"today in the bay." >> good friday morning. thanks for joining us. it's 6:00 now. i'm laura garcia-cannon. time to check in with meteorologist rob mayeda in for christina. >> good friday morning. off to a pretty nice start. san jose 61. we don't have much in the way of fog around the valley. and the golden gate bridge the low clouds at the tops of the

tower this morning. you can see 57 degrees, so yes, low clouds to get your morning started. warming up inland, we should see 80s around san jose, 90s as you head to concord and livermore. 68 san francisco. 74 oakland. northbound looking at low clouds and perhaps some of those slowing things down around 101. >> might be an issue. fog not as bad as it was the last couple of days but that's an issue, especially through the construction zone you have fog and restricted lane flow, going to have slow speeds down to san pedro. seeing improvement over the last 15 minutes. also an issue, on highway 57, slow because of the nationals that will cause slowing between novato and vallejo as the crowds head there. and you have another story that will cause some delays. >> that's right, mike. because this morning friends and family will remember the life of a fallen officer who was killed while helping a friend.

christie smith is live in san rafael this morning where our memorial service for a marin county deputy will be held. good morning. >> reporter: good morning, laura. this is bound to be a very knew1:al day for those whocc deputy jim mathison, he was well liked. we're told up to 1200 people are expected here today at a memorial service at 11:00 this morning at the marin veterans memorial auditorium. there are no parking signs posted around the venue. the 49-year-old mathison was a 9-year department employee a eputy shot and killed near acc: home on july 19. he was unarmed and off duty when he went to the home after 28-year-old man after the ex-girlfriend, a mother and friend, informed him that threatening sendingcc1: text messages. investigators say that mathison asked hallerin to leave and he

was shot. another man shot hallerin. very emotional day. the service today is from 11:00 a.m. to 4:00 p.m. there is no parking in the area between 6:00 a.m. and 3:00 p.m. on a stretch of civic center drive or mckin is parkway. mathison's and best friend expected to speak. the doors open at 10:15. christie smith, "today in the bay." >> thank you very much. there will be a vigil tonight for a 29-year-old oakland man shot and killed as he was feeding the homeless. the vigil for paris powell will be held tonight at the scene of the shooting, 47th avenue near san leandro street. it starts at 8:30. powell and his family were delivering food to the homeless early wednesday morning when drovee in a turquoise vancc1: by and started shooting a. bullet hit powell in the head. he died at a hospital. his wife who is pregnant was

grazed by a bullet. their 3-year-old baby girl was also shot but is okay. mrs. powell says she and her husband routinely fed the homeless at night. >> he took a great person. he's still out there somewhere that i might even run into him and not know that he murdered my husband for no reason. whoever he is, it's not fair. i almost lost my daughter. >> powell is convinced it was mistaken identity. >> san francisco police say they have the gun but not the person who allegedly removed it from the scene of an officer-involved shooting. the gun fired in the bay view district. tests reveal kenneth harding was killed with a bullet from his own gun but that gun disappeared from the crime scene. over the weekend a neighbor led officers to a semi-automatic pistol. that was tested and it is harding's gun. >> east bay police found evidence proving a high powered

assault rifle was used to shoot at a police officer. the officer was on foot patrol in the east bay regional park district when two men fired at him. he took cover but the suspects got away. the officer wasn't injured. police think the men were guarding a pot farm. they spent the week looking for evidence. they found shell casings and a marijuana farm. officers are still looking for the men. come next year the state may not have the money to get rid of pot farms like the one in the east bay hills. most are disposed of by the planting program. the state program has eradicated millions of plants during the 28 years but the bay area citizen report state funding was slashed to nothing in the new budget. the federal government helped pay for the program but ultimately it's the state's responsibility to run it. with the cuts across the board that may not be possible until

2012. the program is responsible for this week's sweep that netted almost 300,000 pot plants. lieutenant governor gavin newsom says he has the answer for california's economy and will present the plan. damian trujillo is live at wise technology in north san jose where newsom will unveil that vision. >> reporter: good morning. the lieutenant governor says he knows why california's economy has been slow in its recovery and plans to reveal the state's flaws here at wise technology later this morning. wise specializes in what is called cloud computing. newsom has been traveling the country, in fact the world, to find the root of california's economic woes. the lieutenant governor says he was cleared to find out the state has no export agency. where 35 states have representatives in foreign countries, newsom says they have

zero. california is stuck in the leadership void. there is no one to steer the ship so a frustrated lieutenant governor will be in the silicon valley to reveal how he thinks the state economy will rebound in his action plan he says he suggests creating a state jobs czar. it would help business develop and expand and create economic development ideas. newsom wants to eliminate some. he wants to form regulatory strike teams to help businesses cut through the red tape and wants to bolster trade by having state representatives in foreign countries. in essence he says california cannot rely on its reputation as a beautiful state with great universities and talent. newsom says our way of thinking has to change. damian trujillo, "today in the bay." >> thank you very much. this morning it is looking more

like ed lee will be running for mayor of san francisco after all. the chronicle reports that lee will announce next twheek he plan to run for the job. he was appointed last november after promising he wouldn't seek election when his term ended. >> the hikers held captive in iran for almost two years will finally have their day in court. shane and josh are expected at a court hearing on sunday. iranian officials say it will be the final hearing in the case. fattal, bauer and sarah shourd were arrested when they allegedly crossed into iraq. shourd was released on bail. iranian officials ordered her back to the country for the trial but says she will not return. the white house and automakers expected to announce agreement to raids fuel economy standards. it would require mileage to average 54.5 miles per gallon by

2025. the average for 2011 is 27.3 miles per gallon. 6:08. how high can temperatures get? let's check win rob for christina. >> looks like maybe some 90s out there. but this morning we're seeing more low clouds. about 500 feet off the ground so it's not just sitting down on top of the golden gate bridge. 55 degrees right now. yes t sea breeze pumping in the low clouds that will prevent temperatures from getting too toasty inland. we have been watching that moisture across the desert southwest, you can see it's doing something moving east to west out of palm springs, into the mountains of l.a., then turn to the north as we head into the weekend f. your travel plans include lake tahoe and look out

for thunderstorms for the weekend. some of us may try to spill over to the coastal range. have to watch to see if we see thundershowers south of santa cruz for the weekend. 80s around san jose. 78. 68 san francisco. so the weekend looks great. including if you are heading to gilroy, in the low 90s. watch out for the thunder that could pop up on the coastal range come sunday. >> also watch for that breath that can pop up. we'll look to antioch, the east bay. we had, well, tire tread on the roadway. that's unexpected and it was hit by four cars. they were off to the shoulder. that cleared. i expect to see slowing. holding up around the 40s and the 50s. then in the 50s as you head to the bay point. a heavier volume this morning for there and 580 out of livermore and the altamont pass. central livermore we expect more

>> oh, come on. >> young, beautiful, you? come on. >> reporter: and garlic breath at 6:00 in the morning. this is the 33rd annual gilroy garlic festival. it's so much fun it's getting hot. we have steve and kevin and gourmet alley, they are going to grill up some calimari. fire in the hole like they say out here. those are some serious flames. this is one of the attractions at the festival. it starts this morning at 10:00 and runs through sunday evening. joining me now is vito, the chairman of -- co-chairman of gourmet alley. what can people expect this weekend? >> a lot of great food, a lot of great entertainment, beautiful setting, the weather's going to be awesome so come out. >> in terms of people think of what can i get that's garlic. there are some strange things to be had.

>> garlic ice cream, calimari, scampy, pepper steak sandwiches, all kinds of good stuff. >> reporter: it's a big party here. and garlic is king. >> sure is. >> reporter: in terms of garlic preparation, how many tons of garlic? >> 4,000 pounds of garlic. about 10,000 pounds of sausage. we have a lot of food ready for you all. just come on down and have some. >> reporter: and breath mints or hand. >> definitely. you got to have it. absolutely. >> reporter: all right. now, the festival runs through sunday, 10:00 to 7:00 each day. adults $17 to get in the door, seniors and most children $8, kids under 6 free. and parking is also free. if allen can give you a shot of that. look at that for breakfast.

watching in southern california is going to move closer to the bay area for the weekend. certainly a threat for thunder for areas to yosemite but stay tuned for your weekend forecast. it's coming up later on at 5:00 because maybe some of the moisture could creep to the bay area hilltops by sunday. around the bay area, 60s in san francisco, 74 in oakland, 80s for san jose, don't like that head to morgan hill, highs in the low 90s. same around livermore, areas east of castro valley seeing upper 80s to low 90s. bay area temperatures not changing a lot. the item to watch the mountain thundershowers which could flare up. >> up next, why the university of california's budget is getting a lot of scrutiny this morning. >> everything you do online stored for an entire year. that's what the government wants to do. we'll talk about with it in tech today coming up. >> a look at 880 through the south bay, north speeds are nice. 101 slowing through san jose.

area. warmer temperatures inland. we'll check the full forecast coming up in a bit. first i want to check the morning commute. there are things going on. >> yeah. i was going to say slower than we thought. now chp reported an accident at somersville so there is more slowing, in the 20s and 30s here from about "g" street. it may be in the lanes. we'll wait for the update. but also don't let this get by. speeds are down through bay point as well below 50 miles per hour. slowing heading into concord for 680 in another half hour or so. a smooth drive toward the maze and i keep checking, chp says no metering lights yet. that's smooth into the city. you see the bikes hitting the road and the golden gate bridge. driving okay underneath them. >> california democrats could get a larger hold on the state

senate thanks to redistricting maps. the commission overseeing redistricting will vote this morning to approve the 177 district maps and put them on public display. under the law the maps must be available to the public for a two-week review period. if the maps are adopted they go into effect for the 2012 election. the maps could easily give california democrats a two-third majority of the senate and minority groups could gain a lot more clout. >> the university of california faces a big audit by the state. auditors want to know how the university system spends more than $1 billion annually on, quote, miscellaneous services. the state audit notices a lack of transparency. the 15-month audit analyzed spending from 2005 until last year. >> you shouldn't compare apples to oranges but scott says you can compare apple to the u.s. government. >> you can.

apple the high tech company. say apple makes ipods, government doesn't. the u.s. government has atomic government. apple doesn't. so they are different. but here's a shocker. when it comes to cash on hand they are about the same. thanks to the debt ceiling crisis, bloggers point out that depending on how you measure it, apple has more cash money than the government of the united states of america. apple has about $76 billion in cash savings, the government 1:billion. you have to go through some mathematical hoops to get there but it's a fun statistic. well, part of congress debates the debt ceiling, another part, the house judiciary subcommittee has a bill that would force internet service providers to hold onto your data for a year, what sites you visit, what computers you use, what content you post. all of that available without a court order. supporters say it would help catch bad guys. critics point out bad guys would

just use public networks instead. then the british government banned its subjects from visiting this website. we were surprised that we could visit it because nbc has lots of bans. it's called news bin. it contains lots of pirate ed music. governments, western democracies, rarely if ever pick out one single site and say it's illegal to look at that. downloading pirated material definitely illegal. looking at a site that offers that, arguably not illegal. >> interesting. we'll see. 6:26. coming up on "today in the bay" at 6:30, the brothers accused of attacking a pilot could face additional charges. we'll tell you who is investigating now. and a deputy killed trying to help a family friend will be laid to rest. we'll have a live report coming up.

thanks for joining us. it's almost 6:30. i'm laura garcia-cannon. time to check win meteorologist rob mayeda in for christina. >> good morning. we're looking at temperatures now in the upper 50s in san jose. mainly clear skies. golden gate bridge the low clouds but they are off the bridge deck across the golden gate. 57 degrees currently and you see what we've got outside now. it's fog that has pushed inland from the coastline. back to the coast as we head to the afternoon, 4:00, 60s san francisco, mid 70s in oakland, 80s around san jose. 90s down toward the gilroy garlic festival later on today. mike. >> rob, it's going to be crowded around that area. busy around the roadways as well. there is so much traffic that even on this friday we turned on the metering lights a couple minutes ago so it's on at the toll plaza t commute building for highway 4 as well. a heavier volume and now a couple of accidents. we'll sort out the details in the next report. >> lieutenant governor gavin newsom says he knows why

california's economy is failing and he know what is to do about it. he plans to outline that strategy for the state in san jose. damian trujillo joins us live from san jose with more in the lieutenant governor's plans. good morning. >> reporter: good morning. you can visualize lieutenant governor newsom shaking his head when he read the california plan to get the economy going again. that's because there is no plan so. newsom will reveal his vision and findings here at wise technology later this morning, wise specializes in what's called cloud computincomputing. newsom couldn't believe the state has no trade representative. he found out 35 other states have official representatives on foreign soil. california, one of the largest economies, has no one in that role. there's no one to out the

california products to foreign countries. he'll meet here at wise technologies with business, labor and education leaders and unveil his 180-day plan. in it he suggests a state job czar to develop and expand and create economic development ideas. newsom wants to eliminate some of the state commissions that overlap with other commissions and agencies. he wants to form regulatory team to help businesses cut through the red tape and to bolster trade by having state representatives in foreign countries. newsom will be here at 11:00 to reveal his master plan. live in the silicon valley, i'm damian trujillo "today in the bay." >> thank you. suspected serial killer joseph nasowill be back in court today. a judge will find out if he has the money to pay for an advisory

counsel. if not the public will pay for a court appointed one. nasodecided to defend himself against charges he killed four california women. however, he said he will need help preparing his legal defense. >> the two men accused of attacking an american airlines pilot on a flight bound for san francisco could face charges. the fbi is investigating the incident. authorities say assaulting an airline crew member is a federal offense. jonathan baez and his brother luis were arraigned. they were pulled off of a flight at miami international airport allegedly became belligerent, attacking the pilot. there is no word on when they will next appear in court. >> this morning friends and family will remember the life of a fallen officer who was killed while helping a friend. christie smith is live in san rafael where a memorial service for a marin county sheriff's deputy will be held. >> reporter: good morning. friends say jim mathison was a

caring friend and caring deputy, so much so that even inmates liked him. today, 1200 people are expected here at the veterans memorial auditorium to pay their respects to the 49-year-old deputy. he was shot and killed on july 19 trying to help a friend during a domestic dispute. he was unarmed and off duty at the time. the suspect and a parolee showed up and shot mathison twice. a relative of the victim ended up shooting hallerin at the scene. there will be no parking between 6:00 p.m. and 3:00 p.m. on a stretch of civic center drive and mckin is. even foot traffic with people walking and crossing civic center drive. the doors open at 10:15. mathisson's son and best friend

expected to speak. >> thank you very much. it's 6:34. public records in alameda show city leaders were put on notice that a water rescue program is necessary, two years before a man drowned on crown state beach. the oakland tribune reports that warning came in february 200918 grievance letter filed by a leader of the firefighters union who claim that the fire boat and water rescue program were implemented because of that necessity. the firefighters union maintained that alameda's decision to discontinue the program to save money violated a contract because it changed working conditions. alameda is conducting an independent investigation in the death of the man who took his life in the waters off of crown beach two months ago. >> game show host alec tra beck will have surgery to repair a ruptured achilles den son.

he is expected to spend six weeks in a cast. he injured himself chasing a suspect who broke into his hotel room. the incident happened wednesday morning. the suspect is lucinda moyers. she remains in custody charged with one count of burglary and receiving stolen property. she is scheduled to be back in court on monday. >> it is 6:36. time to check in with rob mayeda. good to have you. >> good to be here. friday morning so far pretty nice around san francisco, at least the fog is not down on the top of the golden gate bridge. you can see the camera can see at least partly across the bay. the tops of the towers there and some of the taller buildings seeing fog. oakland 880, okay as the fog has not dropped down. about 500 sfeet where the ceiling of the clouds around the east bay. 59 san jose. we have sunshine around the south bay. air quality, the east bay inland

valleys, moderate, which isn't that bad for this time of year. the item to watch, temperatures not changing much but in the sky may change as some of the moisture spills out of the desert southwest that could toss a risk of thunder for the coastal regions this weekend. today mid 90s toward the tri-valley. livermore the hottest spot. morgan hill not far behind with 90s. 80s around san jose. and petaluma, 60s for san francisco and 70s in oakland. you know them well. our typical micro climates. look out for the mountain thunder, the sierra, expect to see quite a bit of thundershowers through the end of the weekend. >> micro climates, something for everyone. we have traffic for a lot of folksment seems like everyone if you're in the backup. for 4, we had debris around railroad avenue, four or five cars, they moved to the shoulder, sounds like they might have hit the tire debris, causing a backup. in that at summersville a new

accident. the 16-mile-per-hour reading toward that area so a rough day out of antioch but not so great through pittsburg where speeds are below 50 miles per hour. here livermore out of the altamont pass. that's where the gathering happens around the cut where folks cut down to livermore and pleasanton. 680 and sunol looking smooth. in fact, approaching the bay bridge no major drama. the low clouds might be an issue. so far chp isn't reporting problems. >> good to know. we were telling you earlier the nfl lockout is over. so are the cheerleaders. this is something special about this rookie raiderett. and two votes, zero progress in washington as the deadline inches closer. a live report from washington is

6:41. the debt ceiling showdown is intensifying. last night house speaker john boehner couldn't muster up enough votes in his own party to support the bill. tracie potts joins us live from washington with what's next for lawmakers with only four days before defaulting. now word that the president's going to speak this morning. >> that's right. we found out that around 10:20 our time. 7:20 your time in the hour president obama will give a statement to the press at the white house and the diplomatic reception room. we don't know if he'll take question. he usually does that in the press room. unclear if he'll take question but apparently giving some sort of update on the status of the gorks and as you mentioned they fell apart for the republicans last night when behind the scenes they couldn't get enough votes for boehner's short-term plan so they scrapped that. hoping possibly to bring it back up to day but possibly around

lunch time or later if at all. the other thing that just happened a few minutes ago we learned on the democratic side, the democrats have a plan in the works but they were really sort of in a wait-and-see mode to see what happened on the house side. now that seems to be stalled, democratic majority leader harry reid is going to move thinks plan forward. that is a plan that may never come to a vote because republicans have enough votes to block it and said they will. we also today may hear from the treasury department about their emergency plan, what happens if we come to tuesday and it's default. what bills do you pay and which do you not pay. >> all right. families struggle with all the time. thank you. what would you do if you found $16,000 just sitting on the ground? a man is getting recognized for his honesty. he went into a bank, found the bag full of cash after hours

may try to spill to the bay area by the end of the weekend. futurecast model showing some of those thundershowers saturday and sunday afternoon. this moisture drifts about 100 miles to the west, then we have to watch out for the diablo range and down for areas south of santa cruz. if we see moisture spill across the valley. you can see this is hopefully good news with the thundershowers is that it should also bring rain. if we don't see rain and you get that lightning, this is one of the leading causes for -- the rain coming down along with some of the thunder. around the bay area highs in the 80s around san jose. warmer toward los gatos, low 90s, 60s for an stran fran and about 84. watch out if you are heading to the sierras. laura. >> thank you very much. 6:47. we're going to take you back to the gilroy garlic festival.

pizza. what about garlic ice cream, watermelon, garlic frogs legs, the list goes on and on. we're in gourmet alley, this is the heart and soul of the festival. we have our pyro chefs with us, ashley and steve and you guys are firing in the hole. they are going to make up calimari. garlic calimari of course. check out the flames on this friday morning. you can find them out here all weekend long. it's more than just the food at the park. joining me is susie connell. you have been with the festival many years. what can people expect? >> we have three stages of entertainment, there's approximately 45 different bands, one of the new up and coming country singer, kip moore, and then we have the garlic cook-off, the garlic

a fence to save a 6-year-old girl and her father from drowning. jeff was at his home when he heard calls for help. the 29-year-old high school teacher says he ran out, saw a man trying to pull a girl and her father from the bottom of the pool. he used his cpr training to revive the girl and her father. >> what are you supposed to do. it's how you react and what you're supposed to do. i feel confident if i was in that situation other people would have done it as well. >> witnesses say the girl and her father may have been on the bottom for a couple of minutes. both are recovering thanks to that hero. >> new town houses will replace a family-run business that has been a draw for kids, families really for decades. on sunday skaters at the cal skate rink in milpitas will take their last spins around the rink. after more than 30 years cal skate closing its doors. no more music, line dances and
