or fremont. >> well, this morning a warning for people who use a popular south bay trail. los gatos police looking for a suspect who tried to kidnap a teenage girl. marla tellez is live with the latest. >> jon, good morning. talk about a close call. we are right where police say the 17-year-old girl was almost kidnapped. this is lark avenue at one of the entrances as you mentioned the very popular trail. runners and walkers love to use this trail on a daily bay sils. it all happened in broad daylight. police say it was about 4:15 sunday afternoon when a man drove up to the girl as she was walking on lark avenue, asked if she wanted a ride. when she said no, he got out of his car, grabbed her arm, even tried picking her up. she fought him off by punching

him in the face and the groin, and then she ran away. that's when the man got back in his car and drove towards winchester boulevard. we have a suspect description. police say he's a hispanic man, about 45 years old with slicked back black hair. what's noteworthy about what he was wear sng dirty blue jeans that were plsplattered with pai. he was driving a small dark brown hatchback or sedan. possiblily a vw jetta with tinted windows. the girl said it has several large areas that are painted dark blue or black over the dark brown, essentially splotches of paint, as if trying to cover up rusty patches on that car. of course, if you have any information about this attempted abduction that happened here on lark avenue sunday afternoon, you're asked to call police.

>> thank you very much. accused child molester jerry sandusky is speaking out in an exclusive interview with nbc. the former penn state coach talked to bob costas by phone last night. he had been indicted on 40 counts of molestation and abuse. he told costas he's innocent but >> i can say i have done some of those things. i have hugged them and i have touched their legs. without intent of sexual contact. >> we will have more from the interview later in the newscast, including what one expert has to say about whether sandusky is lying.

if you would like to see the nbcbayarea.com and tune in to hear from sandusky's lawyer, including a stunning revelation about one of the alleged victims. it is 5:03. the woman accused of ripping off alex tribec will attend a court hearing today. she, of course, is accused of robbing tribeck and his wife while they were still sleeping in their san francisco hotel room back in july. the lawyer says she was at the hotel working as a prostitute and not as a thief. she could spend life in prison. prosecutors say they do not plan to push for that. it is 5:04 right now. from ogawa plaza to sproul plaza. the occupy battleground has moved to berkeley. christie smith joins us live from berkeley where evicted occupy protesters will join community leaders in a student strike on cal berkeley's campus. good morning. >> good morning, laur are.

we took a walk around. there are already three dedicated students. not sleeping, but sitting on the steps to the hall. and they say they welcome support from occupy oakland and even occupy sf. they broke up the occupy oakland encampment. some of those demonstrators say they plan to come here and support the cal student with their movement. just last week students tried to set up tents. police quick lu moved in and tore them up. the chancellor called for a review of police action.

students may try to set those up this evening. they had planned to go there by the bus load, but the meeting was canceled for fear some outside agitators might come in and get violent. now coming up in our next hour, we just spoke with some of the students here. we'll tell you what they have to say about their day of action. back to you. >> thanks so much, christie. police in san francisco have put up barriers near the occupy sf camp. they are on the northwestern and southwestern corners of justin herman plaza. officers say there will be ample warning before police action takes place. the camp is also dealing with an outbreak of parvo virus. it affects dogs and it can be deadly. the city set up a temporary vet clinic at the encampment yesterday to help treat dogs.

members of the alliance for californians for community empowerment along with union members will occupy the bank at noon. they want the bank to give the woman a loan modification. she says she was steered into an interest only loan and is now facing foreclosure. city leaders expected to vote to approve $10 million in funds to work on the proposed site. critics say if the stadium never gets built the city is just wasting money on a unnecessary prep work. they will borrow most of the $10 million from the 49ers. also tonight the council will discuss whether to approve the sale of the great america theme

park for the record it's located next to the 49ers site. it's a san francisco company in which the 49ers are major investors. finding a place to light up in alameda could get tougher. they will hold a vote on an anti-smoking measure stricter than current straight laws. it would be prohibited on sidewalks, outdoor restaurants and in parks. the city council will decide tonight whether to outsource policing of the city to the san mateo county sheriff's department. another option is to pay an additional $410,000 a year to maintain the current police force. some residents are concerned it would only lead to fewer

headed out. they cannot come to an agreement with seafood processers about the price for crab. fishermen want $2.50 a pound. proce processors are looki ining to p $1.75. there's a good chance you may have spotted something new out of alcatrez island recently. crews will stabilize the historic water tower and other features of the national landmark. the work will be noticeable on the water tower we mentioned, which is visible from san francisco. scaffolding is reaching up to the top. then it will be covered with white tarps. bay area congresswoman is headed to court today, accused of shop liflting. what they plan to do about it.

occupy wall street had police raiding its camps, cleaning out protesters and removing tents. 70 people were arrested there. mayor bloomberg says they want to clean up the area. they will allow protesters back in, but no overnight camping. parts of southern california, the streets are crumbling away this morning. crew tillty crews are on a street just south of los angeles working to try to fence off the

unstable road. the first issues appeared last spring. crews are not sure what caused it. it could be deadly to onlookers who get too close. so far no homes or buildings are threatened. >> it looks like it will be cold this week. some sunshine and maybe rain. >> this has been the pattern for the last three weeks. now something that's developing right now, becoming more of a factor. you're down to a quarter of a mile. even though you're reporting ten mile of vitzability, we still have pockets of fog out there. all the way from livermore to the coast. watch out. you know what happens when it rains.

and business inventories. earnings from retail giants wal-mart and home depot. the dow lost to close at 12,078. the nasdaq off to 26,057. jpmorgan chase is scrapping a test run of a checking account that charges a $10 a month fee. they typically give ways to avoid monthly fees. chase and other banks have been trying to make up for revenue being lost to new regulations, curb, overdraft and debit card swipe fees. that's it from us at cnbc. now back to you. berkeley is looking to take another controversial stand tonight, this about the u.s. military operation that led to the death of osama bin laden. council members will vote on whether to support a resolution honoring the memory of apache tribe leader geronimo.

they are upset they gave bin laden the code name geronimo during the operation. if approved they will send the president a letter condemning the yoouse of geronimo's name. they want the president to issue a formal apology. state assemblywoman heading back to court after being caught on surveillance video allegedly shoplifting from a neiman marcus store. she's accused of trying to steal $2,500 worth of clothes for the store. that was on october 25th. a spokesman says the incident was a mistakement he says she carries two cell phones and she was at the time using both with a bag in her hand when she inadvertently stepped outside. >> it is 5:20. a bay area school district filing suit against the county. we'll have details up next.

holding it to his ear at a red light. the appeal is on the case that pits a peninsula school district against it's account. tossing out a $20 million lawsuit followed by the san mateo county school they claim the county made a bad investment to the now bankrupt lehman brothers. it will be heard some time next year. >> he is making news over his spat with facebook. scott mcgrew, who would have thought? >> i suspect we have viewers too young to remember him. better known as the ex-husband of this lady, padma, the cohost of "top chef." he really is. he got into a spat with facebook, the social networking

site. apparently not sure who he is either. someone shut down his account because his first name isn't really salman. that was the only way he was allowed to have it. he started complaining on twitter, saying dear facebook forcing me to change my name is like forcing j. edgar hoover to become john hoover. in the end facebook relented. speaking of what's in a name. what about overstock.com? the ceo is trying rename the company o.co is a mistake. so few people know it's an internet suffix. they know it as the name of the stadium. the loud stadium with the raiders. but they're not sure why it's o.co. they tried to go to o.com. that's not a website.

completely from the roadway, not sticking out into the slow lane. the interchange is clearing in time for traffic to start building out of san leandro. >> thank you very much, mike. >> police are asking for your help to find a suspect who tried to kidnap a teenage girl over the weekend. marla tellez joins us live with an update. zbr good morning. we are above very popular l los gatos creek trail. this is on lark avenue where police say the 17-year-old girl was almost kidnapped. now on any given day this trail attracts dozens of runners and walkers. tu attempted abduction happened in broad daylight. the 17-year-old girl was approached by a man in a car. he drove up to her, asked if she wanted a ride. he did not take her no for an

answer. he has slicked back black hair. he was wearing dirty blue jeans splattered with paint. as far his car, the girl says he was driving a small, dark brown, either a hatchback or sedan. possiblily a mid 1980s volkswagen jetta with tinted rear windows. what is noteworthy about the car. it has patches of blue over the dark brown, as if trying to cover up rusty spots. now the police have september out fliers to all the schools in the area so teachers, parents and students have been informed.

the cal campus is bracing for a major protest. they are calling for a general strike. angry over plans to increase the cost of higher education. it will include a rally. students will then march downtown berkeley to protest big banks. more details in a live report a half hour from now. occupy protesters are also upset. the group says at least seven protesters were victims of police violence and false arrests. they plan on filing the lawsuit later this month and is asking the chancellor to resign. university officials say they're not aware of the suit. >> many of the occupy oakland protesters plan to be in berkeley to take part in the cal

demonstration. some returned last night but did not try to put their tents back up. only about a dozen people were left. police said the occupy protesters can stay provided they do not camp out. they held a skbren assembly to figure out how to take back the plaza. the occupy movement is costing the city of oakland millions of dollars. $1.1 million on police costs. ha does not include for dl 500,000 the city paid yesterday to get outside law enforcement to help clear out the camp. oakland mayer quan is under fire this morning. here chief legal adviser dan siegel resigned yesterday morning. this less than a week after

ballard left. then last night deputy mayor sharon cornu decided to leave. her resignation has nothing oo to do with the occupy raid but she felt ineffective in her role. from an "f" to an "a." some have seen miraculous improvements in their grade without extra credit. now the fbi is investigating. bob redell is live at santa clara university. bob, what is the latest? >> god morning, jon. santa clara university realized somebody was tampering with their academic records when a student noticed something wasn't right with her transcript, that one of her grades wasn't what she remembered. upon further inspection the

school discovered someone had hacked into their computer system and changed the grades of more than 60 students. mostly graduates. all the changes in the positive direction. all the grade changes were in a favorable direction. others were significant from an "f" to an "a." >> it is believed the hacking took place between june of 2010 and july of this year. in response the school tells us it had increased computer security and is reviewing thousands of records going back ten years. no suspects as of yet. even though someone was able to change the grade in the computer system it is not official. it takes a lot to authorize a

we'll see showers in the north bay on thursday. the bulk of the moisture comes through friday and saturday. gusty winds turning very cold. and your snow levels, 5500 feet to start. dropping to 2,500 feet early saturday. but the good news is it's just in time for ski resorts which will be opening up through this friday. we are counting on snow in the sierra nevada. we'll start the snow level at 5,500 feet on thursday. then take a look at your overnight low. 22 degrees. south lake tahoe looking forward to show. things don't change all that much until we hit late thursday. the first part of thursday should be pretty comfortable. the showers arrive in the north bay late. friday looking like a washout. mike inouye and myself will be tracking showers for you. lit be a rough commute friday morning. by saturday the coldest air settles in. that's when the snow levels fall potentially to 2,500 feet.

that's right. we have to watch it. we're looking over here. 101. they cleared this up early 101 at old bay shore highway. the construction crew is gone. now look at the speed sensors. nice flow of traffic throughout the south bay in the northbound commute direction. westbound 580 to livermore. you have typical slowing building. 17-minute drive. let's get you to oakland. nothing to tie you up now that construction crews have cleared in the northbound direction. southbound is smooth as well. this patch in the middle, well, traffic shifted on saturday. so you're using the new retro fitted bridge. golden gate bridge, nothing going on here. a nice easy drive and a clear

view. further north, novato, santa rosa, low visibility. a quarter mile could be an issue for drivers. >> nba talks are still going on. bad news, they're not good. the nba season is happening this year is a long shot at this point. players rejecting the league's latest offer and dissolving the union. his group is prepared to file an anti-trust action against the league. the entire upcoming season is in jeopardy. >> parts of san jose could have new drinking water. the water district will consider a plan to add fluoride to water this morning. parts of the city already have it including north san jose. the vote would impact the areas that do not. many say when there's no

might be a bold understatement to say a south bay man got more than he bargained for when he bought a used chrysler mini van more than a year ago. he recently found, get this, a half million dollars worth of cocaine hidden inside of it. he bought the van in santa clara. he realized there was a problem in the driver's side window. it wouldn't roll down. he decided to take it to a mechanicic. >> he had taken off the entire panel. from here to here and this width was just, there was seven kilos in this door. >> that is seven can recollect ilos of cocaine. they found 12 more kilos in other parts of the van. he immediately called police who came and removed the drugs for

the van. >> a bentley with the cost of that mini van. a discovery at an east bay storage unit could launch a second california gold rush. a south bay man shelled out $1,000 for an old trunk at a storage unit similar to this one. according to "storage wars" he found a treasure inside. half a million dollars worth of gold coins. the new season of "storage wars" starts tonight. the south bay is ready for the holiday season. yes, there will be carolers, activities for the kids and the
