loren. >> my home-ec teacher said the same thing. tried to wake up and get your cake up. i failed that class. good morning to you. our temperatures are nice and mild. 64 in san francisco, and 46 in stan that cruise. not going to climb that much. a lot of fog forecasted for this morning. right now it's not too bad. >> christina, we had a clear view of oakland where we had traffic stopped until two or three minutes ago. we let the traffic go northbound with the taillights past the coliseum through the construction zone. back to the maps, there's also construction on the southbound side you'll see slowing in both

directions. i'll get you a look out there further east coming up. this morning the search is on for a grouped of masked gunmen who robbed a 7-eleven store in the east bay. police think there could be a connection between this robbery and a couple others we've reported in the east bay. good morning. >> reporter: good morning. there have been a string of similar robberies in recent weeks. i walled into the police this morning to find out if they think it's the same group of guys. but what's happening is very similar. this is at the 7-eleven. what they do is they walk past of course cameras and security monitors. overnight on sunday four men in masks rushed into the store. two of them pointed guns at the

clerk. that might not stand out alone, but there have been at least a dozen similar robberies of 24-hour stores and gas station. police told us a robber shot at a guy who was getting gas. a clerk said the men had halloween cash. they took cash, con dops and 7-up, but left out other valuables in plain sight, like a laptop. police are looking for a link with the latest robbery. recently police said several police agencies in the area are working together to try to solve this. i do have calls to police this morning a tried to talk with a gentleman in here to see if he might show us the security tape. i can tell you i saw a security tape from a similar robbery at a

different 7-eleven and these guys are in and out fast. >> yeah, seems like they have a method. accused serial killer back in court today. the 77-year-old deciding to defend himself in the criminal chil. but he asked the judge to allow a paralegal to sit with him. he also wants permission to use his mobile phone in his jail cell to help him out on the case. the san francisco board of supervisors takes a final vote on a law to give money more workers for health care costs. employerscan take back any unused money after a year.

earlier they voted to amend the law until 18 months after the worker left the job. the board will take a final vote tonight. mayor ed lee says he'll veto the board law if the board passes it. overnight san jose's homicide count rose by one after another deadly shooting. this happened in south san jose. it comes just hours before an important news conference at police headkwears to address all the violence. >> sadly i just covers this story yesterday, talking about the rise in suicides as well as the officer-involved shootings. this is the third deadly shooting i've covered in the past week alone. today the police chief will address this duringing trend.

police say an 18-year-old was shot last night. it happened on ross circle. the crime scene tape is gone. police say a 911 call came in last night. when they arrived they found the 18-year-old shot. now police are expected to release more information today about a possible suspect. this brings the homicide rate in san jose to the mid-30s. that's 15 more than all of last year. in the meantime, officer-involved shootings are also up. so far there have been six. three of them deadly compared to four in 2010. police say with budget cuts and layoffs this is a tough time for the department.

>> we have a minimal number of officers from previous years. >> police just released more information about sunday's sixth officer-involved shooting in east san jose. officials say the officer felt threatened by the suspect who was carrying some type of weapon, so the officer fired his weapon. two other officers fired their stun guns instead. the man was pronounced dead at the scene. the department called an 11:00 news conference to talk about the deadly trend. we will bring you the latest at 11:00 and also 5:00 and 6:00. >> today the man who ran into a san francisco building to warn 30 people it was on fire will be

honored. he and another man ran from the 1 it's to 3rd floor knocking on all the doors to get everybody out safely. he will be honored at the board of supervisors meeting later on today. so. the so-called mr. magoo bandit hit again in the bay area. he hit a bay area bank on october 4th but they won't say where he's hit 12 banks throughout california, including one in san francisco and novato. investigators say he traveled long distances in hopes that someone will recognize him at a motel or gas station. he's named the mr. magoo bandit because of the prescription glasses he wears, which i take great offense to, because i i have a pair the biggest coke bottle glasses you've ever seen. >> those aren't even it. i don't bring them to work.

the bell, we turn to brian shactman at cnbc world headquarters. good morning, brian. >> good morning. absolutely. he's a business and cultural icon in the country. in terms of stock futures, they're lower after yesterday's sellout. stocks dropped on disappointing earnings on the likes of wells fargo. ibm reported disapointing numbers last night. profits were up, but not as much as wall street wanted. china's economic also slowed, heightening worries that the world's growth engine is losing -- and fed chairman ben bernanke speaks this afternoon. we have a slew of earnings today. bank of america. goldman sachs was worse than expected. these are all in the last half hour or so.

now back in negative territory for the year. the u.s. government and big banks are working on a plan to make refinancing available. typically in those situations you can't refinance because there's not enough equity in the home. reports say the plan would only apply to loans own bid the bank, bank of america, citigroup, jpmorgan chase, wells far go finally american airlines and the pilot union are making significant progress in talks. shares of american parent amr dropped on monday on disappointment a deal wouldn't reach over the weekend. the issues of wages and work rules have yet to be resolved, but a contract could be struck by tomorrow when america reports its earnings. that's it from cnbc global headquarters back to you. >> thanks, brian. >> earlier you found out you revealed you may have flunked

we could see light showers. what it will do for certain is deepen the marine layer. it will take longer to get out of the fog. it's cult off from the jet stream. the jet stream is pushing east. this will nudge the area of low pressure right in the bay from tomorrow afternoon to tomorrow evening. if you're waking up with us in the coast or the north bay, you have a chance of showers. don't wash your car. 75 at noon in san jose. possiblily until 2:00 p.m. in the city of san francisco. 69 at the coast today. 78 degrees in san jose. then one more cool day before temperatures ramp back up. we're looking at a nice weekend. back to you.

we still do that. just like every day. looking at the construction. these folks have done their work. at los gatos, highway 17. 880 in the northbound direction heading up to 101. that construction crew cleared as well. the southbound side, you may still have some. and the area of concern right there is 280 at 87. we still have a crew. it's been extended until 5:30. maybe longer. we'll watch those reports right now. no major traffic flow through downtown. then a little further north at marsh. again, light volume of traffic past the bridge. a clear view from the peninsula or westbound to 880.

police release today the 911 calls made during a shooting ram middle age last wednesday. the suspect was in custody just five and a half minutes after the first call. for those who heard the gunshots, who saw the killings, those minutes went on forever. it must be so scorery to watch something like that. others are covered inside, hiding in bathrooms.

many of the callers say they think they knew who the shooter was. one of the hair style's hiss is charged in the murder of eight people. now he may face the death penalty. the time is 5:20. the city of concord is getting all set to make it illegal to smoke downtown. the city council will hold a final vote to make smoking illegal within a 17-block radius around the plaza. the plan already has preliminary approval. the law will allow smoking in private areas provided they are not accessible to the general public. police say they will, however, issue warnings before actually citing people. well, adding up the cost of college education may now be as simple as just logging onto your computer. colleges across the country are being told to put a net price calculator on their website. the online calculator asks for

welcome back, everybody. voters will consider taxing medical marijuana businesses next month. if approved it would help a city emerging from bankruptcy. measure c could tax the businesses up to 10% of gross reconvenient and charge $500 a year to do business in valleyo. that's on the planting, harvesting and selling of medical pot. the $500 a year base tax would go under voter approval. it would be determined by city council, which would set a tax rate by adopting an ordnance. kids in san francisco may get a break today. the city supervisors decide to

allow them to ride muni for free. more than 40% of the middle school and high school student use muni to get to class in the morning. the community pass jumped to $21 last summer. if the city approves, the school district and community group district will foot the $600 million a year tab. >> thanks, jon. apple will make big news with another new release. >> this is pure financials. but shock incentives, too. the whisper number is $29 billion in total revenue in three months. that's $21,000 every minute apple makes. now one thing i want to see is can ipad sales top $10 million? we got distracted by the iphone

by one in a deadly shooting. this happened in south san jose. marla tellez has more with what's been happening. >> good morning, jon. we just came from the latest scene. police say an 18-year-old was shot last night in the cul-de-sac on the circle. now the closest major intersection is camden and graham. this morning a crime scene cleaner is scrubbing away the blood from the streets. police got a 911 call of someone shot in the area. he died early this morning. police, though, are not releasing any information just yet about a possible suspect or even what led to the shooting.

we are expected to bring more today. that brings it to the mid-30s. about 15 more than last year. officer-involved shootings are also up on sunday. the department reported the sixth. that's compared to four in 2010. now residents are concerned, requests for neighborhood watch groups has doubled since last year. one isty layoffs. they say the shifts are minimally staffed. today at 11:00, jon, the police chief will hold a news conference to address the disturbing trend when it comes to the rise in violence. >> marla tellez, should be interesting to hear what he has to say. two california senators will speak at a senate hearing today. senators dianne feinstein and barbara boxer will tell a sub committee about the need to strengthen pipeline safety.

the hearing stems for last year's deadly blast in san bruno. both senators will discuss efforts to address the deficiencies and regulation and management of pipeline safety across the country. the senators say too in communities are vulnerable to what happened in san bruno. 5:34 right now. just hours ago the senate passing a pipeline safety bill. the bill will boost the federal government's regulatory enforcement powers. it calls for automatic shut-off valves for newly installed pipes and ends the rigorous safety inspections for older natural gas pipelines installed before 1970. the house approved a bill that would freeze federal pop line regulations. the senate and house will now come together to make a bill that will pass in both houses. >> it is 5:34. the protesters of the bay area occupy movement continue to make their presence known in oakland and san francisco. protesters set up a tent city in the plaza.

and police were trying to move them out because they say they're violating city law. bob redell join us live in san francisco with what's happening out there this morning. >> good morning, that effort on behalf of sfpd to try to move the protesters out of the justin herman plaza seems to have stalled over the past 24 hours because this camp they have set up here has actually grown since yesterday morning. there was a report that police were demanding the protesters to be out at 10:00. well, that never happened. if it did, there was no effort on behalf of police. i talked to an officer this morning. what is the status zm he says status is status quo. he compared this to sunday night, monday overnight.

monday early morning. this was the scene when police had a physical confrontation with the protesters trying to get them to remove. five people were arrested. they were all cited and released. who is lost in the discussion about whether or not they can stay on have to leave justin herman plaza is what the movement overall is about. some want people to take money out of the campaign. >> they believe that this is a good thing that we're doing here right now. but the political details vary. we're doing the right thing in

continuing to talk torks have the engagements. to explore the use of public space. the reaching out to people. the awareness. this has changed my life. i'm sure it's changed everybody else's life here. >> by our estimates there's probably about 100 protester who is are camped out here at justin herman plaza. the reason they came down here is because they can out of space outside the federal reserve building. there's about 40 or 50 protesters camped out there. we're talking to one person. they said the occupy sf people would try to meet with police and/or the city around 1:00, 1:30 to come up with some sort of agreement on where they can stay without being in violation of the code. >> it's the open question forum. no doubt they'll have a lot to

say. >> all the so-called occupy protesters have sweeping the nation and the bay area for weeks. protesting corporate greed and economic inequality. occupy oakland went from calm to chaotic after a week of occupying the area in city hall. yesterday protesters clashed with the news media because they didn't want their tent cities photographed. and adding all the the attention to the cause were the three u.c. berkeley grads freed after being held captive in iran. >> it feels like the city is a part of me. it's a part of my heart. to see this happening, i can't tell you how incredible it feels. >> protesters claiming they represent 99% of the population who say corporate greed is taking jobs and money that should be going to schools. >> it's one of those days. you probably don't need to run the heater or ac.

in terms of your temperature rngs not great when it comes to sunshine. but you're starting mild at 63 degrees. meanwhile i'm forecasting the upper 70s. how does 70 in san jose sound? just about right. you have a mile and a quarter of visibility here. we expect the numbers to really fall after we head through the 7:00 hour. watch out for thick fog. the future cast shows you it will hang around for most of day. the cloud cover will push back a little bit between 2:00 and 5:00. nothing in terms of sunshine like we saw yesterday. coming up in my next report, i'll tell you about the cut off low.

18-year-old father gunned down on a sidewalk. police have not released his name. but the family says it was david, the fur of a 4-month-old baby and recent high school graduate. his body was found saturday on chestnut avenue just minutes before police responded to the gunshot heard. police are trying to determine if he was shot there and dumped on chestnut. >> santa clara county supervisors will vote on a proposal to shape the way it deals with undocumented immigrants. they will insure none are used beyond what is legally required. critics say when local agencies

rich. they will push p for a ballot measure to add a tax on millionaires. the group needs to gather enough signatures before the measure can be placed on the ballot. in 2004 california voters passed prop 63, a similar tax on the rich when millionaires paid a 1% surcharge to fundamental health programs. a bay area city is making the list of the best places to retire. according to u.s. news and world reports, walnut creek is where to go if you're looking for the greenest place to retire. other cities are flag staff, arizona, with the most pleasant year round weather. boone, north carolina. pittsburgh, pennsylvania, for the best mix of affordability and amenities and pittsfield, massachusetts is the best place for single retirees.
