fights between silicon valley companies. some days court houses will shut down. in the bay area it could mean plans to build a family court house in downtown san jose, those plans could be shuttered. the state judicial council will meet friday to consider recommended cuts. >> 5:08. good morning. you made it to monday morning. we have meteorologist rob mayeda in for christina loren. nice weekend here in the south bay. >> we got sun to break out flew the clouds which was nice. our temperatures still trying to

warm up to july standards. this morning we've got 50s outside for most of us. but the low clouds really have not surged inland like we've seen so good news in terms of the weather. we have a healthy sea breeze that will probably be on the increase as we head through the afternoon. right now the satellite view also very interesting for july. we've got a weather system that is tossing clouds to the north. in fact, some rain possible later today for places north of ukiah. as the system sweeps through north bay locations could see sprinkles out there and this is going to keep the sea breeze going through tuesday. as the system gets out of here we'll see temperatures starting to warm up. around the bay today, temperatures in the 70s around san jose, 60s again for san francisco. 70 in oakland. if you head to the north bay north of ukiah, close to 81 before the clouds spill in. might see overnight showers. seven-day forecast, warmest days will be coming up wednesday and thursday, a cooldown friday, then rebound nicely as we head

and the world. the students record their samples online, reading various phrases in english and native tongue. so far about 300 of the almost 6,000 students have submitted voice samples. >> meanwhile, upper classmen at san jose state are asked to live in a hotel for the upcoming school year. but the school hasn't said which hotel. it requires freshmen to live in dorms on campus. with a large group of freshmen in the fall about 250 have been asked to give up spots in the dorms. the university will put the students up in a hotel and have promised it will be a business class with access to public transportation. >> a new poll finds hiring appears to be on the up swing. the national association for business economists says 43% of firms surveyed will likely increase employment over the next six months. they say they have no significant layoffs planned so

good news there. 49% have no expected change. we want to turn to "today in the bay's" nicole lapin at cnbc world headquarters. good morning. >> good morning. futures are lower as concerns of the debt issue continue to weigh on markets. no talks were held this weekend on the deal to raise the debt limit, none are scheduled for today. the government could run out of cash to pay its bills in two weeks. asian markets fell on the same debt worries. europe is also lower but we do get data stateside that could drive us on the housing sector and investors are bracing for an onslaught of earnings as a fifth of the s&p 500 will report. today we hear from a biggy ibm after the close, but to recap some of the market action on friday the dow rose 42, 12,479 is where we closed. the nasdaq to 2789. and the ceo of general mills is blaming government ethanol

subsidies as the driver for rising food prices. if corn goes up wheat goes up. he says general mills which makes stuff like cheerios and soup had to pay twice as much last year for wheat and the cost of corn and oats are now up 30% to 40%. the company absorbed a lot of these increases but still i got to say passed some on to you and i the consumer. ethanol and biofuels consume about 40% of the u.s. corn crop. chuck schumer says he's going to introduce a bill, under a rule that takes effect in august airlines only have to reimburse if bags are lost forever. schumer says airlines should refund those fees upon request. that makes sense. only a small fraction of bags actually are lost forever. you know, hopefully you haven't been in this situation. sadly i have. the bag comes back three months later, a year later it's not the

same. stuff doesn't fit, out of style. >> request absolutely. okay. thanks. 5:17. for the first time a military contingent took part in a gay pride parade. about 200 active duty troops and veterans marched in this event held in san diego saturday. soldiers wore tee shirts for each military branch. the branches allow service members to take part in this but not in uniform. the march comes a day after a federal appeals court reinstated most of the "don't ask, don't tell policy." that prevented the government from investigating or penalizing any one who is openly gay. 5:18. did you enjoy the nice weather this weekend? i certainly did. rob joins us with a look at the forecast. how is it going to look this week? >> looks pretty good. if you like warmer weather i think we can finally get that in the forecast as we head toward the middle of the week. one of the things we're seeing this morning, may be a pleasant start, we're not locked in by low clouds around the bay area.

san francisco veterans memorial. the winning design was chosen from three finalists. it will consist of three pools circling stone. the pools form a circle of water that glides over the stone from the street to a garden below. the movement is meant to symbolize the merging of heaven, the circle and earth the octagon. it will be built between the war memorial opera house and the veterans building. >> 5:24. if you are just getting ready to head out the door to head to work on this monday morning mike's got a look at the traffic. >> i do. if you are getting ready to head out, sorry, you're not the first. slowing things early on a monday morning. 54 down from 65 about 15 minutes ago so a slowdown through antioch and walnut creek, looking steady so far for that portion. the commute directions coming into the area, speeds in the 50s but no big concern there.

that's because there are relatively few through the area as well as larger trucks bringing that average down a bit. your commute still 18 minutes off of the carquinez bridge. to the bay bridge toll plaza. an accident, eastbound 580 on the broadway avenue off ramp that might affect traffic. no lanes are reported blocked there. at the golden gate bridge, the sun starting to peek out and show some of the silhouettes. a smooth drive, seeing both towers, clear visibility here. another shot across the bay, the san mateo bridge, no major problems. the wind is great. no major issues. and visibility great so far too. >> thanks, mike. here is a question. is a groupon discount a gift certificate? scott says the answer matters a lot. >> it does. good morning. if you're not familiar with groupon, it's a discount that you buy online like half off a cut and color at a salon.

well, they have expiration dates and california law says you can't have expiration dates on gift certificates, so that does raise the question, did you just buy a gift certificate? connecticut has similar laws and this morning the state is considering whether to force groupon to remove the expiration date from its offerings. that would be a huge problem for businesses selling discounts because they would have to carry the yet to be redeemed discounts on the books forever. some trouble for netflix streaming. the company says it's fixed. anger over the price hike continues to simmer as well. if you look at netflix performance you couldn't be in a better stock. an all-time high a couple of days ago. and what a weekend for news corp. the former head of news of the world was arrested, the head of the "wall street journal" stepped down, no proof he did anything wrong. but he used to be head of news of the world, and then marla, the prime minister of england

maybe a little warmer in the south bay today. 65 san francisco, 78 in san jose. the seven-day forecast comes up in a few minutes. the weather pretty good. monday's commute maybe not so much. >> not so much for a couple of people. one person southbound 880 at dixon landing road sounds like the car making progress. the person was not injured but activity as you come down toward 237. further south we're looking at the northbound direction of 101, this is north 101 at bailey avenue. i got word from chp they are closing down the slow lane approaching the jackknifed produce truck. they have to off-load 70,000 pounds of produce, and then remove the truck. this could be an issue if it lasts more than an hour. >> 5:31. new information this morning about the man shot and killed by san francisco police in the bay view district over the weekend. he may have been involved in a shooting that happened in washington. anger is intensifying in the neighborhood and new investigations on the shooting are under way.

"today in the bay's" bob redell is live in the bay view with the latest. good morning, bob. >> reporter: good with morning. some people here in the bay view district of san francisco question whether sfpd was justified in the shooting of the man who is now being memorialized along the sidewalk where he was shot saturday afternoon after police stopped him for a muni fare violation. there is cell phone video that shows a tense scene after the shooting. the man who was shot can be seen bleeding on the ground. his name is reportedly kenny harding, a 19-year-old parolee recently released from prison, also wanted in connection with a shooting last week in seattle. the video shows sfpd surrounding him with guns drawn. an officer assists while waiting for the ambulance and while this is going on there are a lot of bystanders yelling at police demanding to know why they shot an unarmed man screaming, where's the gun?

here it is according to police, another amateur video shows it lying on the ground near the scene. investigators were able to recover it after someone took off with it. they say harding used it to fire on two police officers after they detained him for not having a valid bus transfer ticket at a platform about a block away. he did run away firing shots according to police, at least one of the officers fired back, hitting harding who later died. sfpdtd.a. and the office of citizen complaints are investigating this officer-involved shooting. a news conference from sfpd is scheduled for today. as we mentioned police in seattle were interested in speaking with kenny harding, at our sister station in seattle we have ha part of the story. nicole. >> reporter: good morning. you can see the memorial that continues to grow here behind me. it was here on this street in south seattle that four people were shot, one of the four a

19-year-old pregnant woman died. i had a chance to talk with her family. they had a lot to say about this potential break in the case. her family tell me they received a phone call sunday morning from police telling them that the 19-year-old man killed in san francisco could be connected to the shootings that happened in seattle on wednesday. it was late wednesday night that a man walked up on foot and opened fire, shooting at four people on a south seattle street, that's according to seattle police. three of the people are recovering from injuries but as i said, tanya gilbert who had turned 19 and expecting a baby was killed. we spoke with her friends and family. one of the victim's friends told us it was the first day she felt safe enough to step foot outside after she heard the person of interest was shot and killed in san francisco, news that brought mixed emotions. >> from what i understand he was

gunned down. i really do wish it wasn't like that. >> going to be able to see who he was in court and just to let him know the pain. >> reporter: family, what friends are waiting for, what we're waiting for is learn more from seattle police. we expect that to happen later this morning. live in seattle, marla, back to you. >> quite the involved case. thanks. budget cuts in contra costa county are taking a toll on overnight paroles. the sheriff's department feels as few as six deputies during the graveyard patrol to cover the entire county. by comparison, richmond staffs at least ten officers at night. other cities have at least six officers on patrol for a much smaller area. the contra costa times reports it takes deputies 11% longer to respond to top priority calls including crashes and felonies. >> we have an update on an

"today in the bay's" christie smith is live in richmond where some worry about the uptick in violence. not a good thing to think about. good morning. >> reporter: good morning. no, not at all. here we go talking about yet another shooting here in richmond. we just spoke with richmond police. when they arrived they found two people shot and killed in front of an apartment complex laying on the street. a third person, a woman was also shot. we got an update on her condition. she is in critical condition this morning in the hospital. this happened around 10:15 last night on bissel avenue. the victims, a man and woman in their 30s. investigators are also looking into whether this could be linked to yet another shooting that happened 30 minutes earlier, only a few miles away a. 23-year-old man was shot on

gertrude avenue. he's expected to survive. there have been numerous shootings in the area as you mentioned. there was a shoot-out in a richmond home. three people shot and killed. i just spoke with a richmond police department spokesperson and here's what she had to say about this latest shooting. >> we are looking into the possibility that they are connected. one was in north richmond which we had problems with shootings in north richmond, and then our central area of richmond. one was in north richmond and the other happened in our central district. >> reporter: there have been no arrests in this latest series of shootings that happened overnight. she tells me that the gang units are out there working to try and develop intelligence about what may be going on on the streets. she says when the chief comes in he'll be talking with patrol units about patrolling the high risk areas. one of the problems they deal with is that they are not getting a lot of cooperation

minneapolis to detroit, it's unbelievable. this pattern is the reason we're so cool in the west. it's locked in the pattern of high pressure to the east, trough to the west. so we actually have rain showers off to the north coast as we head through the afternoon. probably not the bay area but north of ukiah this afternoon may see a stray shower or two. highs around the bay area, 78 san jose, 83 morgan hill. that's the hot spot. 65 san francisco. the seven-day forecast will show you that we'll feel more like july come wednesday and thursday, then the end of the weekend looking toasty there. >> kind of toasty. that's good news. we haven't had hot weather for a while. you continue to see speeds dip through the area, going just past love ridge. that 63 looking good as you head past east willow pass road. that's typical slowdown. 780 shows a bit of a dip westbound but no major concern. the big concern is here this 50

that's showing up and holding across the carquinez bridge for a patch. the east shore freeway moving smoothly. no incidents across the bridge. we'll follow this. the north bay we have southbound 101 out of novato and down to central san rafael. we have slower sensors but the volume relatively light. lanes should reopen in about 20 minutes. south of there on 101 as well. the golden gate bridge, a beautiful view coming into the city. that's what happens when you say nice stuff about the bay area. sunol, green hills because of a great rainy season. the heat will make those turn brown quickly. on 680 we'll have metering lights, steady green for this week and next week we'll see them fully functional. so that could mean a change of traffic flow. >> that's new. >> the metering lights staying on green. letting folks know that they are there for this week. >> i'm glad somebody took a

shabeau in north oakland in the rock ridge neighborhood. this was shurs mornithursday mo. the ymca in oakland is raising money to help the woman's family pay for a funeral. demonstrators will be out today protesting u.s. airways over the sagging pants arrest. they will be outside the departure area demanding the airline meet with the naacp on the deshon marman case. the 20-year-old university of new mexico football player was arrested last month at the airport after he allegedly ignored requests by airline staff to pull up his pants as he boarded the plane. marman was arrested after police say he refused to leave the plane. the d.a. in san mateo county has dropped charges in the case. marman reportedly plansto sue.

silicon valley getting ready for what is expected to be a spectacular financial quarter from apple. scott mcgrew, they are stuffing money. not in the pockets. >> i have this mental image of apple tying to find places to put that money. couch cushions, sock drawers, apple continuing to make spectacular profits. they spend almost none of it. the company will report its latest quarterly financials to wall street tomorrow. the company stock has been somewhat stagnant after quadrupling over the past two years. how popular is apple? this is a political advertisement for vladamir putin, a russian tv ad. in it a young voter declares her love for putin. she is on her iphone. in that bag she has herself an ipad, comes up to her friend who has a mac book. this is not an ad for apple. this is for putin. let's check on the mac book, et cetera. when i was growing up and i hate to be the old guy in the room,
