i'm jon kelley. let's go to christina for the hump day forecast. >> we'll have some interesting weather between now and friday. rain showers on the way as we head through early thursday, showers start in the north bay, but this morning we're dealing with very cold and dry conditions. take a look at novato. 37 degrees. you head over the golden gate bridge and hit san francisco and it's 60 degrees. the reason why our temperatures are all over the place is because those dry warming winds. major changes on the way. lots you need to know about. 5:01. first let's check your drive with mike. good morning. a live look at oakland past the coliseum where we've been watching the picture change. now traffic flowing smoother past the coliseum. around fruitvale you may have a traffic break the next ten minutes as they clear construction crews. over on the left street, that's high street and they continue to work for the lane shift that will happen on the 12th. more changes off 880. right now a smooth drive guys.

>> thank you very much, mike. >> we'll check back with you. this morning the east bay bracing for a general strike that could shut down oakland along with a list of other parts of the east bay. christie smith is live where protest rs are set to protest in front of banks and march down to the port of oakland. >> reporter: good morning. normally when we're out here at 5:00 in the morning, most people who are part of this encampment are sleeping. but that's not the case this morning. they are up. they're out here making signs and a lot of new signs out here this morning. cal students have a sign out here urging people to join this general strike. the number of tents out here at frank ogawa plaza, well over 100. we shot some new video of a cafe near the plaza this morning with a sign up saying they won't open today. some businesses support this general strike. others just don't want to deal with the crowds that are expected down here and what may

come. the call today is to leave work or school and demonstrate against banks and other corporations. demonstrations start as early as 9:00, then noon, then 4:00. at the port of oakland. mayor jean kwan says she hopes it puts tissue front and center. the police officer's association saying the mayor sent conflicting messages about this. want to show you other video. this morning the police internal affairs office and recruiting center located at the edge of the plaza completely boarded up this morning. some protest rs are calling on each other to police themselves, but even demonstrators are saying that there are some elements that will agitate. so that's what we have from here, reporting live from oakland, i'll send it back to you in san jose.

>> the story will be progressing throughout the day. christie, we'll check back in with you. as occupy san francisco protesters have the backing of vup voice source. the resolution asks mayor ed lee and the police department to not use force against the protesters. it was approved by a supermajority which means if the mayor chooses to veto it, the board could overturn the veto. police investigating a deadly shooting in the bayview area this morning. police say they were called to fitzgerald avenue and ingalls street and found a man on the sidewalk suffering from multi-al gunshot wounds. he was take tone the hospital and eventually died. no arrest haves been made. anyone with information is asked to call the san francisco police department. it's 5:04 t. antioch man charged in a string of threats against schools in the east bay will make his first court

appearance. 36-year-old larry bentola is set to be arraigned on 14 fell felony counts. he was arrested friday. police say he sent e-mails, letters and faxes to several contra costa county schools and used his former friend's name in threats to tarnish his reputation. the threats caused parents to pull their kids out of school and police to increase patrols on campus. right now fire investigators still trying to figure out exactly what blew the walls literally off a home in richmond. we showed you this video yesterday morning of a tilted home on ohio avenue. fire officials say something was leaking in the home and vapors built up causing the explosion. the trouble is they don't know what the leak was. pg&e checked the gas lines and they say it did not play a part in this. three people were actually in the home at the time. fortunately all are expected to be okay.

>> a lot of damage there. san jose mayor chuck reed wants voters to decide the fate of pot clubs for the city. he wants the remaining clubs to foot the bill for the measure. marla tellez joins us with more on the controversial plans. good morning, marla. >> reporter: good morning. this has become quite the issue here at city hall, turning into a game of tennis, a back-and-forth match between the city and medical marijuana collectives. i wanted to point this out to you, mayor chuck reed sent out this memo yesterday to the rules and open government committee about increasing marijuana -- the marijuana business tax. it was just last week that the medical marijuana regulations approved by the city council were to take effect. now, this meant all but ten of the city's more than 100 pot clinics were to shut down. this was not good news for the pot club owners. on friday the club submitted a petition with more than enough signatures from city voters to suspend the new rules.

almost 49,000 signatures were collected when all they needed was more like 30,000. once the referendum petitions are certified, the council will decide whether to repeal the new regulations all together. or they'll put the issue in the hands of the voters. assuming it ends up on a ballot, mayor reed wants to raise the tax from 7% to 10% to pay for the citywide vote on whether to repeal the pot regulations. reid estimates an election would cost the city more than $1 million. that's money the city does not have as it deals with the deficit for the 11th year in a row. pro points of the pot clinic say a tax hike will end up hurting the patients who use marijuana to ease symptoms of cancer and other illnesses. now bottom line, mayor reed is saying, okay, you know what? you did your job. you went out and got the signatures. you want an election, you have

to pay for it. the city council will take up the issue once again one week from today. laura? >> thank you very much, marla. 5:07 right now. police say a wrong-way driver should consider himself, yes, extremely lucky after getting stuck on caltrain tracks. the man-made a wrong turn near the east meadow drive train crossing about 9:00 last night. lucky for him the on coming train did see him and managed to stop in time. police believe the man, he thought he was turning on to a street, possibly because his gps provided wrong directions. happily he was not injured and was able to later drive off. alameda county has approved a new smoking ban stricter than the existing state law. the new ordinance bans smoking in apartments and prohibits smoking in all indoor workplaces and outdoor public places. that includes sidewalks, outdoor restaurants and parks. during last night's vote, the city council also asked for several revisions including a

ban on smoking inside of condos. san jose now has a new blueprint for what the city will actually look like years down the road. the city council unanimously passing the envision san jose general plan last night. the report spells out the city's vision for what san jose will be like in 2040. the plan aims to prevent the conversion of industrial land for housing. instead, city planners see urban villages springing up that would let neighbors live, work, shop and play all in the very same spot. surfers will be back out at san francisco's ocean beach this morning taking part in the rip curl pro search. this year's competition has a little extra drama after possible shark sightings on day one. a surfer says he left the water in the middle of the competition after seeing a big shark. not everyone agrees. one park ranger says it was more likely a dolphin than a shark.

south. a live look at the golden gate bridge to the north. it shows a very clear view and a clear drive. kind of boring. that's the way we like to see traffic. you're at the limit all the way from highway 12 down to the golden gate bridge. live look at the bay bridge, a few more cars here, but an 18-minute drive from the carcinas bridge to the toll pla plaza. this will build, i promise you. >> now is a chance to get a cup of coffee. quiet right now. it is 5:12. east bay commuters could soon have a new way to travel across the bay to san francisco. the bay area's water transit agency is exploring the idea of using hover crafts to ferry vehicles across the bay. they say hover california is more fuel efficient than standard catamaran ferries and they can travel over shallow waters and can go to hard-to-reach places during an emergency. cities like the plan because they wouldn't have to dredge the bay to build costly documenting facilities. have you ever ridden in one? >> no.

friday roll in, mostly cloudy conditions and showers, timing it out on your futurecast. stopping the clock at 7:00 a.m., you can the first band of rain comes in, intermittent showers all the way throughout your thursday until about midnight friday, getting a pretty good amount of rainfall over the entire bay area. so as we wake up saturday morning, one of the coldest mornings we've had in almost five months, talking about temperatures in the upper 20s in some cities in the north bay. a frost stay start anticipated for saturday. as we head through monday and tuesday, it will be nice. 62 degrees, nice in terms of the clarity that we're going to see. a lot of sunshine, a.m. fog tuesday, 64 degrees. wow, it's a wacky wednesday. what do we have ton roads? >> a minor collision in the studio where i ran into a monitor. we'll pick that up later. no, nothing is broken. we're looking over here to the roadways where we're looking at the south bay and the northbound speed sensors are just fine. much better than in my

navigation through the studio. we want to point out a couple spots. look at the speed sensors. we have a minor disabled vehicle over on the shoulder, 280 at 87. that will be a distraction. out of lanes, so no big deal there. the issue there is 880. we have a construction zone between 101 and 280 itself. we will see temporary traffic breaks as crews clear. watch the alameda off-ramp maybe blocked until 9:00. we'll watch for a slowing there. 880, oakland, where we get a live shot past the coliseum. the construction crew is cleared from 880. high street, the crew remains there. b.a.r.t. system, no delays for this system. no transit agency delays yet. they're warning of possible delays because of the general strike in oakland. keep that in mind for ac transit as well. i think i'll put in the suggestion box, crash helmets and safety belts. we'll check in with bertha

coombs live at cnbc headquarters. fresh off the press, adp, the biggest payroll processor in the country says we saw 110,000 private sector payroll jobs created in october. they actually revised up their numbers for september as well to 116,000. most of those jobs were created in small and medium companies below 500 employees. large firms actually handed out pink slips, although according to challenger, gray and christmas, there were fewer pink slips, down about 63% in october. so that's looking pretty good for the friday jobs numbers. lots to pay attention to for investors today. we have the two-day fed meeting coming to an end. there will be a press conference after today's meeting around 2:15 eastern time. france and germany meeting the greece's prime minister who idea called for a surprise referendum on the really unpopular

austerity measures that are a requirement for greece to get bailout money. still a lot in the air with regard to the greek bailout. the dow started the month off with a near 300-point free fall down to 11,658, having erased nearly half of its gains from october. the nasdaq will start at 2607 after taking down 77 points. qantas this morning says it's going to be compensating passengers affected by the labor dispute that caused its planes to be grounded last weekend. 70,000 people were impacted worldwide. qantas is offering refunds, rebooking and other compensation for expenses passengers have incurred through today. if highways were made of plastic, man, gm would have a surefire hit on its hands. the automaker unveiling a real live concept version of the original hot wheels camaro complete with the metallic paint and over dv sized wheels co-defined by mattel that owns the hot wheels brand.

it is 5:23 right now. a group of stanford law professors created an initiative to limit california's three strikes law. it would reserve the life in prison penalty for only the most violent criminals. third strike offenders make up about 6% of the prison population, but they are responsible for a disproportionate share of the state's massive prison health care costs as they age and they need more medical attention. the proposed ballot initiative is now under state legal review. the u.s. coast guard is issuing a warning to whale watchers this morning. certainly watch from a distance. new photos are emerging of kayakers getting too close to humpbacks in santa cruz. there's also an amateur video of a massi . coast guard says people shouldn't discount a whale's

power. legislation created by supervisor scott weiner got unanimous approval during a board vote yesterday. the proposal prohibits public nudity in heft rauntsz and requires people who are naked to place a towel or some other layer of fabric on a bench or chair before they sit. the board will vote to give the law final approval next week. you're on your own on your own bike. >> words to live by. >> layer of fabric could be pants. >> that's always a novel idea, right? occupy protest rs planning to march on the busy port of oakland later today. we told you about that. why the question? scott mcgrew is here to tell us. >> why the port? the ave. laj long shore man doesn't have a lot in common with the average protester. some dock workers are refusing to work. that is a labor issue that has nothing to do with the occupy movement. why are the occupiers headed to the port? the first reason, it's super busy. blocking the ports is going to

be busy. the second reason may be more strategic. "the l.a. times" points out this morning the port workers have a special clause in their contract that let's them stay away from work but not be considered on strike if they would have to cross community pickett lines. lots of unions honor other unions picket lines. the occupy movement isn't a union. in the long shore men's case, it doesn't matter. members of the international long shore and workers union have a very solid contract overall. the average cargo unloader makes more than $100,000 a year. a long shore man who tracks cargo but doesn't unload it gets higher pay, $120,000 or more, this after renegotiating their contracts back in 2002. salaries on the high end can be in the $150s. nobody has been able to do a census of the occupiers, but chances are they're fairly well off as well. they're railing against the 1%

so bone dry out there. the winds still pumping out of the northeast in some cities. so that red flag warning in place until 9:00 a.m. just as john pointed out, 24 hours away from some pretty significant rainfall and cold ather moving into the bay area. a lot to talk about when it comes to your bay area forecast. first let's check your drive with mike inouye. >> we'll have similarly drastic changes for highway 4 over the next few minutes. christina, we're already seeing a slowdown right around hillcrest, speeds dipping down into the 50s off and on. over here, this is the surprise, pittsburg showing speeds down below 60. this may be a early sign of slowing. we'll track it. it's 5:31 right now. this morning the east bay is getting ready for a major protest that could cripple the city of oakland. "today in the bay's" christie smith joins us in oakland where the impact of the so-called general strike could force businesses to close down this morning. good morning. >> reporter: good morning to you, laura. for so early in the morning

frank ogawa plaza is buzzing. there's even a truck ability to deliver a pa system. cal students have a sign up here. this could potentially end up being the largest demonstration oakland has seen in years. spoik with a demonstrators this morning who says he was at occupy wall street and is at frank ogawa plaza where police raided tents earlier. now at least 100 of them are back. this general strike is calling on workers and students to basically shut down the city to demonstrate in front of banks and corporations, also march down to the port of oakland today. some cafes and small businesses in downtown oakland have signs up this morning that they just won't open today. we did speak earlier to support this. others saying they're not going to open their doors because they don't want to get caught in the crowds or clashes that may come today. i spoke with a demonstrator who

told me what they're going to try to do a police any people who may be out here to cause trouble. >> whether it's getting in the way or calming people down which is a large part of it is deescalating the situation where people could get very angry because there's a lot of pentd-up anger. that's where a lot of the violence can come from. and so just intervening in those situations and saying, like, you need to calm down and deescalating the situation i think is a very important thing that we can do. >> reporter: we just shot new video this morning outside the police internal affairs office in the recruiting center. the windows are boarded up this morning. this is on the edge of frank ogawa plaza. the police officer's association saying they've been getting mixed messages from mayor kwan. now all the tents back out here this morning. i can tell you the activity is certainly picking up out here this morning.

a lot of folks just anticipating big crowds, very excited about what's going to happen today. when we were out here last week on the morning of that raid, we were by the b.a.r.t. station. one thing they didn't do was roll up the gates to the b.a.r.t. stapgs. i guess they wanted to keep the peace there. bob redell is keeping an eye out there this morning. how does it look? >> reporter: good morning to you, christie. b.a.r.t. is going to be beefing up security at some of its stations. what's interesting is the group no justice no b.a.r.t. was planning a protest from 7:00 -- >> unfortunately, sorry we lost the shot with bob redell. we'll check out later to find out what he has cooking on his report. the general strike could also cause problems for your kids at school. the oakland educator's board has endorsed the occupy oakland general strike and urging members to participate, including taking personal leave or holding teach-ins on the history of general strike. in the meantime, the oakland

school for the arts which is located downtown has canceled classes today. according to the school's website, students will not only miss their normal activities, but the high school exit exam in math which is required for graduation. the occupy protests have created a spin-off in san francisco. some families who lost their homes to banks are now trying to reoccupy them. people in one stretch of the bayview district marched down casada avenue to take back 11 foreclosed homes. organizers say the banks deceived them with high interest loans and refused to help them reduce their payments. homeowners say they intend to say even when the banks try to remove them. more protests are planned in the near future. 5:35. a wildfire burning out of control in napa county destroyed at least one home this morning. the fire broke out around 8:45 last night at soda canyon road. people living in the area have

been evacuated. the power has been shut off. so far the fooir has burned between 50 and 100 acres, right now about 50% contained. no injuries have been reported. investigators say the fire may have been caused by downed power lines. 5:36. changes when it comes to the frafrt. want to check in with meteorologist christina loren. >> we still have the high fire danger out there this morning. this morning national weather service has been prompteded to extend the tread flag warning until 9:00 a.m. because we are so bone dry in places like fairfield. 13% in concord and at 10% in napa where traditionally at that time of the morning we're in the 80% to 90% range. we will start to see the numbers creep back up as we get a stronger onshore flow. that's not going to happen until at least 10:00 a.m. still have the high fire danger in the north bay and east bay hills this morning. 37 in novato, 60 in oakland and

it's actually at the limit from 238 up to the bay bridge toll plaza, just a 15 minute drive. a live look at the golden gate bridge shows a clear drive as well. no problems, highway 12 through novato, and to this golden gate bridge shot. talking about a general strike in oakland that could affect your lines for mass transit. bob redell is out there in downtown october land. bob, do you have any status on b.a.r.t. and some of the effects today? what's going on. >> good morning, mike. as we were saying earlier, no justice no b.a.r.t. this is a protest group protesting the b.a.r.t. police shootings. they decided to do a protest at some of the b.a.r.t. stations from 7:00 to 9:00 this morning to show their solidarity for this planned general strike. then when it came to their attention that by perhaps interfering with b.a.r.t. traffic maybe that wouldn't be a good idea for them because people who are going to be coming down to participate in this general strike would be using b.a.r.t. so they decided to call that off. that's good news if you're trying to get downtown.

what b.a.r.t. is doing for the increased traffic, they are expected increased traffic. they'll be running longer trains. they're talking eight to ten cars. they'll also have increased security at four of the downtown stations including oakland city center b.a.r.t. 19th street, west oak land and lake mary. those being the four main stations that serve downtown oakland area. they're expecting increased traffic on bat. if you're the type of person that wants a seat on the way in or if you want to be in the crowds, b.a.r.t. does have a plan for this. mike? >> we'll take it from here. thank you very much, bob. giving us a very good perspective. the time is 5:39. what barry bonds is now doing to try to help the family of the family of injured giants fan. why that injured hawk may not neat need treatment much longer. the beginning of the end.ta

"today in the bay's" brian mohr joins us with the latest. >> reporter: well, the cain campaign is quite frankly getting a crash course in crisis management right here in the nation's capital. cain wants to be talking about 9-9-9. everyone else wants to talk about the 1990 and his time at the national restaurant association. we're finding out today one of cain's accusers is saying through her attorney that she would like to get a confidentiality agreement lifted so she could set the record straight. another one, according to "the

the prosecution actually rested its case yesterday after dr. conrad murray told the judge he would not testify in his own defense. prosecutors say murray gave jackson the powerful anesthetic propofol. murray's attorneys say jackson gave himself the drug. 5:44 right now. troubled actress lindsay lohan could wind up behind bars today. a judge deciding if lohan will go to jail for violating probation. her probation was revoked after she failed to fulfill community services requirement. she was ordered to complete 16 hours of community service before today's hearing. if the judge finds she's in violation once again, lohan could be sent to jail. >> amazing. 5:44 right now. want to check with forecast with meteorologist christina loren. >> it's dry out there this morning. >> it sure is. >> likely you have some symptoms from that very, very dry air mass as well. my friend matt said he smiled

yesterday and his lip cracked wide open. that means you want to keep the chap stick nice and handy. 59 in oakland. in napa, 61 degrees there, 61 degrees in fairfield versus the 40s, 41 degrees as a matter of fact in novato and 45 in santa rosa. what's happening is you're getting these warm downsloping winds. what happens, they warm as they pump from land to sea. it's a drying effect as we head throughout the day today. we are going to see that change. for now those winds are still coming in very, very strong from fairfield through concord and napa getting the strongest wind speed right now which is why they have only 10% relative humidity. very, very dry. also trying to get ahold of a fire up in napa. resources are spread thin. that red flag warning has been put into effect until 9:00 a.m. you still need to be practicing the best of fire city. 76 in redwood city and 78 in los gatos. a lot of sunshine coming in. things start to change as we

head through tomorrow. this big ridge of high pressure pushing that marine layer way out to sea. low pressure starts to move in. this is a very significant area. very cold area of low pressure to be dropping into the bay area this early in the season. we'll see the fog return tonight. as we head through tomorrow, gusty winds develop. we'll see pretty strong winds, especially through the east bay hills. they'll be out of the northwest as opposed to the northeast. mostly cloudy conditions as we head through tomorrow. we'll time those out. first band of rain between 7:00 and 5:00. we'll get a nice dry break for the second half of your friday. then another round of rain moves in sunday into monday. the good news is we are going to fall back. so we get to sleep in with a little rain coming down on saturday night into sunday. don't forget to change that clock, though. you don't want to arrive to work early. worst idea in the world. >> that's right. do not arrive at work early. let's look to the south bay where traffic is moving smoothly

so you might have to hold off leaving just now. no delays northbound. we have seen right here 101 at guadeloupe parkway a little slowing. over the last ten minutes i've seen speeds dip down into the upper 50s. still an early sign that the volume is starting to increase as you come up past 680. the lower peninsula continues to move smoothly all the way up to palo alto and towards the dumbarton bridge. you can see the speed sensor at 280. east bay times, 242 through concord, 580 and 880 through oakland all at the limit. the volume is picking up. you'll see a good steady flow of cars off the eastshore freeway. still a 19-minute drive off the carcinas bridge to the toll plaza. some people living in san francisco's castro neighborhood may need to adjust their morning routine. the power will go out between 8:00 and 10:00 this morning at

18th and castro streets. another outage is planned for about the same time tomorrow. the electricity is being turned off so pg&e crews can install a new transformer. a red-tailed hawk shot through the head with a nail is expected to be released today. the hawk is recovering in a san jose wildlife center. she was captured ten days ago after somebody reported seeing her with a nail right through her head. that nail did fall out during the capture. her caretakers say she's fully recovered and she's well enough to be released into the wild this morning. the l.a. dodgers' baseball team is up for sale. late last night the dodgers and major league baseball agreed to a court supervised sale of the team. the dodgers filed for chapter 11 bankruptcy protection in june after a dispute between owner frank mccourt and commissioner bud selig. some of the san jose sharks are about to hit shelves of your

for started ag rumor that a big-time earthquake was about to strike berkeley very soon. professor genie stours who chairs the university's department of public administration wrote an apology on monday. stours originally sent an e-mail predicting a magnitude 6.0 quake would hit after a recent swarm of smaller tremors. the e-mail said geologists were consulting the city council on this matter. the e-mail made it all the way to the internet. geologists are not in the business of making predictions. joined no longer, angelina and angelica sabuca will wake up this morning and realize they're separated for the first time in their lives. a team of more than 20 surgeons, physicians and nurses at lucille packard children's hospital spent about nine hours separating and reconstructing the 2-year-old girls who were

extradition. >> assange had been waiting for a court decision in an english mansion. a couple hours ago he found out he will be carted off to sweden to face questioning. it's important to point out it's questioning. assange has not been charged with any crime. he's been accused. he fought expedition, but it may be because he fears sweden will in turn turn him over to united states which accuses him of distributing classified information through his wikileaks website. a new study says many american parents not only know their children are using facebook under the age of 13, they're actively helping them sign up which violates facebook's terms of service. the study is also critical of the american law called the children's online privacy protection act. facebook sets its minimum age to 13 to make sure it doesn't violate that law. the studies author say this hard and fast rule of 13 puts parents in a very awkward sipgs. do you prohibit your kids from
