it's tuesday, july 26th. this is "today in the bay." >> good morning everyone. it's 4:30. i'm scott mcgrew. we're going to start with a forecast and meteorologist christina loren. good morning. >> good morning to you, scott. we have a comfortable day for you. mild conditions, just a touch warmer than where we ended up yesterday. as we head throughout the afternoon we're going to see pretty strong winds develop and we've got a chance for thunderstorms in the forecast. i'll talk about when and where coming up. right now, though, maybe you're headed out the front door. construction out there, mike. >> 880 like you talked about through san jose one lane blocked from 280 to 101. we're talking about a closure, 237 at 101, that should be picking up shortly. an accident, 101 at 13th, no injuries, we'll watch for the activity to clear. it's on the shoulderer.

back to you. >> in just hours officers are going to be out looking for one of two gunmen who fire add rifle at park police. it happened in a remote area near the upper san leandro reservoir not far from the moraga country club. christie smith joins us with the latest. good morning. >> good morning. i spoke with the east bay park police by phone and they tell me this manhunt will likely resume after 8:00 this morning. what they are telling me they are looking for maybe more than two suspects now, someone who opened fire on a park police officer yesterday evening who was on patrol in a rugged area of parklands near upper san leandro reservoir. park police said that officer had to take cover, he returned fire. it's unclear if any one was hit but some neighbors heard the gunfire and were concerned.

the officer was not hurt but he had to call for emergency help and had to be rescued with the use of an armored car. officers from moraga, lafayette and others were called in to help. police believe the shooters may have been protecting a marijuana grow operation. >> east bay property is an area that has been known prior for marijuana grows, and we have had pictures in previous grows where we have had armed individuals guarding the groves. >> reporter: investigators searched on foot and with the helicopter yesterday evening, but they couldn't find the suspects and suspended the search. they tell me they will begin again this morning and also evidence of drug activity in the hills. reporting live, christie smith, "today in the bay." >> thank you. again so i'm clear how many suspects are they looking for do they think are out there? >> reporter: they are telling me

this morning that at least two, and maybe more that opened fire on this park police officer. yeah. >> christie smith, thank you much. >> well, this morning narcotics agents are also raiding marijuana farms in six northern california counties, part of a major operation to get rid of illegal marijuana farms in the mendocino national forest. it's a mix of law enforcement from federal to county. the raids started last week and officers arrested 77 people and netted 300,000 marijuana plants. the raids include lake county. the east bay teen who went face-to-face with a bear in the alaskan wilderness on his first trip out of richmond ever is back home this morning with an incredible story to tell. cheers and tears for the 18-year-old victor martin, as he hobbled on crutches into his richmond home.

martin and six other teens were walking single file across a river when the bear attacked in the mountains north of anchorage. the bear bit martin on the ankle. the teen's sense of humor still intact. >> oh, yeah, i looked at him. i kicked him dead up in his face right in the middle. kicked him. we was done after that k.o., you don't mess with me. don't play that. >> all joking aside he is very lucky to be alive. all seven teens were injured by the bear. two are still in the hospital in alaska with serious injuries. >> a stunning twist in the case of three boys charged with sexually assaulting two girls on a field trip. all three admit they attacked the girls in a redwood city park. two of the boys, 13 and 14, could get a maximum of eight years behind bars. the third boy who is 12 could get a year in jail for sexual battery. the boys admitted what they did yesterday.

the day their trial was supposed to begin. two other boys are also charged in connection with the assault. >> nearly four months after bryan stow was beat sfwoon a coma police are looking for more giants fans who may have been attacked at dodger stadium on opening day. >> any one who was assaulted march 31 at dodger stadium, especially any one wearing giants attire, any one on the third base side or any one assaulted in the parking lots, to contact us. >> security at dodger stadium is tight after the two men beat stow back in march. two suspects appeared in court for the first time yesterday. they did not enter a plea. sanchez also accused of attacking another man and woman on the day of the stow attack, accusations his lawyer denies. >> doesn't fit the profile of somebody who would commit this type of crime. he's a family man. >> also arrested in the case

dorene sanchez. she's facing charges as an accessory but is out of jail on $50,000 bail. >> the fate of 100 workers hangs as pg&e considers closing five power plants in the east bay. the utility says it wants to close the plants in east contra costa county to make its power grid cleaner. these plants are all at least 20 years old and run by burning petroleum coke, that's a byproduct of oil refining. pg&e says it's possible the workers at the plants could be offered jobs at a facility in tracy. that one burns cleaner burning natural gas. >> folks in san jose not too thrilled at the idea of a tax increase this november even though the city faces a huge budget shortfall for the coming year. a poll conducted by the city shows the only tax increase voters seem to be willing to deal with is a quarter cent sales tax. even that measure only got 57%

support. >> in order for the hike to make it on the november ballot the san jose council has to declare a fiscal state of emergency and that vote has to be unanimous. some observers say that's not likely. >> 4:38. turns out procrastination pays off. you have extra days 30 of them, to make sure your kids get vaccinated from whooping cough. governor brown is giving school districts a month after school starts to make sure that students have gotten the shots. these vaccinations are required for students, grades 7-12. before the governor took the action schools were scrambling to make sure students were vaccinated by the first day of school. many school districts were worried they'd have to turn away kids who had not got at any shots. now, christina, i'm no doctor but if you take all of those kids not vaccinated and put them in school for 30 days i think that defeats the purpose.

but i'm not the governor and i'm not a doctor. >> they are always bringing something home from school. then the parents bring it here to work and we thank you for that. good morning to you. we're looking really good today and tomorrow. and then it starts to get warm around here. this area of low pressure sitting just to our north. really not budgeting. we head throughout the day, another significant marine layer formation and that means a mostly cloudy start but a nice sunny afternoon with mild conditions. high pressure still in control in the southwest portion of the united states. this is a big strong ridge of high pressure pumping in subtropical moisture. you can see it's clockwise rotation, that's an amplifying ridge. we head through the next couple of days this will bring that moisture here to the bay area. and we could see some thunder boomers as a result. we'll talk about that. right now we're in the 50s headed to the upper 70s and low 80s. got that forecast coming up. >> good morning. thunder boomer. we'll look for that.

lot of space so you should be able to get by. >> mike, thanks for the update. room service, housekeeping, movies on demand. imagine living in a hotel instead of the dorms while you goto college. that could happen for a group of san jose state freshmen. san jose state has a housing crunch. upper classmen making room for incoming freshmen. administrators are negotiating a deal with a yet to be named hotel, this hotel will be within walking distance or short light rail ride from campus. >> the main concern is that students want to live on campus, they want to have the benefit of being close to class and to the library so we're going to do our best to address that with the light rail, shuttle service in the evening. >> once students find which hotel has been chosen they have five days to agree or decline and get their money back. students who decide not to live in the hotel have less than a month to find a new place to

a well known orinda man was living a lavish lifestyle. he was swindling families to pay his bills. the former head of the orinda real estate group accused of stealing hundreds of people's savings. carl miller cheated 175 clients out of more than $1 million taking retirement money and using it on personal luxuries including a $3 million home and the use of a private jet for family vacations. miller pleaded not guilty to those charges, he faces nine felony counts. if convicted he faces up to ten years in prison. miller's alleged victims say he deserves it. >> i'd like to see him spend a lot of time in prison to make up for what he did to the people. >> miller's attorney says miller is trying to do what he can to make things right. >> the ongoing debt ceiling debate means a busy day on wall street. let's turn to nicole lapin.

good morning. >> good morning to you. futures are a little higher. stocks closed lower monday, trading over the concern that the ratings agencies could still downgrade the credit rating even if the debt deal is reached. asian markets rising, europe is higher, we get data out this morning significant on home prices, new home sales and consumer confidence. ford, 3m, ups reporting. yesterday the dow falling 88 points to 12,592 where we closed, the nasdaq lost steam as well, 16 points off to 2842. the irs also is making it easier for innocent spouses to escape responsibility for the tax debt of their husbands and wives. under the law taxpayers who file jointly are generally liable for partners debt. you could only qualify if you

course scott mcgrew. low pressure to our north, mild conditions. on shore flow for today. that will be the case for tomorrow as well. then things start to change as high pressure regains control of our weather pattern. you see all of that subtropical moisture surging up from the south. that is monsoonal moisture not yet impacting the weather pattern. it will. give it time. i think by thursday into friday it will get pretty muggy especially in the south bay, even the east bay valleys, then downright hot as we head toward this weekend. yeah, one of those weekends where you probably want to make indoor plans like hitting the movies. 56 in livermore, 58 in hayward, 56 degrees in oakland. if you are waking up with us in oakland at about noon today, 68 degrees. this is representative of what we're thinking the sky will look like. a mix of sun and clouds. i think we'll tlooz marine layer earlier than yesterday. that's going to make for warmer afternoon, a touch warmer, 4:00 p.m. in san jose, here's what we

expect, 81 in san jose, 63 where we expect our noon temperatures to be in the city. and then by 4:00 p.m., 65 degrees. so, one of those days where you get a 10-degree spread in san francisco, kind of dreary all day long. but i think the sun will shine a little bit earlier than yesterday. 80 in san rafael, 72 oakland, 81 degrees in san jose. your seven-day outlook, we continue to warm up into this weekend. 93 degrees on sunday. and the warmer cities across the bay warmer, 97 degrees in places like concord. so you want to make indoor plans this weekend. back to you, scott. >> thank you. they lost their way, now scientists trying to scare a couple of wayward whales out to sea. not having much luck, though. a gray whale and her calf wandered up the river a month ago. they are trying to get to alaska from baja. that's not how you get there. the 45-foot mother, 15-foot calf

>> it's 4:52. there is a picture of the hp pavilion t shark tank. a napa man free on bail accused of molesting an 8-year-old girl during a camping trip. marin county sheriff's deputies say a family of five was sleeping in their tent at dillon beach. the girl woke her parents up and said there's a man sleeping in my sleeping bag. a group of campers grabbed the suspect, bound his hands with plastic cable ties until deputies arrived. the district attorney is deciding whether to file charges. he needs to understand this case better. >> san bruno has to decide what to do with its ban on pot clubs. council members will decide whether to extend the ban on -- or set up rules to govern pot shops.
