deadly drive by shooting took the life of a teenage girl n. the meantime five suspects accused of taking part in the crime in court. marla tellez is live in morgan hill. she joins us with an update. good morning, marla. >> laura, good morning. people who live in this typically quiet community are certainly shook up over the death of 14-year-old tara romero. this is why the city of morgan hill is planning a community meeting to happen tonight. 7:00 to 9:00 tonight right here at the morgan hill community and cultural center. 14-year-old tara romero of morgan hill was shot and killed in a dive-by shooting friday night. it happened near cosmo and del monte avenue. police say the five suspects are gang members ranging in age from 17 to 23. today all five are scheduled to be arraigned in santa clara county superior court at 2:00 this afternoon. romero's father tells nbc bay

area he hopes they save the court system and money and his family grief by pleading guilty. >> people like this have no regard for life. it's like getting promoted in the military, you know? >> romero's friends have set up a facebook page in her honor. already more than 450 people like it. according to the page, there is a fund-raising car wash happening this saturday in morgan hill, saturday the 12th to help raise money for romero's family and funeral costs. in the meantime once again, the city of morgan hill hosting a community meeting to talk about tara romero's death from 7:00 to 9:00 tonight. this is the city's first homicide in more than two years. >> simply tragic, too. such a young life, pretty girl. a $125,000 reward now on the table to help solve a murder case that took place eight years ago.

the san francisco police department and citizens against homicide are unveiling a new billboard to try to solve the 2000 beating death of viktor bach. he was killed back on halloween in 2003. police hoping the reward will bring them some new leads in this case. a new wave of occupy protests will hit the heart of the silicon valley today. a group of south bay organizations inspired by the demonstrations across the country will stage an occupy the streets protest, holding a noon rally in front of chase back in downtown san jose. the group wants to show what it says is rising inequality and poverty in silicon valley. more protests will be held through next week at different locations. protests will hit cal state campuses today as well. faculty at san francisco state and so nome ma state hit the picket lines yet. today it's cal state east bay and san jose state's turns, protesting what they say are

misplaced priorities. they plan to take back bargaining and first approach. picketing will be from 7:30 to 10:30 this morning. san jose professors will walk out from 9:00 to 11:00 this morning. east bay families struggling to make ends meet and send their kids to college are on the minds of protests planning to establish an en can't ment. we're hearing thousands of people may show up. >> reporter: good morning, jon. there's a whole day of action planned here at uc berkeley. son instructors and students planning to walk out here on sprawl plaza. they're going to be protesting tuition hikes and cuts. behind this is this movement occupy cal much like occupy san francisco or occupy oakland. meanwhile the chancellor came out and said encampments won't be allowed on campus and you

can't occupy buildings. protests are kay, tents and structures, no. signs are up this morning laying out the agenda, starting at picketing this morning at 7:45. they'll be a teach-out where the instructors come out and hold classes outside. a noon-time rally where the crowd is expected to swell, up to thousands of people out here. exactly when and where this encampment will spring up today is being kept under wrap according to "the daily cal" newspaper. there is a meeting listed at the encampment at 6:00 and something they're calling a convergence at that time camp tonight at 10:00. one student organizer is saying he expects this day of action to be much larger than others because they're getting support from occupy oakland. one officer is quoted as saying police will take the appropriate action. but protesters are saying no surprise here, they're moving

forward anyway. i'm christie smith, jon and laura, back to you. >> thank you very much, christie. the polls have closed and the unofficial results are in. 10 % of the precincts are accounted for in san francisco, but some 79,000 absentee ballots have to be khalid. in the race, george gascon is leading after the first round of voting by 42%. david onek got 22%. charmin bach came in third with 20%. no one has a majority, ranked voting must go into effect. in the race for san francisco sheriff, ross mirkarimi has 38%, cunnie has 28% and miyamoto has 27%. a winner also cannot be declared until someone has 50% plus support. ranked choice voting will be used in this race as well.

we have other unofficial election results to pass along. sunnyvale measure a has failed. the city council will continue to elect the mayor from the council members. san francisco voters have approved measure h which asks the school district to change how it assigned schools districts to schools. palo alto approved measure d to have outside arbitrators settle disputes with the city. supporters san jose it will protect people from public safety strikes. meantime, emeryville has improved two measures to increase business taxes. cupertino, pittsburg, foster city and redwood city passed taxes. school bonds for san francisco, newark, san bruno, elementary and millbrae all passed. pacifica passed a parcel tax to help fund schools. measures that failed include a parcel tax in laugh yell, a sales tax increase in san francisco, a bond measure for san mateo community college and

a bond measure for the san bruno unified school district. a new jacket perhaps? it's kind of cold outside. we'll check in with meteorologist christina loren. >> if you're headed out right now, you'll need to put the old one on first. 36 in snap pa. 34 in santa rosa. it's so cold we may break more temperature records. as we head through the afternoon, warmer than where we ended up yesterday. high pressure in control of our weather pattern. that's keeping your skies nice and clear. it's also leading to frost. so watch out for that especially up in the north bay where your temperatures have been in the mid to low 30s for the past couple of hours. 68 degrees later in redwood city. a gorgeous day for you. about 69 degrees in san jose. a couple of 70s popping up. fairfield, gilroy, a nice warm day on tap for you. as we head throughout the next 24 to 48 hours, coastal storm rides right up against the coast.

it's going to sit and spin over the pacific. however, this storm could move inland just enough to dump rain on the peninsula, on san francisco, all the way up to marin county. we'll talk about what that means, possibly inches of rain in less than a six to 12-hour period. we'll break that down. first let's check your drive with mike inouye. >> we'll take you to the peninsula where just a couple seconds ago i checked with chp again. we have the closure that is picking up northbound 101 at embarcadero. those crews will be moving through the area. the chiclets will come back to our maps after the next few minutes there. watch for the little slowing as you're approaching the dumbarton bridge. east bay will look at 680, wall nutd creek -- let's get to the bay bridge toll plaza, a nice easy drive here. no problems, an 18-minute drive off the carcinas bridge. we'll look at walnut creek where we have construction in both directions. in the south, red gear road starts the construction zone. from the north starting over there at stone valley road. no major slowing, but this is

going to be there for another half hour or so. we might see a little showing up. watching the skies, too. we told you yesterday about the astroid that was going to narrowly miss earth. it came and went without incident. astroid 2005 yu 55 flew by yesterday afternoon. the close orbit helped scientists capture pretty incredible images, it measures 1300 feet across and was closer to us than the moon. scientists say there was never any danger of a collision. five prom meant bay area athletes and leaders will be indungted into san jose's sports hall of fame. figure skate tease rudy gal linda and christy yamaguchi are among the inductees. gal lindo is a former u.s. champs. others include coach art

welcome back everyone. beautiful bay bridge this morning. look at the sheen on the water. a cold, clear morning. bundle up before you head out. 5:14 right now. >> cold, crisp, puts it in perspective. 30s and 40s. it is a cold one out there this morning. at 34 degrees, two degrees above freezing in santa rosa. 35 in fairfield and 34 degrees in gilroy. so we are oh, so close to breaking more low temperature records as we head through out the morning. looking pretty good. 35 degrees in fairfield will make way to a temperature around 70 degrees later today. we are going to see the 40s jump up into the 70s as well down in the south bay. we have a nice second half of the day on tap for you. same goes for tomorrow and then things start to get very, very tricky for the second half of tomorrow and tomorrow night. a wet system ready to make its way onshore. high pressure is keeping our skies nice and clear this morning. the clear skies make way to

frosty conditions. temperatures comfortable this afternoon. enjoy the sunshine and the warmth while it lasts because temperatures will start to drop off. we have the clouds and the wet weather rolling back in as of tomorrow. 65 in fremont. 60 in livermore and 70 in los gatos. a comfortable day in the south bay. fairfield, 70 degrees for you. 69 in livermore. as we head throughout the next couple days, this is what we're expecting. low pressure sets up just offshore. the center of low pressure should maintain right over the pacific, at least for 24 hours. but what will happen is we're going to have these bands of rain affecting the coastline. the immediate coastline for potentially up to 24 hours. take a look at how much moisture this thing is packing. whenever we talk about the reds, the yolos, the oranges, this is moderate range coming in. set the clock in motion and stop it at 9:00 a.m. this is what we're expecting for your morning drive on friday. let's check your drive with mike

inouye. >> good morning, christina. we'll take you to the roadways where we're looking at vermont, sbl 101 the vermont off-ramp has a disabled big rig blocking part of your off-ramp there. no major concern because of the easy drive right now. but we'll let you know as chp arrives on scene whether or not this is going to be a problem if they'll have to close the off-ramp. it is open right now. the bay bridge, a live look at the construction, zoned for the lower deck, that has cleared up. barely see any taillights. there we go, traffic going on below heading over towards the oakland side. an easy drive in both directions across the bay. we are looking over here to the south bay where 880 has a construction zone still going on from old bayshore highway down towards 280, still have lanes blocked there. no major issues for the south bay or the altamont pass. an easy 14-minute drive through the dublin interchange. we'll end with a look at 880

with the construction on high street cleared up. the nimitz, no problems, guys. back to you. >> thank you very much. a change of power in it li is giving a big-time boost to markets in asia and throughout europe this morning. for details on that and the rest of your news before the bell, we turn to brian shactman live at cnbc world headquarters. good morning, brian. >> good morning. it's amazing how quickly things turned. it's turned pretty negative. asia was up, europe started okay. things have really fallen off the floor there. europe front and center. investors worry about italy and its mounting debt. italy is the world's third largest nation. it could drag down the whole global economy. in terms of the inside baseball stuff. the highest since italy joined the european union. that's a lot of fear in the

marketplace. stocks rose yesterday as prime minister sylvia berlusconi won the vote but didn't get the majority needed to get the confidence. he'll step down sometime next year. two totally different stories. the dow was up 100 points to 12,170. we'll give all that back and then some. toyota recalling about 420,000 toyota and lexus vehicles to replace the crank shaft pulley on the v 6 engine. it's possible the outer ring of the pulley could become miss aligned causing noise and a warning light to come on. it's in the 2004 to 2006 model years. no accidents or injuries have been reported. if you have the cars, please check it out. retailers rolling out holiday shopping apps. it provides prices and whether the item is available in your local store. as for apple, the company adding new features, letting people bye products and pick them up at any

apple store. more ways for us to buy. >> that's what's it's all about. brian shactman, thank you very much. basketball is on the back burner at gilroy's gavilan college after three players were injured in a car crash. andrew gaines las multiple skull track tours. he and two other players were injured in a sunday night crash. devontae johnson fractured his lower leg. the car's driver billy heard has several broken bones. police say alcohol was not involved. gavilan was supposed to start the tournament in livermore tomorrow night but decided to pull out for obvious reasons. >> guys are trying to come to grips. right now basketball is not important. life is important and relationships are important. the gavilan women's volleyball team dedicated tonight's game to

the players. 5:20. crews are trying to repair an oil pipeline that burst in concord. they say that foul smell in the air may not go away for a while. in fact, it may get worse before it gets better. no word on when the cleanup will be complete. >> kind of like rotten eggs. coming up, efforts to bring the a's to san jose clears another hurdle. now hiring, how job seekers can meet with local companies to meet with new employers today. firing another silicon valley company starts layoffs. we'll talk about it coming up. ♪arefreghway, let lip aw♪

san jose is one step closer to drawing the oakland a's down to the south bay. the city council voting yesterday to give the a's exclusive rights to buy nearly five acres of land downtown for $7 million, actually a good price. the club will not buy the land until it gets approval from commissioner of baseball bud selig. san jose voters would also have to approve this through a vote. some of the bay area's top companies are in the mood, the hiring mood that is. they want to meet you face to face today. the job hunters boot camp will be held at the south san francisco conference center today starting at 10:00 this morning. it should finish up around 2:00.

26 companies including facebook, safeway and kaiser permanente will be there for this. the event is sponsored by congresswoman jackie spears. scott mcgrew says there are a lot more job hunters out there. >> the bay area hit with more lay-offs. we're supposed to be in recovery. adobe says it will cut 750 jobs trying to reposition itself moving away from some of its older products towards the cloud. now, ironically adobe has been making plenty of money, expecting to make $1 billion in revenue this quarter. adobe also said it would move away from mobile flash. this may not mean much to you. i'll remind you of that fight between apple's steve jobs and adobe. jobs refusing to put flash on apple products saying it was clunky and a battery drain. in the end, steve jobs won. we saw lay-offs from advanced micro devices as well. as many as 1500 workers will

jon, good morning. the city of morgan hill has actually sent out an official flier to let people know that this meeting is happening tonight to talk about the death of tara romero. that meeting is happening right here at the morgan hill community and cultural center. now, the 14-year-old was with three other teenage friends friday night when they were senselessly gunned down in a dive-by shooting. romero was killed, her friends injured. this happened as they were waiting for a ride home near cosmo and del monte avenue. five suspects were arrested. all are scheduled to be arraigned at 2:00 this afternoon in santa clara county superior court. romero's father tells nbc bay area that his daughter was focused, quick-witted and smart. >> she wanted to go to har hard. i said i better start saving now. >> reporter: her friends set up

a facebook page in her honor. in this case her friends say r.i.p. stands forest in paradise. there is a fund-raising car wash, proceeds to go to the family to help pay for funeral costs. if you're one of the concerned folks in the city of morgan hill, you're encouraged to attend tonight's community meeting at the cultural center of morgan hill right on monterey road. jon, it's also important to point out that is the city's first homicide in more than two years. >> such a sad and tragic story, marla. thank you very much. it's 5:32 right now. don't be alarmed today when every tv and radio station takes part in a nationwide test of the emergency alert system. the test is expected to start at 11:00. it should last about 30 seconds. you'll hear the sounds of town and then a familiar phrase, "this is a test." it's an unprecedented test of the nation's emergency alert

system. a number of bay area cities have brand new mayors this morning. veteran city councilman alan nag gi will be the first new mayor of newark in 33 years. san ramon's new mayor is bill clarkson. livermore's new mayor appears to be john marchand who beat out the competition. in the san francisco mayor's race, it shows that ed lee with a commanding lead at 31%. john avalos trails him with around 18%. dennis her farrah 11%, david chiu 8% and leland yee 7%. because no one has a 51-plus majority, ranked choice voting kicks on on this. election officials they'll have an official winner sometime this

afternoon. san francisco voters showing strong support for a measure to over all the city's pension plan. more than two-thirds of voters supported proposition c which would increase public safety workers and raise the minimum retirement age for some. the changes would save about $1.3 billion over the next decade. proposition d, a competing measure would extend the retirement aegean further to save $1.7 billion. that was losing. here is a sign that the holidays are here in the bay area. the holiday ice rink at embarcadero center opens today. this is only the fourth year, relatively young. you were saying you've seen this grow into a holiday tradition. >> it gets a little better every year, bob. more people found out about the ice rink in union square. they come down, it's become a holiday tradition for a lot of families. they come down here and get their christmas card pictures done here. they have a lot of fun. we have a lot of people that pick this time of the year to ask their significant other to marry them. >> getting on a knee and it's intentional as opposed to what i'm probably going to do. >> exactly. some of them do a great big thing. they like to get the microphone and make it a great big public display of affection. others kind of you'll see a guy out on the ice drop to one knee, and then ask them to marry. it's a wonderful place to do it. why not? look at this. is this not great. we're skating in the premier shopping district of san francisco. this is awesome.

families will get to use the outdoor ice rink in san jose. it opens up in just over a week. jon kelley and i will be down there at downtown ice. it will run from november 18 through january 29. it's open for 13 extra days this year in honor of the u.s. figure skating championships held at the hp pavilion in january. christy yamaguchi will talk about the competition at nbc bay area news at 11:00 a.m. got about a week to get ready, get our outfits. >> yeah, the sequence. she always picks what we wear. feels like an ice rink in places like santa rosa. 42 degrees this morning in san mateo. headed towards a nice comfortable afternoon. we have low clouds to contend with in places like novato, reduced visibility, down to about a mile and a half here.

5:41 right now. as the holiday shopping season is gearing up, congress is once again charging you tax to shop online. the plan has failed in the past, it is gaining support. "today in the bay's" tracie potts is live in washington with the details. good morning. >> reporter: this has been on the back burner for a while. for years the u.s. supreme court said only congress can allow states to tax internet sales. if there's a store in your area, you're taxed. for most internet sales, you're not. now the groups pushing this say states need more revenue, that california alone could get another $4 billion next year if the state was allowed to tax your online purchases. now, online merchants, as you might imagine. ebay, amazon, are against this. amazon fought it in california. they say they'll support it if the tax codes are simplified. what they don't want to deal
