>> reporter: another deadly shooting in the city of east palo alto bringing the number, the total to six this year. i'm christie smith. we'll tell you what happened, plus what the city plans to do about it coming up in a live report. >> a bay area boy battles a bear and survives. how he escaped while others are fighting for their lives. and how thieves allegedly worked from the inside in the largest high tech heist in silicon valley history. a live look at san jose this morning. it's monday, july 25th, this is "today in the bay."

>> good morning. it's 4:30. i'm scott mcgrew. happy monday. let's check the forecast and meteorologist christina loren. >> good morning, scott. we're going to get a couple of flies days before this stubborn area of low pressure moves aside and let summertime set into the bay area. we are expecting pretty strong fog to develop as we head through the next couple of hours. we'll let you know where we expect the heavy fog, what that means for your commute coming up. let's check the commute with mike inouye. >> we'll take to you the south bay, two areas. the accident 280 at saratoga is clearing but this construction work i hear that may be clearing, about a half hour earlier than expected. the full freeway closure, the last of this phase, clearing by 5:00. my phone is ringing. that may be confirmation. we hear the crews are clearing the scene right now. >> mike, thank you much. this morning a man is dead, another fighting for his life after an overnight shooting

outside a restaurant in east palo alto, this as the city is trying to get a handle on the up tick in violence this summer. "today in the bay's" christie smith live on the east bay shore road with the latest. good morning, christie. >> reporter: good morning. this latest shooting happened behind this building. two people shot, two men, one of them killed, happened about 10:30 last night. east palo alto police still gathering evidence this morning. here with me is the acting captain jeff lu. can you walk us through what happened here. >> what we know is 18 and 19-year-old hispanic males arrived in the parking lot here last night. we know somebody opened fire with firearms, striking one of them with non-life threatening injuries. he was transported to the hospital. the other victim suffered a fatal gunshot wound and died on scene. >> any suspect information? >> we don't. we're asking for the public's

help. anybody that thinks they know something, contact us using our anonymous tip line or voice mail message or anonymous e-mail address. >> this comes as there have been a number of shootings in the city, also i wanted to mention that the city had announced a plan for summer violence reduction program targetsing hot spots, gangs, also using the help of other agencies, even using charging suspects in federal court when that applies. also, there was a mention of an 11:00 a.m. you guys are going to talk about some possible suspect information on two other shootings. >> yes. we're having 11:00 a.m. press conference, regarding two homicides from last week. where we're looking for two persons of interest that we need to talk to in that case. we have a little more information at 11:00 including a quick time line of activities. >> thank you for being here with us, early this morning.

that's what we have from here. reporting live in east palo alto, christie smith, "today in the bay." >> thank you much. 4:33. later tonight a teenager from richmond is coming home after living through a bear attack in the alaskan wilderness. over the wilderness the bear attacked a group of campers including richard martin. they were crossing a river. martin and the rest of the campers were finishing a survivals skills course when the bear attacked. the teen said they were crossing the river in single file when those at the front screamed about a bear, coming towards them. the two teens at the front got the worst of the attack. they are in the hospital in anchorage with life threatening injuries. martin managed to call his family in richmond shortly after being rescued. >> he said the bear had chased him, but he fell down and started kicking and all he could

do is kick and pray. >> in all, seven boys were mauled, so far are all alive. the attack the teens helped each other by setting up a new camp, giving first aid and calling for help. rangers say the bear was likely trying to defend cubs. >> today we may finally see the faces of the men accused of brutally beating bryan stow at dodger stadium. 29-year-old louis sanchez and marvin norwood will be in court to answer charges of mayhem, assault and battery. police reportedly tracked down the pair by gathering receipts from ticket sales. the two jumped out as prime suspects because fans described them as being aggressive and belligerent during the game. stow is still in serious condition at sf general. we should point out, of course, l.a. police made these accusations against a different man before. >> four middle school boys expected to go on trial accused of sexually assaulting two girls during the class field trip.

the class from kennedy middle school was visiting a park in redwood city when prosecutors say the boys broke away from the group before the attack. they are between the ages of 12 and 14, charged with lewdness, sexual battery and false imprisonment. each could face 15 years behind bars if convicted. >> a difficult week ahead for the family and friends of a family killed in a fiery crash in canada. 49-year-old robert howard and his wife ana marie diaz and their daughters had started a three-week family trip through british columbia on friday. when a tractor-trailer crashed head on into their camper. video here. the driver of the tractor-trailer reportedly walked away without injuries. we spoke to relatives in palo alto. they are still in shock. >> it just seems impossible that a family that was so full of life could just be gone so quickly. >> robert howard grew up in palo alto, attended stanford.

ana marie attended cal poly. their daughters both went to school in palo alto. >> a young girl is reportedly on the mend after she was hit by a stray bullet during a slumber party. she is doing better. on friday linda was in bed at her cousin's home in the western addition, when a bullet blasted through the window, hit her just above the heart. today police should release the names of the two teenagers arrested in connection with the shooting. >> 4:37. inside job, that's what investigators are calling the largest high-tech computer heist in bay area history. police say two of the nine men arrested for the february heist of $37 million of commuter chips worked at unigen. pierre ramosen union city and 31-year-old leonardo bremen

joined the company shortly before the heist. a company spokesman says the two showed up at work the day after the heist. the two along with the other defendants will appear in court on wednesday to face charges. if convicted they could face life in prison. investigators still trying to track down six other people they think were in on the job. >> let's check in with a forecast and meteorologist christina loren. >> good morning. i'm so excited it's monday. i bept you are too. we've got this nice flow today and tomorrow. we're going to see comfortable weather. still below average, then by wednesday things startto heat up. what's happening is we've got this stubborn area of low pressure sitting here. off to our north sitting and spinning. as we head through the next 48-72 hours it's not going anywhere. it's going to keep the on shore flow in place and that means our

temperatures will stay below their seasonal averages and means we're going to see a lot of fog, not only this morning but the next couple of mornings in san francisco, oakland, and that could make for a rough commute. we're looking pretty good in terms of visibility but i believe we're going to see substantial fog and low cloud cover all the way throughout the east bay and the south bay this morning. just to the south we've got this monsoonal flow setting back up. high pressure is amplifying. it will make an impact on our weather. we're going to have to wait for that, probably until late wednesday into the rest of the week. temperatures really start to climb back up to the 90s. today, the 70s. 79 in concord, 79 in fremont, and 77 degrees in san jose. i know coming up from campbell to here in san jose i had a lot of construction this morning, mike. >> what was your route? >> i take the 17 to the 880. >> wow, so there's a lot of construction through that area. that's news as far as slowing going because the maps showing a

smooth flow. this is the one we're talking about for the focus. 101, as you pass by tully. i got the latest. the northbound crew has just cleared the scene early. the southbound crew is on scene. that has a full closure so the alternate is capital expressway, stay clear for the next 20 minutes. no delays reported for that crew. christina is talking about construction for 17 up to 880 out of campbell up to studio. you may find that as well. typically those clear about 5:00 as well. the accident at 280 in saratoga has cleared. easy flow through this portion of the south bay. we'll show you what things are like north, 880 moving nicely and the construction north of the coliseum into downtown has cleared as well so. folks on the move early this monday morning. >> mike, thank you. 4:40. french police searching the house of the father of the man who confessed to 93 killings in norway. about a dozen officers

>> welcome back to you. it's 4:44 as we take a look at gab brie yell directing the newscast a. woman accused of one of the most powerful men in the world of attacking her in a manhattan hotel now, after staying silent for nearly two months, the maid in the story is coming forward with her side of the story.

this is the woman on the just released cover of "newsweek." she says she called out hello, housekeeping before opening the door to the hotel suite. she says the former leader of the international monetary fund suddenly appeared naked, pulled her to the bed. she tells the magazine i push him, i get up, i wanted to scare him. i said look, there's my supervisor right there. but the man said there was nobody out there and nobody was going to hear. the new york prosecutors are considering dropping the charges against strauss-kahn because she admits she told some lies about her background and what she did in the moments after the alleged attack. the prosecutors say she also lied about a different sexual attack while applying for political asylum. >> eight days to go until america's checks could start bouncing. lawmakers battling over a plan or plans to raise the nation's debt ceiling before the august 2nd deadline. this morning many eyes will be on wall street and the reaction to the impasse on capitol hill

with the possibility of a default just nine days away. for more on that and other news before the bell, nicole lapin. good morning. >> hey, yeah, i thought going in that it would be much worse than it is now. based on the news that you outlined, scott, futures are lower but they have come off the lows of the overnight trading session as investors continue to monitor what's going on in washington. as you said next tuesday's august 2nd deadline is when treasury will say that the u.s. will run out of cash to pay bills setting up a possible default on our national debt and downgrade of our top credit rating. that could push interest rates up on just about everything from mortgages to car loans to student loans. major agencies like s&p and moody's warned that they would still cut the u.s. rating if they deem the deficit deal isn't enough. so they will cut if it they do reach a deal, and essentially if they dochblt that's the biggest rigsing. asian markets were down, there is a lot of red arrows across

european trade. a bumpy day on wall street. dream works is reportedly in talks to give netflix the streaming rights to its movies which include "shrek." the deal could be announced this week. it would replace dream works deal with hbo set to expire in 2014. a quick update on the fake apple stores in china i told you about last week. reports say the chinese government found five fake stores in southwest china where an american blogger stumbled upon them and posted about them last week. well, they have shut down two of them pending an investigation but they can't do anything about the others, this is weird and weirder, they weren't selling fake apple products. >> so you can't shut down a fake store if it's not selling fake apple -- okay. sure. i'll go with that. nicole lapin, cnb krrk, thank you. for the first time in a long

time, california does not lead the united states in the most expensive gas. that honor goes to connecticut, at $4.04. that's unusual because california's usually at the top. trumped only by hawaii. in california, the average price for a gallon of regular unleaded is $3.82. that's still up 68 cents from this time last year. here in the bay area, the price ranges from that $3.82 in san jose and oakland, $3.90 in san francisco. >> all right. meteorologist christina loren has a look at the forecast. >> good morning. why do you need to use all of that gas when you can stay here and get the best weather across the country. it's been so nice this month. we've got more of the same to start you out this week. onshore flow will bring about a mostly cloudy start. the clouds will keep things cool in the afternoon and in some cities you're going to be cooler this time of day, than we're going to see later on this afternoon. so we're looking forward significant changes as we head

through the midsection of the week. but really, more of the same for today, tomorrow, all the way through wednesday. 56 degrees now in concord, 57 in livermore, and 57 degrees in hayward. you're on the way to the 70s so in the east bay it's going to be a little cooler, warmer up in santa rosa. we're starting out with not as much fog as yesterday at this time. 63 in san francisco, 82 in redwood city with the mostly cloudy start making way to mostly sunny skies. then as we head through the middle of the week we start to warm up. the 90s come back. 90 on thursday, up to 92 degrees on friday. and overnight lows fluctuating in the 50s, a beautiful start out there. walk out the front door you don't need a jacket. it's perfect. 90 degrees by thursday and then we climb all the way through sunday, so enjoy these next couple of days. the warm-up's on the way. >> maybe it's not just santa who has a naughty and nice list. it seems the tooth fairy is leaving more cash for west coast

visit was scheduled during the raid on osama bin laden's compound. we're sure they will be on their best behavior. apparently all it takes to get you out of jury duty is a trip to the white house. the chronicle reports that san francisco mayor ed lee was summoned to jury duty but will be excused for the trip. technically he is on vacation. he has been visiting his daughters in new york but will swing by to meet the giants at the white house rose garden. >> we have a busy morning shaping up for "today in the bay" and laura is in the newsroom. >> good morning, scott. good morning everyone. it is a busy monday morning already. in fact, the man who confessed to the attacks in oslo appeared before a judge this morning wanting to tell the world why he did what he did. but the judge decided to hear his story in private. we're closely following that case. plus we're also learning more about how los angeles police

let's look here to the roadways where we'll interpret this. 14 minutes out of the altamont pass to the sunol grade and 680. a smooth drive off of 680. nice down to the south bay. this zone i circled, the area that christina was telling me she saw construction but it was before the 4:30 show. now no construction remains as far as the closures through the area. the southbound side of 101 reports the crew on scene. should be picking up but a smooth flow the rest of the south bay. i have a note, folks traveling toward 152 and cutting over there off 1 a 1, that's the 152 is where casa de fruita is. no major injuries but a road closures because they have to repair a verizon telephone pole. >> that drive always scares me. >> very curvy. >> trash companies increasing their haul. coming up why it could cost you
