park at mcarthur. overnight they hit a wall here. again, paperwork at a 2:30 in the morning accident. watch that intersection. so many shows over the weekend. a lot of occasions for you to slow passing the exits there. >> mike, thank you very much. we continue with a threat against a school in martinez. an agresive response by the school and police. >> it's certainly an unsettling thing to happen. a threat directed at the campus. surgeonly the district and the police department are fighting back. this is the campus.

it's here in martinez. so far they uncovered nothing to lend credibility to this as something real. but the school district and the police department, they're trying to make sure that the kids feel safe being here. police are trying to track down the owner of the e-mail account. it may take some time. according to published reports, robotic calls went out to parents letting them know extra adult supervision will be here today. police providing extra personnel on campus. they decided to go ahead and continue on campus. often the goal of the threats is to disrupt classes. in the end they find they're unfounded anyway. teachers also expected to attend a safety meeting first thing this morning. despite the threat, they're trying to continue with business as usual and make sure all the the students feel safe being

here. that's what we have in martinez. scott, back to you. what really happened to the 2007 college party with baseball players? today we are expected to get an official word about the case and the alleged rape. when he took over he promised a fresh review of the case. the previous d.a. decided not to pursue criminal charges. rosen will announce his findings this morning. the then 17-year-old girl at the center of the case filed a civil suit. she lost in court. we'll post them online at nbcbayarea.com. we'll have a full report tonight. a horrible tragedy after eight people died in a shooting rampage at a beauty salon.

outside the salon where the shooting took place. scott decrie is accused of killing them. someone who knew him says they were involved in the custody dispute over their son. well, hot dugs with a side of guns and meth. that's what federal agents say were sold to them by a hot dog vendor in the south bay. the two were arrested in september. ortiz admits selling nine guns to the agent at another location, but not from his hot dog stand. ortiz's friend defending him this morning. >> not here. not in front of everyone. it was somewhere else. no drugs were sold here or

anything like that. >> nine guns, yes. hot dog stand, no. castillo has been ordered detains. oakland police chief anthony batts planned to wait until next month to step down but city wasted no time. the mayor swore in the assistant chief, howard jordan, appointing him as interim chief. the move two days after now former chief resigned saying he didn't feel like he had the power he needed to run the department effectively. jordan says he understands the challenges before him and he's ready. >> as the interim chief i will make solid decisions. the term interim will not apply to my decisions. i will make decisions as though i'm the chief. i intend to lead in that direction. >> he's ready to move forward in a way that no one else in the force is ready. >> now this is a position that jordan knows well. he served as interim chief in

2009 leading them through four police officers. >> the post closures in the oakland school district have sparked outrage among parents. now some school board members aren't keen on the idea either. one board member called it a mistake. district officials are meeting with parents at the elementary schools that need to close. one trust yn ee said we tried to do the right thing. he estimates they would save $2 million a year by closing the schools. they are set to make a final decision on october 26th. thieves in oakland had to settle for something less valuable. bandits broke in, headed for the office with a safe inside. they brought tools. they tried to break in with a jackhammer. >> they tried cutting tlu the

shactman live at cnbc headquarters. >> good morning. google is a monster. stock futures are higher. investors shrugging off the latest news out of europe. citing weak economic growth and high debt in the country. and google could boost tech stocks today. the internet giant reporting better than expected earnings. stock flows miked on thursday as investors remain cautious and tepid economic data from china. a busy economic day today. we get reports on retail sales, inport prices, and business inventories. the nasdaq is up 15 to 2620. speaking of google, creating an online music store to compete with amazon and itunes. they're holding talks with music labels about licensing their song catalogs with only emi if close to a deal.

welcome back to you as we take a live picture outside. it's going to be a warm one today. less than a week after attorneys announce they're cracking down on medical marijuana dispensaries, federal agent i raided a pot club. federal officials said medical marijuana has become a for-profit business, exploited by people who don't really have legitimate medical needs. u.s. drug enforcement agents raided the dispensary. seized 99 pot plants. the dispensary did have a county sheriff's perm to grow pot they believe the pot club was targeted because the owner was in newspaper stories about medical marijuana. the city of san jose trying to keep open a historic theater. they want to restructure a $2 million bailout.

the deal was made back in 2006, but it still can't make payment os the city. so the city council will consider restructuring the loan at the end of the month so the theater doesn't go into default. meantime a beloved bay area grocery train on the verge of going out of business has been saved. andronico. they paid $16 million for the chain of markets. they plan to improve the stores and improve on the brand. andronico has been in business for 82 years. the coast guard wants to investigate a sunk-in second warship. environmentalists worry that this could cause a catastrophic oil spill. the ship torpedoed and sunk in
