let's see how your commute is shaping up. it's mike inouye. >> welcome back. for the end of the week you're called the closer. yesterday saw slowing from mid morning all the way in toward midday. right now a smooth drive at the interchange and no major issues through livermore but we'll track 580. folks had a tough one yesterday. >> 5:01. the next time you stop by your favorite coffee shop or bar in san francisco, don't be surprised if you see a live musical performance, this come as city leaders try to inject life in local businesses and revive the storied music scene. kimberly joins us with more. >> reporter: good morning everyone. when you think of the music scene you might think nashville, new york, new orleans, but san francisco, well, a big push is now under way to make the city much more inviting to musicians and entertainers. the san francisco board of

supervisors has given unanimous initial approval for a new permit geared to businesses whose function is not the presentation of live music, we're talking about cafes and restaurants. one supervisor proposed the legislation with a limited live perform earns permit. as it stands entertainment permits cost $2,000 a year, making it out of reach for many places. we caught up with one musician heading to b.a.r.t. -y was surprised by the change and says it's a step in the right direction. >> competition on b.a.r.t. is fierce. musicians want to play, they want to play for people. it's like one of the last venues. there are street musicians. there are a lot of quality musicians that can't get in doors to play because they haven't been around long enough. >> reporter: it's estimated 700 cafes and restaurants could take advantage of the permit. under the rules the performance would have to end by 10:00 p.m.

though after a year of holding the permit businesses would be eligible to extend performances to 11:00 p.m. the board of supervisors is expected to give final approval for this legislation after their august recess. live in san francisco, kimberly tere, "today in the bay." >> thank you very much. it's 5:03. today a judge will weigh a manslaughter sentence for the son of former california assembly peek ee eer nunez. nunez and three friends were convicted of killing luis santos in san diego back in 2008. santos' family filed a suit accusing schwarzenegger of failing to notify the victim's parents before reducing the sentence. san diego county has filed a similar suit. critics say schwarzenegger did it to help out a political friend. >> fire crews are battling a wild fire in a remote part of

mendocino county. more than 800 acres burned in an area northeast of covelo. rugged terrain is making things difficult for firefighters. they have the fire 25% contained. expect to have it completely surrounded by saturday. no homes are threatened right now and the cause remains to be under investigation. >> cities across the bay area are getting helping hand in the fight against obesity. kaiser permanente giving $1 million grants to low income communities in richmond, concord and san francisco. the grants are part of kaiser's three-year plan to bring together government agencies and local organizations to promote healthier living. funding will be spent on establishing wellness committees in schools and developing programs on nutrition, exercise and cooking. the money will go to richmond's iron triangle, the monument corridor in concord and the bay view neighborhood in san francisco. >> we're following a developing

story out of the east bay this morning where a thief goes after some unusual items in the streets of vallejo. christie smith is live in vallejo. officials say more than 20 manhole covers have been stolen. good morning. >> reporter: good morning to you, laura. i heard of copper theft and wire theft. this may abnew low. talking about storm drain grates. these things weigh over 100 pounds and so far at least 20 have been ripped off in two weeks. when the grates are missing it can be dangerous. one woman drove into one and put in a claim. you could fall straight down up to 15 feet in some cases. that according to vallejo sanitation and flood control. we spoke with them this morning. the thought is that these things are probably sold throughout for scrap. but for the city, this is a high dollar theft. $350 to replace each one. of course that's literally money down the drain and kind of a new

thing for the city of vallejo. what they are saying if you see someone trying to yank one of these up call 911. if one of these is missing, make sure you call the sanitation district directly and they will get someone to replace it. they are looking at a number of options including maybe even spot welding these things down so they are not so easy to lift up. but that would be a tall order. there are thousands of these things spread out in different parts of the city. christie smith, "today in the bay." >> so it's the storm drain, not manhole covers. >> right. we're hearing is that they are actually the grates, like someone can literally put their hands in there and lift these up. these are the storm drain grates of course the water goes out to the bay. so we're on wilson avenue, it's been hit pretty hard. they are up and down the street. >> thanks for the update there. it's 5:06. university of san francisco is looking into the past as it

plans for the future. school officials announced it purchased the historic folger coffee building. the university plans to use that as a downtown hub. usf says it reaches a broader base of students. the main campus is located north of the panhandle neighborhood. >> we're getting new information this morning about delays for work on the new devil slide tunnelment it appears it's now going to take a year longer than expected. caltrans says the tunnel along highway 1 will now open in late 2012. the project to build twin 4200-foot tunnels started about five years ago and only supposed to take a few months. there were construction delays. as a result, the $314 million project will cost more and those costs will you know, eventually be passed along to taxpayers. a san mateo assemblyman plans to investigate. >> let's investigate the forecast this morning.

>> chief investigative meteorologist christina loren. it's pretty nice down there. actually we're not seeing a lot of the fog touching the surface yet but it's getting very close. you are going to find that on the golden gate bridge that's where it's foggy. not so much on the bay bridge where we have pretty gusty winds and that is preventing the formation of fog so you're going to find a clearer drive over from oakland and the city than from the city to marin county. onshore flow continues throughout the weekend. we've got this trough of low pressure. the first one is providing us with a pretty strong onshore flow. another one on the way to keep the mild weather in place into the beginning of next week. then it starts to warm up. we'll get to that seven-day. watch out for drizzle this morning, if you are waking up especially toward the coast, up

in the north bay we're seeing the thickest fog so far. we're watching for the fog to settle in along the peninsula as we head through the next couple of hours. mike and myself watching that for you all morning long. 60 in san jose, 59 in hayward, on the way to about 78 degrees hater on. picture perfect for august. i've got the seven-day coming up. how do we look? >> looking all right. highway 4, we often warn about the significant changes slowing around 5:30. so a very easy drive. yesterday wasn't that bad heading through bay point. of course i didn't have to drive it. it was slow all the way out of antioch into concord. the walnut creek interchange, smooth, nice along the benicia bridge or westbound across the carquinez bridge. both nice from the north bay. novato to san rafael, typical mild slowing down 101 to 580 and the richmond bridge. where the 55 is where they merge

and around golden gate fields. 43 at the caldecott tunnel, we'll check that out. so far no incidents reported there. the golden gate bridge, an easy drive across from the north bay as well. you see the glow of the lights, there is some fog, mist, some friends did let me know they had to use their wipers. of course no fog at the bay bridge right now because of the winds. chp issued a mild wind advisory. keep in mind. >> good to know. could be a new mayor in town. could a reality tv star be jumping into the race for mayor of san francisco? we told you about with ben flanic earlier this week. he is a sonoma county wine maker and bachelor who was dumped during the finale of "the bachelorette." maybe it's running for office. wine maker, failed proposal, future mayor you think of san francisco? well, yeah, he has yet to

>> welcome back everyone. good thursday morning. all quiet on the streets near san jose's hp pavilion. people in one east bay community will soon pay more for water and sewer services. discovery bay's directors have voted to hike water and sewer rates by nearly 18%. the increase would go into effect this year. they voted for a second potential increase of up to 21% next year. discovery bay says it needs the money to upgrade existing equipment and fund new development. >> despite washington's best efforts to rein in banking fees a study finds there's no change. one year after lawmakers approved new regulations for banks the consumer federation of america says the median overdraft fee is $35, the same it was last year. the survey also found two-thirds of banks continue to pile on fees to customers, if they fail

to balance their accounts after the first overdraft. last year's regulations were designed to prevent customers from paying all of the fees but that apparently hasn't worked. for the rest of your news before the bell we turn to nicole lapin. good morning. >> good morning, laura. futures are laura after a crazy session yesterday. the dow had been down as much as 164 points at one point in the session, on very disappointing economic news. continued worries about europe's debt crisis and the lingering threat of a downgrade to the u.s. credit rating. the markets closed higher snapping the eight-day losing streak. asia was mixed, europe is slightly lower right now but we're waiting for the jobs numbers out this morning with new numbers on unemployment filings. gm reports earnings and we're watching a slew of earnings coming into cnbc to dictate how we will trade. the dow closed up 29 points yesterday, 11,896, but we are very precarious and the question

is will that last? the nasdaq composite added to 2693. also this morning u.s. retailers reporting july same store sales, total sales to rise more than 4% as stores helped by deep discount and the warmest weather pushing shoppers to snap up summer merchandise. invest investors, the back to school season the second biggest selling season after christmas. the warehouse clubs like the costkos and the sam's clubs and the high end chains are expected to lead the way here. watching jobs. unemployment rising more than 90% in cities all across the country in june reflecting a national slowdown in hiring. the labor department says that unemployment rose in 345 large metro areas, pretty sharp reversal from a few months ago because it fell in nearly every area in april. a dozen reported unemployment above 15%, 11 of those in

>> good thursday morning to you. 5:22 now. as we take a live look outside at the golden gate bridge this morning. may need the windshield wipers to clear the mist off. a permanent change today is part of a heavily used san francisco street. mcalister between hyde and market streets is now open to two-way traffic. for years that portion of mcalister was one way. it allows quicker bus service in the part of the city. muni says the 5 fulton bus line will be three minutes faster,

saving $200,000 a year in operating expenses. something to get used to. it will look strange to folks. i want to check the commute. >> a one way turns to two-way it's alarming seeing traffic coming. 101 this accident just cleared in the last few minutes. this was southbound 101 approaching airport boulevard. around 380, there's the airport marked on the map. that is clearing. we had the earlier sigalert south at third, all chp activity has cleared even though the lane's cleared over an hour ago. a smooth drive to the san mateo bridge. the san mateo bridge, the headlights from the peninsula, a few more, a smooth drive and you can see the high rise, lights twinkling. there may be fog and mist between the san mateo bring and the city and coming from the north bay as well. we're looking at the south bay, down to 17, possibly drizzle on the lens. sorry, the windshield, or the lens you put your head out the

window. 162 to watsonville, to hecker pass, a tree down. i'll update you if it lasts longer than a few. and then we're looking at 880 through oakland, northbound with the headlights, smooth drive past the coliseum a. little glow because of the mist in the air. so far it's okay. >> makes traffic look pretty. 5:24. the u.s. army soldier accused of plotting an attack on service members at ft. hood will be in court. naser abdul was arrested at hotel a few miles from the front gate of the post. police say when they arrested him they found enough explosives to make at least two bombs. he admitted to planning an attack on his first court appearance. ft. hood is the same post attacked in a shooting by another army soldier. >> president obama is 50 years old today. the president will celebrate with a party at the white house. last night he kicked off the

celebration with a concert and dinner fund-raiser in his hometown of chicago. the fund-raiser was for his re-election campaign. today's celebration will take place in the rose garden. jennifer hudson singing there. evidence of a massive conspiracy by one country to attack computers all over the world. scott mcgrew, that points to china. >> it does. you remember the united states used the worry about a missile gap, now it appears we're in a hacking gam. major security company says it's uncovered evidence of hacks on six american government agencies, 13 defense contractors at least three tech companies, even two media companies. the company mcafee which uncovered the hacks won't say who is behind it but all of the arrows point to communist china. these are not the run-of-the-mill hacks. these are major that get in the root access of computers

a meeting is planned for tonight, we understand. >> reporter: yes. good morning. the silicon valley cannabis coalition will be meeting and what they are trying to do is trying to get-out-the-vote effort going to try to get people on to san jose city council next year who are more sympathetic for their cause for medical marijuana. the complaint is that the city of san jose is trying to restrict the number of marijuana collectives in the city to ten, possibly 25. we're here with dave at the all american cannabis club, this is his collective in the south bay. i guess my question to you is, if you look at the cities that have outright banned medical marijuana, los gats the recent, san jose saying yes but we want to limit the number. what's wrong with that? >> state law dictates that you must increase access for medical

marijuana. so any city that bans them is going against state law. >> okay. but that's also within the guidelines of federal law, correct? >> well, it is, but people in the state have to follow the state law. >> so what would you suggest that the city of san jose do? they have some obvious concerns, people would argue legitimate concerns, about people coming in, let's say with a doctor's note, quote unquote, to get marijuana. when maybe they don't need it. they are trying to find a halfway. what's wrong with that? >> the problem is the way they are going about. the way to get to the point they want to get is providing sensible regulations so make so it that these businesses can be operated and actually monitored by the city. >> okay. do you have sympathy with the argument that they need to be regulated especially from the police point of view of their concerns over people coming in with maybe not a legitimate doctor's note. >> they need to be regulated.

there are 130 in san jose and they are completely unregulated businesses. that's dangerous for a lot of reasons. >> thank you for getting up early. they meet tonight at 8:00. these collectives coming together trying to encourage a get out the vote to get the people that they believe who are sympathetic on the council when the election is next year. bob redell, "today in the bay." >> thank you very much, bob. it is 5:33 now. what was supposed to be a great day out on the bay ended in tragedy. one man dead and his father injured after a large motor boat plowed into their fishing boat. investigators are looking into what happened. the large boat likely didn't see the smaller boat when they collided yesterday afternoon. the family understandably overcome when they heard that news. 30-year-old ninh truong died

after being trapped while his father clung to the hull. witnesses say the younger man was brought the to shore unconscious but his father was alert. >> with the first guy, you know, trying to get him back alive and stuff. he didn't look too good for him. the second guy they brought, a few minutes later he was moving around and he looked hurt. >> the 60-year-old father who speaks mainly vietnamese tried to tell rescuers that his son was trapped. officers say the captain of the motor boat pass add sobriety test. >> the man convicted of kidnapping and raping jaycee dugard admits he is responsible for snatching three other northern california girls as well as dozens of date rapes. the district attorney said garrido made those claims during a jail house interview in may. however, he insists he is not responsible for the high profile

abduction of makayla garrett. investigators are working to track down potential victims to see if more charges can be filed against garrido and his wife. >> it's something you see in big cities, san francisco leaders want to bring back some of that in the city. kimberly has a look at the new measure. good morning. >> reporter: good morning. this news is music to the ears of musicians, many who have been struggling to make a living in san francisco. we did meet up with a musician who says that many are forced to set up on the street or bar platforms since there aren't many venues in the city to perform. the ones that do, they have their choice of the cream of the crop when it comes to booking bans. the supervisors initially

meteorologist christina loren. she's back, refreshed from vacation. >> yes, it's amazing what a couple days off will do. if you are up at this hour you probably don't live like a normal person. 5:36 now. it's chilly especially at the coast. a nice second half of the day, a dreary overcast start. mostly cloudy conditions from san jose up through the north bay. low pressure is is the reason why. it's kicking in the onshore flow keeping things mild throughout the weekend. as a result we have a little of that coastal drizzle. if you're headed toward half moon bay, santa cruz, san francisco, you might use the wipers. fog isn't that bad yet. it could become more and more thick so we're going to watch that. that's likely, we have a lot of moisture in the atmosphere. 10 miles bblt. starting to see that drop in places like santa rosa and

oakland. right now still eight miles or better across the board. we'll watch that all morning long. 59 in farld. on the way to the upper 70s, low 80s, a beautiful day. and then a little bit of a change as we head to next week. we'll talk about that and a couple of tropical systems. we're going to look at those. let's talk to mike. >> you still think about the tropical systems. nice to think about summer vacation. a lot of these wish they weren't in the slowing which kicked off so eight after the half hour. through antioch, also the the 57, a little bit further west. that's slower than we saw as well. we may see early slowing for the entire stretch. it's a thursday, may abheavier commute around the bay. we see a slower drive southbound 101 from highway 37 to san pedro road because of the construction. another 20 minutes for the crews to clear. as you head to the richmond

bridge, a smooth drive in both directions to the east bay for example, as you merge around the golden gate field. the bay bridge has a wind advisory, though, but no major fog. we have that at the golden gate bridge. oakland, 880, christina talking about lower visibility. it's not an issue for drivers but there is moisture and the reason why the numbers come down. there you have it. >> maybe the glow of the lights of a new stadium?

of the lights that you're seeing. not a lot of traffic to report. we'll check with mike in a bit. it's 5:42. people in japan, canada and other parts of the world see their life expectancy increase but the u.s. is falling behind. tracie potts joins us live with how the bay area stacks up. good morning. >> good morning. we took a look at the university of washington did at every county in this country, 80% of them compared to those top nations are falling behind. and what they found is that life expectancy for women are generally about five years longer than men. but in some areas of our country we're now beginning to catch up where the top nations were over 50 years ago. there are regional differences, racial differences, people in the south live not as long as people, for example, on the west coast. but take a look at some of the local numbers. average life span for a woman in california, over 82 years.

just over 77 for men. again that 5-plus year span between the genders. in the bay area, taking a look at five local counties, the best place for women to live if you want to live a long time is san mateo county. 84 1/2 years is the average there. the average for men in santa clara county, 80.6 years. you can see the lows here as well. bottom line, these researchers found there are vast differences not only across the country but within states. in some cases a decade difference within one state of how long men and women are living in this country. >> i've got big plans for my future. >> then you should probably move to san mateo county. >> thanks a lot, tracie. a northern county camp counselor is behind bars accused of having sex with a 14-year-old boy.

katrina herrador was a camp leader. she was arrested after the parents of the alleged victim found suspicious text messages on his phone. herrador worked for the summer program called teen extreme. police say she met the boy at camp and admitted to having sex with him at her home last week. >> she did give us a statement as to what occurred that evening. >> was it admitting that the incidents occurred? >> yes, it was. >> vacaville police are investigating whether she had inappropriate relations with any other teen at the camp. >> two powerful community groups taking on a restaurant accusing it of discrimination. a statue of jack daniels outside the saloon and grill has a sign hanging from. the sign says no tattoos, no shiny shirts, no large neck chains and several other

restrictions. the naacp and the latino leadership alliance says they are discriminatory against latinos and blacks. at least one constitutional law professor says posting the signs might also be illegal. >> trying to use proxies for the kind of people who might be behaving in certain ways gets into slippery territory. >> the owner of the old wagon saloon and grill didn't want to talk on camera but managers say they will meet with the concerned groups to change the verbiage. the old wagon was single out we should mention others have posted similar signs in the past. >> when you get cash from the bank you expect it to be real. but it turns out bay area tellers are handing out tens of thousands in fake bills every week. kathy says she had no idea three of the $100 bills she withdrew from her chase bank were fake.
