we'll sort that all out. first let's check your drive with mike. >> they have just cleared the sane on 680. all activity looks like it has cleared and a smooth drive in both directions across highway 84 and down to the soit bay. we'll track this for the rest of the south bay. >> thank you very much. this morning the search is on for the gunman who opened fire at a family party in the east bay shooting four people, including a 9-year-old girl. today in the bay's christie smith joins us live from pittsburgh. i understand the family just moved into the neighborhood. >> reporter: yeah, that's what neighbors are saying. they just moved here a couple of months ago. police are saying they hadn't been called here for any sort of problem before. so exactly what the motive for this is unclear. i want to show you what it looks like in front of the home.

then there are holes in the garage. possiblily bullet holes. four people were hit. all of them teenagers. the youngest, though, just 9 years old was hit in the arm. all of them expected to survive. one or two in critical condition this morning. this was around 8:45 last night at a home on the corner of ravine here in pittsburgh. neighbors say the family just moved in. we see some neighbors walking in trying to get a look at this. a lot of them saying they ran back in. the shooters, two of them wore hooted sweatshirts. one had a bandanna on his face.

police saying they probably got away on foot but may have ran to a car. as soon as i hear from pittsburgh police, i'll bring you the latest information they have. back to you in the studio. >> such tragedy. thank you, christie. also this morning san jose police investigating another officer-shoved shooting. it marks the sixth one this year. marla tellez joins us live at police headquarters with more on the alarming trend. they are investigating the sixth officer-involved shooting of the year. just six days apart and both of those turned deadly. yesterday's happened just before noon. police say they responded to the call of the armed man acts suspiciously. when officers approached the man

he did something to prompt one of them to shoot. the suspect died on the scene. one week ago from today, san jose police shot and killed a man they say was armed. this happened near highway 87 and capitol expressway. compare that to all of 2010 when san jose police recorded four. officer jose garcia says departments across the country are experiencing a similar uptick. >> we can't speculate. other than nation wise it seems there are a trend where individuals are more confrontational to officers. >> now when it comes to vims among the people who live in san jose, that's not a good trend either. san jose's homicide rate currently sits at 44 for the year.

that's 13 more than all of last year. we still have two and a half months to go before 2012 comes. now as for yesterday's latest officer-involved shooting that turned deadly. police here say they're going to release more information about the shooting later this afternoon as to what led and what prompted officers to fire their weapons. >> this morning, an east bay man accused of shootsing a police officer and then going on the run will go on trial. andrew was 20 years old when he allegedly shot at two fremont officers as they tried to arrest him on domestic violence charges last year. the bullets hit a 39-year-old officer who survived after several surgeries. he was arrested near the california-new mexico border. he faces attempted murder on a

police officer. this morning a gunman on the loose after a shooting on in-in-out burger. the suspect in the shooting is 20-year-old. police say the man entered the restaurant around 12:30 a.m. and shot the victim right in the chest. investigators say he's a member of a hayward tobacco. the state's largest group of doctors is taking a controversial position on pot. the california medical association is calling for the legalization of marijuana. the medicinal value of marijuana remains unclear. the only way to find out is to legalize it and do more research. the decision is being applauded by medical marijuana advocates. >> i'm 100 bank account confident as the cma is given the opportunity to look more deeply into cannabis, they will

>> just minutes after the start of the race in las vegas, two cars bumped, setting off the rain reaction. within seconds, several car burst into flames. two cars flew into the air, slamming into the cash fence. one of those was dan wheldon. number 77. the two-time champion was air lifted to the hospital. two hours later his fellow racers found out the 33-year-old was dead. >> we're all very sad. i just feel for his family. >> my wish for now is for his family, for his kids. for everyone around him. >> before the race several drivers expressed concern that the track was running too fast. racers reached 225 miles per hour in practice. dan wheldon leaves behind a wife

and two young children. many remember where they were on this day 22 years ago, the day the earthquake struck the san francisco bay area. today marked the 22nd anniversary of the 6.9 magnitude quake. it killed 63 people and toppled buildings and crumbled highways. thousands more were injured. more left homeless. they are holding an open house in remembrance of the quake. there will be a moment at 5:04 this afternoon. that, of course, is the moment the quake hit. this morning martin luther king jr. takes his place alongside lincoln, jefferson and washington. the towering legacy of the civil rights leader immortalized in stone on the the national mall. a 30-foot sculpture shows king emergeg from the stone. president obama and his family joined the king family to actually dedicate the memorial yesterday.

earnings ended at 2667. president obama is kicking off a three-day bus tour, trying to rally support for the stalled jobs plan. lawmakers are trying to pass what they can. he has to do so cautiously baa many of his economic team have ties to the financial industry. and stores in berkeley could be closing the doors. the ceo of esprit says they could close all the u.s. stores if it can't find a buyer. it was founded in san francisco in 1958. it lost half the market value in september after reporting the annual profits were nearly wiped out by restructuring charges and admitting the brand had lost its soul. that's really sad. i used to love esprit. i grew up in boston. it was very cool and fresh california. >> that's the key. you said you used to love.

the jeek starts to take a move to the east. that's going to get the low pressure system to the bay area. not expecting significant rainfall. it will really start to increase the onshore flow and make the marine layer much deeper. as a result low clouds, coastal drizzle tuesday and wednesday. temperatures dropping off 10 degrees by tomorrow afternoon. then 15 degrees as we head through your wednesday. temperatures at 77 down from 86 tomorrow. so you'll notice a difference. downright cool and cloudy on wednesday. thursday, friday, saturday it starts to get warmer. a nice, sunny, comfortable afternoon with temperatures where they should be this time of year. mike inouye on the green screen. >> right here reporting for

why anyone would want to shoot into a child's birthday party. we did shoot new video this morning of the garage which appears to have three bullet holes in it at the bottom. two people in hooded sweatshirts walked up to the garage and opened fire. at least 30 people were here celebrating a birthday party. four people were shot. all are expected to survive this morning. but at least two are in critical condition. neighbors heard what they thought was fireworks. >> it feels bad. i've lived here nine years. nothing this big has happened before. it's bad.

police say others tried to cover up the crime scene. officers are not sure if the shooter is still on the loose or if he was killed and hidden. >> a search is on for gunmen that killed two people over the weekend. 3:00 saturday morning on olive street near 81st avenue. he died at highland hpital in oakland. then a 22-year-old fairfield man and a 20-year-old were shot near interstate 580. >> right now, police are searching for the vandal who slashed the tires of nearly an entire neighborhood. they found streets full of cars with tires.

police acting victims to fill out an online crime report on the website. the tires were slashed in the same area one month ago. >> they say no need to worry if you hear a periodic extremely loud noise that sounds like a jet engine and a white cloud that may look like an explosion in the south bay. it's just pg&e. the line is off of highway 101. the work starded on friday with crews setting up equipment along the estates neighborhood. the work will continue through october 29th. crews will take out the gas line out of service and then fill it with water and then reconnect it. big loud booms. don't worry. >> it's just us. it is monday. make sure you got to coffee on.

welcome back, everybody. here's a quick look at top stoirs we're covering this morning. now the search is on for two men who shot four people, including a 9-year-old girl at a birthday party last night. one teenage victim is in critical condition. the others expected to be okay. officers shot a man in the parking lot of an apartment complex in east san jose. police won't say what led up to the shooting or if the man was armed at the time. in san francisco occupy sf protesters clashing with police overnight. the trouble started when protesters told police they would not clear their tents from the herman justice plaza. several people were detained. a san francisco campaign donation rule is proving to be sticky and hard to follow for
