3:00 a.m. and a live look right now at the shuttle. the crew home safe and sound. we'll also have a live report coming up from kennedy space center in about ten minutes. we'll hear from the pilot of the first "atlantis" flight, coming up in a half hour. >> certainly a parent's worst nightmare, a stranger kidnapping their child a. woman goes to court to answer to charges she tried to kidnap a 3-year-old girl claiming the girl was her daughter. marla tellez is live in san jose this morning. such a brazen attempt, marla. >> reporter: laura, it's really hard to even imagine. this is the neighborhood where it all unfolded. the closest main intersection is park and meridian, we're on park this morning on the 1200 block where it happened. now, in this neighborhood it's a mix of small businesses, some pretty nice homes, some apartment complexes, and in fact, we're only about a mile away from the rose garden down the way behind us here.

the attempted kidnapping happened monday night about 9:00. police say 26-year-old myra flores approached 3-year-old jasmine and her 14-year-old sister denise. flores tried to lure jasmine away by offering to buy her candy. her teen sister knew better so she took her sister inside their second story apartment. flores actually followed them, forced her way inside and tried snatching jasmine, convinced that jasmine was her own daughter. >> she said like no, that's my baby. then she tried to grab her. yeah. and my mom tried to stop her and then like the lady was pushing her and then after that they were like -- i called police. >> smart girl. the 14-year-old denise did call 911 but it wasn't until a neighbor intervened that flores took off. police arrested her about a half

a block later. flores is being held at the santa clara county jail on $200,000 bail on suspicion of attempted kidnapping and residential burglary. police are not commenting on flores' mental state nor are they saying whether or not she happened to be under the influence of drugs or alcohol. laura, as you mentioned she is going to be in court today for her first court appearance to be arraigned. >> amazing. good thing the little girl and the family are safe. thank you very much. it is 5:04. new information this morning about the man who shot and killed an off-duty marin county sheriff's deputy. we learned the petaluma ex-convict was allowed to remain on parole even though he was convicted just last month on drug charges. thomas hallerin was sentenced to two years probation for trying to get pills with a fake prescription. he was allowed to remain because the offense was not a violent one.

hallerin gunned down deputy mathison before he was shot and killed himself. >> a memorial service will be held for a san francisco professor killed in a shuttle bus accident. dr. kevin mack died while riding a shuttle bus to san francisco general hospital last thursday. a big rig collided with a vehicle on octavia boulevard and initial reports suggest the bus driver may have ran a red light. the 52-year-old worked for more than a decade at ucsf. the memorial will be held at the university's campus at 5:00. >> as a result of that crash ucsf will put seat belts in all shuttle buses. >> following news from oakland where plans to build a football stadium got a lot more complicated and more interesting. christie smith is live with more on how two bay teams could possibly call the same stadium

home. good morning. >> reporter: good morning to you, laura. welcome back. the niners and the raiders play in two of the oldest stadiums in the entire nfl, so if you are a bay area football fan talk of a new stadium probably sounds like a good thing. the raiders and the niners sharing a stadium? that's what we're talking about. the niners and the raiders fans. a wine crowd beer crowd scenario here a. new collective bargaining agreement with the nfl players and owners which needs ink means that funding may be available for a stadium. but it also increases pressure for the teams to share a facility. both teams confirm they continue to talk about a joint stadium, the 49ers, they remain committed on a facility in santa clara so that certainly is a possibility. maybe not to raiders fans, though. but the city of oakland also revealed plans to look into a new stadium near o.co coliseum.

>> welcome back everyone. possible good news this morning for east bay pensioners today. a federal judge in san jose will decide whether to settle a lawsuit filed by the alameda county employees retirement association against wells fargo. the group is suing the bank along with several financial institutions over the recent

mortgage investment meltdown. wells fargo offered $125 million to settle and lawyers for the 20,000 employees say they will accept that deal. however, the other banks named in the suit have yet to offer a settlement. >> it's not been a good week for the bay area based wells fargo. the federal reserve ordered the bank to pay a $85 million fine. the fed says that wells fargo steered potential borrowers to loans with higher interest rates. it also accuses the bank of falsifying loan applications. wells fargo has agreed to pay but has not admitted to wrong doing. up to 10,000 borrowers were affected. it will get between $1,000 and $20,000 apiece. now for the rest of our news before the bell on this thursday morning let's check in with cnbc's nicole lapin. good morning. >> hey, great to see you this morning. futures a little lower, flat, but that's due to some of the

intel effect we saw. they reported good earnings last night but cut the forecast on the pc market this year. intel supplies chips for 80% of the world's pcs so it's important. stocks fell as investors took a breather from tuesday's rally amid the jitters not only about debt issues but also in europe. this morning in about 15 minutes we get big data on unemployment, weekly jobless claims, it's important this week because it is the last read for the month. we also are looking to a lot of big earnings, at&t, morgan stanley. just to recap from yesterday dow fell 15 points, 12,571, the nasdaq lost steam off 12 to 2814. also, americans may spend less on back-to-school shopping. the the national retail federation expects consumers to spend $603 on clothes, school supplies and electronic, down a

half percent from last year. with gas prices quite high and job growth at a near standstill shoppers will seek bargains. nearly 60% plan to visit department stores with several less expensive private brands. china has been at the center of producing counterfeit goods. now the country is taking it one step further. an american in southwest china stumbled upon three fake apple stores. the whole store. workers there were wearing traditional blue shirts like they do like in san francisco, the stores have posters, even advertising, ipads and iphones, but none of them were actually listed as legitimate sellers for apple products. that's getting a lot of buzz this morning. >> that's worse than buying those designer handbags in china town. >> the workers didn't even know that it was a fake apple store.

>> that's amazing. thank you very much. always good to see you. it's 5:16. shuttle "atlantis" back home, safe and sound. it touched down just a few hours ago. it's the final mission, the end of an era as we take a live look there at the space shuttle. "today in the bay's" jay gray live at the kennedy space center where the shuttle program has officially come to an end. a little bit of sadness for folks. >> reporter: no question about it, laura. look, it's an amazing and emotional day here at kennedy space center starting with that picture perfect landing. just over two hours ago, but people trying to catch their breaths after what was just a beautiful sight to see "atlantis" landing here, the touchdown of the wheels, the chutes deploy. and then it rolls to a stop, ending as you talk about the 30-year shuttle program. and really, spawning mixed emotions here. there's a lot of pride over what's happened over the last decades and with this mission

specifically. but sadness that this chapter in american space exfloration is closing. then the uncertainty that so many are dealing with, really not sure what direction nasa may go next. so a lot to deal with. they are trying to focus on "atlantis" and all of the good that's come over the 30 years of the shuttle program. >> quickly, do you know where they are going to park the shuttle now? >> reporter: yeah, the shuttle will be moved from the runway, taken back to the vehicle assembly building where it willing decommissioned, all of the toxins removed and this shuttle will move a couple of miles to the space museum here at kennedy space center where it will be exhibited. all of the shuttles disburse to museums across the country. that's the good news in this that people will get a hands on look at what has been an amazing spacecraft. >> take your kids to see it. thank you, jay. it's 5:18 now. i want to check in with meteorologist christina loren. they had clear skies for the shuttle landing there.

warm temperatures here in the bay area. >> yes, warm, warm temperatures. especially inland today. the good news is it's going to be short lived. as we head through tomorrow we drop off by about 10 degrees. high pressure, though, really in control of our pattern. and once we see this dip, this trough of low pressure move through here and cool us off over the weekend, high pressure is going to regain control and next week is looking much, much warmer. so this really nice fair stretch of weather that we had coming to a close soon after we get through a couple more nice days. this is what we're looking at. in terms of our fourth named storm in the pacific, this is hurricane dora, now it's so impressive is how much it intensified overnight. look at the well-defined eye. you have the fastest wind speeds. dora is a category 4 storm packing winds of 140 miles per hour. through the next 48-72 hours it will continue to push to the northwest, that's pretty good news. it's heading away from land. however, we could see some of the outer bands impact your

travels, headed to cabo check ahead. i think they are going to see rough surf at the least and gusty winds through the next couple of days so we'll keep our eye on dora. on the eastern seaboard. they are looking at two tropical storms, both headed away from land that they have bret and cindy a. nice day, a nice clear start, very little low cloud cover for us, that means it's going to be hot inland. 65 in concord, headed to to about 89 degrees in livermore at 1:00 become. 82 in concord. we'll round out with mid-90s. make sure you drink lots of water. if you work inland, at the coast though, perfection. a little warmer in san francisco but less low cloud cover to start you out. we cool off for the weekend. then we spring back up monday through wednesday. we'll talk about that coming up. >> no, i don't want to talk about that. 5:20. hundreds of state inmates about to make their way to one county jail in the bay area. how the county plans to deal

>> welcome back everyone. 5:23 this morning. as we take a live look at the kennedy space center where the shuttle "atlantis" touched down earlier this morning about 3:00 a.m. our time. and ending an era for nasa's shuttle service system. 5:23. public safety officials in san francisco will meet today to discuss how they plan to house and supervise new prison inmates transferred from the state. earlier this year governor jerry brown signed a law that transfers low level adult

offenders to county jails. about 700 of those inmates and parolees are slated to come to san francisco's jail and probation programs. today the san francisco board of supervisors will meet at city hall to plan how they will manage that transition. let's see how the roads are looking this morning with mike. >> we're looking at antioch now showing highway 4, that before and after shot. this is the before with 67. so unlike when you lose weight on those commercials we're going to pack on the on theage in 20 minutes we'll see slowing. a lot more cars hit the road. 580, the smooth 14-minute drive to the dublin interchange. the volume starting to pick up over into livermore. we'll see slowing there over the next half hour as well. south bay, one accident at 880. the southbound direction, at the transition with 101. it is off to the shoulder but watch the connector. you might find activity as you approach. music in the park through

downtown, so street closures as is tradition around caesar sla vez. plan for that. stay away from the front of the fairmont where all the activity is. sunol, you saw a smooth flow there and here. a nice drive southbound over the hill into fremont. the top of the screen you can see the sun starting to make an appearance. >> don't have to wait until tomorrow. the population of golden gate park's bison is dwindling. doctors say on tuesday one of the bison had to be euthanized after being ill for months. two weeks after another was put down. there are only three left. the golden gate park officials plan to remedy the situation. they say they are going to bring in younger bison, thanks to a $50,000 gift from richard bloom. he donated the original herd back in 1984 as a gift to his wife, senator dianne feinstein so. he's keeping that project alive.

into a raging water fall at yosemite. the three hikers from the central valley are identified. 22-year-old hormiz david, 21 erld nursing student ramina badal and ninos yacoub. all three on a church outing when they climbed over barricades at vernal falls and swept away while posing for a photo. last night hundreds came together for an emotional prayer service at st. george's church. it's a community hit especially hard by the tragedy. st. george's sponsored the outing. the three hikers now presumed dead. one family still holding on to hope that they may still be alive. >> he's the brother we never had, he's our best friend and i know he's going to come home. he's coming home and this isn't real. he's coming home because he's my big brother and he's everything

plans for the next big remodeling project have hit a snag. monty is here to explain. >> reporter: good morning. the airport commission has scrapped that first plan to remodel terminal 3. people are here lining up for their early morning flights. there's a new plan and new design and it's triple the price of the previous plan. the airport commission made the decision last night ending its contract with hensel phelps construction which has been paid about $3 million to begin work on terminal three. the airport is expected to resolicit bids on the project expected to cost $104 million. officials said they made the decision because they want terminal 3 to be as nice as the new terminal 2 which just underwent a $383 million renovation. the new plan for 3 includes an 18,000 square foot expansion, new restrooms and upgraded curb

hacking suspects busted by federal agents will appear in federal court on charges of launching cyber attacks on paypal. 14 people across the country now under arrest, accused of being members of a hacking group called anonymous. members allegedly attacked the paypal website after it cut off payments to wikileaks. the fbi says the arrests send a message saying that hacking for social causes is unacceptable and illegal. >> they say imitation is the sincerest form of flattery. scott says one company may have taken it too far. >> a company in brazil flattering the heck out of san francisco-based zynga. a video submitted in a lawsuit brought by zynga, that's the company. you can see the video on tech crunch. open top is a zynga game. on the bottom is a game made by the brazil company. the two are so similar and this
