74 degrees in san jose today versus just 70 degrees in the city of san francisco. but, hey, if you're just now waking up, likely you have to turn the heater on overnight. we have 36 degrees in some north bay cities, just four degrees above freezing. we'll talk about that red flag warning. lots to go over when it comes to weather an traffic. let's check that with mikey. unfortunately a new accident for 880. the nimitz freeway by our coliseum camera, just north of the 66 avenue exit. the slowdown -- sounds like the fast lane and maybe a middle lane is affected. chp is still arriving on scene. we have yet to get more details. you see the slowdown that's approaching. i'm hearing about another accident that's on the freeway. i'll gather more details for that. that's also in the oakland area. definitely lots hamg in the east bay. one day after being tear-gassed, arrested and dismantled, occupy

oakland regrouping this morning. "today in the bay" christie smith live in oakland at frank ogawa plaza where protesters say they will return later today. >> reporter: good morning to you. at least a dozen protesters are still out here this morning at frank ogawa plaza. they say they want to keep up the pressure about economic inequality and they want the plaza back. police are out here, too, barricades still up out here but overall it's been pretty quiet since we've been here this morning. but i wanted to show you at least one of the signs that is still up from last night at this drugstore. closed. police are saying that one of the things that happened to them is they were hit with paint. there's paint on the door here this morning at 14th and broadway. police are saying that protest rs are getting hit with several colors of paint and chemicals. we have youtube video to show you how the situation deteriorated downtown. police say the number of

protesters reached about a thousand, hours after police raided the occupy oakland camp at frank ogawa plaza arresting about 100 people. protesters say police got too rough with them. police saying they were hit with rocks and paint. one man out here this morning told me he had been camping out for about eight days in the plaza. he was arrested yesterday morning and sent to north county jail in oakland. >> i realized how close i was and just came on down here. i could hear the crowd from yesterday in front of the jail from my cell. >> what time did you get out? >> 10:00. >> 10:00 last night? >> yeah. >> then you joined the protests that were going on at that time? >> yeah, yeah. but the time i got down here they had already started gassing. >> reporter: police haven't said how many people were arrested last night, they're expected to speak with us a little bit later this morning and fill in those details. but at least one protester was

hit with a canister. protesters are saying it was more people that were hurt. the occupy movement against corporate greed and economic inequality continues. protesters are saying they'll keep this up through out the day, standing out here with their banners and whatnot. they say more of them will be here by 6:00 tonight. that's what we have from here reporting live from oakland, christie smith, back to you in san jose. on the other side of the bay there seems to be confusion between occupy san francisco protesters and city leaders. a member of the camp sent out an e-mail saying they expected police to raid their camp between 10:00 last night and 2:00 this morning. four city supervisors offered support of the camp. they say protesters have a right to continue a peaceful assembly. 200 people and 50 tents currently occupy justin herman plaza in san francisco. 6:04. a tragic scene in concord overnight. a bystander is killed during a

police chase. it all started they say over a cell phone violation. today in the bay's bob redell joins us live from concord with an update. >> reporter: good morning, laura. what makes this tragic is that an innocent driver was killed. this driver was coming off the 242 off-ramp on to grant street here in concord. you can see the blue spray paint police have left behind. that's where the accident took place. the driver of a bmw was impacted by a pickup truck. the driver that was flee being police, the impact was so severe that the innocent driver didn't even live long enough for a trip to the hospital, declared dead at the scene. police were able to get the driveer and another passenger of the pickup who tried to leave the scene. they were arrested a short time later. this started, as i said, around dinnertime last night, not too far from him in overville. that's when police noticed the driver of the pickup was talking

on cell phone. they tried to pull them over. instead they fled. there was a short police pursuit and that ended right here at granted street when that driver of the pickup collided with the driver of the bmw killing that driver. there's a pretty good reason we think why the driver of the pickup did flee because after they captured them and after they searched their vehicle, police officers say they did find a gun inside. chp has also joined the investigation at the request of the concord police. they were asked to give an independent perspective. chp told me this morning that's exactly what they're doing. jon, laura? >>. meantime concord police looking into how a woman wound up dead inside a vacant apartment. police found the woman's body around 2:30 yesterday afternoon on glenside court. detectives are investigating her death as a homicide.

if it's the case, it would be concord's sixth homicide this year. at least 300 people in san francisco neighborhood are waking up without power this morning after pg&e had a transformer explode. emergency crews responded to an area near portola drive and market street at about 10:30. a spokesperson says an outage ruz reported about the same time of the explosion. close to 300 homes last power. pg&e says at this time it's not aware of exactly what caused the transformer to explode. 6:07 right now. you may notice pretty chilly out there this morning. a little taste of fall finally. let's check in with christina. >> good morning. it's brisk. it's crisp. this morning you'll need a jacket. low relative humidities out there. still have gusty winds. we'll see our temperatures today just a hint warmer than where we ended up yesterday. the sun is going to have to work harder because we're starting so bitter cold this morning, in

places like santa rosa and novato. the wind has everything to do with how cold it is. take a look at. this you're calm in santa rosa and novato. in fairfield you still have the northerly breeze. this is where you are the coldest, where you have the calm winds. 34 degrees, two degrees above freezing in novato. 38 in santa rosa versus 59 in fairfield where that wind moving everything around is keeping you nice and warm. basically this morning you'll need the jacket. take a look at how much cooler we're running in some cities. 16 degrees cooler than we were at this time yesterday in santa rosa and novato. that's a big drop-off in temperature. it was cold yesterday morning. make sure you have that puffy coat ready to go. but tomorrow morning it's not going to be as cold. staying clear, staying dry. offshore flow will be at its peek today. we'll see the offshore flow decrease just a little bit. thursday not as breezy, as we see the rinds we re lax we'll

see the dry air settle into the bay area. tomorrow will be the driest day in terms of relative humidities. 50 degrees as you make your way out the front door. you'll be at 55 degrees in san francisco. as you make your way home from work, 71, breezy conditions and 70 degrees at the coast. you can see not a lot of separation in terms of our inland temps versus those by the water. that's because of the offshore flow. we'll talk more about that. we've got your halloween forecast ready to go in the seven day in my next report. first let's check your drive. a map of the east bay approach to the bay bridge, no drama. green means go. that's great news. we have two accidents to report for the oakland area. the one i have, the chopper is over us right now. let's get a live look in the port of oakland area, seventh and maritime. pretty dramatic scene when we came upon it. looks like a container truck versus another vehicle. someone was taken from the cab of the truck and being moved over towards the ambulance. that person was moving around.

we could see frost accumulate in that area. you want to take it easy. red flag warning in place through 6:00 a.m. thursday. low relative humidities, gusty winds and warm temperatures. as we head throughout the day today, we'll see the winds pick up at least through about 11:00 a.m. and we'll start to relax a little bit tonight. hasn't been that bad in terms of wind speeds. they continue to come down over the past few hours. this is what we're expecting throughout the day today. 34 right now in novato. just two degrees away from freezing. 46 in napa and 48 in hayward. watch out for the patchy frost at least until about 8:00 a.m. sunrise at 7:30 where we get our coldest temperatures. yesterday you may recall at this time it was chilly. you're 16 degrees cooler in santa rosa. the sun is going to have to work harder to get the temperatures up into the mid 70s. 74 in san jose, versus 70 in san francisco. when we get the offshore flow it negates the marine influence.

it pushes the marine layer out to sea. 72 in fremont, 71 in redwood city. red flag warning in place for elevations above 1,000 feet until 6:00 a.m. tomorrow. offshore flow will strengthen. breezy, on the cool side. but temperatures staying nice and mild and dry all the way through halloween. 72 degrees on monday in san jose, 63 in san francisco. let's check your drive with mikey. pretty pleasant drive right now as you're approaching the bay bridge with the caldecott tunnel, highway 13 and 580, no problems. as we zoom into oakland, we've been talking about the activity continuing for occupy oakland. because of that, closed is 14th street between broadway and clay. that's where christie smith has been reporting all morning. keep that in mind, a lot of folks use that broadway exit to get into town. a live shot past the coliseum shows you still working on the accident northbound side 880

right around high street. the fast lane is blocked as well as it looks like a disabled vehicle has been removed -- no, still one over here on the shoulder. look at all the folks backing up approaching the coliseum. only slow from about 98th up to just past 66. another live look at the bay bridge. the cash lanes, no metering lights and a little lighter than we expect. it is a wednesday. a smath drive down the eastshore freeway. 20 minutes from the carcinas bridge. sensors on our maps for san jose and the area, we're looking at 101 with blips around guadeloupe as well as 85 towards highway 87. typical spots for the early start for the slowdown. >> speaking of the south bay, mike, san jose streets among the worst in the country, and the city actually too broke to repair them. now property owners may be asked to help fix the big pothole problem. "today in the bay's" marla

tellez joins us from san jose with details on the proposed partial tax. it could be a bumpy road for city lieders. >> reporter: laura, good morning. it could be a bumpy road simply because of this. it would require two-thirds approval by voters, and that could be a tough sell. now, i've got to tell you, we're in downtown san jose this morning. the roads here are in pretty good condition. in fact, we spent quite a bit of time driving around all of san jose this morning looking for that, just horrible pothole to show you. you know what? we found more patchwork than we did potholes. still, according to trip, a national transportation research group, 64% of san jose's major roads and highways are in poor condition. that same study says that cost drivers $756 a year. and what researchers call the vehicle operating cost caused by poor road conditions. but a top transportation

official in san jose tells the "mercury news" it's more like 18% of the roads in san jose are in bad shape. he says the current bill to fix city streets could total about $1 billion over the next decade. the city facing yet another deficit year just does not have the money. so at last night's city council meeting, city officials began talking about a parcel tax for homeowners and businesses to upgrade the roads over the next decade. here is the stringer. the tax would cost on average $300 to $400 a year for property owners. city officials say the brunt of the cost could land on businesses. so homeowners would may more like $100 to $200 a year. again, the load block again is getting this approved by voters. it would require about 67% approval by the population, by the voters here in san jose. it's not as if, in fact, this is going to be on next month's ballot, laura.

in fact, the next time they're going to be talking about this issue, city officials will be looking at the issue again is not until march. >> thanks for the update, marla. sticking on the roads, the mtc asking the state panel to add another 290 miles to toll lanes. the bay area's first toll lanes opened a year ago on 680 from pleasant ton to milpitas. the lanes are free to car poolers, but people by themselves have to pay using fast track. critics say the lanes don't help low-income commuters and the money should be spent on public transit. 6:19 right now. coming up, the beating of brian stow expected to play a vital role in the l.a. dodgers bankruptcy hearing. we're going to tell you why. this is a live look at dillon, colorado. they've had crazy weather in denver. on monday it was 80, then snowed

6:24. scott mcgrew says watch shares of tesla this morning. >> we don't normally criticize other pope's reporting. in this case we have the same information another station does, but they came to a completely different conclusion. it's going to affect company stock prices. abc news featured tesla on its "world news tonight" program, speculating the company could face bankruptcy, citing their own reports as evidence. tesla says it won't make money in the foreseeable future as it ramps up production of the model s sedan. the company has been honest showing it isn't making any cash, spending the money it does have on new equipment. won't make money until it starts selling you that four-door. investors in amazon.com fled the stock after the company said it would not make a profit. that's kind of a strange reaction. amazon has been clear it makes lots of money, but it's pooling

westbound 580. that's your commute at harrison as you're approaching the interchange with highway 13 and 980. as they try to remove the cars from the accident, they had to block all lanes and that has been the case for about 20 minutes now. starting to move lanes as i understand it, three lanes are now open. that's up from one. traffic should start to move much smoother soon. 580 is a problem through oakland. i'll give an update on the accident by the coliseum. two big incidents for the oakland area. speaking of oakland, protesters are regrouping in oakland this morning after police raided their occupy oakland camp arresting dozens of people throughout the day and evening. "today in the bay's" christie smith joins us live from oakland this morning where last night officers fired teargas at protesters after police say they tossed a range of items at them including paint and chemicals. what's the latest now? >> i can tell you that frank ogawa plaza here is still off limits. oakland police are out here this morning. some of them still have helmets

on. they've got a barricade up. protesters are out here, too. if that chair is any indication. what they're telling us is that they're in it for the long haul. some of these protesters have been here all night. one told me he just got out of jail last night from the demonstration yesterday and then joined the demonstration that was going on yesterday evening. now, downtown oakland, we have some youtube video of what it was like when police fired at least five teargas canisters into the crowd of hundreds of people. protesters backing the occupy oakland movement. it deteriorated quickly. police say they gave warnings to the crowd to disperse near frank ogawa plaza where there was a tent city that had been broken up early in the morning. those people had been there, hundreds of them since october 10th when the movement was set up. now, police say protesters threw rocks and bottles and paint. here is what one protester told us about why he's staying put.

>> i'm still here. i haven't left. and there's only a few people here, but there's going to be more. it's not about -- the thing about it is, nothing is being done about what occupy stands for. occupy stands for corporations and politicians and government being sold out. >> one woman was hit by a canister, but protesters say that more people were hurt and at least two officers were hurt by paint, as you mentioned, and some chemicals and rocks and bottled lobbed at them according to police. police haven't told us yet exactly how many people were arrested last night. but nearly a hundred were arrested earlier in the morning as police broke up that tent city. protesters are telling us this morning that their goal, the reason that they're here is they want to occupy frank ogawa plaza again. they say they're going to stay put and more of them are coming at 6:00 tonight.

that's we have here in oakland, christie smith, back to you guys in san jose. meantime occupy walnut cream also starting up today. for the third wednesday in a row, protesters will gapther outside the city's b.a.r.t. station at the corner of ignacio valley road. nurses will also be attending the event dubbed main street meets wall street. it plans to occupy the area starting at 4:00 in the afternoon until nightfall. hundreds have attended each of the past gatherings. an innocent person is dead after an overnight police pursuit in concord which started over a clel phone violation. "today in the bay's" bob redell is live in concord with an update. good morning, bob. >> reporter: good morning to you, jon. this driver last night around 6:00 was coming off the off-ramp here of highway 242, was not even involved in the crash when they were struck and killed right here on grant street. you can see the paint markings

that the police have left behind. the crash was so severe that this person doesn't even live long enough for a trip to the hospital. they died here on the scene. this happened around dinnertime before 6:00. a short assistance at over hill road. concord police tried to pull over the driver of a pickup truck who was talking on his cell phone instead of complying. he took off leaving police on a chase that lasted less than a minute. so short that the officer didn't even have enough time to decide whether to call it off. when it ended with this deadly crash, the driver of the pickup and at least one passenger took off on foot but police caught them not too far from here. officers might have a better idea of why this driver refused to pull over inside his pickup. they did find a gun. concord police called on chp to join in on the investigation to give their opinion as to what happened here last night. jon and laura? >> bob redell, thank you very

much. the father of a man accused of killing two people in ft. bragg leading police on a month long manhunt said it might have been prevented if the county enforced laura's law. the father pleaded with them to use the law. it would require counties to require outpatient treatment for mentally ill people who refused help. brass sew's father said his son was mentally ill and had delusions but refused to get treatment. it's 6:35. it will be more than a month before we find out how the woman accused of killing michelle le will play. gisele esteban has been ordered to return to court december 2nd. the judge ruled she couldn't fire her lawyer as requested. the 22-year-old accused of killing le in may of this year. le's body was found in alameda county back in september. it's 6:35 right now.

high alert in the hills. a red flag warning is in effect for the north and east bay hills. in response the national park service has banned camp fires, charcoal grills and smoking at marin county parks. the ban affects point reyes sea shore and golden gate recreational sites. the warning runs through 6:00 a.m. tomorrow morning. red flag conditions happen when strong winds combine with warm temperatures and low humidity. now we're getting the cold temperatures to go with that low humidity and red flag status. christina loren here to explain all. it's the clear, clear start that's making such a cold morning up in the north bay. we have temperatures just a couple degrees away from that freezing mark this morning. what happens is the skies clear out courtesy of offshore flow and all the daytime heat that we accumulated yesterday just rated aets into the atmosphere. it's a cold and clear start in most cities. we do have some patchy fog out there. but it won't last long. by about 9:00 a.m., mostly clear over the entire bay area.

offshore flow is expected to strengthen as we head through the first part of your day. as we head through tonight and into tomorrow morning, the winds will relax a little bit. not as breezy for thursday. definitely the dry air mass settles in and hangs around through thursday and into friday. 38 degrees right now. watch out for patchy frost from santa rosa through novato. 46 in napa and 44 in concord. temperatures running about 17 degrees cooler in some cities than where we were at this time yesterday. you know that's a substantial difference. you adjust the thermostat in your house a little bit, just a couple degrees and you notice a difference. northwest wind at 8 miles per hour is keeping temperatures a little more mild in fairfield. that's where we have the lowest humidity this morning. relative humidity readings at about 20% in fairfield. 50 degrees at 7:00 a.m. as you make your way out the front door. you'll need the jacket today probably until about 10:30, 11:00. at noon about 70 degrees in san jose and then 71 degrees at 5:00

p.m. almost uniform conditions at the coast versus your inland temps to die with the offshore flow firmly in place. coming up if my next report i'll have the seven day outlook, your halloween forecast, a lot to talk about when we come through the next few days. things are going to change eight ll bit. first mike is getting busy right now. how do we look out there? >> we have a couple of accidents for oakland. still following the accident here westbound 580 at harrison street. that's your commute direction, just three lanes are open. there still. we have the cleanup and about five chp vehicles assisting. quite a distraction as you head westbound through oakland just north of the warren freeway, the highway 13 splat. further south, 880 in the commute direction also slowing, but recovering. a live look past the coliseum shows the earlier accidents has cleared to the shoulder. the flashing lights with a slowdown. the volume of course building which will contributed to the slowdown here. the bay bridge toll plaza has a

backup as well. the metering lights are on. the backup and slow crawl from the 880 over crossing, a smooth drive down the eastshore freeway approaching. back to you. it is 6:39. coming up on today in the bay, a lot of san jose streets have some serious problems and have costly repairs that need to take place. the city looking to, guess what, pass the cost on to you. student loans help fuel the occupy wall street protests. now the president is offering help to people dealing with piles and piles of debt. a live report from washington is coming up next. state farm. this is jessica.

'6:46 with a look at that time forecast. >> good morning. kind of dry out there. a little on the breezy side. expecting the breezes to pick up this morning. just as quickly as they pick up, by mid morning into the afternoon, they will start to relax. we'll see offshore flow at its peak today. that means all the cloud cover that usually accumulates right at the coastline, all those low clouds that stack up at the coast, not typical. you'll see the shot of the bay bridge, about ten miles of visibility in the city of san francisco. we had patchy fog earlier. as the sun wafrms us up, we won't see much of that today. offshore flow is the reason why we have this red flag warning in place through 6:00 a.m. tomorrow

morning. low relative humidities, gusty winds and warm temperatures today are going to keep that red flag warning in place for elevations above 1,000 feet until at least 6:00 a.m. thursday. then we'll see a little improvement as we head through probably tonight into tomorrow morning. the winds will relax and we'll see our relative humidities creep back up. this is what we're talking about for today. let's set this in motion for you. your wind speeds this morning aren't that strong. in fact, the strongest breeze i have to support is more than 8 miles sustained in fairfield right now. your temperatures are crystal clear and cold as a result. so clear up in santa rosa, you're at 38 degrees. 37 in novato and 47 degrees in oakland. temperatures running about 16 degrees cooler than just 24 hours ago in many cities across the bay. grab the jacket before you head out the front door. the highs line up in the 70s. even with such a cool start, we'll end up a touch warmer than yesterday. clear coastline again today

"today in the bay's" marla tellez joins us with details of

a proposed tax to help fix the problem. >> reporter: good morning. here is the question for you. if you live in san jose, are you willing to pay as much as $400 a year to pay for better roads? that's essentially the gist of this suggested parcel tax idea. this is what city officials in san jose started brainstorming last night at their city council meeting, a parcel tax for homeowners and businesses to upgrade city streets over the next ten years. on average this tax would cost $300 to $400 a year for property owners. city officials say the brunt of that cost could fall on businesses. so homeowners would be pay are more like $100 to $200 a year. a top transportation official in san jose tells the "mercury news" the current bill to fix city streets could total about $1 billion over the next decade and the city does not have that kind of money considering it's facing another year in the red.

that same city official says 18% of the roads in san jose are in bad shape. but we found a national study that says 64% of san jose's major roads and highways are in poor condition. so quite the discrepancy there. this morning we are live in downtown san jose, if you're familiar with this area, you probably know the roads here are in pretty good condition. but i have to tell you we spent quite a bit of time driving around san jose looking for that severe pothole. we found more patchwork than we did actual potholes. as for that parcel tax, are you going to be voting on this any time soon? the answer is probably not, and that's because, laura, city officials aren't going to be even talking about this topic until march. laura? >> thank you very much, marla. new this morning, this literally just in. minutes ago a london coroner releasing the autopsy results

for amy winehouse. she officially died from alcohol poisoning. a pathologist says she drank a very large amount of alcohol and she was more than five times over the legal drunk driving limit when she died. winehouse died back in july at the age of 27. one day after being tear-gassed, arrested and dismantled, occupy oakland regrouping this morning. "today in the bay's" christie smith live in oakland at frank ogawa plaza where protesters say they will return later today. good morning, christie. >> reporter: good morning to you. in fact, some are here right now. there are about a dozen protesters still out here this morning at frank ogawa plaza. what they're saying is they want to get back into the plaza and occupy it right after police made the raid yesterday. no access, though, police still have metal barriers up around the plaza and city hall. i want to show you youtube video of how the situation

deteriorated last night when there were 1,000 demonstrators released. police fired teargas canisters into the crowd saying protesters threw rocks and bottles and painted them. protesters say it was the police that got rough with them. one protester told them this morning he camped out in oakland for eight days in support of the movement, got arrested. yesterday morning was taken to north county jail, only to get out and protest again. >> i realized how close i was and just came on down here. i could hear the crowd from yesterday in front of the jail from my cell. >> what time did you get out? >> 10:00. >> 10:00 last night? >> yeah. >> then you joined the protests going on at that time? >> yeah, by the time i got down here they already starting gassing. >> reporter: he still has his armband he has on this morning from being arrested yesterday
