in the south bay through the east bay where we typically get kind of a break from the low cloud cover. not today. as a result cooler, the weekend just around the corner. i've got that forecast coming up. right now let's get to you work on time with mike inouye. >> we're warning about a mist on the windshield. the bay bridge, some reports getting hood on the windshield. we expect a slow drive across the upper deck and the toll plaza starting to see the build. we'll see that continue throughout the morning. there you go, some folks waiting in the cash lanes. >> thank you very much, mike. we're following a developing story out of the east bay where a thief is going after unusual items in the streets of vallejo. it's causing problems for the city and expense. christie smith is live where officials say more than 20 storm drain grates have been stolen in the last two weeks. >> reporter: good morning to you. it's amazing the things that people take if they are not nailed down. in vallejo it means money

literally down the drain. 20 of these things, these storm drain grates, taken in the last two weeks and they are not cheap, costing the city about $350 a pop to replace. the thought here is that they are probably being sold out there for scrap. but in the meantime, it's making for a dangerous situation on the streets. cars can get stuck which has happened. and if you're walking you could take a nasty fall, in some cases up to 15 feet down if the grate is missing. these are heavy, about 100 pounds. workers at the sanitation and flood control district had to replace five in one day alone. copper theft, thought they had seen that. this is a new one. if you see someone trying to steal one of these things. of course if you see them in the act you want to call 911 and report that. if a grate is missing you can call the district directly.

707-644-8949. they will try to get someone out to replace it as fast as they can. they are looking at options, one is possibly doing some spot welding on the grate to keep them down. but one of the issues there is that there are thousands of these things across the city. reporting live in vallejo, christie smith, "today in the bay." >> thank you very much. this morning fire crews are battling a wild fire in a remote area of mendocino county. more than 800 acres have been scorched so far in an area northeast of covelo. rugged terrain is making things difficult for firefighters who contained it to 25%. no moms are threatened now and officials say they expect to surround the blaze by saturday. the cause is being investigated. >> one man is dead and his father recovering from injuries after a boating accident off of sierra point. this morning investigators are trying to figure out what happened but they say a large boat likely didn't see a smaller

boat when they slided yesterday afternoon. the family overcome with emotion when they heard the news. 30-year-old ninh truong died after being trapped under the boat. his father clung to the hull. the younger truong was brought to shore unconscious. his father was alert. >> trying to get him back alike, didn't look too good. the second guy they brought, he was moving around and he looked hurt. >> the 60-year-old father who speaks mainly viet that meez tried to tell rescuers but at first they couldn't understand which delayed the rescue. officers say the captain of the motor boat pass add sobriety test. phillip garrido admits he is responsible for snatching three other northern california girls and dozens of date rapes. he insists that he is not responsible for the high profile

abduction of 9-year-old ma kel legarrette. he bears some resemblance of the sketch. prosecutors are trying to keep details of the conversations under wraps. prosecutors say they are working to track down potential victims to see if more charges can be filed against garrido and his wife. later today a sacramento superior judge will decide on combining two lawsuits seeking to rein state the sentence for the son of former assembly speaker fabio nunez. in the two suits former governor arnold schwarzenegger is accused of violating state law when he failed to notify the victims' parents of his intent to reduce nunez's sentence from 16 years to seven. schwarzenegger made the decision hours before leaving office. the judge says the cases are based on similar arguments and

should be considered together. a district attorney wants her lawsuit separate from the suit of the family who was attacked in san diego back in 2008. >> unfair restrictions. that's what advocates of medical marijuana are saying. in the south bay they are fighting back, getting together to develop a strategy to preserve access to medicinal pot. bob redell joins us live from a club in san jose. a meeting is planned for tonight, we understand. >> reporter: yes. silicon valley cannabis coalition bill meet, trying to get a get out the vote drive going. we have john hughes here, a medical marijuana advocate. what is the point of tonight's meeting? >> to take the next steps to get organized for our coalition, the city council has still yet to create a reasonable ordinance. this is sending a message.

we know there are a few seats up in 2012. so we're going to start a registration drive with the cannabis. >> to try to get people more sympathetic to your cause. the city of san jose now has agreed to limit the number of medical marijuana collectives to 10, that could be up to 25. which means that the roughly 130 there are, significant number would shut down. why is that not reasonable? what's wrong with that? >> we feel that the market should decide how many collectives. the proposition 215 which is the california compassionate use act, dictate there is should be safe access for medical marijuana patients. what the city is doing by limiting these is limiting access. >> you see the city's concern, though, that they could see that people would abuse the law, they

come in with a doctor's note that you know, maybe the doctor kind of gave it to them. they don't need it and are going to smoke it for recreational use. >> we completely understand the city's trying to get an ordinance on the books. we understand there should be regulation. we totally embrace that. we just want to help them come up with that reasonable ordinance. >> john, thank you very much. that meeting tonight, let's get out the vote drive, trying to get going. looking at the city of san jose's website. what they have on the agenda t plan is in december to get the process going where you would have the cannabis collectives in the south bay apply to be one of those 10 or 25 that would be officially sanctioned and allowed in the south bay. reporting live, bob redell. >> thank you, bob. 6:08 now. the university ever san francisco is looking to the past

as it plans for the future. school officials purchased the historic folger building. the downtown location in san francisco gives the university a way to reach a broader base of students and public transportation also play add key part in that decision. the main campus of usf is located north of the panhandle neighborhood. >> cities across the bay area are getting a helping hand in the fight against obesity. kaiser permanente is giving $1 million grants to communities in richmond, concord and san francisco. they are part of kaiser's plan to bring together agencies to promote healthy living. funding will establish wellness committees in schools and develop programs on nutrition, exercise and cooking. >> good day to get outside, take a walk, maybe get your body

reviving its once storied music scene once known for the san francisco sound launching acts like the grateful dead, jefferson airplane, santana, janice joplin, san francisco lost its clout to austin and new orleans. leaders are trying to change that. kimberly tere is live with a look at the city's new plan. good morning. >> reporter: good morning. i'm in north beach which is of course filled with cafes and restaurants that could benefit under this new plan, bringing patrons not only great food but also live music. ♪ the cost for an entertainment permit is $2,000 making it out of reach for most places except entertainment venues which have a choice of the cream of the crop. but now under legislation proposed by supervisor a so-called limited live

performance permit would cost $385. the san francisco board of supervisors gave unanimous initial approval for this permit geared mostly toward cafes and restaurants. this morning we did catch up with one musician heading to bars to play for commuters there. he was surprised by the change and says it's a step in the right direction. >> competition on the b.a.r.t. is fierce. musicians want to play, they want to play for people. it's like one of the last venues. there's a lot of street musicians in town. there are a lot of guys, quality musicians, that can't get in doors to play because they haven't been around long enough. >> reporter: it's estimated 700 cafes and restaurants could take advantage of this new permit. under the rules the performance would have to end by 10:00 p.m. after a year of holding the permit businesses would be eligible to extend performance to 11:00 p.m. the board is expected to give its final approval after its august recess. live in san francisco, kimberly

tere, "today in the bay." >> you need a guy playing saxophone behind you. 6:17. the founder of the mavericks surf contest won his fight against the company that kicked him out. the judge ruled the mavericks surf ventures breached itscourt with the co-founder jeff clark. clark helped start the company to run the surf contest. the company fired him as contest director back in 2009. maverick surf ventures agreed to pay clark but apparently that never happened. a san francisco judge ordered the company to pay clark what it owes. but another battle looms for clark. he is fighting for control of the famous surf contest, on august 17 the county harbor district will decide if they will issue the permit to the contest to clark or his ex-wife. >> new video to show you inside the japanese tsunami. it's surfacing nearly five months taf disaster. the video was shot from inside a

car that was caught up in the rising waters. take a look how fast everything in the path is consumed. cars, trucks, big rigs, tanker trucks. as the water came up the cars are tossed around like toys. we don't know what happened to the person shooting this video. hopefully that they got out. water eventually crashes through the windshield. the japanese government revised the number killed to just under 21,000. nearly 5,000 people are still missing and presumed dead. hard to look at the devastation there. >> 6:19. on to better news, i want to check in with meteorologist christina loren with a look at the forecast. >> foggy out there. it is cool marine air that will keep things comfortable. temperatures really mild for today. not too hot, not too cold. just perfect. this is san francisco. thicker fog than yesterday. our temperatures will be cooler

this afternoon. the forecast in the upper 70s and low 80s. the warmest spots the low 80s today. low pressure is the reason. another low-pressure area, system, on its way to our area as we head throughout this weekend. for us that means temperatures aren't going to fluctuate that much. only climbing by about 4 or 5 degrees. as we head through the first part of next week, we've been waiting for a ridge of high pressure to set up out in the pacific. hasn't haned. something else that we're watching out in the pacific. we have eugene. a category three storm. really only impacting shipping interests out here, heading away from land. it's turning to the northwest and will continue to do so. pretty strong storm for this time of year. we have tropical storm emily on the eastern seaboard getting ready ta make landfall in florida. only expecting quite a bit of rain from that system. nothing too substantial. it's a tropical storm not a hurricane. we're not expecting it to develop into a hurricane.

it's uncovered evidence of hacks on six different american government agencies, 13 defense contractors, at least three companies even two media companies, three tech companies, two media companies. the company mcafee which uncovered the hack says they are not going to say who is behind it but all of the cursor arrows point to communist china. these are not the run of the mill like the one that hit paypal. these are major attacks that get in the root access of computers targeted using remote access tools or rats so it's dubbed shady rat if you hear that later. a separate study by hewlett-packard says that hacking cost the average big company $6 million a year. other news, the online service hulu says it will team up with documentary filmmaker morgan sperlock to produce shows on hulu. the first time the company

coalition to start a get out the vote drive to try to change the composition of the city council. we're actually at the all-american cannabis club in san jose, this is one of roughly 130 medical marijuana collectives, dispensaries in the city. the council wants to limit the number to ten, maybe they would eventually up to the 25. two gentlemen who disagree with that. dave hodges the owner of the collective, why is it unreasonable in your eyes for the city to limit the number of collectives in the city? >> well, really, the market should dictate. we have about a million people in the city of san jose. limiting to 10 would be unreasonable. >> but the argument being there's other cities, los gatos, nine in the south bay who banned

these medical marijuana collectives. this could be viewed as a halfway point. a meet in the middle >> if they do it right it could get to the right direction of control over the 130. unfortunately, a ban is the wrong approach and making it impossible for these places to operate does not get us first. >> reporter: john hughes, tonight you're going to help with this meeting. what do you want to come out of the meetinging, what kind of movement do you want to see? >> we want all of the collectives on board in starting this voter registration drive. 2012 is going to be a big election year. we're optimistic the city council is going to come up with a dignified and reasonable ordinance but we need to take measures into our own hands and be pro active and that's why we are starting a voter registration drive. >> do you see the concern that some have as far as having too many dispense areas.

people coming in maybe not with a legitimate note or a doctor who is sympathetic to their wanting to get stoned for recreational purposes and the city not want to have that element. >> we totally agree with the city there needs to be regulation but it needs to be reasonable. currently what they have on the books is not reasonable and is going to put most operations out of business. >> gentlemen, thank you for being up early with us. i was on the san jose website and the way they have lings planned out for the rest of the year, that by december, if everything goes to plan, they would start the application process where these collectives could apply to be one of the 10, possibly one of the 25 that would be allowed, considered to be legitimately allowed in the city. they are aiming for december. bob redell, today in the bay. >> 6:34. a northern california camp counselor is behind bars this

morning accused of having sex with a 14-year-old boy. katrina herrador was arrested this week after the parents of the alleged victim found suspicious text messages on his phone. police say herrador met the boy at a camp and admitted to having sex with him at her home last week. >> she did give us a statement as to what occurred that evening. >> was it -- his admitting that the incidents occurred? >> yes, it was. >> herrador worked for the summer program called teen extreme. vacaville police are investigating whether she had inappropriate relations with any other teens at the camp. >> following a developing story out of the east bay. a bizarre crime wave is hitting the streets of vallejo. christie smith is live where officials say more than 50 storm drain grates have been stolen.

good morning. >> reporter: good morning. it's amazing the things that people take. you probably heard of copper theft or electric wire theft. this is the new thing here. someone is lifting these storm drain grates up, about with 100 pounds each and likely selling them for scrap. in one day the sanitation and flood roll had to replace five of them. at least 20 of these have been ripped off in a two-week span. they are about $350 each. it can be dangerous to have a hole in the street or the sidewalk. one woman damaged her car. if you were walking you could drop down. some of these at least 15 feet deep. if you see someone stealinging one call 911 or if one is missing call the district. the city is looking at a number of things including maybe spot welding to hold it down. that would be labor intensive

because there are thousands of these across the city. christie smith, touchdown. >> new details in the massive salmonella outbreak. the federal government is recalling 36 million pounds of ground turkey. usda says the tainted meat came from a cargill plant in arkansas. the meat has been linked to a death in california and 76 other cases around the country. there isn't enough information to recall specific brands. the meat is safe to eat if it is cooked the an internal temperature of 165 degrees. certainly not going to be that hot around the bay area. a little cooler. i want to check in with christina. >> you can cook your meat in comfort. sometimes it gets too hot and you don't want to cook.

this weekend temperatures aren't going to fluctuate that much. low pressure keeps things nice and filed. another trough on the way that's going to continue. all the way throughout the weekend and as a result this morning a little coastal drizzle possibly until about 10:00 a.m. maybe 11. watch out for drizzle. we're watching for reduced visibilities starting to keep down along the peninsula. 56 at temperature in san francisco, and san jose, a comfortable 60 degrees. in the city of oakland, if that's where you're headed for, 65 degrees, we'll talk as soon as the clouds break apart. a mix of sun and clouds. the brees will pick up. get the cloud cover out of the way. 69 degrees. warmer, about 79 degrees in places like livermore. 8 oyn gilroy.

francisco lost its music clout to cities like austin and new orleans, but city leaders are taking a big step forward trying to change that. good morning, kimberly. >> reporter: good morning. north beach is one of many neighborhoods lined with cafes and restaurants that could benefit from this plan bringing live music inside. as it stands an entertainment permit will run $2,000 keeping many small businesses out. a vote by the board of supervisors may change that. it initially approved a new cheaper permit that will allow many cafes and restaurants to host live music. the limited performance permits cost $385. a musician we caught up with was excited. he says many of them are forced to set up on a street corner to

make a hiving. this permit could open up many other venues for them to play. >> the cabaret license is prohibitly expensive. for these small places like said i know a place up the street and they barely make it you know. they can't afford to pay thousands of dollars. >> it's estimated about with 700 cafes an restaurants in the city could take advantage of the new permit. the performances have to end by 10:00 p.m. it's expected to give its final approval after the august recess. >> thank you very much, kimberly. 6:55 now. two powerful south bay community groups are taking on a popular restaurant for discrimination. a statue of sack daniels has a sign hanging from it.
