>> good morning. i'm scott mcgrew. let's get started with meteorologist rob mayeda in for christina. >> good morning. pretty nice start to the morning in san jose. 60 degrees, clear skies. you'll run into thick fog in spots that may slow your morning drive. mostly 50s with patchy low clouds inland. the summer micro climates under way. you can see 80s to low 90s inland but cool around san francisco, 68 degrees and the seven-day forecast will show you temperatures inland look toasty as we kick off the weekend. 90s around the bay area in the afternoon. >> taking the kids to the city today. oakland, we're watching an incident in the chp plotter. about 2:30 in the morning from what i understand an arrest was made, a driver under the influence. no one injured other than the driver and the wrecker there.

that should be clearing up in the next few minutes. i have other spots to watch. >> a good samaritan in the hospital fighting for his life after he was shot while feeding the homeless in oakland and police are searching for the gunman. "today in the bay's" christie smith is live with more on the story t status of the good samarit samaritan. this happened at midnight, right? >> reporter: that's right. and to any one who knows brother john as he's joan in the neighborhood, this really doesn't make sense. he was doing what he always does, that is helping to feed the needy in oakland when someone opened fire. this has rattled even veteran police officers here at the oakland police department. i have calls in to the homicide section this morning for an update but one officer i got on the phone did tell me as far as she know there is have been no arrests in the case. brother john had just finished a delivery meal late last night near 47th avenue. this was part of his regular

delivery route, to make sure the less fortunate had something to eat. that's when someone opened fire on the van he was in. he was shot in the head. his wife grazed in the shoulder and 3-year-old daughter in the vehicle, she was hit in the arm. the latter two expected to be okay. we spoke with a man who was on the family's regular route, he had just gotten a meal. >> very torn up. i'm trying to understand the situation. it's not easy to understand. i'm not going to ever understand it. >> reporter: brother john was last known to be on life support after the shooting. we do have calls this morning in to highland hospital for an update on his condition. as soon as we hear we'll let you know. christie smith, "today in the bay." >> thank you. 4:33. a late night police chase that spanned several east bay freeways is over but not with the results that the police hoped for. the chase ended in central valley just before 11:00.

the men are in custody but not the murder suspects officers thought they were chasing. turns out the car was connected to murders in east palo alto and grand junction, colorado, but the men inside were not. officers are looking for jaime cardenas. also accused of a triple shooting in colorado. last night's chase began before 8:00 in newark where police spotted the car. the driver took off on 880 south, then 237, doubled back to 880 north and drove all the way to oakland, snaked on the 980, eastbound 580, finally stopped near tracy. the suspects ended up on interstate 5 where police used spike strips to stop them. not clear why the men were driving a murder suspect's car. pg&e will dig in the san bruno blast zone. people near the pipeline got a

surprise phone call yesterday, alerting them that crews will be working this morning. apparently the public utilities commission and pg&e want to dig up an old abandoned pipe so it can be inspected, part of the investigation into the deadly pipeline explosion. the city and cpuc will monitor the dig. "today in the bay's" marla tellez is on the way. she'll have a live report coming up at 5:00. >> police think she's dead but the family of a missing nursing student continues to pray she is alive. the family of michelle le gathered last night in hayward and had a vigil at mount eden park near the scene of the disappearance may 27th. they had a rally to remind the public that le is still missing. >> most of us have gone back to our normal everyday lives, but then there is us. the ones who understand that there's no such thing as normal

everyday life any more. or at least until she comes home. >> le was last seen at the kaiser permanente in hayward. there is a $100,000 reward for her return. >> a warning for parents this morning. los altos police are looking for a man who exposed himself to a 13-year-old girl, it happened monday near grant road and richardson avenue. the girl had a lemonade stand when a man pulled up in a black ford f-series pickup truck, he flashed the girl and drove off toward foothill expressway. police are working on a sketch of the suspect. >> the south bay woman accused of busting into a home in san jose and trying to grab a young girl from her mother's arms will be in court today. 26-year-old myra will be arraigned on attempted kidnapping and burglary charges. a 3-year-old girl was playing with her sister in the front

yard of their home july 18 when flores walked by, tried to coax the toddler away. the two ran inside. she tried to pull the child away from her mother. the mother fought flores off and called 911. >> the plolee accused of attacking bryan stow asking to be released from prison. attorneys for giovanni ramirez filed document seeking the immediate release of their client. they say the parole board caved in to political and public pressure when it ordered ramirez to return to jail on that parole violation. police found a gun in ramirez's home while searching for evidence connected to the stow beating. last week lapd publicly announced that two other men had been arrested and charged in the attack. let's check win rob this morning. >> good morning, scott. pretty nice start for most of the bay area we're seeing 50s and low 60s but you will run

into thick fog along the coast across the golden gate bridge. something mike will keep an eye on for your commute. we're seeing southwest winds in fairfield but not as strong as earlier in the week. the marine layer has been squished down. warm temperatures inland today and tomorrow. for the weekend moisture moving out of southern california which we have to watch out for in terms of lightning-sparked fires. i think most will stay in southern california as temperatures cool slightly for the weekend. today, pretty nice, 60s around san francisco, 70s for oakland, 80s for san jose. inland around the tri-valley temperatures climbing into the 90s. if you head up to ukiah, 101 around ukiah for the afternoon. seven-day forecast, toasty inland as we kick off the weekend. cooler as you approach the start of next week. a check of your thursday commute with mike. >> we'll check 580. so far the traffic is moving nicely through the area.

14 minutes. i'm going to call out the area. a person with a disabled minivan on the shoulder but the lady and her family walked onto the freeway to use a call box that includes three kids. so be very careful, watch the area as you pass by. hopefully chp will arrive soon and give them a hand. we're looking here toward that san mateo bridge, off of the bridge, construction over to 880 you'll be diverted off. then the bridge to the south, the dumbarton overnight construction there as well. we'll continue bridge check with the golden gate bridge and rob said fog and there is fog to be sure. no major problems because the cars aren't driving there right now. >> sure not. >> there are a few. there we go. now we have a car and a truck. back to you. >> now that the nfl lockout is over teams will get back to work

yesterday's big market sell-off. investors growing worried about the stalemate in washington over raising the nation's debt ceiling. the house is to vote on the boehner plan but he might not have enough votes and senate democrats for their matter say they are going to oppose the bill. it will run out of cash to pay the bills starting tuesday, setting the stage for the first u.s. default. asian markets were down, europe lower, but we get significant employment data this morning and pending home sales and earnings from dupont and exxon-mobil. recapping some of the market action yesterday, at at the end of the session, the dow was off 198, 12,302, the worst since june 1. the nasdaq lost 75 to 2764. foreclosure activity has dropped in several areas because banks are no longer taking a move against homeowners falling behind on payments.

foreclosure rates fell in 178 areas during the first half of the year. the biggest declines in new york, maryland, florida, jersey, connecticut, massachusetts and illinois. those are all areas where courts play a significant role in signing off on foreclosure documents. the irs is asking airlines to refund taxes to passengers who bought tickets before last weekend but now taking trips. those people may be owed money because congress let the taxes expire. the airlines aren't required to issue refunds, that's probably why you said kind of. the the irs is saying look, you can treat it like when passengers exchange a refundable ticket for those they don't use. >> not required but do it out of the goodness of their airline heart s. that theed. >> >> right. and give up the $25 million every day by these fare increases after the taxes expired. mind you with that money

happened to the town where cannon taught english to japanese children, completely destroyed. >> not even close to finishing cleaning up. so, it's going to be long, long process. >> reporter: for three days after the earthquake and tsunami hit the 25-year-old's family in san jose didn't know whether or not she was dead or alive until cannon's sister saw nbc's ann curry in the region and sent her a tweet to look for her. >> are you cannon? >> reporter: moments later a reunion via satellite phone and days later a return home to california. >> i'm nervous to go back where the earthquakes are happening, they are still having aftershocks. >> reporter: she is now heading back to japan where the school she taught sat holding a graduation ceremony. it was canceled when the tsunami hit. >> it's still a struggle,

especially with the people still living in the evacuation centers. >> reporter: cannon will try and help. her family raised $3,000, cash she will bring with her. >> buying notebooks or helping get uniforms, something that is needed and that i can do sort of directly. >> reporter: mostly she's looking forward to seeing the people she says saved her life. >> really therapeutic to go back there and be with people who know what time was like and see that they have moved on or doing well hopefully. >> reporter: you can see cannon's bags are packed. she will be in japan five weeks during her journey sending video updates you'll only see on nbc bay area. >> 4:48. boy, i remember that day well. i remember trying to understand what people should do. there is a tsunami coming? >> and the video. didn't even look real.

it was incredible. an incredible story. we'll be monitoring that as she heads in and gives us reports. you can see this morning around san jose, 60 degrees, we don't have much in the way of low clouds around the valley, different story if you are closer to san francisco. in oakland at 52 degrees, and around to the golden gate bridge it's golden but it's fogged in. 56 degrees, that will slow down your drive especially highway 1 or coming up over the summit of 17. not much of a sea breeze as far inland. a couple of thing, temperatures starting to come up for the inland valleys, also the air quality starting to drop off. seeing moderate air quality for the east bay valleys and the south bay. we don't have tropical moisture near the bay area now but the moisture which has been in the desert southwest may creep closer as we head to the weekend which we'll have to watch the mountains to the south to see if

we see thundershowers. if you head to california, the forecast for phoenix, i'm not kidding, calling for blowing dust and 105 degrees. it's hair drier hot. probably thunderstorms that could be causing more dust fronts around arizona. 101 around fresno. 76 looks nice and closer to home east of sacramento a high close to 100. around the bay area, pleasant mix of temperatures, talking 60s around san francisco and the coast. mid to upper 80s inland around san jose. south to morgan hill you'll see temperatures in the mid 90s. these are typical from the 60s around san francisco to 95 in vacaville. the next couple of days, the hottest in the seven-day forecast. cooler temperatures early next week. scott. >> thank you. 4:50. the the giants in philly. if tim lincecum is feeling

down the streets last night after several hundred people began throwing bottles and vandalizing cars. they were upset because the producers of the film canceled the premier. the film was about a party last june called the electric daisy carnival rave. lapd says no one was injured in the movie premier priot. >> the ban for circumcision appears over before it started. the south bay boy stabbed while walking his dog. we'll hear from him next.
