>> reporter: good morning. i'm christie smith live where the coast guard is ramping up their search for a missing 62-year-old wind surfer from foster city. we'll tell you what they are doing coming up in a live report. >> a suspected hell's angel and a cop's fall into disgrace. why a south bay officer faces jail time. plus -- you're hearing gun shots, plenty of questions, why police say they had to shoot and kill a teenager. a live look at downtown san jose this morning.

it's tuesday, july 19. this is "today in the bay." >> good morning. it's 4:30. i'm scott mcgrew. let's start with a forecast and meteorologist christina loren. >> good morning to you. we have gorgeous weather in store for you today. big time changes tomorrow. i'm putting the 90s back on the temperature map. today the low 80s. this morning watch for fog development and low cloud cover as we head throughout the morning. have i the full forecast coming up. mike's watching the roads for you at 4:31. >> good morning. you know, a lot of construction going on so we take you to the south bay maps. we have the tully road construction going on. 880 around stevens creek, we have that lasting another 20 minutes. crews are probably starting to pick up. closure, 85 at saint theresa.

i know the off ramp is affected. i'll clarify what is going on. to the summit, also 17 between 9 and 85, more paving work. that's going to be an issue as well. >> thank you. she was supposed to be gone for a half hour but now nearly 12 hours later the search is on to find a missing wind surfer. today in the bay's christie smith. crews and boats and helicopters have been searching. this is frightening. >> reporter: it is. good morning. i got off the phone with the coast guard. they say that right now at this hour they are still physically searching. they have a 41-foot boat in the water, they also have access to a helicopter that they say has very sharp search lights on it that can get down close to the water. still looking for that 62-year-old wind surfer from foster city reported missing yesterday after 7:00. she was last seen near the

coyote point area. her husband says she was due back around 5:30. rescue boats have assisted in the search but the coast guard is saying they took the lead. this woman has a hand held radio with her and other items. she was wearing a black wet suit, blue helmet and riding an orange board. she has an ongoing health problem that has not been disclosed but that is a concern to rescuers. i asked why they had not released her name. the coast guard said that's a district decision. for now they are coordinating the search efforts from here on you're a buena island. things are going to pick up at daybreak. reporting live, christie smith, "today in the bay." >> thank you. 4:33 now. this morning a fairfield mother whose child died in a fire is now out of jail a free woman.

the district attorney is dropping manslaughter charges against latisha james. investigators say james and her sister stood outside talking to friends while candles inside the apartment sparked a fire, killing four children in april of 2010. three of those children were strapped into strollers when flames ripped through the apartment. james' sister still faces child endangerment and murder charges. >> also this morning san francisco police still responding to angry questions about why they shot and killed a 19-year-old wanted parolee in the bay view district. those sounds are gun shots recorded by police shot spotting technology. police say ken harding fired a gun at them on saturday when they tried to question him on a muni platform near oak dale. police say the shot spotter

proves that harding shot at officers first, activists say it doesn't prove that at all. >> the gps is showing flush. we don't know what flash. it could be the 10 bullets that were fired at him. we don't know. until we see a ballistic report. >> activists are disturbed by cell phone video that show police standing by harding as he bleeds in the street. there is also youtube video that shows a passerby picking up the gun at the scene as an angry crowd grows. police say they have the gun but looking for a phone and shell casings. apparently those were taken from the scene. kenneth harding was wanted for questioning in the shooting death of a pregnant woman in seattle that happened last wednesday. harding was also convicted of pimping a 13-year-old girl in january 2010. he served 22 months behind bars in state prison. he got out this past april.

>> an east bay mom is accused of going on a car burglary scene with a baby on board. 26-year-old raven stewart and 24-year-old lache rodriguez broke into at least five cars on friday. stewart reportedly had her 4-month-old baby with her. the women were trading some of the items for gift cards at a target store. >> today a former santa clara cop will go on trial on charges of sharing police secrets with a member of a motorcycle gang to pay off a debt. today, lawyers will start picking jury members for the trial of 37-year-old clay rojas. a federal grand jury indicted him on charges of giving criminal histories, dmv records and other things to suspected hell's angle member. the trial is expected to last about two weeks. >> some oakland city leaders

trying to get a pot proposal back on track after setbacks. oak loond city council looking at ways to regulate and tax pot farms even though the fed ram government warned the city that such farms are illegal under federal law. tonight the council will discuss new rules that could be put in place to control pot dispensaries. the council will weigh in on set fees including a fee to apply for a permit, a $60,000 fee for each dispensary and $211,000 fee to grow the marijuana. >> san jose's largest private employer slashing 6500 jobs. 15% of the cisco employees have titles of vice president or higher. more specifics about the layoffs will be released by the company on august 10 when cisco reports quarterly earnings. 2100 employees are leaving the company as part of voluntary

retirement programs. the rest in the thousands will be laid off. >> let's check back at 4:37 with christina loren. good morning. >> good morning. if you enjoyed yesterday we have more of the same in store for you today. as we head through the next couple of days even oakland and san francisco will be touching on the 80s in the warmest spots. let's talk about what's happening. we've got low pressure to our north. this was driving in that on shore flow all last week that kept us below our seasonal averages. that was the case yesterday. we started to climb because finally this area of low pressure pushed inland. as we head throughout day it will continue to push inland, off to the east out of the area. allowing for high pressure to build back in so as we head through tomorrow and thursday, we're talking about the 90s, mid 90s back in the east bay. so today, 82 degrees, that's it for livermore. 61 right now. we head throughout this afternoon it's not going to be all that warm especially at the coast. hey, san francisco, oakland, get

ready for gorgeous days as we head through the next couple of days. a short lived mini heat wave. then we fall back to our seasonal averages. i've got the seven-day ready to go. mike's watching the roads. a lot of construction. >> it's typical before 5:00, and we do have that going on. the maze will get a quick clip of that. no major construction as you approach the bay bridge toll plaza. the green all over, close to the speed limit. the richmond/san rafael bridge moving. here novato to san rafael t southbound side slow from the sensors. it's one of the lanes is blocked. slow moving equipment. that will continue to about 6:00 a.m. we're watching that as folks continue past the richmond/san rafael bridge to the golden gate bridge a light easy flow and there is that live shot where you see the lights across this span, no problems for fog across the bay here or the san mateo

oakland-based company rejecting a bid. in a statement clorox, saying it was neither credible nor adequate. icon's bid was likely meant to start a bidding war from possible suitors like procter & gamble. if you are trying to score a gig at redwood city you might want to show up wearing boots. the video game company expanding the sports division adding 300 jobs but in central texas. ea has about 450 employees in texas, in the austin area. the governor of texas says the video game industry ranks second in the country behind california, with $25 billion in overall annual revenue for texas. ea sports is the developer behind madden and fifa soccer. >> will the debt ceiling cause the markets to come crashing down?

for more and news before the bell nicole lapin. >> good morning. futures are higher after yesterday's massive losses which led of course were led by the financial sector. investors concerned about economic issues especially as you know the lack of progress in washington on a deal to raise the nation's debt limit. we do get data out in the next hour on housing today. and a ton of earnings out from goldman sachs, wells fargo, other big names, coca-cola and johnson & johnson. apple, yahoo! reporting after the close. we look at chipotle. it's like christmas here with this many earnings. the you dow falling yesterday t nasdaq lost 24 to 2765. borders is calling it quits. the book store chain called out today's bankruptcy auction after a failed attempt to get an offer. the company is going to close its doors, liquidating 399

stores and going out of business by the end of september. borders has nearly 11,000 employees and has struggled to adapt to the shift to digital as more people are opting to rebooks on the kindle, and on the ipad. and american express as well is getting into the daily deals business, launching a facebook app that offers personalized coupons to shareholders based on their likes, interests and info from your facebook profile. it's pretty simple. there's going to abdeal section. you add that to your account. >> thank you much. let's turn to christina. she has the seven-day forecast. >> good morning, scott. i like that. that's what's going to happen when we lose that cloud cover later today. it looks like we're not going to see that much this morning. marine layer's only 2500-foot depth. that means the low clouds that push in they are not going to push all the way inland but those that do push in will clear out well before noon.

a gorgeous day if you're looking for the sunshine in san francisco, 61 now in livermore, at 57 in napa, in beautiful wine country. 59 degrees in santa cruz. later today by about 12:00 p.m., mild conditions, 63 degrees. you don't need a jacket. we'll see maybe a thin veil of clouds. temperatures warm up to about 4:00 p.m. in the city, looking at a high around 68 comfortable degrees, tomorrow about a 10-degree increase in our temperatures as high pressure regains control of our weather pattern. this is what we're looking at today. perfect weather for outdoor activity you are so lucky to have the day off. it's nice to drive when it's not that warm. 80 in fremont and 82 degrees in san jose. yesterday was spring-like. tomorrow it's going to feel summery. the warm-up, 94 by wednesday. we warm all the way through thursday, and then another area of low pressure that's going to cool us down to the 80s as we

head through next week, that's when looks like summertime sets in across the bay area. could be seeing triple-digit heat monday, tuesday, wednesday, and the warmest cities across the bay. i'm holding off now, though, scott. it's a little ways away and i'm accurate three to four days out. >> fair enough. are you ready for football? after months of legal wrangling, today could be the day that nfl owners reach a deal with the players union. "the washington post" report a deal is ironed out today players could vote on it as early as tomorrow. franchise owners could vote on thursday. if it gets the green light teams could start signing free agents next week. the new deal will reportedly cut back on the money paid to top drafted rookies and will earmark $1 billion in pensions and benefits for retired players. >> the giants will have to be on their best behavior next up for the world champs a meeting with

tourist are expected to enter a plea. the 50-year-old was shot when she was caught in the crossfire of a shoot-out in the theater district. two other people were injured in the shooting. five of the men allegedly involved in the shoot-out will answer to murder charges today. one charged as an accessory to murder. >> a san leandro police officer facing drug charges will leave the force. jason frederickson resigned last friday after he was charged with giving a pound of marijuana to a confidential informant with whom he was having an affair. the 38-year-old has pled not guilty. he is free on bail. prosecutors have not said where he got the drugs. frederickson worked recently as a narcotics detective in his nine years with the department. >> benicia police released this photo of a suspect wanted for armed robbery at a wells fargo.
