glistening glorious bay bridge on this wednesday morning, october 19th. this is "today in the bay." good morning to you, thanks so much for joining us. it is 5:00 right now. i'm laura garcia-cannon. >> good morning. i'm jon kelley. let's get the check on the weather. you painted a very nice picture out there of the bay bridge. >> a little crispy out there this morning. we actually have some cities waking up in the low 50s. you'll need the jackets in santa rosa. for the most past, a really nice day today. 73 degrees is the forecasted high, up to 75 through tomorrow, a nice looking weekend ahead as well. changes on the horizon, we have flight delays as well. first we don't want to delay you on the way out the front door.

>> we'll help folks in the north bay, we'll show you how to get around this. about 11:30 last night, a car took a power pole down, minor injuries reported. the closure of lakeville highway. 101 is the alternate through the area. the rest of the north bay is all right. i'll show folks the east bay commute when we come back. the gunman who shot and killed a member of the heloise angels during a funeral, may have been killed by other hell angels. >> investigators are saying they're not sure if the suspect is dead or alive. believe me, they've gone to great lengths to find him. you'll know what i mean in a moment. police believe 38-year-old steve ruiz is the man who shot and killed fellow member steve tausan. the shooting happened saturday

at the funeral of jeff pettigrew. you'll recall pettigrew was the president of the san jose chapter who himself was shot and killed at a novato casino last month. the shooting happened among a crowd of some 3,000. police say because they have reason to believe ruiz is already dead, they've gone as far as getting a judge's order to check pettigrew's grave site. >> we did dig up mr. pettigrew's grave subsequent to a search warrant. we did that based on information that it was possible mr. ruiz was in that hole, and we wanted to verify that he was not in there. >> reporter: and they, in fact, did verify he is not in there. police say this case is proving more difficult than others because so many witnesses are not cooperating, and some have actually destroyed evidence. what's interesting is after the shooting, san jose police did not follow protocol and totally secure the crime scene.

officials say this is because, a, there were thousands of people, as i mentioned about 3,000 people were here at oak hill. and b, respectfully they wanted to allow the memorial services to continue for pettigrew. bottom line is ruiz is still considered the main suspect in this case and rehe mains on the run. police say, jon, they will continue to search for him. >> interesting twist on this one. thank you very much, marla. two overnight shootings in oakland injured three people including a pair of teenagers. the first shooting took place on 2nd avenue just after 9:00 last night. two boys were shot by another teen. they were taken to the hospital and are listed in stable condition. the shooter meantime is still at large. second shooting took place nearly two hours later when a man took himself to a hospital after suffering a gunshot wound at the intersection of sunnymere and seminary avenues. he's listed in stable condition.

5:03 right now. a pair of public meetings will talk about how to restore the bay after the cosco busan oil spill back in 2007. a noon meeting at the state building in oakland and also a 7:00 p.m. meeting in mill valley. both will discuss how money from a recent settlement will be spent for this event. the cosco busan crashed into the bay bridge four years ago spilling 53,000 gallons of ill into the san francisco bay. the company that owned the ship agreed to pay $44 million for the environmental catastrophe. it's 5:04 right now. occupy oakland is entering its second week. the city says protesters have brought more than just angry people to the east bay. there's also rats. here on the plaza. i took a walk around, and there's cooking equipment and the tents go way past the tree you see there, all the way past the steps of city hall. fortunately i haven't seen any rats out here this morning. it is dense when you walk around, the city saying they may have to shut down occupy oakland because of the rats, graffiti, alcohol and illegal drug use. the city saying they know rats were already here. apparently it's worse in recent days because of all the food that's around. this is day ten of occupy oakland in solidarity with all the others going on across the country angry at financial inequality. there's a straw across the grass out here, wooden pallets, kitchen setup. we spoke with russ tillman who has been coming and going for days. he says he doesn't see all these problems. >> the city activity, you have to pay for these things, and i don't know if they're thinking

about potentially trying to push us out. i hope not. if they do that, they have to realize there's a lot of expenses involved in a major police action or something as well. so we want to be peaceful. we want to just be here and work towards our goals of making the country and the world a better place and oakland. and we hope they're on our side. >> just yesterday the occupy oakland movement spread from here, from frank ogawa plaza to snow park near lake merritt. there are several tents out there this morning. folks over there telling us they're in it for the long haul, but the city is saying, really, there are limits to what they can take, and i wanted to mention that there are a couple of protesters who are standing out here on the corner this morning looking for oakland police in case they should come. but we haven't seen them out here this morning. jon and laura, back to you. >> looks pretty quiet for the moment. thank you very much, christie. in santa rosa occupy

protesters taking their case to the city council, wanting the city to pull funds from major financial institutions such as bank of america and wells fargo according to the press democrat. they're asking for permission to camp at city hall and requesting a portable toilet. they've been occupying in shifts since saturday night. occupy protesters in san francisco have cost taxpayers $10,000 in police over time, health inspections and cleanup. protesters have been occupying the streets for almost a month now. they're going to have to start bundling up, just as christina told us yesterday, cooler temperatures in the afternoon hit. i could feel it. >> on the money. >> that cold front, well, what we saw, a little low pressure area did drag this weak cold front through. you know what? the places in the south bay actually felt the impacts more so than those in the north bay and along the normth earn end of the peninsula. so the reason why is we had that little cut-off low pass through.

it dragged a weak cold front through the area this morning, we're seeing thick fog in the areas where high pressure is picking it up from los angeles. thick fog along the coastline of california. flight delays from san diego through burbank. cancellations because of thick fog yesterday. check with your carrier before heading to so cal. areas from the north bay down through san francisco really clear because we have a little bit of wind that's mixing out the fog and really preventing it from getting a clans to gdevelo. your temperatures will stay in the 50s and 60s through about noon today. only up to 66 degrees at noon. in places like concord where traditionally we hit the mid 70s. that cold air will settle in for today. our temperatures will climb back into the 80s, a lot of sunshine for the weekend. it's hump day. we want to get you over that hump. once we get you over the cooler

weather, you'll get one more blast of summer-like weather before next week late in the week. a cold front. let's cheblg the drive with mike inouye. >> we'll take you to antioch where highway 4 will see the slowing. right now that's 64 on the right side of your screen at l. street. we'll watch for that to change dramatically over the next 20 years. construction at love raj, both the off-ramp and on-ramp. that's where some of the congestion starts to build early in your commute. so far 680 and continuing to the dublin interchange. 14-minute drive out of the altamont pass through livermore and heading over towards the castro valley y, a smooth drive for 580 and 238 heading towards the san mateo bridge, a clear flow as well as a clear view across the bridge. overnight chp says there were gusty winds. there you go, guys, back to you.

report was later denied. we get data on consumer pricing and housing reports, earnings from morgan stanley better-than-expected. we're waiting on american airlines. the dow rose 180 points to 11,577, the nasdaq up 42 to 2,657. some 55 million americans will see their first increase in social security benefits in some three years, although the possibility of higher medicare premiums could eat up that extra cash. the increase will probably be about 3.5% and it will first show up in checks this coming january. as for the exact size, that will be determined when the government releases the consumer price index later today which includes annual adjustments for the fiscal year. starbucks going blond. the coffee chain adding a lighter roast to its menu trying to reach a wider range of consumers. the new blond roast is a departure from their typical dark-roasted beans. the company has been criticized

by some who feel their coffee is too dark or too bitter. more than 70% of the premium coffee sold in grocery stores is the light variety. i'm a coffee wimp so this is good for me. >> no, you're not a coffee wimp. but hey, the good news is they say blond coffee has more fun. >> really? >> uh-huh. >> brian is with me. he understands what i'm talking about. >> brian is not the only one with you. i know everything you're talking about. i like it dark, i'm not going to lie. i'm got to chase my coffee. you might need extra coffee if you're waking up in morgan hill where the fog is thick. north of morgan hill, north of san jose, you can see winds out there helping us out. if we lose the winds, the fog is going to creep in and settle in. so we're going to watch those

winds for you. the thickest fog is coming up from southern california, so right on the southern california coastline all the way up to about santa cruz you'll find the thick fog. we're expecting more to develop as we head throughout the morning. it's the winds really preventing that fog from settling in. fairfield right now, a wind gust up to 35 miles per hour. meanwhile sustained breezes at 23 miles per hour. that's a really strong breeze through fairfield right now. that's what's helping you out in that area from the fog settling in. 61 in concord, 60 in livermore, we're expecting a later round of fog. it's going to stick around mostly between nine and noon and it's going to be so thick in spots, we're expecting the fine mist or drizzle. keep that in mind for today, nice and mild on thursday, it will take a couple days for the cool air to mix out. we will hit the 80s saturday and sunday. 83 on monday. things start to change as we head toward the end of next week. cold weather on the way. first mike has a serious situation. what's going on out there? >> big changes over the last

couple minutes in san francisco. a sig alert now and a truck fire reported. from what i understand, the details still coming in, it sounds like a double tanker, one carrying gas is now involved in an accident. the tanker as well as three other vehicles for southbound 101 at market street. that's very much as you're getting off city streets and starting 101 getting out of san francisco. it looks like van ness should be okay if you're heading out of the city. a full closure for southbound 101. and supposedly what would be a big fire and visible from city streets, we'll track that. bob redell is heading to the area. already seeing slowing off the sky way off the bay bridge into the city. we'll continue to follow this. i don't know if our cameras were able to spot that from san bruno. we do see breezy conditions in the area. that might be an issue for winds, they might kick that fire up a little bit. we'll track this as well as folks off the bay bridge. on the oakland side they haven't made any changes because of the light volume of traffic.

you saw the slowdown getting into city streets. 101 closed in a southbound direction at market because of a truck fire. back to you. >> thank you very much san jose police officially closing the book on a double homicide near san jose state. officers say eric otokawa and his girlfriend kristina pandula were shot on october 8th. police think pandula was just a victim of circumstance. they say her boyfriend was selling drugs to ricardo moreno, the man who eventually shot both of them. he was killed by police on october 10th on hillside avenue. they found him after responding report to a man walking in the area with a gun and no clothing. 5:19 right now. even though the summer is over, the fire danger hasn't gone away. starting today crews will be performing controlled burns across 800 acres of the big basin state park. it's slated to last for several days. officials say people shouldn't

worry if they see smoke rising in the area. state and county fire agencies will be taking part in that burn. the family of a man who died after oakland police arrested him will be getting a big payout from the city of oakland. oakland city leaders agreed to pay $1.7 million to the family of jerry amaro iii yesterday. he was arrested on suspicion of trying to buy drugs from undercover officers in east oakland back in 2000. the family's lawsuit claims officers used excessive force breaking five of his ribs and cutting his left lung. about a month later he died of pneumonia caused by fractured ribs. a reward is being put up today for information on the vandals who prematurely released thousands of baby salmon. the fbi joining the investigation on the. nets were cut at a holding area

>> 5:23. >> getting ahead of myself. bank robbery suspect dubbed the magoo bandit is now under arrest this morning. 43-year-old scott james larson surrendered to fbi agents in san diego on monday. he was dubbed the magoo bandit because of his balding head and the thick glasses. remember the old cartoon character? larson is accused of holding um three bay area banks, two l.a. banks and six around san diego. the most recent robbery happened october 8th in ventura county. so far larson is charged with one bank robbery, but he could face additional charges. a couple of big name stars will be in san francisco tonight for the premier of dreamworks new movie. >> you may know my name, but you do not know the legend. >> oh, that voice. antonia banderas and salma hayek

time to get the hump day forecast to get us over. tell us about it. >> you get through wednesday and you're so close to the weekend. we have a really nice weekend shaping up. cool days to get through. today and tomorrow temperatures will be below their seasonal averages. we are expecting pretty thick fog to start to roll in from the south as we head throughout the next couple hours. right now your visibility is still good. we'll let you know when that changes. we've got the seven-day forecast coming up. first mike has more on the tanker fire. what's going on out there? >> sudden changes in your commute. an accident first reported as six cars. now it sounds like three separate cars as well as a big rig tanker. all these flashing lights are just part of the activity because a tanker truck which was reportedly carrying two tankers full of gasoline or at least had some gasoline closed southbound 101. the truck fire sounds like it's still going on south of market on 101. as folks are getting off the bay bridge, this is an issue getting

off the bay bridge westbound into san francisco. they'll be stopped up because 101 which splits off, that's closed forcing folks on to city streets. stay completely clear of the area by hospital curve. avoid the area entirely. use 280 if you can get over there a little to the south and to the east. you see the slowing coming off the sky way and down towards the area. bob redell is heading out. >> we'll have the latest. thanks for the update as well. an east bay elementary school under fire this morning after a fifth grader got a nasty and threatening note. the anonymous note was left on joe griffin's daughter's desk in walnut creek. he says it even included a drawing of his daughter being shot. >> a diagram written, like stick figure with my daughter getting

shot by a gun and then a message underneath that, too, not to tell anybody. >> but she did tell someone. the fifth grader brought the note to her teacher on friday. two school days later other parents were notified, but some parents say school leaders just took too long to respond to this incident. police now investigating it as a terrorist threat which is a felony. in the meantime, griffin's daughter is staying home. it is 5:33 right now. there is mounting evidence this morning that our bay area bridges and overpasses are in bad shape. with bob's signal there breaking up just a little bit. we'll have more on that report as it certainly affects not only bay area bridges but so many overpasses in the area as well. today marks the 20th anniversary of the oakland hills fire. 20 years ago today the fire sparked in the hills of north oakland and southern berkeley. it was a small brush fire not extinguished completely. on october 20th it reignited causing a massive fire that affected more than 3,000 homes and took 25 lives. today the oakland police department and american red cross will acknowledge the anniversary of the fire by hold ag blood drive. you stop by the police department on seventh street between 9:00 a.m. and 3:00 p.m. to donate. it is 5:34 right now. investigators looking for the suspect involved in a deadly shooting at a hell's angels funeral, it may be too late. marla tellez is live with a look at this investigation. good morning, marla.

>> reporter: jon, good morning. they could be too late because the suspect may already be dead. san jose police releasing new extremely bizarre details about the investigation into the shooting death that you're talking about here that happened at oak hill memorial park. now, police believe steve tausan, a local hell's angels member was shot and killed here on saturday by 38-year-old steve ruiz. both were among the crowd of about 3,000 who came to pay their respects to jeff pettigrew. you may recall pettigrew was the president of the san jose hell's angels chapter shot and killed at a no vat dough casino last month. police say they learned there's a chance someone may have already killed ruiz and this is where it gets bizarre. police say they have reason to believe ruiz was buried with pettigrew. they got a search warrant and actually dug up his grave. officials say inside they did not find ruiz. police chief chris morris says

for us today we're talking about a comfortable second half of your day with temperatures in the 70s. kind of a cool day when you consider our seasonal averages for this time of year, we should be at about 80 degrees in san jose and just below 70 degrees in san francisco. today temperatures are going to be cooler than average. we're expecting pretty significant fog later on this morning. yesterday that was the case. we had a late round of fog. today we're expecting the same and expecting the thickest fog down in the santa cruz area. the santa cruz mountains over 17 could become treacherous. we'll watch that for you. the winds are preventing the fog from settling in. that's the good news. if we lose those winds and we are forecasting those winds to calm down over the next couple hours, that's when the fog will settle in. 58 degrees in san mateo, 61 in sunnyvale. futurecast shows by noon today the sun comes out, still dealing with the cool air. we'll show you when it starts to get significantly warmer around here. that forecast is coming up. first, though, mike inouye is

following a serious situation, a really bad place to be jammed up this morning, right, mikey? >> especially right now as the commute is just building. folks are coming in building off the bay bridge. that's where we have this huge accident and fire which, as i understand it, the tanker fire is actually out and that's great news because this is a tanker with two trailers carrying gas. this would be a huge potential for more problems. the fire sounds like it's out. injuries at the scene, still a full closure for 101 between i-80 and cesar chavez itself. all the flashing lights obviously a distraction for folks on the opposite side of the freeway. avoid the entire area if you can. we'll take you back to the maps. this is at 101, van ness, cesar chavez and bay bridge coming to the interchange right there. 280 is clear, but avoid that portion of the city if you can and jump on a little further south. the rest of the commute building for antioch, usual suspects kicking off now. that's a little lighter.

welcome back. a new report on the growth of mental illness in america. tracie potts live in washington with all the details. good morning, tracee. >> samss says almost 20% of our country is dealing with some form of mental illness. that's one in five, and almost one in 20 in most areas dealing with a serious mental illness like schizophrenia. here is the thing that they're concerned about. lots of americans dealing with this, very few americans actually getting treatment, almost 38% which means over 60%

of people who are believed to be mentally ill are not getting any treatment at all. it's a very treatable condition. the danger is untreated it can lead to other physical illnesses as people try to deal with their issues. heart disease, diabetes, obesity. mental illness is the leading cause of disability. in california 19.6% of residents have been affected, 4.3 with a serious mental illness. one of the things, jon, the government is trying to bring out, there are lots of myths about it. it affects children, people of all races and it's not just a personality weakness. it's a real medical condition that they say can be treated. >> tracie potts from d.c., thank you very much. gop candidates rolled the dice during last night's debate in las vegas. they're all lined up and ready to rumble. republicans focused on the big

along the coastline. that means drizzle through half moon bay. take a look at what's happening. we've got that little cut-off low. it passed over us mostly to the northeast overnight. place ms. the northeast portion of the bay area are getting the strongest winds as that system continues to trek to the east. as we head through the day today, the winds will start to calm down es special i vly over the course of the next, in places like san francisco and oakland. today the jet stream carrying that area of low pressure inland. for us we do have a tight pressure gradient. the winds will be a factor at least for one more hour. this isn't going to play anymore. all the way through the weekend we eliminate any rain chances which is great news if you want to make outdoor plans for this weekend. as you know, we're well into fall now. our weather really starts to change. we've got an area of low pressure that will bring more shower activity late next week.

francisco pd and chp. avoid the entire area if you can. 101 south of that interchange is just fine as you're heading towards 280. 280 is a great avenue to get out of the city. getting into the city, not a good alternate coming across the bay bridge. you will start to slow after ninth as you head towards the split at the hospital curve. a smooth drive on the east bay and no major incidents. the south bay starting to show slowdowns. oakland city leaders debating whether or not more money is the answer to its crime problems. crowds packed last night's city council meeting as lawmakers went over a spending plan on measure i. this is a proposal parcel tax designed to raise $60 million over five years to fund public safety programs including the rehiring of some cops. a lot riding with this measure, especially for its biggest supporter mayor jean quan. she made the vote to table a

employees. jobs died october 5th after a long battle with pancreatic cancer. he was just 56 years old. the raiders have a new number one quarterback on their roster this morning, carson palmer, formerly of the bengals already in oakland. he'll start working out with the team. he's signed through 2014 and says he plans to retire a raider. they gave up up a first round pick and will have to surrender a conditional one for the 2013 season if they go on to win a play-off game this year. palmer could be ready, he might start this sunday against kansas city. >> we'll be watching. possible progress in the efforts to get the nba season started. negotiations between players and owners ended just before 3:00 a.m. in new york last night. they'll be back this morning aided by a federal mediator. commissioner david stern says he saw great progress during the talks. if a deal is made soon, the season could start on november 15th. one golden state warrior is making good use of his time.

stephen kur ri has gone back to school. he's at davidson college trying to finish his degree in sociology. he had off-season ankle surgery but says even if his ankle were 100%, he would have gone back. he'll try to work out a deal with his professors to get credit for at least a semester. he's less than a year away for a degree. a great example to kids. >> i love to see that, guys who leave school early to go to the nba go back to finish up. the time is 5:51. rescue workers will be back out in san francisco today trying to save an injured red tail hawk, how he was hurt. plus, there's an app for that. new way to keep track of friends and family participating in the occupy protest. google has a new cell phone code named ice cream sandwich. we'll take aatooatk k herman cain's apples and oranges taxes. delicious news coming up.

welcome back everybody. crews will be back in golden gate park this morning trying to capture a red tailed hawk that was shot in the head with a nail gun. the group wild rescue based in monterey managed to get a shot of the hawk with a nail in his head. somehow it's able to fly, making the bird hard to catch. since hawks are a protected species, there's a $5,000 reward for any information for the jerk that shot this bird in the head with a nail. occupiers now have a new way to get in touch with relatives if they happen to get in trouble with the law. yeah. there's an app for that. the free android app called, i'm getting arrested can notify friends, loved ones and even a lawyer that, hey, i'm going to
