continuing until now. many other spots we've seen spin outs over the course of the morning. just be careful. slick conditions out there. >> very. be careful. thank you. >> thank you, mike. more and more people inspired by the occupy movement message are stepping up and taking action in their own hands against the big banks. marla tellez with how one south bay businessman is planning to make a statement today. >> good morning. so far we heard quite a bit from the 99%. not a lot from the 1% until now. the owner of me fox and company says he is the 1%. he'll be leading by example. 75-year-old mike fox sr. says he's leaving bank of america. essentially he will pull out his company's money and the funds from his personal account in a show of support for the occupy

movement. here's the thing. we're not talking a few thousand dollars. he is going to yank that out of the corporate banking giant. personally he's transferring several hundred thousands dollars. he tells mercury news he's not sure where he's going to put his money, but it could land in a local bank. this comes just before what is being dubbed bank transfer day. act vests are urging everyone to move to a not for profit movement. me fox is a bempbl distributor. we're back here live. we'll get a look at the

budweiser truck. mr. fox has 150 employees here? annual revenue of $70 million. he says the bank transfer could take about six months and cost him at least $30,000. trying to make an impact here and make a statement. >> it is 5:03. oakland is getting criticism for the handling of the occupy movement. they held a special city council meeting to address concerns. the meeting was heated as protesters council members and oakland mayor gene quan came together. many fear the movement is spiraling out of control and kothss the city time, money and

reputation. they are proposing a solution to help the cause, possiblily allowing the tents to remain in front of city hall. it's unclear if he will get enough council votes to pass the resolution. alameda county sheriffs department says 103 people were arrested during the protests alone. occupy sacramento was seeking a temporary restraining order to stop the city from enforcing the ordnance. they argue it violates their light to a free assembly. another hearing for a preliminary injunction against the city is scheduled for january. a $2,500 reward being offered for help solve an animal cruelty

case. the humane society says a black and white cat was found drowned on wednesday. a 5-found dumbbell was around the neck. they think it was a pet because it was declawed. the humane society is looking through reports of lost cats to try to find the owner. if you have any information about this crime, please call the peninsula humane society. >> that's just horrible. it's 5:50. this morning pgee's new ceo says the company wants to earn back the public's trust. hay plan to spend millions to upgrade the pipeline structure. good morning. >> good morning to you, laura. happy friday. the new chief at pg&e came in and said the bottom line is they have to work on their customer service, improving it.

so customers will say it looks like they're finally turning things around. average customer service just won't do it. pg&e will spend $400 million in two years. the new ceo started in september. he told the mercury news it was clear it wasn't functioning well. they killed eight people last year. the new spending plan will be in addition to the $2.2 billion to be spent on pipeline repairs and ren novations. they will speed up retears to minor leaks and cut the time it takes to start new service to business customers. reporting live in oakland, christie smith. >> thank you. a bay area congresswoman

rapping up her attempt to live on food stamps today. that's for the record is $4.50 per taint. she and several other house democrats taking on the food step challenge to protest potential cuts to food assistance programs. more construction work to replace doyle drive. it could cause trouble for your weekend plans. parts of highway 1 will be closed as work continues to rebuild the drive. crews are recon figuring doyle. this weekend's work will replace highway 1 north of the mcarthur tunnel. construction will shut down the ramp from northbound 1 to northbound 101 from 9:30 tonight to 9:00 this morning. >> the construction can always wreak havoc.

so can the weather when the streets get wet. christina loren here to tell us what's happening there. >> you can go ahead and plan on a rough commute, especially up to the south bay where we are receiving the most moisture now. we had a good batch pass through the city of san francisco, oakland, hayward was just hit. these showers are clearing out quickly. which leads me to a little bit of concern when it comes to frost development in the north bay. now that it's nice and crystal clear and the cold blast is moving in, we could see temperatures fall to the upper 20s. your temperatures dropped off by 10 degrees over the course of the past hour or so. future cast is completely dry over the greater bay area. so later on today you get a mix of sun and clouds. it will be deceptive outside your window.

dry bay area. what you'll also notice is that cloud cover is pushing south. you see we have clearing over the ma rin county coastline. that makes for a very cold start. all that heat radiates in the atmosphere. as you can see we have moderate rain coming down embedded with the green. that will make for a rough commute. give yourself plenty of time. 48 degrees in sunnyvale. 37 in santa rosa. 37 this morning in novato. i'm going to play it safe. we could see spotty activity throughout 10:00, 11:00, 12:00. what happens after that is the cold blast settles in. temperatures only in the 50s. one of the coldest days we've had in quite some time. 58 in san francisco. 61 in oakland. that cold air really starts to

market. and whether the jobs report will help us put together a day of gains. gaining 208 points to start today. the nasdaq added 57 to 26 # 7. the october unemployment due out in 13 minute nous. the senate blocked a $60 billion infrastructure proposal that included highway, rail and armt improvements. the deal of the day is groupon itself. they are trading under the ticker symbol grpn. the company is offering $35 million class a shares at $20 a share. they will get an evaluation of $13 billion or so. i'm wonder how they will

celebrate with deals as well. >> i'll check it out. log on right now. a disturbing pattern of police tleft. that's the allegation. he presented videotape and several people who claimed police wrong doing. many of the people claim police confiscated money and property but never logged it as evidence. one woman says police took $500 from a piggy bank. they claim of police misconduct back in march. officers say thieves are working together to steal bicycles. thefts have spiked with 80 cases reported. police say if you notice anything suspicious, people or cars, you need to report them.

welcome back, everybody. as scott mcglue just reported monthly jobs numbers are out. tracie potts is live in washington to give us an in depth look at the situation. good morning, tracie. >> good morning. it's 9%. ever so slightly less than the month before. that's a net number. the number of private sector jobs created, more than that.

left the number of government jobs that were lost. that net number was 80,000. what was good news is revisions from september. they look at the month before. they say we thought we had this many jobs. we actually had this many. september was better than originally thought. october wuds almost flat in terms of unemployment rate. although we did see more jobs. and we're moving in the right direction so slowly it's not making much difference in the unemployment rate at all. >> well, president obama is wrapping up his g-20 summit.

from the san francisco giants organization is expected to plead guilty. prosecutors say she made wire transfers for bank accounts controlled by the giants to her own personal accounts. she embezzled more than $2 million from the team. she must forfeit half a million dollars along with her 2011 bmw. the charge is getting a much needed day off after a roller coaster win last night. san jose gave up two goals over two minutes. they finally scored with just a few minutes left in the game. waiting for him. no score in overtime. they went into a shootout. getting the only goal. sharks win it 4-3. they play the predators tomorrow night. >> you have to see the game tomorrow night to hear it does
