>> good morning. thank you for being with us. dark and early on this tuesday morning. it's now 5:00 on the dot. i'm marla tellez in for laura garcia-cannon. we have meteorologist christina loren, welcome back, missed you yesterday. >> well, thank you. i'm back in black. white the opposite of the sun-shiny day we're going to see across the bay area. we're getting a little fog. what's happening it's developing earlier which means it's going to clear out faster. the shallow marine layer we have out there is going to clear out of here before 11:00 a.m. the sun will be shining over the city of san francisco. then tomorrow, we tack on an extra 10 degrees from today's daytime highs. so get ready for a warm-up. i'll talk about that, we can chat it up in weather. right now let's get you to work on time with mike. >> watching for the 10-degree increase. we're looking here, clearing and nothing dramatic overnight.

we had 880 at stevens creek, the off ramp reopened. 85 here at santa teresa. it is construction and that should be cleared by about 6:00 a.m. as well as the rest of the south bay traffic. highway 17, new grinding work started so tonight highway 9 toward 85 we have that grinding work and of course they continue to work till 6:00 at the summit. >> thank you. 5:01. this morning search crews are looking for a 62-year-old wind surfer missing almost 12 hours. christie smith is live in yorba buena island with an update. what are the conditions out like right now? >> reporter: well, it's actually quite nice now, that's the good news. i can tell you that this woman's husband says she is really experienced, she had all of the right gear with her. she was due home last night around 5:30 but never showed up. since then the coast guard has been out there looking for her. they are still out there at this

hour and plan to add more units at daybreak to try and find her. i talked with a spokesperson who tells me at this hour they are using a helicopter with search lights and a 41-foot boat to look for the 62-year-old woman from foster city. she was wind surfing yesterday. told her husband she would be gone about 30 minutes. she never came back. the coast guard was notified after about 7:00 p.m. last night that she was missing. crews from alameda county, foster city and redwood city assisted in the search. by nightfall the coast guard t crew that kept up the search, we were told she had a hand held radio a blue helmet and orange board with a red sail, was wearing a wet suit. she has an ongoing health condition that is a concern to rescuers that hasn't been disclosed to us. search efforts are being coordinated from here on yorba buena island and again, because

crews got somewhat of a late start after 7:00 last night they are going to put additional units in the water today at daybreak. live on yorba buena island, christie smith, today in the bay. >> we'll be wishing for the best. thank you. allegations of abuse are forcing the closure of a private school near sacramento. the police are investigating molestation charges against the principal of citrus heights elementary school. a complaint filed by the department of social services says robert adams had inappropriate physical and sexual contact with children over the past 15 years. reports say at least ten students were abused. investigators have met with parents of current and former students. >> the u.s. coast guard is asked to salvage a trip which sunk off the baja coast. friends of a petaluma man missing want the agency to check inside the ship. the 105-foot fishing boat sank

during a storm on july 3 carrying more than 40 people during a 6-day fishing trip. 35 passengers and crew were rescued. the coast guard and the mexican navy ended a 9-day search for the missing men. family and friends are working to raise money for a private dive team if their request is denied. san francisco police are continuing their search for the man accused of kidnapping a woman. this happened last sunday at 1:00 in the morning near the intersection of 19th and mission streets. investigators say the suspect approached the 19-year-old and then threatened to shoot her. he dragged her to a brown colored van and drugged her before driving off. she managed to escape about a mile later. she was not hurt. the suspect description is limited. he's in his mid-20s.

the good news about job growth in silicon valley. our bob redell is live with an encouraging report out this morning. let's hear the good news, bob. >> reporter: well, also the bad news. good morning. over the past 24 hours there have been what you might appear to be conflicting signals over the future of jobs in silicon valley. cisco systems, san jose's largest private employer has announced it will shut 6500 employees, roughly 9% of its work force. the computer networking equipment make ser trying to cut expenses in response to slower sales and increased competition. about a third of those employees are taking voluntary buy-outs. the remainder will be laid off. employees here in the united states will be notified some time in august though cisco is head quart erd here the company has locations all over the world so not all of the layoffs will

come from here. while this huge tech company is cutting, other firms in the valley are expected to take on new people. a new survey released expects a 15% jump in new high tech jobs over the next two years. nova that headed up the study came to this conclusion after interviewing about 50 executives and serving about 250 companies. many of these will be in engineering and will require advanced training and high level skills according to this report. and that could present a problem. some companies question whether there are enough people in the valley with that kind of know-how, pointing out that this country's education system has failed to adequately produce enough bem those type of college degrees, they speak of the talent gap, we heard of that before and the concern that if you have this tremendous talent gap, silicon valley could lose

some competitive edge. >> thank you, bob. a pittsburg company says it may have to lay off nearly all of its work force. united spiro pipe. it has about 100 employees and officials say they may have to lay off up to 83 of those employees because of the economy. the company has slashed hours. >> 5:07. san francisco telling us how drastic court cuts could be. the state has cut $350 million from california courts and the system has tapped out its emergency fund. as a result more than 40% of the staff at san francisco's superior court will receive pink slips meaning come september they are out of a job. it means 25 of the 63 county courtrooms will close when that happens it will take hours to pay just a traffic ticket. at least a year and a half to get a divorce.

months to get court records and it's possible only criminal cases will go to trial. the new treasure island development project is hitting a snag. opponents are filing a lawsuit saying the city did not adequately assess the environmental impacts of that. a group says it does not want to stop the plan to develop treasure island but does want to assure the project can be sustained as a region. the lawsuit asks the san francisco court to force the city to do a revised environmental impact report. >> good morning, rise and shine. it's 5:08. christina loren joins us. it was a gorgeous day yesterday. >> just for one day only we've got a big time temperature increase through wednesday and thursday. for today looking similar to yesterday. a couple degrees warmer. low pressure is finally, finally moving inland.

>> good morning. welcome back at 5:14. a live look at hp pavilion near downtown san jose. looks to be a gorgeous day for tuesday. as promised some bay area cities have filed suit against the california government asking the state supreme court to reinstate their redevelopment money. san jose and union city are at the top of this lawsuit list. they say the state's two recent laws that take money from redevelopment agencies are

unconstitutional because they violate prop 22. voters passed a law last fall to prevent the state from raiding local coffers including redevelopment agencies. brentwood and oakland have filed declarations in support of these lawsuits. >> borders calling it quits. the chain has decided to shutter all of its 399 stores across the country. that includes six here in the bay area. the stores are in san francisco, palo alto, sunnyvale, two in santa rosa, and one in vacaville. the move means about 11,000 people nationwide are now out of a job. for the rest of your news we turn to nicole lapin live at cnbc. good morning, nicole. >> good morning to you. a lot of people are upset about it. futures are higher after yesterday's big losses in the markets led by the financial sector. investors concerned about economic issues especially the

a look at your forecast. >> good morning to you at home. we have nice weather for today and if you're waking up with us in oakland or san francisco you're going to get a couple of really nice days as high pressure takes control of our pattern. right now low pressure still in control. we had a short trough come through yesterday. as a result a little fog early yesterday. we're going to see more fog this morning. but high pressure is moving in quickly. it's going to warm us up for a couple of days. 90s inland wednesday and thursday. i'm talking mid-90s. a significant increase in terms of our day time highs. we're noticing that fog. santa rosa, quarter mile visibility. give yourself extra time. 63 in sunnyvale, 57 in san mateo. 56 in the city, and that goes for oakland as well. fairfield, 58, you're going to warm up quickly once the sun comes up. 83 by noon today in fairfield.

google last week turninging in spectacular numbers. that company continues to hire. you mentioned apple. we have no reason not to expect them to be absolutely spe spectacul spectacular. as you know, opal is growing quickly. it wants to build a new headquarters. they have jobs available. now apple and yahoo! in the same sentence only happens about once every three months when they report their quarterlies. it's a best of times, not so great of times. yahoo! continues to struggle. marla, it too is hiring. it posted 60 jobs to its sunnyvale location just in the last couple of days. as pob points out these tend to be very high end jobs. masters, engineering, that kind of thing. >> select slice of the population. okay. thank you, scott. 5:34. san francisco is taking a high

doing. she lad a board she could float on. still as you said it's been 12 hours since she was last seen. the search effort is coordinated here near san francisco. the coast guard saying they have still at this hour a 41-foot boat in the water and using a helicopter with search lights to look near coyote point. she is 62, from foster city. she was due back at 5:00 p.m. yesterday. crews joined in but as night fell the coast guard took over. there is some concern. she has ongoing health problems that hasn't been disclosed but that is a concern. she has with her we're hold a hand held radio and other safety equipment. a black wet suit, a blue helmet and orange board with a red sail on it.

>> welcome back. 5:43. another day, another set of talks. but are they making progress in the efforts to raise our national debt ceiling? today in the bay's tracie potts is live in washington with the latest. good morning. >> good morning. making progress, yes, according to the president. a deal, no, not yet. there is a vote today in the house, republicans are putting forth a plan they call cut, cap and balance.

essentially they want to cut the deficit, cap the spending and put in motion a balanced budget amendment to the constitution. democrats say they are concerned that this plan cuts too much out of medicare and social security. couple of other gop plans out there, com coburn suggests $9 trillion in cuts, four times what was on the table in the negotiations. but he's also backing tax increases. now, this is something that the republican party has been against. another republican plan in the senate by mitch mcconnell that would allow the president to raise the debt ceiling on his own and sort of procedurally force democrats to go along with that with no cuts, essentially politically making them responsible for doing nothing about cutting the deficit. but all of those at this point just on the table. they are still talking, still negotiating. in the senate, majority leader harry reid says they are going to work over the weekend as long

police shot spotting technology. police say kenneth harding fired at them on saturday when they tried to question him on a muni platform at third street near oak dale. police say the shot spotter proves harding shot at officers first. activists say it doesn't prove anything. >> we believe that the shot spotter report confirms that there were three shooters in this incident. mr. harding first, followed approximately two seconds later by the two officers returning fire. >> the gps is showing flash. we don't know what flash. it could be the 10 bullets that were fired at him. we don't know. until we see a ballistic report. >> activists say they are disturbed by cell phone video that shows police standing by harding as he bleeds on the street. and there's also a youtube video that shows a passerby picking up a gun at the scene as an angry crowd grows. police say they now have that

gun but they are looking for a phone and shell casings apparently taken from the scene. >> a san leandro police officer facing drug charges is leaving the force. jason frederickson resigned last friday after he was charged with giving a pound of marijuana to a confidential informant whom he was having an affair with. the 38-year-old has pleaded not guilty and is free on bail. prosecutors haven't said where he got the drugs. frederickson worked recently as a narcotics detective in his nine years with that department. >> today a former santa clara cop will go on trial on charges of sharing police secrets with the hell's angels members to pay off a debt. jury selection starts this morning in the trial of 37-year-old clay rojas. a federal grand jury indicted rojas on charges of giving criminal histories and dmv records to suspected hells angel member william betancourt.

the trial is expected to last two weeks. >> 5:47. pretty impressive video out of arizona this morning. check it out. a dust storm rolling over the city of phoenix. this is what it looked like from the sky. you can see the clouds slowly blanketing the city. on the ground you can see what the 25 to 30 mile per hour winds looked like. people still able to drive but yeah, visibility was low. this is the second dust storm to hit next to month. a larger one coated the city just on july 5th. i've never experienced a dust storm. doesn't look like i want to. meteorologist christina loren i'm sure you know plenty about them. >> we had a couple come through palm springs growing up. this morning you know what, phoenix, most of it the nation, they are dealing with oppressive heat. we have had such beautiful days, almost fall-like weather over the bay area. this morning you see the fog on

the golden gate bridge, that's the one wrench in the system. throughout the next couple of days we'll see less and less of low cloud cover and fog. high pressure is dominating the weather pattern in the midsection of the nation. we have some really, really hot weather, record-breaking heat that was the story. it's going to be the story for today and tomorrow. for us, a nice dip in the jet stream has kept things nice and cool. that will continue to be the case for today. but high pressure is moving in quickly so as we head through the next couple of days the 90s return inland, wednesday and thursday. really nice weather, though, right at the coast. san francisco, yep, it's going to be beautiful tomorrow and especially on thursday. right now we're waking up with 50s, a couple of 60s. 63 in san jose, 61 in livermore. a little more cloud cover to start you out this morning in the south bay. serving as a blanket. you're warmer down here than napa, 57, 56 now in santa rosa and 57 in novato. in santa rosa we're noticing

back to you. >> amazon.com is getting involved in california's election process with a referendum against charging sales tax on its goods. scott mcgrew joins us with a look. >> last night attorney general harris announced she would allow amazon to collect signatures in the state to put a referendum on the california ballot. a move would force voters to approve sacramento's new law charging sales tax for on line purchases. as it's proposed this morning a yes vote means i agree, charge me sales tax when i buy a book from amazon. no means don't. obviously more than amazon is affected but is the biggy. expect someone asking for your signature soon. amazon needs a half million of them before this can appear on the ballot. all of this talk about law and taxes, how about a robot chaser. video from stanford. students have perfected the jedi
