forecast i would say. >> a couple of hours it was colder. still 34 in gilroy, gilroy south. the frost advisory through 9:00. clouds spilling in. temperatures come up a little bit. upper 30s and 40s around san francisco. notice here on the radar precipitation trying to fall through the clouds and not reaching the ground yet but changes later on today. here's a quick check of the hour by hourhe forecast. towards 2:00, look at that, 7:00, there comes the rain flying on through and then things trend breezy and cool. the temperatures very cool start to the morning. the clouds do interesting things to the numbers. first helping the morning temperatures out of the lower 30s. for the amp, blocking out the sun. highs today mid to upper 50s. we'll let you know how much the temperatures stay down and the forecast. >> i need the down vest. thanks, rob. police in a quiet south bay

city of 40,000 people are investigating the death of a woman who was shot to death outside of an apartment complex. three other women were also injured in the same crime. this happened in morgan hill about 10:30 last night outside the village apartments at cosmo and del monte avenues. morgan hill police chief swing is releasing few details but no one is arrested. there's no information on the identity of the victims but the three women that survive are in the hospital. police looked for suspects and to look for evidence. six blocks were shut down for hours. >> this crime scene is spread out over a large area. we probably have four, five, six city blocks cordoned off. we have officers looking for evidence that might be out here and processing the scene and maintained the integrity so we don't compromise prosecution maybe later on down the road. >> police of santa clara county sheriff's department and highway

patrol assisting police with this investigation. if your to-do list today is the bank, you may notice unusual activity. this is bank transfer day, a national grass roots movement made up of fed-up consumers urging people to close their accounts at major banks. this movement is taking credit for forcing bank of america to reverse the decision to charge customers a $5 debit card fee. now, following the same spirit residents of san francisco's neighborhoods are calling on banks today to help homeowners facing foreclosure. the two neighborhoods with highest number of foreclosures in the city. an alliance plans to speak about their plans today at noon at 4650 mission street right across from chase bank. a war veteran is suffering from a fractured skull after a clash with oakland police at the occupy oakland protest this week. his friends say he wasn't even

protesting. we have video of the melee and this story from cheryl hurt. >> all right! >> reporter: our cameras were rolling when there was an arrest late wednesday night in downtown oakland. >> i'm an iraq war vet. i had two tours in iraq. i had two tours in iraq. one tour in afghanistan. >> reporter: he is recovering from injuries in a highland hospital bed. his family and friends say he was beaten by police. >> i'm upset to me my friend have to go through anything. he served his country. he's -- he is a local business owner, a good person. >> reporter: that's why they are in shock. he is the coowner of a pub. his friends tell us he was walking near the occupy protests when he came face to face with a wall of police. >> he said why are you doing this to an american citizen? >> i don't think any human being deserves to be treated or have

their -- be assaulted by speaking their mind. >> reporter: he isn't the only war veteran making headlines for being hurt in occupy protests. scott olson suffered a fractured skull last tuesday when police clashed with crowds. just last night the police chief expressed sorrow over olson's injury and explained why police had to use force on two separate occasions. >> our officers again were pelted with rocks and bottles, there were fire perimeters around the building making it difficult for us to accomplish our mission. there were three officers that were injured and roughly five demonstrators who were also injured. >> reporter: cheryl hurd, nbc bay area news. >> oakland police department released this statement saying police conducting is an investigation regarding the vet and the circumstances of the arrest on november 3rd. quote, this case asre all reported or alleged incidents of

force is under investigation. anyone with information is asked to contact the major crime section of the oakland police department. occupy oakland is costing the city quite a chunk of change. the price tag not including the last week of protests is $1.2 million. the biggest expense is $700,000 which has been to cover oakland police department salary. also the city paid nearly $29,000 in other staffing costs and then there's $265,000 in so-called hard costs, those are expenses like glass replacement, internet security enhancements and public works, as well. when this driver injured two occupy protesters on wednesday night he was released at the scene on the order of oakland police. that's the word from b. rachltt. after a witness lodged a complaint against the agency and the officers on the scene that night. that driver injured two people. last night b.a.r.t. issued a statement saying the officers were instructed to get personal

information from that driver and then release him which was a move, of course, that angered many protesters. the oakland police department is investigating the accident and the police response. the 99% occupying the plaza and other camp sites across the country say they want the 1% to spread the wealth and they say that they have a lot of ideas about how they could go about doing that but the question is, could any of those ideas work? today in the bay talked with experts in san francisco. >> reporter: the occupy movement is standing up against the growing gaps between the haves and the have nots. >> it's tough economists have been talking about for a long time. but for now, they think they brought it more to the fore. >> reporter: jim wilcox says protests are turning an academic issue in to every day conversation across the country. what if lawmakers took their advice? would americans see more jobs and better education? let's start with taxing the 1%.

wilcox says it's not enough. enstead of tax hikes for everyone would help reduce the deficit and improve services. >> also will provide us with some of the funds that we could use to help maintain the infrastructure and improve our roads, bridges and schools. >> reporter: how about ending the north american free trade agreement? >> it would make for less trade by everybody and we'd all be worse off. >> reporter: he says prosecuting bad bankers will help weed out swindlers but won't improve the economy and he believes banks aren't lending because the economy is recovering slowly. >> it is true at this point they have plenty of funds to lend out but given how weak our economy is, given how soft sales are, given how tough it is for business men these days, they're having a really tough time finding really good borrowers. >> reporter: the income gap occupy protesting won't budge without more jobs. >> we need more people working

to go buy more things and if the administration can get a jobs bill through -- >> reporter: occupy is a sign of the times. today in the bay. >> now that expert says that it takes time to reverse the income in america but a way to be part of a conversation is to vote. one of the best known and perhaps gruffest voices of television journalism is silent. andy rooney known to generations for his wry, humorous essays on "60 minutes" died this morning. five weeks ago he announced he would not be a weekly contributor to the cbs magazine. he died today in a new york hospital from complications of minor surgery. he joined cbs in 1949, spent the last 33 years delivering inquisitive and sometimes cranky segments on "60 minutes." they were called "a few minutes with andy rooney." he asked thousands of questions.

apple after forced out in 1985 and before being brought back in 1996 landmark theaters will show it at -- on 17 screens around the country. locally, you can see it in palo al alto, berkeley and san francisco. this morning, an unlikely story of friends who were inseparable to the day they met to the day one of them died. at an elephant sanctuary, tara is mourning the death of her best friend, a dog named bella. the friendship began when bella wandered on to the grown, met tara and wandered in to the heart of that gentle giant. they loved each other. last week, though, sanctuary workers found bella's body. she was attacked by coyotes. what they do know is tara carried bella's body for a mile.

and now the numbers coming up. clouds moving overhead helps to retain the heat off the ground from the day before and a sea breeze pumping in moisture and more mild temperatures in to san francisco. 49 degrees, 48 in oakland. 37 in gilroy and upper 30s around santa rosa and napa. there's the west wind at 12 moving in to san francisco. some of the headlines this morning, obviously, jacket winter weather, winter coat weather i should say for most of the bay area. afternoon, umbrellas on stand by. especially heading towards the evening and if a cold front passes later on tonight don't be surprised for thunder. we'll talk about that in a second. first, college football. cardinals, that's typical oregon weather. 45 degrees around game time. lunchtime our time, over at spartan stadium, idaho in town. should see rain developing as we go through the afternoon. 50s around game time and cal bears, home game at at&t park today, 56 degrees, cool and

breezy and rain moving in. a few sprinkles out there but the main event still working its way down the coast and like the last system a lot of cold air support. more moisture to work with so as we head toward the evening, seeing a quarter inch of rain for wetter spots and more than that in the foothills. you can see around 2:00 starting to see the rain drop in. heading towards the evening, right across the tri-valley. may hint at a little bit of thunder and then heading in to tonight, notice things trend drier. in the day tomorrow, i think we see a few hilltop showers, drier finish to the weekend and a cold night heading in to sunday. rainfall projections, most places a quarter inch or so, heavier amounts across some of the foothills of the north bay. heading to the sierra, look out for a winter storm warning around 5:00 this afternoon. notice the progression as we get it here at 7:00. this is when the snow machine turns on in the sierra.

way of living that's launched here in the bay area. >> reporter: could the secret to a better life lie here at sea? if n a few years you may be able to live in a small city on the ocean. >> the goal is to create a new frontier where people experiment with new political and social systems. >> reporter: founded in 2008 by milton freedman's grandson has already received more than $2 million in funding to keep the idea afloat. most of that money came from paypal founder peter teal. consider the burning man meets silicon valley. the idea to build cities on cruise ships or platforms that might look like this. the new societies won't just look different but operate differently, too, because they'll be located more than 12 miles out the sea in a zone where most u.s. laws don't apply. >> it's a diversity of societies, societies where everyone gets something much closer to the governments that

they want. >> reporter: as protesters across the nation cry out for change, this may be what they're looking for. >> there's much more interest in this in the last few months than ever before. >> reporter: we talked to supporters of occupy oakland moving. they say this is the wave of change we need. >> you get to escape the things you don't like and create what you want. >> reporter: or will you? >> there's always a top down structure, the captain of the ship. somebody has to make the decision and it might have to be some sort of a corporate structure. rather than a governmental one. and so, how's that really any different than what they're experiencing now? >> reporter: proponents say the new societies won't just offer new governments. they may also become a place where scientists do research without government regulations. and don't forget the business opportunities out at sea where some companies may be able to avoid paying corporate taxes. >> right now plans are in the works for the first business off

san francisco's presidio, you're confronted by history. workers are digging deeper in to the past, peeling awaylayer ey layers. >> we know the original walls were from 1776. >> reporter: beneath concrete and plaster, crews exposed the building's original walls part of a $15 million project aimed at restoring one of san francisco's oldest buildings. with walls constructed of mud and other materials, it takes a specially trained crew from new mexico using old techniques for a modern retro fit. >> even though we had to purchase the bricks, everything else doing to repair it is using the traditional methods used in 1776. >> process is to put a dry pack of mud in here. >> reporter: in some ways you could say adobe expert pat taylor has always been covered by mud.

>> i grew up in an adobe home. >> reporter: he trains other crafts people to restore all adobes, an ancient building technique handed down through generations. >> i always told the guys that we've worked our whole life to get to this point and apply the experiences to here. >> reporter: since founded by the spanish in 1776, the old officer's club is subject to multiple eras of style, the army gave it a victorian look in 1885. then came a spanish colonial makeover. >> last couple of weeks we have been able to take off some of the more modern finishes and uncover the victorian era finishes and then underneath that the adobe finishes. >> reporter: first time since 1885, the old walls are once again seeing light and at least for now most will be restored and recovered. some will remain on display as a glimpse in to a past that allowed progress to take hold. nbc bay area news. we have more ahead for you

wind direction on shore starting to turn more mild in terms of the air around the inner bay. lots of clouds right now but the rain-producing clouds up the coast we suspect they drop in around lunchtime. a frost advisory for areas gilroy south and notice the temperatures in the afternoon. the clouds reflect back a lot of sunshine today, especially in the north bay. talking highs in the mid-50s around santa rosa and upper 50s to 60s and rain starting to pick up later on this afternoon. we have snow levels close to 4,000 feet. again, with this cold system and in the sierra maybe a foot of snow coming down. this is pretty wild for this time of year. we'll show you the details of your complete forecast coming up. >> all right. we're looking forward to those. thanks very much. gun violence shocked morgan hill overnight. police are investigating the killing of a woman and shooting of three other women. 10:30 last night outside of a village apartments at cosmo and

del monte avenues. no one has been arrested. all police are saying right now about the surviving women is that they remain in the hospital. police blocked off six city blocks surrounding the apartment building looking for suspects and for evidence. by the way, gilroy police and santa clara county sheriff's department with the highway patrol assisting morgan hill with the investigation. north of san francisco, three people were shot in the mission district. san francisco police say they were called to 167th and hoff street last night around 11:00 finding three people suffering from several gunshot wounds. those people are now at the highland hospital not releasing their conditions. police are not releasing suspect information but they do say if you know anything you should call it in. another iraq war veteran recovering from injuries following a clash with police. our camera was rolling when he was arrested late wednesday night in downtown oakland.

the friends say he wasn't protesting but was walking near the occupy protests coming face to face with a wall of police. they say that that's when police beat him for no reason. >> told the cops they shouldn't treat people -- why are you doing this to an american citizen? >> i don't think any human being deserves to be treated or be assaulted by speaking their mind. >> he is now recovering from a fractured skull at highland hospital. he was not the only war veteran making headlines for being hurt in occupy protests. scott olson you might remember suffered a fractured skull last tuesday when police clashed with crowds, as well. a grass roots consumer group called for today to be bank tanser if day. the facebook organized group of fed-up consumers urging bank customers to close accounts at major banks in favor of credit unions and community banks. the movement takes credit for the bank of america stopping its plan to charge customers a $5 debit card fee.

following in the same spirit residents of san francisco's two neighborhoods are calling on banks to help homeowners facing foreclosure. members for the alliance for californians for community empowerment plan to speak about the plan at noon today at 4650 mission street which is right across from chase bank. a south bay sheriff's department could be stretched thinner if a peninsula city decides to cut the police department. today millbrae city leaders will let residents weigh in on the proposal to take control of patrolling the city. city leaders aren't sure if it can afford to spend roughly a third of the city's $17 million budget on the police department. the city has already cut about a quarter of its police force over the last decade so right now only 21 officers are on the job. this morning's meeting starts at 9:00 at the community room at 450 poplar avenue in millbrae.

the controversy around solyndra is growing. congress is seeking documents. the white house called the move unprecedented and unnecessary. white house counsel kathy rumler said that the office already turned over 85,000 pages of documents on the solar tech company that laid off 1,100 workers after receiving the federal stimulus money. now more on the death of andy rooney. known to generations for his wry, humorous and sometimes contentious essays on "60 minutes" he died this morning. he announced five weeks ago he was no longer appearing as a weekly contributor. rooney joined cbs back in 1949, but it was his inquisitive and cranky demeanor which became what he was best known for in the 33 years on "60 minutes."

and pretty as a picture. we told you to avoid the golden gate bridge because of construction but you can go on the bay bridge if you want to and see the sight that is are pretty. an update on the conjoined twins of san jose separated in a nine-hour surgery earlier this week. the girls are now breathing on their own. angelina and angelica were separated by a team of more than 20 surgeons and nurses at lucille packer children's hospital on tuesday. the surgery which was reported worldwide went so well that doctors predict the girls will probably not need any future surgeries. angelina and and gel ka have overcome steep odds. about 25% of conjoined twins survive after birth. the doctors expect them to be in the icu for a week and then

another week in the hospital and then home by the end of the month. super cute, too. a south bay marching band about to enjoy a once in a lifetime experience. the marching band is going big time performing in the macy's thanksgiving day parade. the only west coast band playing the big apple. today in the bay spent some time with the musicians gearing up for the moment in the spotlight. >> now on the field for halftime entertainment, the mighty mustang marching band and color guard. >> we're in the zone. >> reporter: in less than three weeks the marching band is playing on a different field. in front of the biggest audience in one of america's biggest parades. the macy's thanksgiving day parade. >> the pressure's on. the pressure's on. we have a lot of work to do but the band's looking good. it's going toward what we want. >> i'm a little nervous but i think really one thing that the band stresses is we are a family

and going out there together and will be something, a family feeling and nervous together. it will be great feeling. >> reporter: it's one of ten high schools across the nation picked the perform and the only marching band from the west coast. they know it's a big deal. >> it's huge. homestead's never had this kind of honor. i'm humbled to have been chosen. >> reporter: for six months they're keeping their eyes on the prize. football games to help them get ready for the thanksgiving number. >> everything we do is kind of a build-up to macy's. including discipline, getting ready. >> reporter: sitting in the stands, cheering them on are their parents, just as excited to go to new york. >> i feel real proud for the school, proud for the kids. i just feel really good they'll be able to get this big chance. >> reporter: preparation, focus, hard work. all of that is about to pay off on the streets of the big apple. >> once in a lifetime. once in a lifetime.

seeing if anyone has the short running shorts. someone way off in the distance. here's the reason why. you can get away with shorts this morning in san francisco, 49 degrees a. sea breeze. the air is more mild. further inland, though, 30s around santa rosa, napa and gilroy the cool spot at 37 degrees. the clouds and sea breeze helping to keep the temperatures from this point onward a little more mild. see the winds out of the west at 12 through san francisco and onshore push reaching fairfield. yes, a chilly start. you want a real coat this morning. none of the light coat stuff will do it because we have 30s and 40s outside. for the afternoon, increasing clouds and those clouds will probably block some of the sun for the afternoon so with a cool start very likely to see highs mostly 50s, rain showing up later and a chance of thunder possibly, too. talk about that in a moment. first the college football games or more games besides lsu and alabama today. we have stanford in oregon. 45 degrees. very oregon-like for oregon

a windowless, cramped shell where they rarely showered. officials with the $15 million mars 500 experiment says they proved that humans can go to the red planet. a shower would be nice, i think. they had champagne, a big trophy, victory speeches, the whole deal but it was a big mistake. on tuesday, surfing legend kelly slater awarded the 11th world championship at the rip curl event in san francisco but yesterday slater discovered that he did not, in fact, clench the title. he added up the points and, whoops, not enough. he did tell surf officials via twitter but has another opportunity to clench the championship winning one more heat today. that's pretty honest of him. that's commendable. i would think confident that he was going to take it anyway. just one day later. still to come, are you a black friday shopper?
