you're waking up with us along the peninsula. you can see from your radar, we have a lot coming into marin county. a little bit over san jose. there's more on the way. we have a lot more on the way. we'll tell you how long it will last, and we have the weekend forecast ready to go. still ducking the rain in the south bay. watch for the crew to clear that. further south i have my eye on a small fire started after a minor accident at the cochran offramp. so far no lanes are blocked on the freeway. >> thank you very much, mike. occupy oakland could be taking down very soon. cries to break out the encampment are growing louder after a deadly shooting near the camp. christie smith joins us live at oakland. o occupy group is trying to distance itself from the violence. it may take the action that nearly is forced by the city.

good morning, laura. i just spoke with a demonstrator off camera. he said it's been a sad imand hard time for the movement. a man was shot and killed yesterday. he said it's not necessarily tied to the movement. i wanted to show you how close it was. this is the encampment. the shooting happened 40 feet away from the steps of the plaza. demonstrators with occupy oakland say they were among the first to run out here and try to help the victim. but the tribune reporting a small fight broke out inside the camp. after that he called in someone from outside the camp to help. he visited the camp before. it escalated. occupy oakland demonstrators tried to stop it. later there were five or six

shots. police are saying the victim may not have been involved in any dispute. mayor quan said for the second time the camp needs to go, but how and when she didn't explain. >> i don't have the time to play politics right now. i spent every waking hour working on a solution, a peaceful solution, if we can, to close the encampment and honor the spirit of the 99%. >> council member fuente says he hopes to put pressure on mayor quan for her handling of the occupy oakland movement here. meantime, just this morning, i've seen at least one woman coming here with a carload of sleeping bags and socks. she wants to make sure in case

the encampment is taken down that the folk who is are here have some things with them so that they have at least a sleeping bag and something warm when they're forced to move on. live in oakland, christie smith, john and laura, back to you. lawyers for the occupy oakland protesters hit by a car during the group's strike earlier this month will talk about the incident today. the protesters were marching the through an intersection in downtown oakland on november 2nd when a car just tries to cross through. two protesters stopped out in front of the car and started banging on the hood. this afternoon the lawyers will hold a news conference. the occupy movement seems to have worn out its welcome in san francisco. business owners near the occupy encampment at justin herman plaza tell the san francisco examiner they have seen a spike if shoplifting and break-ins since the camp started. ferry building managers say

there are reports of occupiers using the building's restrooms as washrooms, with some taking sponge baths in the stalls. managers tried to get police to crack down on the protesters, but the city has not acted on the requests. >> a south bay marine killed in afghanistan will be remembered today during a memorial service in san jose. 31-year-old staff sergeant steven dunning graduated back in 1998. he was killed attempting to disarm a bomb. his memorial service, which is open to the public, will be leld at noon tomorrow at the jubilee christian center in san jose. pg &e will continue. they could smell gas. but testing is to make sure that the pipelines like the one exploded in san bruno are still safe to use.

meantime, crews continue to shore up a leak found over the weekend. crews were performing pressure tests on the san mill road to page hill road when they found a pin sized leak. crews are trying to determine if there are more weaknesses on that portion of the pipeline. it is back to the drawing board for california's high speed rail project. it would have run up the peninsula to san francisco. marla tellez joins us live with more on what is next. >> reporter: good morning, jon. this has been an ongoing court battle for three years now, and so it continues. now the bullet train would have shared tracks with cal train, that's why we are here where we are this morning. this is the cal train station in san ho. yesterday a judge ruled officials failed sho show how it

will affect traffic and homes. the plan was to have them run from gilroy to san jose, up the peninsula and into san francisco at a cost of $99 billion to california taxpayers. the city said they didn't want the elevated tracks to divide their communities. they also showed concern it would be an eyesore and lower property values. yesterday's ruling says the california high speed rail authority must study how traffic would be impacted in the south bay since some places are heavy traveled would potentially have to be eliminated. the judge ruled the peninsula route has to be scrapped all together. despite that, officials with the high speed rail authority are confident. they have not been defeated just yet. they are telling mercury news, quote, the authority will comply

fully with state environmental law. so no doubt about it, the ongoing court battle will continue. there will be an opening ceremony at 11:00 a.m. and a parade downtown at noon. that means street closures and possible delays. the parade starts at market and montgomery streets and ends at the civic center plaza. to find out if your route will be impacted, go to sfmta.com. cities all over the bay area will hold events for veterans day. palo alto will plant trees at 9:00 this morning. also congressman mcnerny will

if you are going to attend any veterans day, we salute all our troops out there. bring an umbrella. bring the jacket. you'll get rain over the parade. not a lot, unless you attend the concert. that's my biggest concern. areas at the coast will see the most of this moisture. here's the core of low pressure. the subtropical moisture tap is being taken to california. they will get more rain than us. we have a big band to get through throughout the course of your day. on and off showers throughout the day, especially at the coast. it could pick up anywhere between half an inch to an inch of rain. so we are talking about significant rainfall in cities that don't typically get it in this short of a duration of time. we'll tell you when it becomes a problem. and we'll have rainfall totals for you today. let's check your drive now with

president obama was at arlington cemetery to lay a breathe before his basketball game on the west coast. the time is 5:15. meteorologist christina loren talking about the storm. >> it's been a tough one. it has arrived. we have showers coming down now along the peninsula. pretty steady rainfall in san francisco. you can see where the core of low pressure is. it's still sitting offshore. you can see it digging into the

south area of southern california and subtropical moisture tap associated with it. now you see the tail end of the system. yesterday we were concerned about this area of low pressure sucking up the subtropical moisture and pulling it into to the bay area. first band has moved onshore already. the heaviest rain is through concord and antioch. make sure to take it easy. danville starting to get their first showers of the morning. you have to contend with the showers through at least the first part of the day. they start to hold off a little bit through 3:00 p.m. and onward. let's take you through the hour-by-hour forecast for today. light showers until 2:00 p.m. for the coast. we're not going to see the action in places like livermore for the second half of your day.

for us, though, showering conditions at the coast until 10:00 p.m. certainly the case. so inland cities, you're going to be spared from the heaviest rain. then everybody clears out by 7:00 a.m. tomorrow morning. making for a nice, clears, crisp day across the bay area. we also need moisture to clear out the air quality. that be the case as we wake up tomorrow morning. this is what we're expecting in terms of communications. potentially up to an inch in novato rngs redwood city. i'm thinking like a quarter or half in the places that get the most rainfall. you really need to watch for that this morning. your seven-day outlook shows you, a nice clear weekend. both good days for outdoor

prices. it's $5 more than last year. partly due that more people worldwide are eating turkey world round. they have some people shifting over, but some people eat poultry, like turkey and chicken because they want to be healthier. it's a lot more popular these days. as long as they don't raise prices on marshmallows and yams, i'm happy. a san francisco woman will spend nine months in jail for trying to scam aide workers in the aftermath of san bruno's pipeline explosion. she pleaded no contest to charges she went to this a zags relief program claiming she lost all her belongings in the fire, which was not true. she was sentenced to nine months in jail and three years probation. california cities are allowed to ban medical marijuana clubs. that's the decision from a state appeals court this week.

right to put student safety before free speech rights. when students marched out last year it made national news. it was triggered by what happened the day before on cinco de mayo. five students who wore american flag t-shirts were order thod remove them or turn them inside out to head off conflicts with hispanic students. >> a number of high-tech issues making news as well. you want to do with you want without a lot of regulation. facebook is the latest to get caught on government radar. reports will force facebook to get user approval before making changes to privacy as part of a government settlement. facebook makes changes all the time. if you don't like it up to opt

out. now this will not be able to make changes as quickly. a federal judge ruled twitter must hand over user information to help the government plug a wikileaks leak. the judge in the case says the bit in the your computer. this is a big deal even if you're not the person who sends stuff to wikileaks. if you have an iphone or ipad, apple sent out an update to the operating system that patches a problem with the iphone 4s battery. it makes it easier for siri to understand australians. it's the first time iphones don't have to be synched up to a computer to receive the update. a lot of people don't synch their iphones to computers anyway. now you don't have to.

the friday commute just set to kick in. we'll watch the sensors change, guys. they may be moved out sooner rather than later. christie smith is live in oakland where a deadly shooting is forcing city leaders to make some kind of decisions here. good morning, christie. >> good morning, jon. that's the talk around the encampment this morning. a lot of demonstrators are wondering when the city might move in. when they might force their hand. right now the encampment here looks like it has for the past couple of weeks. tents are here. there are changes. there's a candle light memorial for the man who was shot

yesterday. and oakland police are out here. they've been told to keep a minimal presence. but demonstrators are saying really the shooting is not them. they were shouting this is not occupy oakland and demonstrators were among the first to help the victim after he was shot. but it did happen just steps away from the encampment. there's a growing number of voices calling for the camp's removal saying the situation was escalating. she called on demonstrators to leave on their own. a lot of people who call oakland home say they're done. a recent poll showed 48% want it gone. the others aren't quite sure. 73%, though, say they don't approve of quan's handling of

it. >> the administrator and i will do our best to do what we have to do to return the plaza to public use of the entire zi and to do it in a way that it doesn't cause further harm to citizens or to the city. >> a young man was murdered an and died in front of my eyes today. for that to be here associated with this encampment is unacceptable. we need to hear from the mayor right now. >> we shot video closer to the memorial. and mayor quan issued a statement saying a young man was shot and oaklanders should demand peace and reject violence and this underscores why the encampment must end. they said i am calling on the campers to leave voluntarily. so far that hasn't happened.

live in oakland, i'm christie smith. back to you. video of clashes between protesters and police at uc berkeley is going viral. now some students say police are confronting them when they're not protesting. two uc berkeley law students say campus police stopped thenl on wednesday as they were walking across campus. i said, i'm going to class. the six of them surrounded me and twisted my wrist. >> police later let him go. another student says police stopped her and demanded i.d. buzz she was carrying a bull horn. campus police say they stop people because nonstudents are fot allowed to have amplification devices or display large signs. students say police are

wiper this is morning. let's get to the forecast. we have a lot to go over. take a look at this. we weren't expecting snow in lake hah toe. we were expecting up to two feet in yosemite. that's what we're watching right now. you can see a mix up in lake tahoe. it's still warm up there. so the highest peaks got straight snow. but right now a lot of snowfall is coming down in yosemite. so that means good news for skewers and snowboarders. we'll have accumulations coming up, how much we're expecting. here's the core of low pressure. i set it back for you three hours. it's digging. that be put a big band of moisture over the bay area as we head through 10:00 a.m. all the way through 3:00 p.m. all of this moisture is expected to sit right at the coast, though. . san jose could pick up to a quarter inch. it will be chilly at the coast. 61 in rdwood cities.

worth. tracie potts joins us from washington, d.c. it seems lawmakers on both sides of the aisle are coming together to help find veterans work. it is important. >> it is important. democrats and republicans agree unanimously to give tax breaks and bigger tax breaks to companies that hire veterans and disabled veterans. what the bill that has now passed the senate would provide is a tax credit of up to $5600 for companies that hire veterans who are looking for one to six months or many. plus provide money for mandatory career counseling, better training. allowing them to get the skills they need from the jobs that are open right now. here's the problem. for 9/11 veterans.

to seal off the streets. that was in a two-block radius. only four customers were affected. >> it is 5:49. california has cut a lot of money to get back in the black. the state controller say it's not enough. they have fallen $1.5 billion behind in pref knew. the state also spent $1.7 billion more than initially projected. add it up, more than $3 billion in the hole. if california is between $1 billion and $2 billion short, there will be cuts to higher education, social services and public safety. if it's more than $2 billion short, funding could be cut to k-12 education and community colleges. >> laura checking on sports now. hosting eli manning and his unites. kickoff is set for 1:15.

laura. if your friends seem so far away it's the eyes on webcam ra. this one is treextra cool. it works independently. just plug it into the wall, and it starts beaming sound and video to your iphone or ipad. pretty much automatically. so it's pretty much fire and forget. you can have your parents set it up. so here's an absolutely live picture of the control room. i'm going to tip the ipad to see aaron and theresa. wave, theresa. i don't know how much delay there is in this. there's going to be a tremendous delay. this is a live picture. all i did is plug in the camera. it was good to go. it found my ipad. what's really great about this is that it's totally private. this is a private communication between my ipad and that camera.

this is on the internet, but it's not like somebody is going to be able to see you. there we see the wave coming. find out what your dog chewed up. it's a private communication. you can set it up in your house and not worry that had somebody is tapping in and seeing what you're seeing zplchlt why the big delay? >> the delay out over the internet and coming back. it could be our internet. but it's an hd picture, which is really super cool. you're looking at about a 30-second delay. >> still very cool. we'll be right back after this.
