count rose by one after another deadly shooting. this comes just hours before an important news conference at police headquarters to address all the recent violence. marla tellez is live in the police department. she joins us with more. good morning, marla. >> reporter: laura, good morning. it's like deja vu. we just coverd this story yesterday. talking about the rise in homicides as well as officer-involved shootings for the city of san jose. today the police chief for the department will address the duringing trend. last night's shooting involved an 18-year-old who was shot to death. this morning the crime scene tape is gone. but a cleaner was there scrubbing the blood away. police say a 911 call came in

last night. when they arrived they found the 18-year-old shot. police are expected to release more information about a possible suspect and what happened with the shooting. officer involved shootings are also up. so far there have been six. with budget cuts and layoffs, this is a tough time for the departmen department. >> obviously it's a stressful situation for officers. police just released more information. officials say an officer felt threatened by the suspect, who they say was carrying some type

of weapon. two other responding officers fired their stun guns instead. now the department has called an 11:00 news conference to take place here to address the spike in homicides and officer-involved shootings. >> meantime t guy police across california call the mr. magoo bandit is at it again. this time hitting the bay area. but the fbi is not saying where in the bay area. the suspect got his name for the glasses he wears. the investigators think he traveled long distances throughout the state. and they hope someone will reck

tents. contrast that to sunday night. that's when the confrontation between the protesters and the police became somewhat physical. five people were arrested. protesters said the force used was excessive. they plan a call to action this afternoon at 1:30 at city hall. they want to try to come to some sort of understanding and recognition,that they believe, of what was excessive force use. lost in the controversy is what the overall movement is about. what are the protesters trying

we'll check with mike in just a bit. this morning police are searching for a group of bold and dangerous masked gunmen who robbed a 7-eleven store in the east bay. christie smith is live in pleasant hill where police think there could be a possible connection between this robbery and a couple of others in the east bay. good morning, christi. >> good morning, jon. sounds like here we go the again. i have calls in to see if this is linked to the others. four men with masks ran into this 7-eleven past pretty obvious security cameras. this is about 4:30 on sunday morning. very similar to recent robberies in concord, antioch and pleasant hill. in walnut creek just last month a clerk told us that guys in

halloween costumes took over the gas station convenience store. they took cash, condoms and soda but left a laptop sitting out in plain sight. they fired at a customer getting gas. it's scary for people like joe lewis. he works overnight and goes into these stores. >> the way i work it's safety first. you're always looking around and trying to make sure you see things. >> now after the 7-eleven robbery on sunday the suspects ran through the parking lot. but after the walnut creek incident police told us they were all working together to try to solve this. i did see security tape from another 7-eleven robbery. the guys are in and out fast. back to you. >> what an interesting story that is. >> no kidding. you know what is interesting as well is our forecast.

here's where all the traffic is building up through livermore. as well as coming off the dublin interchange. on 680 itself. we have a little bit of slowing because of distraction. you can see it from the speed sensor, it's not a major issue. we have good slowing through antioch. and we end with a shot ot the bay bridge toll plaza. guys, back to you. >> no kidding. really picked up there. san francisco city council could approve free muni rides for kids today. more than 40% of the city's middle and high school students get to use muni, or they use it to get to class in the morning.

60% of them take it home in the afternoon. the price of the pass jumped to $21 last summer. now if the city approved the proposal, the school districts could foot $6 billion a year tab. at the same time, city leaders launching a pilot program to help truant students falling into a life of crime. it targets about 30 ninth graders. the students are getting individual case management at the school. so far it seems to be working. students have gone to class an average of 23% more school days than they did the year before. 6:19. a new poll says more people than ever say marijuana use should be

board of supervisors. bob redell is there live zlchlt still status quo here at jus tin herman plaza. the occupy sf protesters are holding their ground. they've been here over 48 hours now. there was word police gave them another option to leave at 10:00 last night. there was never anything that came of that. there was no interference. an officer i spoke to said the status is status quo. they're trying to get the ears of the board of supervisors and ed lee to stay in the city park. the issue is there's a city code saying you're not allowed to camp out or bring tents to a city park.

sunday night is when the confrontation took place. police are trying to come in, trying to remove it. that's when protesters surrounded the department of public works truck. not letting them leave. slashing the tires. five people were arrested. they were since cited and released. lost in all the controversy is the overall mission of the occupy san francisco movement. what are the protesters trying to accomplish? we did a quick survey. someone mentioned they want campaign finance reform. another person i want end to bank bailouts. another person said subsidies for vegetable farmers. as you can see, there's not just one answer. >> clearly all of us believe that this is a good thing that we're doing here right now. but the political details vary.

we all agree that this is rightful we're doing the right thing in continuing to talk. to have these engagements. to explore the use of public space. reaching out to people. this has changed my life. i'm sure it's changed everybody else's life here. >> >> reporter: these occupy sf protesters moved from the federal reserve building, which is about two blocks that way on market street. that's where they've been permitted to protest for the past month. they broke off and moved here. they said that area is too crowded. you have 40 protesters there. perhaps 100 here. you have 140 in all. a couple of police officers are posted nearby. there's no indication that anything should be happening with regard to protesters any time soon. jon and laura? >> bob redell in san francisco. thanks for the report. it's 6:34. accused serial killer will be back in court to rule on a couple of moegs.

the 77-year-old has decided to defend himself in the criminal trial. but he's asked the judge to allow a paralegal to sit with him at the defense table during the proceedings. he wants permission to use his mobile phone in his cell to help with his case. the judge will rule on those requests today. he's accused of killing four northern california women between 1977 and 1994. san jose police are searching for the gunman who shot a young man to death overnight. it happened just hours before an important news conference at police headquarters to address all the recent violence in the city. marla tellez joins us live from the police department with more. good morning, marla. >> good morning. in the past week alone there have been three deadly shootings in san jose. two of them officer involved. it caught the attention of the police chief.

he'll be holding a news conference later on this morning the shooting last night took the life of an 18-year-old in south san jose. police are not releasing information about a possible suspect or what led to the shooting. the hds rate here now is in the mid 30s. that's 15 more than all of last year. officer-involved shootings are on the rise. sunday the department recorded the sixth officer-involved shooting. that's compared to four in 2010. residents are worried. they are concerned. police say requests for neighborhood watch programs have doubled since last year. >> we need to know who comes in, who leave, anything suspicious.

>> reporter: 56 officers have been laid off. a spokesman for the department says shifts are minimally staffed. san jose was once considered the safest big city in the country. a news conference is set for 11:00 this morning. ask, we'll bring you the latest at 11:00 and also tonight at 5:00 and 10:00. a pair of california senators will testify at a hearing on the need to strengthen oil and gas pipeline safety. senators dianne feinstein and barbara boxer will speak on the disastrous natch ras gas line explosion in san bruno one year ago. they'll discuss the management of pipeline safety across the entire country. they say it's leaving too many communities vulnerable to what happened in san bruno.

the concerns they addressed follow a pipeline safety bill that happened yesterday. it happened after one with strong ties to the tea party changed his mind. they approved a boost to the federal government regulatory power. it called for shut-off involves and ends the redemption of rigorous safety inspections for older natural gas pipelines that were installed before 1970. be bill goes against the grain of a competing house bill to freeze pipeline regulations already in place. >> 6:38. police release 911 calls made during a shooting rampage last wednesday police say the suspect was in custody right after the first call.

the president is pressing lawmakers so take on his job bill while taking on republicans who object it. tracie potts joins us live from washington with more. >> republicans are saying he shouldn't have spent over $2 million on the black armored buses going through west virginia. a high school in virginia, pushing congress to approve $35 billion to save almost 300,000 police, teachers, firefighters and other public jobs. but it's not what the senate wanted to do. part of the jobs bill they already rejected and now. the president is trying to push them to approve it in part. analysts say there's no coincidence here that the president is pushing this in north carolina and virginia. these are battleground states in the upcoming election.

robbed a convenience store in the east bay. recently there was a similar robberies in the area. >> it certainly sounds like here we go again. there are at least four security cameras pointed at you when you walk through the door. but these guys don't seem to care. four of them rushed in with masks on. two of them pulled own guns and confronted the store clerk, who was scared and handed over cash. i have calls to the police to see if this is linked to a dozen other robberies in contra costa county recently. in walnut creek last month. police say they fired at a

customer, who was just getting gas. fortunately he was okay. but the behavior is odd. a clerk says they stole cash and other stuff like sow soda. joe lewis works overnight and shops at these stores. now he says he's going to watch his back. >> i'm always aware. safety first. you're always trying to make sure you see things. >> after the 7-eleven robbery the suspects ran through the parking lot. last month police told us the police across the county were working to try to catch these guys. they wan that to happen before anyone gets hurt. >> no apologies for jim harbaugh. it looked like this

confrontation on sunday. they decided there was no fighting, so there's no fine. both coaches, were told to behave. he went to shake the other coach's hand, slapping him on the back. he took exception to something harbaugh said and chased after him. he say he is will not apologize because apologies can seem like excuses. let's just play some football. about 1 o 0 people gathered in oakland yesterday for a private unannounced memorial. three super bowl trophies and a single helmet.

overnight the homicide count rose by one after another deadly shooting. this one comes just hours before an important news conference at police headquarters to address all of the recent violence. marla tellez joins us live with an update for us. >> this is not the first time the san jose police had to arrest with a recent spike in crime. police say the latest homicide victim is an 18-year-old who was shot to death last night on ross circle. he died at santa clara county medical sent early this morning. police are not releasing any information just yet about a possible suspect or what led to this shooting. the homicide right now sits at 50 more than all of last year.

officer-involved shootings are also up. so far there have been six this year. three of them deadly. that's compared to four in 2010. now police say as a result, requests for neighborhood watch groups have doubled since last year. so it's certainly safe to say that the residents were people who live in san jose. they are concerned. clearly the police chief is as well. again that press conference is scheduled for 11:00 this morning. concord is ready to make it illegal to smoke in the downtown. they will hold a final approval vote today. the law will allow smoking in private areas provided they are not accessible to the general public. police say that will however issue warnings before they start citing people. well, a report about san francisco restaurants making national headlines could be nothing more than a nasty rumor. a story that first surfaced in a
