good morning. >> good friday morning to you. we show you san jose to get you started. we've got a few patches of low clouds but not a bad start. 59 degrees. low clouds all up and down the coast. some of that around san francisco again, then around lunch time 80s popping up inland and take your pick, a nice spread of temperatures, 90s go out to livermore, 80s around san jose, 68 in san francisco. the weather looking pretty good, mike, how's the friday commute? >> it's hopping. the chp reports big accidents, the latest in the south bay. we're going down to central expressway where i got the update two of your right lanes are blocked. one lane gets by at lafayette at the central expressway because of an accident, a truck went into the side of the road. injuries reported. i don't know the extent. two lanes are blocked. back to you. >> across the bay bridge you'll see bright orange additions to the eastern span. construction project. christie smith is live from

treasure island with more. good morning. >> reporter: good morning to you. that's right, if you've driven the bay bridge recently on the upper deck, you probably noticed these, kind of hard to see at this hour but they are basically bright orange cat walks hanging off of the new tower which reaches more than 500 feet above sea level. they are on the west side, the san francisco side, now this morning at least one is on the east side. and again, these cat walks have nothing to do with modeling. they are basically 12 feet wide and workers walk on them to eventually will install a mile-long suspension cable that will wrap around the tower. the workers have to, basically, hang this steel and walk up there very carefully because these things hang down at a 35-degree angle, the cat walks. workers are tethered as they do their work. the cat walks sit about four feet below where the cable will

go. they are expected to be installed sometime in 2012. the bridge opens still in the year 2013. christie smith, "today in the bay." >> thank you, christie. suspected serial killer joseph nasowill be back in court. if he does not the public will pay. he decided to defend himself on charges he killed four women in the 1970s and 1990s. he says he will still need legal help preparing his defense. >> police found evidence proving a high powered assault rifle was used to shoot at police officer. the officer was on foot patrol in the east bay park district monday when two men fired at him. he returned fire and took cover. the suspects got away. the officer was not injured. police think the men were

guarding a pot farm. they spent this week looking for evidence. they found shell casings from a rifle and a nearby marijuana farm. >> come next year the state may not have the money to get rid of pot farms like the one they found in the hills. most of those are disposed of by the campaign against marijuana planting program. the state program eradicated millions of pot plants in 28 years but the bay citizen reports that funding was slashed to nothing in the new budget. the federal government helps but ultimately it's the state's responsibility to run it. with the massive cuts that may not be possible in 2012. the program responsible for this week's six-county sweep that netted almost 300,000 pot plants. >> it is 5:04. lieutenant governor gavin newsom says he has the answer for the economy and will present his plan later this morning in the south bay.

damian trujillo is live this morning in north san jose where gavin newsom will unveil that vision. >> reporter: there is a reason that gavin newsom is coming, because companies like weis are expected to leave california out of this recession, specializing in cloud computing. newsom says he has been researching the mechanisms in place now in california and he was floored to learn the state has no exporting agency and has no representative stationed in foreign countries like 35 other states do. in essence he says the state has a void in leadership when it coming to job creation. so the lieutenant governor will sit with 200 business leaders and unveil his 180-day action plan. in it he suggests creating a state job czar, the office would help business develop and expand and would create economic development ideas. newsom wants to eliminate some

of the state commissions that overlap job descriptions with other agencies. he wants to form strike teams to help businesses cut through the red tape, and he wants to bolster trade by having state representatives in foreign countries like china. newsom says that this plan require as strategic shift in california's way of thinking. that won't be easy but has to be done. live in the silicon valley. damian trujillo, "today in the bay." >> interesting. thank you very much. new documents show alameda city leaders were put on notice that a water rescue program was necessary two years before a man drowned on crown state beach. the oakland tribune report as there the firefighters union filed a grievance saying the department's boat were a necessity. the decision to discontinue the program to save money violated firefighters contracts because

it changed working conditions. this past memorial day a man committed suicide at crown state beach while firefighters stood on the shore because they were not trained to conduct a water rescue. alameda is conducting an independent investigation of that death. >> 5:07. let's switch gears, check in with rob mayeda. a look at our current conditions right now. >> up to the minute. let's show you the temperatures this morning. it's not too often that you find orange on the map this early in the morning but inland we have 60s out toward the altamont pass around tracy, 60s around san jose and sunnyvale. 55 san francisco with the low clouds, a sea breeze out there today which is going to keep our temperatures in the typical summer spread of 60s around san francisco, 70s in oakland, still 90s inland. the item to watch this weekend certainly if you have plans, the high country, look out for pretty strong thunder. watching some of the showers across southern california as we go through the weekend notice what's happening to the east. those are thundershowers that will be flaring up over the next few afternoons.

there is a chance some of that moisture may creep toward the bay area this weekend which we have to watch out in terms of fire danger. the rainfall projection, this is good news. you get the thunder and it rain that's going to put out spot fires from lightning. the sierra a pretty active weekend and we'll have to watch the coastal range around here as we watch the moisture come up out of the south as we move into the weekend. today no worries about thunder in the hill tops. 87 in san jose, 92 los gatos. 68 san francisco, mid 70s oakland and 84 around petaluma. the weekend looks great. the gilroy garlic festival watch out for thundershowers that could pop up south of santa cruz through the weekend. the weather looks good. friday light maybe not so much. >> the friday stuff, yeah, a lot of incidents popping up. now we're calming down a little but we're watching. the accident we had at the east shore freeway is cleared from buchanan but more activity this time of morning.

accident working in the south bay, this is central expressway east bound. a car went off the road or a pickup into a pole. there's crews on the scene and two of the lanes are blocked. light volume so one lane enough to get you by. watch for slowing. the rest of the south bay is fine. as we did talk about the garlic festival. laura is going to talk more about that. watch for slowing in the area of christmas park, 101, and 17, there is construction. that will be cleared. then also talking about maybe some thunderstorms sunday. a lot of folks probably heading to the beach. >> wash away the garlic. good for you. thank you. we have something else for you to see. remember the iconic image from world war ii, you know the one i'm talking about, yeah, the kiss. it's going to be on display in the east bay. 6-foot tall sculpture depicting the famous times square kiss at the uss horn et museum.

>> welcome back everyone. live look outside from the east bay this morning. we're going to check the forecast. rob mayeda is in. the uc system is coming under intense scrutiny for how it spends money. auditors want to know how the university system spends more than $1 billion on miscellaneous services. they also want to know why the school system spends thousands of dollars more per student at four of its ten campuses. for example, ucla spends about $19,500 per student per year, while uc santa cruz under $13,000. the 15-month audit analyzes spending from 2005 to last year. the deadline to raise the national debt ceiling is four days away with no deal in sight. the the markets continue to react. let's check in with nicole lapin with a look for us. good morning.

>> hey, good morning. futures are lower following the news that the debt ceiling was postponed. stocks were mixed. the markets were boosted in earlier trades by positive earnings and economic data. not so much the case today likely because the economic data we get out is the first look at second quarter gdp expected to be below 2%. we're no closer to a deal in washington with president obama's august 2 deadline, four days away. the postponement of speaker boehner's plan following two hours of debate and meeting with republican critics of the bill, the house and senate leadership will meet again this morning to plan the next moves. wall street will be watching. bankrupt book seller borders group is putting everything on the block including their own name. the company is preparing to auction off its intellectual property rights. up for sale the logo, the website, trademark, even customer records.

he is in for christina. >> good morning. let's show you the sneak preview of what we'll watch this weekend in terms of the weather around gilroy, in the 90s, not too hot but comfortable with morning clouds. so gorgeous weather if you're heading throughout this weekend. our own marla tellez will give us a preview coming up. in the 50s and 60s, unusual to see low 60s to start your morning but that's what we have right now, sunnyvale and san who sigh. a sea breeze which will keep our temperatures comfortable. 60s around san francisco, 70s in oakland. low 90s inland. air quality moderate around the east bay valleys. may be an exception around gilroy all of the garlic smoke this weekend. you'll see more about this coming up on the "today" show. tropical storm don expected to cross the texas south gulf coast. winds at 50 miles per hour may bring heavy rain across south central texas which would be good news because they are seeing a drought but probably not enough to break the drought.

around california we'll be watching thundershowers. for today flaring up across the mountains of southern california. that moisture by this time tomorrow will be drifting closer to the southern sierra and some of this may spill closer to the bay area by sunday. thunderstorms in the sierra the next three days, the item to watch, some of the moisture creeps up the coastal range. a slight chance of thundershowers across the higher elevation around santa cruz this weekend. traveling in southern california look out for thunderstorms across the deserts and mountains, the grapevine, 75 in san luis obispo, drizzle around monterey. up to ukiah, 100 degrees, so much hotter away from the bay compared to what we'll see around san francisco. a high of 68. 74, oakland, livermore and morgan hill two of the warmest spots, around the bay wear temperatures in the 90s. not much change for the weekend but watch out for the chance of mountain thunder. good weekend to head out to the

than 270 musicians from 36 schools across the bay area. it starts at 7:00 tonight at the redwood chapel community church in castro valley. >> let's check the morning commute. >> we'll take you to the east shore freeway where we had an accident earlier. but coming toward the bridge westbound, 18-minute drive off of the carquinez bridge. no major problems on the approach. it's a lighter volume of traffic appropriate for 5:20. we had a lot of activity early on. we have a lot of slowing in the north bay. we have construction, that's the reason for the slower readings. down to one lane in spots and not much of a big deal for the north bay commute. later on, about 9:30 we expect to see a bigger crowd head down to the civic center, the veterans memorial auditorium there is a memorial service for a smallen sheriff's deputy. neat there will be traffic on 101 past the civic center exit.

further south we'll see a live look at the golden gate bridge and smooth traffic. you can see the lights all the way across the span. yesterday the fog. but it may grow later on. >> thank you. it's 5:22. california democrats could soon get an even larger hold on the state senate thanks to new redistricting maps. the state commission overviewing the district will vote to approve the 177 district maps and put them on public display. under state law the maps must be available to the public for a two-week review. if the maps are adopted they go into effect for the 2012 election. the new maps could easily give democrats a two-thirds majority and the minority groups could gain more clout. >> white house and automakers expected to announce agreement to raise fuel economy standards, the agreement would require mileage to average 54.5 miles per gallon for passenger cars

and light trucks by 2025. the average fuel economy for 2011 is 27.3 miles per gallon. >> we continue to monitor negotiations in washington. one report puts cash on hand at $70 billion. scott says it's not much. >> no. good morning. we've come to the point depending on how you measure it, apple has more cash money than the government of the united states of america. it's such a shocking statistic people are buzzing about it. you have to measure it by a couple of things including liquidity. the government has a couple more assets than apple. but apple has more than $70 billion on hand. that's a cash horde that investors are concerned about. perhaps they could lend it to the government. no guarantee the government will pay it back. part of congress debates the

debt ceiling, another part, the house subcommittee approved a bill that would force internet providers to hold onto your data for a year. all of that would be available without a court order, supporters say it would help police catch bad guys. critics say bad guys will just use public networks instead like at starbucks or the library. the british government banned its subjects from visiting this website. we were surprised we could take a picture. nbc bans from sites. it has a lot of pirated material. but the interesting thing, the why do i care part is the idea that the government would ban a specific site. it might be illegal to download. to use it. but it's interesting that a western democracy would ban and say you can't even look at it. >> interesting.

have bigger issues. unexpected for friday, slowing in the north bay and it's not due to fog. rob talked about that. we have the slow drive because construction zones, when we have them, we have more. alameda, we have highway 37, at san pedro, but through the entire stretch much of that down to one lane for 101 so slower, speeds in the 20s for much of the stretch. as well as the activity for a funeral in the north bay. >> right now this morning lieutenant governor gavin newsom says he knows why california's economy is failing and he know what is to do about it. he plans to outline his strategy for the state in san jose today. damian trujillo is live with more on the plan. good morning. >> reporter: good morning. gavin newsom will be here at wise technology later this morning. wise specializes in what's called cloud computing. newsom is coming to the capital

of innovation to give his thoughts on what's wrong with the economy. the results of his research and how he plans to fix it. for one, he was floored to learn that california has no trade agency or trade representative to get the economy going. he says 35 other states already have representatives stationed across the globe, pushing their products. california has none. newsom believes that california has zero leadership when it comes to job creation so he'll meet here with 200 business leaders where he'll reveal what he calls his 180-day action plan to get the state back to competitiveness. newsom suggests creating a state job czar. the office would help business develop and expand and create economic development ideas, he wants to eliminate some of the state commissions that overlap with other commissions and state agencies. he wants to form regulatory

at the marin veterans memorial auditorium. >> a memorial is also planned this weekend for the palo alto family of four killed in a fiery crash in canada last friday. obert howard, hearsis wives an: da daughters died in the crash. the suv and camper van was struck by oncoming tractor-trailer rig. a memorial begins at 3:00 p.m. sunday in palo alto. that is a school where the youngest daughter veronica attended. a south bay teacher is hail add hero this morning after he jumped a fence to save a 6-year-old girl and her father from drowning. jeff bail was at his home wednesday when he heard cries for help. the 29-year-old high school teacher ran out and saw a man trying to pull a girl and her father from the bottom of the pool. bail used his training to help

the girl start breathing. he then helped revive the father. bail says he doesn't see himself as a hero but someone who simply did the right thing. >> it's what you're supposed to do. it's how you react and what you're supposed to do. and i feel confident that if i was in that situation other people would have stepped up and done it as well. >> right place, right time. witnesses say the girl and her father may have been at the bottom of the pool for a couple of minutes. both are now home recovering. >> around this time of year there's that unmistakable aroma of garlic. it's all throughout the air in southern santa clara county. it's a sign that it is time for the garlic festival. who better to send, marla tellez joins us live from gilroy. the first day of the festivities. now, are you all read the go or have you indulged? >> reporter: i haven't had anything garlic yet but i'm sure i'm not far off. >> i love roasted garlic.

with rob in for christina. >> that's right. the last weekend in july can be hot, almost as hot as what the pie ro chefs are doing. this is pretty good.cc1: we have a little bit of a sea breeze. the afternoon pretty comfortable. low 90s so summer sunshine, fantastic weather. 50s and 60s, still enough of a sea breeze to keep the north bay into solano county i say comfortable. 80s to low 90s. air quality, seeing moderate air quality. one local exception there in gilroy where you will smell the garlic. nothing showing up on the radar, east of los angeles watching this moisture because by the weekend this is going to drift closer to the bay area. certainly for the sierra. look out if you have plans in the high country you'll have to deal with thunder. 95 in livermore, gilroy in the low 90s. 68 san francisco, 70s in

expected to sit down with republicans again to try to convince them to get behind this deal, $1 trillion off the deficit, allowing us to borrow another trillion dollars. it's the short-term plan the democrats don't like so it's probably dead in the water in the senate. in the senate the democrats have yet to even get their plan to the floor. it would cut more from the budget, take us flew the elections, but republicans have some issues with it and they may block it from even coming up for a vote. where do we go from here? later today we expect the treasury department may announce an emergency plan, what do you do on tuesday, when you can't pay your bills. what do you pay, what do you put off. we expect those details and more information about the 14th amendment. democrats are pressuring the white house to consider that. the 14th amendment says the president can protect the debt. it doesn't say he can raise the debt limit on his own. >> thank you very much. it is 5:44 now.

a south bay student battling cancer is dead killed not by the disease but by his father. according to the san jose "mercury news." sources say the 50-year-old father allegedly shot his 22-year-old son before turning that gun on himself. the boy was a senior at the university of san diego, on leave after undergoing a blood and marrow transplant. before college he was a standout basketball player in san jose. so far deputies are not commenting on what could have led up to that shooting. >> san francisco police say they have the gun but not the person who allegedly removed it from the scene of an officer-involved shooting. this is a look at the gun fired during the shooting in the bay view district. investigators say ballistic tests reveal ken harding was killed with a bullet from his own gun. but that gun disappeared from the crime scene. a neighbor led officers to a pistol that was tested and the

police department says it is harding's gun. remembering his life but struggling with his death. this morning an oakland mother is mourning the loss of her husband who was shot and killed while feeding the homeless. 29-year-old paris powell and his family were delivering food to the homeless early wednesday morning when someone in a turquoise van drove by and started shooting. powell was shot in the head, his wife who was pregnant was grazed by a bullet. their 3-year-old baby girl also shot but is okay. she and her husband routinely fed the homeless at night. >> he took a great person. he's still out there somewhere that i might even run into him and not know that he murdered my husband for no reason. whoever he is, it's not fair. i almost lost my daughter. >> tragic. she said she's convinced it was a case of mistaken identity. the family is planning a candlelight vigil at the scene tonight.

>> the two men accused of attacking an american airlines pilot on a flight bound for san francisco could face federal charges, the fbi investigating the incident. authorities say assaulting an airline crew member is a federal offense. jonathan baez and his brother luis were arraigned yesterday. they were pulled off of a flight at miami international airport and alleged attacked the pilot. no word on when they will be in court. the date is set for the defining moment in california same-sex marriage fight. september 6th is when the state supreme court will hear arguments on whether proposition eight backers have the right to fight a court ruling that struck down the ban. at issue the fact that former governor arnold schwarzenegger and then attorney general jerry brown refused to appeal the federal court ruling that found the law violated the civil rights of gay californians. voters approved proposition 8 and it has been mired in legal
