>> we give you a live look outside, if you're curious, that's oakland. i'm sure you realize this, it's thursday, september 8th, this is "today in the bay." >> good morning to you. thanks for joining us. 5:00 right now. i'm laura garcia-cannon. >> good morning everybody. i'm jon kelley. we jump right into the weather and christina loren is here to tell us about it. we kind of had a heat splash. wasn't a heat wave but a splash. >> a lot of people were jumping in the pool yesterday. today, you don't need to. it's not going to be that bad. we're dropping off by about 10 degrees on average this morning. much, much more on the mild side in places like san jose where we started out in the 60s, now back in the 50s. 59 degrees there. livermore, another hot day for you. we've got thunderstorms in the forecast, i've got your weekend numbers, i think you'll like them. stay tuned for that. it's 5:00 a.m. mike's here to help. >> construction in the north

bay, it's one of the cooler spots so folks will find slowing a tad as you come through san rafael and getting off of the san rafael bridge. in the area also, the air conditioning's not working. wood land road at acorn way, a car hit a power pole. give your friends a call or crank call them because it's early. >> you're not nice. >> trouble. >> i'm up. >> thank you very much. it's 5:01. we are following a develop are story out of the east bay after months investigating a suspect will face formal charges in court. christie smith is live in hayward where police have the victim's former classmate in custody and charged with her murder. good morning. >> reporter: good morning to you. giselle esteban will be in court to face charges. she is expected to be here at 2:00 this afternoon. it's hard to say, though, that this arrest came as a total surprise. she had been a person of interest for quite some time.

made some statements that raised suspicion of hayward police but now they are revealing a number of things that actually led to the arrest, saying that michelle le's dna was found on the bottom of one of her shoes and security camera footage placed her at the parking garage before and after the nursing student disappeared. hayward police arrested the woman yesterday at her home and took evidence from that condo for hours. le was last seen on may 27th when she went to her car on break at kaiser permanente in hayward. police think she was killed in that parking garage, le's family they were devastated by the news but they are hoping that she's recovered. >> no word can adequately explain the emotions we feel at this moment. we are still determined to bring her home. >> reporter: le and esteban were high school classmates in

san diego, and police didn't talk much about a specific motive but they noted that in media reports esteban blamed le for destroying her relationship with her ex-boyfriend and father to her 5-year-old daughter. he filed a restraining order against esteban before le's disappearance, saying that esteban was stalking him and acting enraged. we also wanted to note that we did make contact with michelle le's family and they say they will be here this afternoon for the arraignment. back to you. >> finally an arrest. >> the debate whether to ban dangerous dogs in one city in the hands of the community. the sonoma city council refused to act on a proposed dangerous dog ban. sanders came up with the proposal after a mauling of a woman that was killed by the pit bull she owned. instead of a ban council members to sided to have community members determine if changes to the current city ordinance is needed. current regulations require dogs

older than 4 months to be licensed, vaccinated and under the owner's control at all times. >> it's 5:03. san francisco will have to keep tabs on more law breakers part of a program to transfer inmates from the state prison into local systems. san francisco will take over close to 650 offenders from the state prison system. 421 of those will be in the community with supervision and electronic tracking devices. the state is giving san francisco $5.7 million to cover that cost. part of that money will go to hiring 27 new probation officers. >> i think it's safe to say a lot of people are fans of this story. actually that would be a bold understatement. oprah visiting facebook today. yes, the queen of talk taking questions in an online chat this afternoon, cool, a chance to ask a few questions. marla tellez joins us live with more. good morning. >> reporter: good morning, jon. this is actually going to be a first for oprah, her visit to

facebook. seems only fitting considering that she has hosted mark zuckerberg. she had him on her show. also considering that she is a huge fan of the top social media website. about 6.3 million people like oprah's facebook page, and more than 26,000 people have already rsvp'd to attend her chat scheduled for 1:30 and last about an hour. you can go to the event page and post a question that she may answer within that hour. we asked folks what they want to ask. everyone seemed to have the same question. almost everyone. >> you have questions for her? >> why did she cancel her show? >> you have questions for oprah? >> you probably know the answer to that one. >> that's a big fat no? >> right. >> why did she give up her day show? it was terrible.

you know. i think -- >> reporter: that may be why she's really visiting facebook today since she ended her show in may and launched her own network, "the new york post" reports traffic to her website oprah.com has fallen significantly by almost half, in fact. it raked in more than 5 million visitors in january and close to 2.5 million in july. so, it's reported she's going to talk with those on facebook, even the ceo of twitter to figure out how to boost her on line presence now that her tv presence isn't as strong. it's reported she and cheryl sandberg are now good friends. shandberg is the coo here ranked the fifth most powerful woman in the world. so again, oprah's facebook chat is happening 130 to 2:30 and

then she is said to be having dinner with sandberg here with other women. i wonder why i wasn't invited. >> we can get on the phone and get you on that list. >> get on the horn. >> we got you covered. >> you got to check your message box. california could be left with one large tab if congress cuts funding for the high speed rail line. lawmakers meet for the first time since vacation. they will talk about what cuts need to be made to pare down the national deficit. some have said high speed rail is one of the lowest priorities, california voters have approved $9 billion in bonds for high speed rail construction but it's only a fraction of the $43 billion needed just for the initial phase of the project. governor brown will have to decide soon whether to issue more bonds to fund that project. >> san francisco mayor ed lee, he's getting flack for deciding to run for a full term. the bottom line is voters still

like him. according to a poll commissioned about i lee's campaign he stomps out his competitors winning 51% under the city's ranked choice voting system. lee's closest competitors were senator yee, city attorney dennis herrera, and jeff adachi. all three came in under 15%. >> one of lee's competitors is getting a new endorsement from a newsom. his wife jennifer. she has endorsed joanna reese. she says there is a lack of female presence in elected city post and vees a self-made woman who has boot strapped her way to the top of a mail-dominated profession. >> a self-made woman. all right. 5:08. we're taking over the world, meteorologist christina loren. >> you are. >> that's right. taking down one man at a time. just kidding. no. we love equality, though. what a great country. we're looking really good. high pressure is bringing in

some of that monsoonal moisture. and in addition to the monsoonal moisture creeping up we have a short wave trough that pushed through so we've got a lot of instability over the sierra nevada. if your travels take you through here you want to take it easy. look at all of this lightning firing off. just around the california/nevada border. we're going to see more of that thunderstorm activity into this weekend. but for today and for the most part tomorrow, on shore flow is going to bring in cooler weather and the 70s will return to the south bay as we head through tomorrow. today we're talking about the low to mid 80s. air quality has improved overnight as well. we had a spare the air day. because of on shore flow it's clearing us out, cleaning us out giving us a nice start this morning, good air quality along the coast. moderate, though, in san jose and through the east bay this morning. here's what we're looking at. 55 in hayward by noon we're going to bump up to the 60s and 70s, but still no 90s until about 4:00 p.m. in fair field. 90 degrees in gilroy.

the city of san francisco, just 69 degrees but, if you stay tuned i've got the seven-day outlook. we're going to see changes into the weekend. i'll show you those coming up. 5:09. let's check your drive with mike. >> all right. i'll take folks to the east shore freeway, heading away from the bridge, we do see slowing. getting to the bridge a 19-minute drive off of the carquinez bridge. easy out of richmond and berkeley away through berkeley we have construction crews clearing around gilman and university, likely the reason why these are slowing sensors popped up on the screen. we'll track that. i'll let you know. 880, market and 980, those construction crews should be moving. 680 a smooth flow as well. a live look at 880, no major issues. a good number of headlights south, north past high street and a smooth flow throughout the east bay. we'll catch up with antioch, right now easy drive, 68 miles per hour at the l street sensor.

it's being called the darkest day in the history of hockey. an entire russian hockey team killed in a plane crash. one of the players who died a top prospect for the san jose

sharks. one ki-- two people survived. daniil sobchenko is among the dead. he was drafted by the sharks in june and spent part of the summer training in san jose. this video we have taken shortly after the jet crashed about 150 miles northeast of moscow. the team was on the way to a game. the cause of this crash is currently under investigation. >> ford offering relief to victims of hurricane irene. for that and the rest of the news before the bell we turn to courtney reagan live at cnbc world headquarters. good morning, courtney. >> hi, good morning, jon. futures have turned slightly negative but that is following yesterday's big market rally which snapped a three-day losing streak. some fears are easing over europe's debt crisis.

we were able to hold onto the gains even after the report economic growth is continuing at a moderate pace. lots of focus on the two major policy speeches, the first from ben bernanke in minneapolis and then president obama tonight. we get data today on the trade deficit, filing for unemployment and consumer credit. the dow rose 275 points wednesday to 11,414, the nasdaq gained 75 to 2548. it's getting close to crunch time for labor talks between the uaw and the automakers. ford and chrysler are far apart in discussions. the sticking point as usual, pay. gm is reportedly further along and closer to agreement. the uaw's current contract expires next week. >> and speaking of automakers ford is offering relief to people impacted by hurricane irene. it's giving the option to delay some car payments if they qualify. so the offer is available to customer who is bought or leased

vehicles through credit arms of ford, jaguar, land rover, mazda or involve va. ni volva. back to you, jon. >> thank you very much for the report. >> now you want to get updated, check in with meteorologist christina loren. a pretty hot day inland yesterday. how are we looking? >> not quite as hot, laura. not as hot at all. i think if you wake up with us inland and one of the many people who commented on this sweltering heat you'll be happy to know we'll drop off by about 10 degrees. you'll notice the difference. we're noticing the difference this morning. we've got more fog out there. on shore flow has resumed. let's say it's more robust. what fog we see will be compressed right to the surface yet again. keep that in mind. but the marine layer wasn't that deep so. what we're looking at is probably clearing by about 11:00 a.m. futurecast shows you that the marine layer will push out to

see. as on shore flow increases you get a few hours of complete sunshine in the city of san francisco. i think that fog's going to roll in by about 6:00 tonight. 79 in fremont. 81 in san jose. 90 degrees today in gilroy. we're going to continue to warm up just a little bit as we head through the next couple of days, then we drop back off to the 70s on sunday. we're going to see a chance of isolated thunderstorms. if you live in the mountain regions across the bay area you have a better chance, a 40% to 50% chance, at the valley level you're only going to look at a 10% to 20% chance. we'll talk about why and when these thunderstorms are expected coming up. let's get you out the door with mike. >> all right, christina. not really issues like that going on. not so exciting in the south bay. we do have construction, sometimes that makes a thunderous sound. we have 237, matilda and fair oak. the off ramps might have construction crews past 8:00 in the morning so plan for your alternate through sunnyvale. but no major disturbance for 237

or 101 through that area. bottom of the screen, 17, construction picking up passing lark. 85 around blossom hill. look at this. 880 this stretch here still has slowing as well as 101 northbound and right in that area we have crews so that's likely causing that slowdown and no other incidents reported. shouldn't be a big issue. the rest of the south bay looking nice. we do have a nice smooth drive out of the altamont pass. 14 minute drive out of livermore and in toward pleasanton and dublin. this area saw a huge backup yesterday as well. tuesday there was an accident. wednesday there were no accidents, a lot of traffic so expect the same for today. as you come down through this area. pretty nice drive yesterday through the castro valley. the y experienced slowing. just construction. right around winton you lose a lane. a live look at the bridge shows an easy flow. back to you guys. >> thank you very much. well, san francisco police warning cab drivers of a serial armed robber.

there have been at least seven robberies since july and in three of those the suspect had drivers drop him off on the same location. investigators say the thief would pull out a weapon, demand the cash and then take off. there have been no reports of injuries, just lost cash. >> 5:19. the family of a respected santa cruz attorney is talking to police about her death. 35-year-old cassman was found dead. her ex-boyfriend is charged with second-degree murder and kidnapping. witnesses say they saw galloway and cassman arguing in a car on a highway last thursday. when police arrived they found cassman's body 18 rocky area below the roadway. galloway apparently jumped over the cliff. he survived the fall and is in the hospital. those who know cassman are having a tough time dealing with her death. >> celestial was sweet, really

friendly and -- it's horrible to hear what happened to her. >> galloway will be in court on friday for a status hearing. prosecutors want to make sure he recovered from his injuries and understands the charges before he is arraigned. >> it's 5:20 now. this morning san francisco board of supervisors hung up on a pension deal between mayor ed lee and police and fire union. the board's budget and finance committee reviewed the deal yesterday which would postpone raises for police and firefighters and increase pension contributions. the deal would shield them from proposition d pension measure. adachi says the she'd would cancel out more than $60 million in savings for the city but the police and fire unions say they made plenty of sacrifices to save the city money. the deal now goes to the full board. >> coming up scientists think they know why abalone and shell fish are dying off the sonoma

>> welcome back everyone. a live look outside. you can barely recognize the shot before all of the cars appeared. this is approach to the bay bridge toll plaza this morning. traffic pretty light so far. 5:23 now. >> scientists say a recent explosion of plankton off the coast could be responsible for a die-off of shell fish. the prized sea snails have been washing up for more than a week. scientists tell the press democrat a recent plankton bloom may have suffocated the shell fish. the calm ocean conditions likely

left the plankton more densely packed consuming more oxygen. the biggest on line retailer giving breathing room from sacramento lawmakers. amazon.com and legislators agreed to give the company more time to find a solution for on line taxes. the company will have to wait until next july to lobby congress to create a tax structure for on line purchases. if it fails amazon will have to abide by california's internet tax law. no word how lawmakers will fill a $200 million hole which was supposed to be collected from amazon this year. >> thanks, jon. the silicon valley companies make staggering amounts of money. even scott is surprised by some of the numbers people are throwing around. >> it's amazing. apple, laura. apple is on its way to its best year ever, could sell as many as 68 million ipads next year. 68 million. to give you perspective, apple

sells about 9 million ipads a quarter now. one of the top analysts that follows apple says that profits could be up 64% in 2013. so we're talking about the second most valuable company in the world growing with quarter over quarter increases like it's a little start-up. the pc as we know it is dead. 5:25. how about facebook. when steve jobs came back to apple mark zuckerberg was 12. facebook is worth $80 billion. this after someone who would know told reuters facebook made $1.6 billion in the first half of the year. $1.6 billion in six months. several news reports say one of the most powerful men in silicon valley journalism is out of a job, fired by aol, according to fortune. aol bought his website tech crunch some months ago, but then there was a spat between airington and huffington in

8th, this is "today in the bay." >> good morning to you. thanks for joining us. it's 5:30 now. i'm laura garcia-cannon. >> and for the record i want everybody to know she is our news guru then. i'm jon kelley. good morning. let's check in with our weather -- >> i'm the dawn of weather. >> the dawn. >> yeah. >> you are so good. good morning to you. we actually have really, really good weather out there for today. if you were too hot yesterday it's going to be much cooler inland. you can probably give your ac a break even in the south bay. your temperatures are mild, we're in the upper 50s, a couple of 60s as well in fairfield and livermore. i'll let you know what we're expecting as we get closer to the weekend, which day is better for outdoor activities. definitely one is better thatten the other. we're going to talk about that. first let's get you out the door with mike.

>> we'll take you out to where construction is changing the environment. around the maze, 880, back to 980 has reopened from overnight construction. but still on the east shore and 680. no full closures. getting through the city reminder, sf symphony until the party on the 11th. a gala tonight. a lot of street acstoyft watch for closures around symphony hall. >> san francisco port authority is giving the booth to tech company start-ups on pier 38. bob redell is live with a look at the reasons behind the closures. good morning, bob. >> good morning to you, jon. we're up here at pier 38 up the street from at&t park. this is a big deal because pier 38 has been a sort of mini tech hub for about a couple dozen companies here along the embarcadero. you've got several start-ups,

tech firms, even a vc firm. they must pack up and leave. the port authority recently sent out this let tear all of the tenants, letting them know that the entire structure has been red tagged. you can see one of them there, that the pier 38 is unsafe, so much so that they must vacate by 5:00 friday night, september 30. just over three weeks from now. the port says its chief engineer found electrical and plumbing problems, and fire code violations. these revelations come after the port recently won control of the facilities from a man who had been leasing it. they said this man had been subleasing a lot of these spaces without prior authorization or proper authorization. the man alleges that during the time of his lease the port failed to maintain the pier. some of the tenants claim that the port is using the red tagging as an excuse to evict them to make way for the

america's cup sailing competition which will come to the san francisco bay area in 2013. the port denies this. we looked back at a term sheet that then mayor gavin newsom produced. that they would use an area around pier 38. you look at the recent environmental impact report for the america's cup, it does mention it will be using several piers but not pier 38. so again, the port insists that what's happening is strictly a safety issue. where are the tenants going to go? some to other locations that they have in the bay area. as far as those who don't have those, the port says it will try to help them find new space. reporting live in san francisco, bob redell. >> bob, all over the story. thank you. >> it is 5:33 now. a new round of b.a.r.t. protests will be held later today and could affect your commute home a. group of activists are

staging a fair the fare protest at the powell street station at 4:30. it plans to make their presence felt inside the station close to the fare gates. the goal is to get b.a.r.t. police to open the emergency gates and let passengers out without paying. organizers say depending on how the agency responds to the protests they may move to a nearby station. this is the latest in a number of protests b.a.r.t. has had to deal with in response to a fatal officer-involved shooting back in july. one of the biggest names in talk shows is one of the biggest in social media. oprah winfrey will pay a visit to facebook. marla tellez joins us live from facebook headquarters with more on how the community is reacting if they like it so to speak. good morning, marla. >> reporter: good morning. it was just in april that the president himself, president obama, he made a visit here to facebook headquarters on page mill road in palo alto. now it's oprah's turn and a

first for her. as you can imagine, though, the folks here at facebook, they are being very tight-lipped, not giving many details about with oprah's arrival time. but we know she's here for a live facebook chat that you can be part of. it gets started at 1:30 today. you just have to rsvp to the event page. so far more than 26,000 people are signed up to attend. she's going to be answering questions from her fans within that hour-long chat. so it's from 1:30 to 2:30. and people we talked to about her visit even those who aren't big oprah fans say what she's doing is a good thing. >> her presence and her personality is a big deal for a lot of people. so i think it's powerful that she's going to facebook. i think that's powerful. >> i'm not a facebookee in the country, or not. i'm sure there's a huge following for her on facebook so

it's probably part of her new social media strategy. >> reporter: neil got it right. it's reported she is here to help boost her online presence. "the new york post" reports traffic to her website oprah.com has nose dived by almost half since she ended her show in may and started her own network. so oppose practice expected to get advice including cheryl sandberg, the chief operating officer here at facebook who was ranked the fifth most powerful woman in the world by forbes. that was just last month. so again, oprah's live facebook chat from 1:30 to 2:30, then said to be hanging out in the bay area, attending dinner with cheryl sandberg, laura, and also some select silicon valley women. that's happening tonight. >> a lot to see and do.

thanks so much. >> this a sign of the economic times. oakland issued a list of possible school closures, the elementary school, marshall, buckhalter, kaiser, lazear, maxwell park and sobrante park. middle schools, frick and clairemont. the district says the slis a rough draft and more schools could be added or removed depending on school pund funding. contra costa county is taking two schools off the list, the district beginning to pay off an $8.1 million state loan. when the loan is paid off there will be an extra $1.4 million a year in the general fund. that money will be used to keep lake elementary and san bab low in pinole open. the two schools slated for closure in 2009. >> i want to check the forecast with meteorologist christina loren. see how we're looking. >> good morning. we're looking good. we have a cooldown in store for

you. unfortunately, that fog is back and it's going to hang around for the most part today in the city of san francisco. you're going to get clearing by about 10:00 in the south bay and the east bay. we're noticing on the radar a lot of moisture being forced down to the surface. by high pressure which is halfway in control of our pattern. we have an approaching low that's going to switch thing around as you head to your weekend bringing in more of that fog each and every morning but dropping our temperatures. as we head through today. this is what we're looking at. 11:00 a.m. a good deal of clearing, the marine layer pushes out to sea. that's when we'll see sunshine in san francisco but i think the fog's going to roll back in between about 6:00 and 7:00 so. you're not going to see as much sunshine as you did yesterday. it was a toasty day in the city. 55 in hayward, 59 degrees right now in san jose. so temperatures overall this morning are running about 2 to 3 degrees cooler on average. and as a result we're going to see a comfortable afternoon, 73 degrees inland, 63 by the bay as you break for lunch, then we round out the day at 81 inland

president will demand quick action. we'll see what happens. good morning. >> good morning everyone. people who are familiar with this plan say tonight's speech will be mainstream, aggressive and specific. now let's break that down. main stream t the white house is saying that he will pitch ideas that both democrats and republicans have supported in the past to help create jobs and spur growth in this country. aggressive. he is urging congress to act on these ideas by the end of the year, so that they can make some difference in the unemployment rate, hopefully a positive one by the middle of next year and well before the 2012 election. and specific we're told that the president will pitch hundreds of billions of dollars in middle class tax cuts, business tax breaks, some infrastructure projects and a pay roll tax cut and extending unemployment for the millions of americans including a lot of californians who still need it. >> a lot of people need it.

shore flow which is not only going to cool us down it's going to bring in more fog each day as we head through the weekend. something else that's hamming out there. high pressure, this is sucking up monsoonal moisture off the coast of baja and creating that stability. we have lightning over the sierra nevada along the california/nevada border. you want to take it easy. we expect thunderstorms in our neck of the woods starting on friday. so i think the best chance for friday will be the south bay mountain regions. and as we head through saturday and sunday more of that moisture will creep up to the north so that inland you have a better shot of thunderstorms as we head through the weekend. 69 degrees today in san francisco. 71 in oakland. 83 in los gatos and 89 in livermore. so overall, i've subtracted about 10 degrees, 90 in gilroy, 81 in san jose. we were at about 96 in the warmest spot in san jose yesterday. as we head throughout the weekend, take a look at your numbers for saturday and sunday. 87 degrees saturday inland, 78 sunday. so basically what this means if

you are trying to make outdoor plans you're going to want to make them on saturday inland and then sunday at the coast. let's check your drive with mike. >> we'll take a look at all of the activity, well, all of the crews leaving the area. still matilda avenue, the on ramp will stay around until about 8:00 a.m. the rest of the construction, that has cleared. we're looking at 880, 85 and 17 all with the clearing through the area as well. a new accident reported by p.d., it's at camden avenue at calico. a car flipped, then three cars are involved or stopped to help. this could be an issue over to 17. we'll track this because they have yet to arrive to give us all of the details. a smoother drive into the south bay. we do see the slowing out of livermore and the alta mont pass. 15 minutes, speeds in the 50s into almost but through livermore, 60s and better toward the dublin interchange.
