was going to be like this. >> mine said frosty the snowman. it's not that cold out there. well, you know, if you're kind of a wuss like me, it is cold out there. that's in the north bay in particular. we have the 30s on the map this morning. 39 in santa rosa. 39 in novato. and it all is because of the clear conditions that we have out there. really, really chally. we'll be warmer this afternoon. >> candy. let's take you to the peninsula where this is a treat. once it gets done. you have construction restricting a number of lanes in either direction. this is going on until 6:30. i'll show you the east bay coming up. >> it's 5:02 right now.

we've heard it all morning long, police ready to move into the occupy san francisco camp. right now it hasn't happened. bob redell is live on the the scene. >> good morning to you. you can hear protesters are still awake. they've been up here all night long. there have been evidence they were going to put on a police raid. by his estimate there were a couple of hundreds police officers there. some in riot gear doing training exercises. then around 2:20 they left in buses and in their vehicles. they crossed the bay bridge. when they got into san francisco they did not head over to justin herman plaza. their location is unknown. there have been rumor here. we have tried to talk to officers on the scene. they will not confirm or deny anything. they tell us they are in the

dark as to what will happen. there have been rumors for the protesters that the raid that was supposed to happen has been called off. but again, that's nothing that has -- can we talk to you real quick? you've been out here all night long. you're hearing that the raid is possibly called off. i'm trying to get a sense of what the mood is like among you and your colleagues. >> a lot of people are leaving kind of early. we had a lot of misinformation. we're not giving up. we want to stay. >> i wonder why you would stay and risk the possibility of arrest or if the police were to use tear gas or anything like that, like we saw in oakland. why risk that? >> it's for the cause. it's for changing the system. a better system. more power to the people. >> thank you very much. thanks for speaking with us. there were many more people out here earlier. i would say 300 to 400.

the city has made it clear they wanted to shut down the overnight camping here at justin herman plaza because it was unsanitary. a lot of people using this as a public restroom. since then a few port-a-pottes. out here. earlier they were out here to show them. i'm going to send it to marla tellez just off the square with that part of the story. >> reporter: good morning, bob. good morning to everybody at home. overnight quickly this has become a political fire squn storm. a hot potato if you will putting current member ed lee against the board of supervisors. as bob mentioned five members of the board of supervisors spent

the early morning hours out here talk thog the hundredses of people really just showing their support for them. you can see as bob was showing you the crowd that from this angle. signs remain up. occupy sf. a living example of a better system. now the five members came out and said they want them to come up with a better solution. allow them to stay. essentially a compromise. they do not want the police to intervene. this is what they told a group of reporters early this morning. >> we think it's important we as a city wrk to develop a protocol while also addressing any health concerns the city may have. >> the reason we're here is we want to make sure there's no violence here tonight. what we saw in oakland is not what we want to have happen in

san francisco. we want to do anything we can to a void a confrontation with the protesters and the police department. this is why we're all here. >> reporter: so far that's been avoided. that was david chu. he is running for mayor. all of them urging mayor ed lee not to have police move in. mayor lee is saying my policy has been straight forward on this. people have been given warning after warning. he says he is expecting that soon police will move in. hat this point the police presence is next to nil. i've seen one police officer drive by right before we went live. the election is just 12 days away. jon? >> march will tellez, reporting in san francisco. thank you, marla. in other news this morning, police are looking for a man who sexually assaulted a woman in a

skyline college classroom. police were called to the campus on tuesday night. a woman says she was in a vacant classroom when a man she didn't know came this and attacked her. he was white. between 25 to 30 yeared old. he had what appeared to be a scar or tattoo on his neck. >> aek oakland roadway will be rededicated no on honor of the four killed in a standoff in 2009. the families of the fallen officers will attend today's ceremony, and a wreath will be laid at the new dedication spot on the bridge. in march of 2009 they tried to pull over this man during a

routine traffic stop. nixon opened fire killing both officers. he then took off and hid in a nearby apartment. other officers returned fire, killing nixon. time is 5:08. san jose's plan to limit the number of medical marijuana disspensryes in the city is expected to go into effect today. city council decided to cut the number down to ten with two in each district. facilities have to grow their own product, which would be potd, on the promise. and meet a list of strict zoning laws and criteria. opponents have circulated a petition trying to get voters to overturn the initiative. there's no word on where that stand stands. >> san jose leaders are stepping up to the plate.

they're ready to sell some prime real estate chblt the plan is to sell five acres of land fire the pavilion to the a's for $7 million. a quarter of what the city paid to buy it. critics say the plan is a public relations gimmick that benefits the team and its owners. the sale is not a done deal yet. major league baseball must still approve the move. >> always an issue to watch. >> we'll see. >> time is 5:09. let's check back with christina loren on the weather. >> hey, guys. it's cold out there. grab your sweater. grab your hand mittens if you someone with sensitive hands when it gets cold. we haven't had temperature this is cold at this time in the morning in quite some time. through the next two hours i'm expected to see a couple of cities hit 34, maybe 32. so we'll cool off before it gets

welcome back, everyone. facebook is moving to the arctic circle. the social networking site says they will put the data center in the swedish city, partly because the cold weather will keep the servers cool. facebook hopes to be a farm will help improve performance for european users. the first facebook server farm outside of the u.s. now for the rest of this news before your bell we turn to jackie live at cnbc headquarters. good morning, jackie. >> good morning to you. futures are up sharply after european reached a deal to stop the debt crisis. this is putting some of the

burden of the losses from the bonds in greece on the european banks. it's also going to expand the size of the rescue fund. this could lift the cloud of uncertainty over the markets. investors were worried a default could trig aerotrain reaction in other countries like italy and asia. this morning we're expected to get data on housing and gdp is expected to show the economy grew a bit faster this summer after a sluggish first half of the year. meantime, the nation's unenforksment rate caused many out of work to borrow from family members and go without necessities. like health insurance. despite the hardships, they remain optimistic they will eventually land another job.

a "new york times" cbs news poll finds more than half believe they'll find long-term employment in the next year and it will be the same or higher salary than the previous job. also we're not hitting the open road as much as we used to. the department of transportation says travel on u.s. roadways is down 1.3% from last year. or down 26 billion vehicle miles. that's the lowest since 2003. the high gas prices likely playing a part. but the weak economy mea have led to a summer trip. >> it's not exactly a winter wonderland. but it's all relative and cold. >> yeah, it is. and those waking up in santa rosa and napa. you have your heater on.

and, of course. we had temperatures in 330 z for the past three hours or so. 44 in livermore now. temperatures running cool. sunrise about 7:30. that's when it's the coldest point of the day. after that the sun warms us up rapidly. it's so clear out there. and the the calm winds making it feel better. 72 in oakland today. 77 in concord, fairfield and livermore. i bumped you up three or four degrees. you'll probably notice a difference inland. and we really see changes in terms of cloud cover and humidity recovery. this area of low pressure finally moves on shore, bumping the big ridge of high pressure situated over the great basin off to the east.

that's going to impact the main part of next week. we're done with the red flag warning at 6:00 a.m. this morning. just 40 minute minuore minutes. we'll be checking for that. your temperatures stay in the 70s inland. san jose is nice and comfortable a lot of people celebrating through tonight, tomorrow and of course sunday night. it's all going get started in san francisco. make sure to bring a jacket with you. temperatures in the 60s. let's check the drive in the city and everywhere else. >> we already busted into the bags of candy. still available at your local store, though. we're looking over here. right there. that expla nation point was a construction zone. 880 southbound between 101 and 280. now the stretch i'm watching for slowing as the crews clear the highway. no slowing just yet. i'll track it carefully for ten minutes. the rest of the south bay is looking nice. the peninsula clear will jump up

to the north bay, where we're looking at 101 southbound. as you look at travel times the cold weather in the north bay. watch the smaller bridges. they ha may get frost over the course of this morning. the san rafeal bridge moves very smoothly. 18-minute drive to the toll plaza. the construction at high street cleared from the onramp to northbound 880. we end with a beautiful view. cameras steady. a clear shot across the peninsula. no delays for 82 or 94. clear crossing over that. the woman at the center of the lawsuit against wal-mart will talk about the revised class action lawsuit against the big box store. if you recall back in june the u.s. supreme court threw out a suit filed on behalf of all female wal-mart employees in california.

saying it was too big and didn't have enough of a common link for all the women. lawyers have now revised the lawsuit and are now refiling it. they claim they were paid less than male counterparts and not promoting them. the six men accused of raping a teenager girl outside a richmond high school homecoming dance could be tried outside of the bay area. lawmakers asked for a change of venue yesterday, saying the high pub llicity could hinder their chance at a fair trial. the judge will rule on the motion next year. all six men pleaded not guilty to charges they brutally attacked a girl. the massive bell stolen from st. mary's cathedral is on its way back home. the arch diocese says it will take them back to the cathedral. it was discovered by a homeless man at an oakland salvage yard.

officers think the 122-year-old bell was stolen for recycling. it's worth $75,000. the thieves would have probably only received a fraction of the amount if they found an actual buyer. m. must have been some very strong thieves. it is 5:21. coming up, the latest update on the injured hawk captured in san francisco this month. we'll have an update on the conditions. >> plus the moves that will make your commute easier if you're willing to pay the> dpr an d> yelp gets a huge victory. the mtc will ask a state panel to add another 2990 miles to toll lanes.

people driving by themselves have to pay to use the fast track. another 266 miles of toll lanes are already approved, but have not yet been built. critics say this lanes don't help low income commuters and the money should be spent on public transit. >> more good news for the red tailed hawk that was found in san francisco with a nail in its cheek. she could be released as early as next week. there's hardly any evidence of the nail that went through the head. the wildlife center of san jose has moved her to a caged outdoor flight area. that will allow her to exercise the muscles in her wings. this is video of the rescue that took place over the weektd. the nail fell out of the hawk's cheek. a $10,000 reward is being offered for anyone with information about the crime.

a huge win for ye will recollect p. it has suffered under accusations that it strong armed small business. >> and you heard the claims, in fact, on our air more than once. those small businesses teaming up for a series of class action lawsuit against yelp. this morning they went down in defeat. this is an enormous victory for yelp taz judge threw out the last of three suits against the company and did so with prejudice. the people suing yelp are not allowed to come back with further suits. they alleged they offered to improve yelp scores if the stores would pay y, lp, which is something yelp denied forever. the "wall street journal's" all things digital blog has gotten ahold of all things confidential survey to show that moral is low and most disturbingly a fifth of all the company's employees would leave for another job if offered. yahoo! is looking for a new ceo.

still have a lane or two in either direction going on for another hour. the offramp there. occupy sf appears to be safe for now. police were planning on raiding the camp, but han hour ago protesters seemed to think police called everything off. bob, a lot has been happening or at least expected to happen ch what's going on right now? >> reporter: they were chanting, playing musical instruments, singing songs. a lot of them have left or gone back to sleep in their tents here. the tents that have been set up

for the past couple of weeks. they said the condition was unsanitary. we awe evidence of at least preparation for a raid. one of our photo journalists happened to be on treasure island overnight. he took this image here of a massive gathering of police. he said he saw some in riot gear that are doing preparation, rehearsal for cloud control. they took off around 2:40 in buses, in their vehicles, across the bay bridge. they did come into san francisco, but they didn't come to justin herman plaza. since then there have been rumors the police were staging. even though we have not gotten anything official from police, the sense is they have called off the raid for one reason or

another. some people were thinking the crowd was too large for police to handle. can i talk to you real quick? i'm with nbc bay area. have you been out here for a while? >> yeah, i've been out here throughout the night. i don't work tomorrow. >> but you did come out here anticipating the police raid, risking arrest if it were to happen, and perhaps other things. why are you so committed? why were you so committed? >> i think they're really trying to send a message here. you know, the president of the united states himself stated a lot of change. no change has really happened. not the way that people expect. >> i imagine there's a lot of relief out here that this raid didn't happen. >> i didn't really feel in danger of the police either. i didn't think it would be a situation like oakland. the department here has a lot more class. i think it's a different

situation. we're not really looking for a violent type of resolve. >> reporter: i appreciate you speaking with us. talking about the clean situation. we did notice a half hour ago a bunch of people were going out here cleaning up the sidewalk. if you look at the sidewalk. it is relatively clean. there is also port-a-potty out here now. we believe those arrived within the last 24 hours. the city was citing unsanitary conditions. namely people using this area as a public restroom. jon? >> bob redell, thank you very much from san francisco. the occupy sf movement is more complicated because of the underlying politics here. mayor ed lee's decision to call in police overnight will be in the spotlight throughout the day. five members of the city board of supervisors were at the the protest early this morning to oppose mayor ed lee' order for a use of force against the protesters. supervisors jane kim, jan avalos and david chu all addressed the crowd.

the state senator was also there. all the speakers announced their support for the protesters and called on mayor ed lee to stop the crackdown. we have put in e-mails to the mayor's office to hear from him about what happened overnight. we'll have his reaction as soon as he and/or his office get back to us. >> in oakland a lot of anger is surrounding tuesday night's protest. youtube video has people very upset. iraqi war veteran scott olson was injured on the ground. as you can see from this video people try to go in and help them. every everyone jumped back very stunned. they managed to get olson out. olson's roommate says he's sedated and in critical

condition. for a look at what is happening today, we turn to christie smith. i understand it's a lot pr quiet this morning. >> reporter: yeah, it is extremely quiet this morning. maybe a dozen protesters out here. and there are two tents out here this morning. a handful of people sleeping on the're side. but i've only seen one oerk land police officer. he didn't get out of his car. he drove right by and took a look at it. yesterday the metal barricades around the plaza came down. protesters ripped down a chain link fence that had been surrounding the park. and i wanted to show you what they did this morning. they made a pyramid shape. one protester told me off camera that he helped make it. he thought it was in his opinion better than the oppressive fence that had been out here. yesterday protesters and their supporters at occupy oakland vowed to reclaim the park after a clash with police earlier this

week where tear gas and projectiles were unleashed to the crowd. police say they were attacked, too. they say the cause just suspect going away. >> this is what people fill in their hearts. this is what people wake up to. they're hurting. people that had food yesterday don't have food because this camp is gone. >> yesterday many of the protesters held a vigil. there are some signs out here this morning for iraq vet scott olson, possiblily struck in the head during a tear gas canister during the clash with police as the crowd around him was trying to help, something else was thrown his way. now the acting police chief is saying that it is under investigation, and he wishes it didn't happen. in his words, the goal is not to cause injury. folks out here talking about that this morning. back here live i have been speaking with the protesters, in

their words there's a media blackout. they didn't want to talk with us on camera. some of the protesters left here and went to support occupy san francisco. just in days that was raided. apparently that's not happening. so they're expecting those people to come back here and help reclaim the park. they're saying that they're staying here. in their opinion they're just not doing anything wrong. as you can see they're doing it anyway. >> christi. they're calling it a media blackout. they're not talking to you on camera. >> they'll talk to you. they don't want to be interviewed one guy said he was hit with tear gas. he was arrested. he had a rough week.

welcome back, everybody. 5:43 right now. in oo new government report confirms it. the rich are getting richer and the the poor and middle class are gaining ground, but not nearly as fast as those up on top. today in the bay's tracie potts is live in washington, d.c. with all the details.

>> good morning, everyone. backing up the numbers we see. back in washington they are crunching the numbers. a couple of reports. the congressional budget office found incomes for the top earners in the country went up 275% compared to 40% from the middle class. only 18% for the lowest income earners. also they found gaps are wide across the country. they broke it down by state. california had the widest income gam between the rich and the poor. and so the bottom line here is that a couple of new government reports seem to be backing up the sentiment that we're seeing spill out on the streets in oakland and other areas around the country that the top 1% in the country seem to be getting richer faster than everyone else. jon? >> tracie potts, thank you very much. if you felt something last

night you were not imagining it. reports of a quake along the hayward fault line in berkeley. a 3.9 magnitude in the same place as the last quake it hit this morning at 5:36. we received calls to the studio. no reports of damages. we will update that for you if anything changes. meantime an earthquake rattled northern california last night. the magnitude 4.7 quake hit in the sierra. that's about 23 miles outside of truckee just before midnight. no major reports of any damage. >> bart's board of directors will talk about new cell phone policies tonight in response to all the the controversy other a decision to shut down cell phone signals in bart stations over the summer. the board has drafted a new policy that would limit cell phone interruptions to the most extraordinary circumstances.

earlier this year bart turned off the cell service during a protest over the fatal shooting of a homeless man. the cell phone interruption sparked a new wave of protest over censorship and freedom of speech. governor jerry brown will unveil his plan to change the retirement system some time today. some highlights include changing benefits by creating a 401(k) style savings plan. while some parts of the plan need voter approval t government hopes to have legislative backing on the rest. labor group are vowing to fight changes to the current retirement system. new information on the earthquake that happened at 5:36 this morning. it's now been downgraded to 3.6.

all the heat from yesterday radiated back to the atmosphere. it's cold out there. plus you're 17 degrees cooler in fairfield. six degrees cooler in napa. four degrees above freezing. that means you might be using the credit card to get the frost off your windshield if you parked outside. 49 in oakland. 48 in hayward. 43 in sunnyvale. calm winds this morning really have a nice relaxation when it comes to the pressure grade yept. nothing above 40 miles per hour. so all in all it wasn't much of a wind event. today will the the driest. 77 degrees in los gatos. today low pressure is returning the onshore flow through friday, pushing the big ridge high pressure that kept us warm and

dry off to the east. for us that means the fog will return. so we're going to get rid of the 30s as of tonight. 75 on friday. 76 in san jose. halloween monday. 73 in san jose. 64 in the city. this time of the year pretty cool. i would also say the bay area is always cool. almost autopsy slowing this time of day. 17-minute travel time from the pass over to the dublin interchange. 205 is slow into livermore. just passing by north livermore avenue. those are the two areas where we're seeing speeds consistently below 40 miles per hour. south bay, all green on this map. the northbound routes all close to the speed limit. i have seen a little shift as the construction crew cleared
