we've got thick fog out this morning in the north bay. you're clear in the south bay and east bay. that weekend, get away friday just around the corner. i'll let you know why you might not want the getaway. weather is going to be perfect. let's get a mike check on traffic. >> check 1, 2, 3, 4. 880, here are the maps. we have a slow drive passing 23rd. there is a double big rig accident blocking the slow lane. 580 might be a good alternate. you see slowing. if you don't have to take it. not now. we'll give a better -- this might take a while. >> we'll make sure and check back. thank you. of course a volatile week on wall street continues. a live look at the big board. we are about a half hour away from the opening bell. investors anxious after yesterday's massive sell-off. the the dow falling more than 500 points to below 7,000. the roller coaster ride in the

u.s. being felt around the world. european markets continue to fluctuate. stocks fell in hong kong and japan but rose in china. we'll continue to keep an eye on things and have a live report at 6:30. >> breaking news out of san francisco, firefighters racing to put out a fire happening at a business on masonic avenue. christie smith is live on the scene. >> reporter: good morning. i have to tell you, we can still smell smoke but it's a huge improvement from when we first arrived here. firefighters got the call about about 5:00 a.m. of a fire that was burning on masonic street. you see a ladder on that end. when they got on the roof they discovered it was burning midway down the street there on hate. it turns out this fire appears to be burning in an apparel

shop. i spoke with a battalion chief who says it then spread to a business next door. all of this burning in the rear and roof area of these businesses. the next store business to the clothing shop is the people's cafe. again, i took a look from the front and i have to say looking in the front door of the cafe and even the apparel business, the damage doesn't look too bad. now, neighbors called this in when they saw flames. i spoke again with the battalion chief. he says there are some challenges with this kind of san francisco building. >> not that it's challenging, it's a typical san francisco construction where we're always chasing fire into the attic space, buildings are built close together. but it's what we do best. we are very good at locating extension of fire and extinguishing it. >> reporter: firefighters say the good news is that it is contained now. how it started they don't know.

they tell me they will be on scene for sometime making sure that everything is indeed out. we did see some neighbors out here when we first arrived in their robes, looks like those folks have returned home now. that's the latest reporting live in san francisco, christie smith, "today in the bay." >> thank you for the update. >> it's 6:04. so far no charges filed after last week's deadly boat collision in the san francisco bay. a preliminary investigation found the pilot of the larger boat didn't see the smaller one when it hit it. the august 3rd crash killed a 19-year-old man and injured his father. the investigation is moving slowly because both sides involved have hired lawyers and are refusing to talk to police. >> environmental and neighborhood groups in san francisco plan to hold a rally protesting the city's environmental review of plans for the america's cup sailing race. environmentalists say the report

is inadequate and fails to address concerns about air and water quality. the plan for the series includes the construction of a cruise terminal along with an open space area along the embarcadero. the city will hold a public hearing at noon today inside city hall. >> a protest that's quickly becoming a battle over free speech a. group of petitioners at odds with safeway claiming the chain is infringing on their first amendment rights. marla tellez joins us with the story. >> reporter: good morning, laura. most of us have experienced this before, making your way into a grocery store like a safeway and you're stopped in your tracks. somebody asking for their signature regarding a political petition. safeway wants to put a stop to this. petitioners are fighting back. at safeway headquarters yesterday about 50 people,

political petition signature gathers protested saying the corporation is disrupting their free speech rights. they say safeway is denying their right to participate in a direct democracy. they say they don't follow policies, break entrances and harass customers so safeway is taking action, in some cases the store chain has filed court injunctions. we've spoken to some customers and they are siding with petitioners. >> i listen to what they have to say and if i agree with it i will sign their petition. >> it doesn't bother you before you even made it in the store? >> it can be frustrating, definitely. >> that man went on to tell me he does in fact think that safeway is taking this way too far, taking them to court not the way to go. i spoke to the organizer of

yesterday's protest, he said that despite the big intimidation actor. that the petitioners are not going anywhere. gh thank you for the reports. relief is on the way for south bay motorists. the california transportation commission has approved $200 million for three road projects and the plan to bring the b.a.r.t. to south bay. merging lanes will be built on highway 101 from palo alto to mountain view and cato road in fremont will be rebuilt along the path of the b.a.r.t. extension add work on the 10-mile line from fremont to berryessa area could begin next year. >> look at that. it will be great for the time we've got to get throughout this morning. jon kelley newest member to the morning team. >> thank you for having me. >> don't mind getting up early. >> thanks for the cup of java.

>> strong. let's check in with christina loren. >> wondering who that was. what a voice on that guy. we've got an area of low pressure increasing on shore flow for us this morning. and it's going to keep things comfortable this afternoon. a touch warmer inland. overall this is producing foggy conditions and right now your visibilities are dropping in the north bay where we have a mile and a half of visibility. in the south bay, we're noticing our numbers drop in places like novato down to a mile, 10 miles in san mateo. looks like the fog is going to creep to the south through the next few hours. 59 degrees in hayward, 57 in sunnyvale. at 55 in santa cruz. if you are looking to get to the beach why this is your weekend. you break for lunch, santa rosa 68 at noon, rounding out at 80.

a little toasty places like fairfield 87 degrees, we continue to warm up for the next couple of days, then we drop back off. i have your full forecast coming up. something is going on with a couple of big rigs. >> good morning. big rigs are fine. you don't want them giving each other a high five or whatever went on. northbound 880, two rigs are blocking that slow lane. no injuries reported. we have to figure out how to cheer that. 880 up to the scene we see slowing on the map and past the coliseum. a steady volume passing high street that will result in slower traffic as this which would withes. hopefully they get that cleared. so far it's been there about 15. also westbound 4 low slowing toward l street. 54 to bay point. slowing in concord. back to you.

for your signature. safeway wants to put a stop to this, they are willing to take everybody to court although petitioners are fighting back. as many as 50 political petition signature gatherers yesterday holding signs, one that red stop safeway's attack on free speech. their argue summit that safeway denies their right to participate in a direct democracy. safeway says they are ready to take them to court. also blocking entranceways. in speaking to customers out here this morning, so far all sided with the petitioners. >> if they have a cause that people agree with, it's good that they reach out and find people that are go to help them out. >> reporter: the organizer yesterday said safeway hired an attorney and this is what those petitioners have been told.

>> they can be arrested with no notice, no arraignment, somebody snapped their picture. intimidation and it's wrong. >> reporter: he says the petitioners are not going to stop. they are going to continue to gather outside local safeway stores. even if it means an arrest. laura, in the end it may have to be settleded in court. >> it's interesting because it seems like other businesses are able to say you can't gather signatures, donations and what-not. >> reporter: i have a feeling it's not going to stop them. >> this morning oakland police looking for a pird suspect in the killing of a toddler. carlos was killed during a gang-related shooting near international boulevard last monday. two people are in custody including a parolee with a history of possessing guns. the time is 6:33. that means the markets are now

welcome back everyone. a good thursday morning to you. taking a live look outside over oakland in the east bay this morning. it's 6:41. >> is washington headed for a gridlock? a congressional super committee is almost set but many people are wondering the they can finally put their differences aside and come to some kind of compromise to stable the economy. that's the trillion dollar question. tracie potts is live in washington, tracie, how do things look? >> we now know the names of nine out of 12 of the members on this committee. the republicans named their half of the panel. mostly conditionses, people on the far right, who will probably oppose tax increases that president obama and the democrats want the get in. the question is they have got to

cut a trillion and a half or we are wooking at automatic increases. are they going to be able the a come together? we won't know until the fall but what we know there are penalties and incentives built into this man, this debt plan to make sure. all of thishelp get our economy on getter footing. so far so good, a wetter day up about 125 points when i last hooked. better than yesterday when we saw the dow bung over 500 points. in washington people asking president obama should he postpone vacation and bring congress back. in an interview with latina magazine the president said there is no need if they are only going to come back to fight. jon. >> tracie potts, thank you very much. >> it is 6:42. coming up, changing bav ricks to try to save lives.
