easy work-around, middlefield. i'll give you a look at the east bay with more construction coming up. thank you very much. a morgan hill family is look for justice in court after their 14-year-old daughter is killed in a drive-by shooting. five suspects accused in that killing will be arraigned in court today. a grieving community gathering to remember the girl that lost her live. marla tellez live in morgan hill with an update. good morning. >> reporter: jon and laura, good morning. this is really hitting this community hard here. that is why the city of morgan hill is hosting a community meeting. it's going to be happening right here where we are this morning, the morgan hill community and cultural center. now, according to the flier that went out about this event, this meeting is to address any questions or concerns people may have regarding the drive-by shooting that left a young girl dead. 14-year-old tara romero of

morgan hill was shot and killed in the senseless shooting that happened friday night near cosmo and del monte avenue. romero's father says the teens were simply waiting for a ride home. he says they were sitting innocently outside an apartment complex when gunfire rang out. police say the five suspects are gang members. one was on probation. they range in age from 17 to 23 years old. three are from morgan hill, one from san jose, the other from gilroy. today all five are scheduled to be arraigned in santa clara county superior court at 2:00 this afternoon. romero's father tells nbc bay area he hopes they save the court system some money and the family grief by pleading guilty. meanwhile community members who are shook up over the city's first homicide in more than two years, they are encouraged to attend that meeting, that community meeting. again that, is happening here at the cultural center and community center of morgan hill.

it is from 7:00 to 9:00 tonight. this is -- the address is 17,000 monterey road. this flier also points out child care will be provided for those parents who need it. jon and laura? >> community trying to come together. thank you very much, marla. it's 4:34 right now. the polls are closed and the unofficial results are in for san francisco's mayoral race with 100% precincts reporting. ed lee is leading the group with more than 30%. avalos comes in second and herrera in third. last night ed lee told supporters he is optimistic about the outcome and he says he is ready to lead. >> they want the city to continue the way we've been running it and increasing jobs for everybody. i think san francisco wants us to do four more years. what do you think? >> since the city is using ranked choice voting this year, the race is far from decided. voters can support three candidates on the ballot.

if nobody wins 50% of the votes, the lowest candidate is eliminated and the votes are tallied again. get more election results from around the bay area at nbcbayarea.com. after a very scary night, all is quiet this morning at sky walker ranch in marin county. a chimney fire triggered an emergency response from three fire departments. sky walker ranch is tucked away in nick see i don't, where george lucas started building his dream business in 1978. today it's a retreat for some of the most tam lented film makers in the entire world. the fire started around 5:30 last night in the main house. the ranch's private fire department tried to get the flames under control but had to call in crews for backup. we should point out george lucas does not live at the ranch, but more than 200 of his staff members do work there. it is 4:35 right now. a san francisco woman convicted of trying to scam aid workers in the aftermath of the san bruno

disaster is set to be sentenced today. nisha marie taylor posed as a san bruno resident displaced by last year's deadly gas explosion. prosecutors say she and her boyfriend showed up at the disaster relief center and claimed their possessions had burned in the fire. taylor faces up to two years in prison. we've seen it in several cities. now a prom meant east bai yun versity is getting occupied. students, teachers and community members from across the bay area will meet in berkeley today to establish occupy cal. they're upset over potential fee increases for students and continued cuts in state funding for public education . organizers say they'll set up an encampment on the berkeley campus. it begins with a rally at noon today on sprawl plaza. opd released this video late today. officers used their own cameras

to capture police being pelted with rocks and bottles. >> the public needs to know that police officers in oakland didn't overreact. they were provoked, assaulted, had paint thrown on them. i think the message needs to come out now, the balanced message of what happened. oakland mayor jean quan saying the occupy campment is hurting downtown businesses. protesters say city leaders are playing politics and sending mixed messages. babbling has been put on the back burner at gav lon college while one player is on life support. andrew gains is on a ventilator after he and two other players were injured in two car crashes on highway 101 in millbrae early sunday morning. devontae johnson fractured his lower leg and the driver billy hurd has several broken bones.

welcome back everyone. taking a live look outside, cold morning out there, but pretty light commute so far. it is early at the bay bridge toll plaza this morning. 4:44 right now. a silicon valley giant is about to get a little smaller. really the timing here is ironic. software maker adobe systems will layoff 8% of its workforce. the latest round of lay-offs will eliminate 750 full-time positions primarily right here in the united states and throughout europe. in a statement add to be bee says it's restructuring the service to better align around digital media and marketing. the lay-off seemed so unexpec d unexpected, announcing it expects to report record revenue in the fourth quarter, more than

a billion dollars. the leading republican presidential candidates meet each other for a debate tonight. this one on cnbc. eight candidates will participate in the debate on economic issue at michigan's oakland university. herman cain still fighting off those allegations of sexual harassment that could come up during tonight's debate. italy may be heading down the same financial path as greece now. that could hurt all the world's markets even more. for more on that and other news before the bell, let's turn it to brian shactman live at cnbc world headquarters. a lot of 401(k)s look to be impacted by these moves, right? >> absolutely. listen, the stock market, people have closed their eyes on this. today it looks like a pretty ugly open. futures have turned sharply negative this morning after yesterday's rally. europe once again front and center. investors are worried about italy and its mounting debt.

italy is the world's third largest debtor nation and has a much, much bigger economy than greece. if italy can't get its fiscal house in order, it could drag down the world's global economy. it's the highest since italy joined the european union. stocks were up yesterday as italian prime minister sylvia berlusconi didn't get the majority needed to hold on to the government. he says he's going to step down some time next year. up 101 points in the dow. we'll give all that back and then some. here is maybe a silver lining story, job openings at their highest levels in more than three years which could suggest companies may increase hiring in the coming months. competition is absolutely fierce. the labor department says 4.2 people are vying for each available job. in a healthy economy that ratio is more like 2 to 1. some companies are being cautious about adding workers.

christmas literally going to the dogs. a new survey finds more than half of americans plan to buy a gift for their pets this year. they expect to spend an average of $46 for toys and treats. what else is there? petco and pet smart pulling out all the stops. petco planning a 72-hour black friday blowout. i can't imagine standing in line on black friday for my dog. i love my dog, but i'd rather get the next "modern warfare" game or something. >> say no more. i'm with you on that one. >> hey, who is there for you thick or thin, unconditional love? >> i don't have a dog. >> that's the problem right there. >> we'll be buying you a dog for christmas. bundle up, maybe put the cute sweaters on the dogs. >> it's cold out there. let's get right to your forecast for today. temperatures are on the cool side.

we might actually break some temperature records this morning, meaning it hasn't been this cold on this date possibly since the early 1400s in places like santa rose sachlt we broke records yesterday, expecting to do more of the same today. after all, really early in the season. 38 degrees in napa. 36 degrees, four degrees above freezing in novato this morning. high pressure is the reason why. you can see the clouds arcing up and around. that big ridge of high pressure will keep our skies clear yet again today. a comfortable afternoon. tomorrow we'll skate by with another nice day. we've got a lot of rain on the way, especially right at the coast as we head through thursday and friday. let's talk about the good stuff for today. lots of sunshine, 68 in redwood city, 67 in san francisco and 67 degrees today in oakland. as we head throughout the afternoon, this area of low pressure will start to get closer to the coast. it's a cut-off low, meaning it's cut off from the actual jet stream, the river of air that carries our systems from west to east across the united states.

today we'll see sunny and warm conditions. clouds increasing just a touch ahead of the system. on thursday, take a look at what's headed our way. over the course of 11:00 p.m. thursday into 9:00 a.m. friday, we have heavy rainfall. we could see coastal flooding, could pick up rain in excess of one inch out of this system between the course of 11:00 p.m. thursday into friday. looking towards a really wet, sloppy commute on friday morning. still getting a lot of rainfall in the south bay at 12:00 noon on friday. get the umbrella handy and make sure you're ready for wet conditions in your back yard yet again. this one kind of a super soaker. by 4:00 p.m. still showery. the steady rain will have passed late friday. your seven-day outlook looks like this, 70 degrees, rain late tomorrow. we'll hit the 70s before the rain arrives and cools us down. on-and-off showers continue through saturday. we'll get a little more of a break before more rain moves in on sunday. this will bring more snow to the

sierra. we'll talk about that throughout the morning. back to you. while most people are just right now starting to get therapy thanksgiving menus together, it sounds like a lot of other people are already thinking about christmas. >> stores are already rolling out their holiday deals and displays earlier this year hoping they'll be able to extend the shopping season. surveys show more people are out doing their christmas shopping earlier this year. they're often the shoppers looking for the best deals, giving themselves plenty of time to think before they buy. some people are embracing the early shopping season while others are reluctantly accepting it. >> you have more time to look around and look at everything and compare. >> i think it's too early. >> consumer confidence for october meanwhile dropped to its lowest point in more than 2 1/2 years. that means a lot of retailers may have to work even harder to try to lure those shoppers into stores. one thing sure to be on a few wish lists this season is the new iphone 4s.
