right now on nbc bay area news, a standoff. police believe they have found the hell's angel member suspected of killing a fellow member at a funeral and a case of alleged road rage that has the bay area freeway shutter down right now. also we'll show you why these protestors brought out the big guns to make their point. the news starts now. up good evening. i'm garvin thomas in for diane dwyer. we begin with developing news. eastbound interstate 5880 in san leandro is shut down tonight. investigators are trying to piece together why the driver of a parra transit van allegedly intentionally hit a motorcyclist killing him and dragging his body for miles. nbc bay area's kimberly terry is live in san leandro with the latest. >> reporter: we're hearing that one man is dead.

that man possibly a member of the hell's angels. and one man is in custody. as you said, eastbound 580 remains shut down at this hour as police investigate this fatal accident. we're being told it could take another several hours for it to fully reopen. authorities say they are investigating the incident as a homicide. according to police, the accident involved a motorcyclist and a para transit van. police say when the van hit the motorcycle it got stuck underneath and was dragged about a mile. the man on the motorcycle was also dragged but not nearly as far, and police say he died from his injuries. some reports indicate there may have been some sort of altercation between the motorcycle rider and the driver of the van before the accident. police also say the man on the motorcycle was traveling with other bikes. some of the riders had hell's angels vests on, so police say it is possible the victim may have been a member of the hell's angels himself and are looking into that. as for the para transit driver,

he has been taken into custody. the crash was reported just before 4:00 p.m. again forced the shutdown of all eastbound 580 traffic west of 150th avenue. this is a joint investigation involving the highway patrol, alameda county police and san leandro police. of course this is a developing story and we hope to get more details as the night continues. as we get those details we will pass them along to you. live in san leandro, kimberly terry, nbc bay area news. >> thank you, kimberly. surprisingly our other top story tonight also has a hell's angels connection. it is developing news out of stockton where swat officers have surrounded a home. inside they believe a member is suspecting of killing and shooting a fellow member at a funeral in san jose. our reporter has the latest. >> reporter: the stand off began this morning. it's now in its 13th hour. it's dark right now so you can't really see it, but police and

swat officers still have their attention focused on a two-story house where the suspect is believed to be hiding. swat officers used flash bangs and tear gas to force who they believe is 38-year-old steve ruiz to come outside of a home on mcdougall boulevard in stockton. neighbors told us that earlier in the day they heard the sound of gunfire. >> there's a lot of broken windows. they're doing a lot of shooting and gas and trying to -- just waiting. hopefully talking to the guy and see if he comes out. >> reporter: neighbors gathered at the edge of the crime tape in this unusually quiet neighborhood to watch as swat officers wearing gas maskses with guns down surrounded the home. >> it's pretty scary. we live in a nice, quiet neighborhood. our children were scared. they're like literally in the bedroom. >> reporter: steve ruiz is wanted in connection with the

slaying of a fellow member of the hell's angels, steve tossant gunned down at the local leader funeral one week ago. police found his motorcycle at the funeral and initially thought ruiz may have been killed. they now believe he's injured with two black eyes and could be with his girlfriend, crystal trujillo. and neither the san jose police department north stockton police department have said anything about what's going on here today, only to confirm that there is an apparent connection with the suspect, steve ruiz. we'll try to find some more information and keep you posted. live in stockton, monty francis, nbc bay area news gun right advocates in san leandro brought out the big guns today. literally. dozens of people gathered this afternoon in san leandro near bayfield mall carrying their biggest guns to prove a point. they want a pending state law banning the open carry of pistols repealed. the new law takes effect january

1nd but does not apply to shotguns or rifles. gun owners upset with the law say they plan to start packing heat in public as often as they can. supporters of the law are calling on the display to an invitation to ban long rifles in public as well. >> my government officials have forced me to do. it's not something we wanted to do. i've been openly carrying for years now and never carried a long gun until now. >> i think that guns breed violence. and i think that the more guns there are, the more likelihood that people are going to be killed. and that's whether it's a kid fooling around with their dad's gun or people on the street. >> those charged with violating the law once it goes into effect could face up to a year in prison. the federal crackdown on medical marijuana clinics in california is having its intended effect. 38 clinics in southern california have already closed down. most of them have been evicted

by their landlords. two weeks ago the federal gort sent letters to the dispensaries and their landlords saying they face seizure and prosecution if they didn't close down. while medical marijuana is legal in california it's still a federal offense to sell it or grow it occupy oakland went mobile today. hundreds of people marched from city hall to lake merit and back. the city of oakland issued an eviction notice yesterday to the protesters who set up a tent city in franco gallup plaza. organizers say in spite of today's walk they're not going anywhere. >> we have a lot of support from the community. the city of oakland really supports us. no matter what the police say, they're staying far away. they've been really good so far as deescalating any conversations with them. if they want to come in here and be violent it's going to look bad on them. right now we feel really strong, a lot of support. that's only going to grow in the next days. >> the latest national polls show support for the occupy

movement endidging up to 33%. in san jose police arrested two more occupy protestors early this morning and cited another all for refusing to leave city hall plaza after 11:00 p.m. protestors reset their camp friday after it was cleared by police. the protesters say they have the right to be where they are. >> it's funny. i mean, they keep coming back every night and cleaning us out. we have so many tents that we're just circulating them in and out of their little lockup thing they got over there. so it's going to be -- we're going to be here every day. people are going to get arrested every night. we're going to set back up every morning. >> occupy san jose has been on city hall plaza since october 2nd. in haywood this morning a good samaritan who stopped a car to offer help to another driver paid with her own life. the chp says 20-year-old mallika cade of fremont and another person pulled over on interstate 880 around 2:00 this morning to help the driver of another car that had crashed near the highway 92 interchange.

chairman jeff ranieri is here. jeff, i understand we broke a record or two with the warmth today? >> it got hot enough across parts of the bay area to see some record heat. oakland topped out at 84 degrees, besting the old record of 83 set back in 2008. so hot enough once again to see those records popping across the bay area. we also had some heat down in los gatos. and down on the the coastline. you know you're in a heat event when coast is warmer than inland. 88 in santa cruz, 86 in livermore. 83 in napa. so let's bring in this mild weather outside right now. if you're doing anything over the next three to four hours, maybe a late dinner outside you can go without the jacket. still holding onto low to mid 70s into walnut creek and concord, 77 in oakland. so 74 in san francisco and still holding on strong there, 75 in san jose. so throughout tonight we are

looking at fog-free conditions staying with us. mild and clear for tomorrow and sunny at the beaches. if you didn't make it out there today you still have another day to head out. also still some warm conditions here inland. then as we look ahead we going to be looking at some fire wind developing in our seven-day forecast. no sign at all of any storm activity here close to the bay area at all. what we have building is still high pressure from the south. that's going to continue to warm us up again 10 to 15 degrees above our averages as we head throughout the next 48 hours. so we'll start off clear with numbers in the 80s inland. and then as we head throughout monday once again those fire winds do look to develop out of the north. so for tonight we're going to find fog free conditions. and for tomorrow a clear start. and we may get a little bit of fog building offshore by 6:00 p.m. tomorrow. but all in all another warm and above average day. we're going to start off with low to mid 60s across the east and also for the south bay. and tomorrow our numbers topping out close to 90 degrees.

firestorm ripped through the oakland and berkeley hills. 25 people lost their lives, more than 3500 homes were destroyed. various memorials have been going on throughout the week. and this morning people gathered at the firestorm tower wallow kated at the rock red fire station to reflect and pay tribute to those who died in the fire. following that there was a formal ceremony with city leaders from both oakland and berkeley at the gateway emergency preparedness exhibit center in oakland. many firefighters who battled the deadly blaze attended the ceremony. >> the amount of effort that we put out, all the risks that we took that day. >> an overall theme of the day was to get prepared for a natural disaster like a fire or an earthquake. there was a family preparedness fair in oakland and the berkeley fire department along with alameda county officials hosted a disaster preparedness workshop. now to a crime of almost

unimaginable cruelty. a dog is alive tonight despite being shot by a pellet gun almost 40 times. the dog was found in a park in berkeley just a few blocks from the berkeley animal shelter. nbc bay area's elyce kirchner is at the shelter with daphne the dog. >> reporter: animal control officers discovered daphne here at a local park in september. she was shy and timid. when vets took x-rays of her this week they discovered she'd been shot nearly 40 times. >> this is the skull. this is her head. as you can see, there are two. >> reporter: the vet hold x-rays showing two of the 38 pellets launched into a 1-year-old pit bull named daphne. >> have you ever seen something like that? >> never. >> reporter: she has been working at berkeley's animal care services for ten years. she believes daphne's sisters were also left at the corner of boulevard drive and addison street in berkeley. they were brought into the shelter in march. like daphne they were shot and

their ears were clipped. >> why someone would do that is hard to say. that's pretty severe in animal abuse to shoot an animal 38 times intentionally. >> reporter: she doesn't know who would shoot a dog nearly 40 times and cut off its ears, but believe the pit bulls were bred to fight. >> they're not aggressive like other dogs. so they would in fact be useless to someone who bred them and then realized they don't fight. i'll get rid of them. >> reporter: she says more and more people are getting rid of pit bulls in a down economy because they can't afford them. >> there's no way to save all of them. there's so many right now. >> reporter: she's hoping to save daphne, though, who amazingly survived extreme abuse. >> she's lucky to be alive, yeah. >> reporter: veterinarians removed nine of the pellets in daphne, but she'll need several surgeries to survive in the long ru run. >> do you daphne will be adop. d

sammy's bright smile and boundless energy brings the abbotts the kind of happiness that only parenthood can. >> it's fulfilling and rewarding. i enjoy every minute of it. >> it's the most incredible joy i've ever had in my life. so yes, we were very eager to do it again. >> reporter: theirs was a paper pregnancy. an international adoption that brought sammy from ethiopia, a country with 5 million homeless children, to the bay area. shortly after his arrival four years ago, parents sarah and nick began the process again so sammy would have a brother. >> in the orphanage just surviving. you think about they were told they were so close to coming home and now there's no answer for them. that's just -- to me it seems cruel. >> reporter: their second son johnny should be here by now. but this week the abbotts and dozens of other families received letters from the u.s. citizenship and immigration services, formerly known as ins, saying there wasn't enough evidence to confirm their adoptive children were really

orphans. >> it was a big blow. >> reporter: the abbotts joined a facebook group with nearly 70 families in the same situation. >> obviously there's a lot of fear in the adoption community about these changes. and we're still not really getting answers. and that's frustrating. >> reporter: they say they support thorough investigations because they want ethical adoption of children who are not victims of human trafficking. but the timing puts parents in a legal limbo. the ethiopian government has already declared the abbotts johnny's legal parents. >> it's a major setback. we're disappointed. very disappointed. >> and emotionally our son turns a year next month. in december it will be christmas and he'll have been in the orphanage for a year. it just feels really inconceivable that we still don't have any idea. >> reporter: what's more, the abbotts say the u.s. government told families it would take two months before their cases would be reviewed by investigators in nairobi, kenya, some 700 miles

away from the orphanages in ethiopia. and there was no estimate for how long it would take to complete this additional review. >> why was this investigation not done sooner? >> you know, i can't tell you that. >> reporter: we asked the usdis for its response to these families claims and for a timeline of when these reviews would be completed. >> it could be weeks. it could be months? >> we can't give you a -- i looked into this because i wanted to be able to tell you a certain time. but because every case is just so completely different, we can't really tell you what the time would be for any one person's case. >> reporter: this spokes well says she understands parent's fears but the investigations are necessary. >> it's our obligation to the adoptive parents, to the birth parents if they're still alive and to the child to making material sure that the child qualifies as an orphan before a visa is issued. >> could it be done more efficiently? >> we don't think so. though we're always looking for ways to make things go even more

smoothly. >> reporter: one bright spot for the abbotts and the other waiting families, the you can scis is now sending a team to ethiopia to expedite the review process. it doesn't guarantee johnny will be home in time for his first birth i day next week. but the abbotts say they won't give back and may travel back to africa to spend the holidays with the baby they hope to bring home soon. vickie nguyen, nbc bay area news. the lure of a good deal can be hard to resist. but saving hundreds maybe thousands on a used car could end up costing you much more if you're buying from a curbstoner. don't know what that is? if you're in the market for a used car, you should. >> reporter: deserved or not, used car salesmen generally don't have the best reputation, above perhaps just attorneys and the media.

still, at the very least they are selling their cars legally. bob anderson, however, is spending his saturday going after people who are not. >> we've got the white ford f-150 that we were watching as well as a blue pontiac to the left near the bank. >> reporter: anderson is an investigator with the california department of motor vehicles. and we're along for an undercover sting targeting curbstoners. who are they? well, curbstoning is the repeated unlicensed flipping of cars for profit. it gets its name from where you normally find the cars, parked by the curb with a for sale sign and a phone number. >> the public comes to know these areas as sort of like a little designated used car center. >> reporter: and while you can legally sell your car this way, anderson and his team are going after those selling cars that aren't in their names.

multiple cars. and cars often not safe for the road. like this pontiac. >> obvious signs of damage on the windshield. it appears that air bags deployed on this vehicle. yeah. this is a great indicator of the kind of vehicle that we're trying to protect consumer from buying. >> reporter: and even if you wouldn't consider buying a car this way, you should care that people do. because this unsafe car might end up driving next to you or your family on the freeway. the seller in this case is walking away with multiple citations. but keep in mind curbstoning doesn't always happen by a curb. craigslist and e-bay have become favorite vehicles for less than legal vehicle sales. and you don't have to be a dmv investigator to spot a potential curbstoner. just do this. find a car you like for sale by a private party. say this 1990 nissan 300 zx. then take the phone number and

search that in craigslist. in this case, 16 other listings for used cars pop up. and although they are listed for sale in different cities, each one's picture has the same house in the background. >> we just feel violated and taken advantage of. >> reporter: carolyn parker believed she was burned by a curbstoner via craigslist. she and her husband agreed to pay $23,000 for porsche. less than a week after taking ownership it stopped working. that's when a mechanic told them the bad news. >> it has been in a serious accident. every corner panel on the car have been replaced. all of the vin tags have been removed. every part of the car had been repainted. >> reporter: so where do curbstoners get their cars to sell? well, often from auto auctions meant for legitimate dealers. sometimes, like in parker's case, the cars had been wrecked.

but curbstoners through a few minor cosmetic changs then sell them to unsuspecting customers. >> the lure of a deal too good to be true got the best of us. >> reporter: chuck redden is ceo of auto tech, a company that helps auctions screen out the illegitimate dealer. >> if you have a dealer that does have insurance, does have the proper bond, does have the proper licensing, and he's trying to compete with someone who has none of those things, then they really can't compete. >> reporter: but while they're making it more difficult, some curbstoners do get through, and bad cars do get in the hand of bad dealers. in that case, it's ultimately up to the buyer to not make a bad decision. >> so how do you protect yourself? you can buy a car history report such as a carfax before buying from a private seller. but even that's not a guarantee. carolyn parker says she bought one for her wocar and it came bk

in oakland today bike enthusiasts pedaled their way through jack london square as part of the first annual pedal fest. guests enjoyed performances on pedal-powered sound stage of a bicycle rodeo as well as a parade. organizers say the goal was to celebrate the diverse bike culture in the east bay and get people to experience the benefits of riding every day. >> we encourage people to come here and bike all the time. today we have free bike ballet but we're always looking to bring peddlars and bicycles here because it's so beautiful and such a part of what oakland has to offer. >> the bay area ranks high in bike riding compared to the rest of the nation. 12% of trips made here are made on bicycles. the only place to top that number is new york with 20%.
