happening in the forecast. >> a little bit of a repeat performance from sterday. we had a lot of sunshine late in the day, but a very, veryro col start. today we're actually starting a touch warmer. that's going to make for a warmer afternoon. enjoy the sunshine while it lasts. we've got a big rain storm on the way as we head into this weekend. right now we're watching for pretty thick fog developing through santa rosa, novato area. visibility hasn't dropped off much yet. we're forecasting it to do just that in the next hour. mike is on top of your drive right now. >> we'll track the north bay drive. so far, so good there. oakland 880 past the coliseum, see the flashing lights, the crew there. that crew will be moving over the next 15 minutes northbound and southbound between the coliseum and fruitvale. construction crews in either direction. we'll see rolling traffic breaks. expect another five-minute delay. tack it on to be safe. police on the move taking down occupy san francisco tents and they make a handful of arrests overnight. why they made their move. good morning, bob. >> reporter: good morning, jon. just to give you a lay of the land first. we're here at market and stewart. behind me in front of 1 market street, the area that police raided overnight. you can see some of the officers are still out there to make sure the protesters don't return to that section of real estate. occupy sfers expanded their camp. protesters said they needed to expand because they're out growing justin herman plaza and the sidewalk in front of the federal reserve. the city says by expanding, it was too much. around 1:30 sf police officers in riot gear removed 15 tents and citing and releasing seven protester. one protester showed us bruises on her arms and legs she claimed she sustained from police. they say they weren't surprised by last night's police operation, they knew it was coming, weren't sure what the

timing was going to be. police had grown frustrating because it was making it hard for people to get by on the sidewalk t. siity feels they had an understanding with protesters that they would tolerate their presence in justin herman and in front of the federal reserve, but by expanding beyond those boundaries, it was just a violation of the rules. >> we need to expand. we're severely overcrowded at justin herman plaza. tensions have been high. health and safety is a big concern, so we needed to expand anyway. >> a spokesperson with occupy sf tells us they do have a meeting with mayor ed lee, one previously planned for 10:00 a.m. this morning. they want to talk about occupying the civic center because, as he was saying earlier, they've run out of space at justin herman where they got roughly 200 tents and another 45 down there at the federal reserve. when i asked if that means they

would occupy the civic center and move from justin herman and the federal reserve, he said no, no, we want to occupy all three spaces then at that point. reporting live in san francisco, i'm bob redell, jon and laura? >> bob, thank you for the report. students at staff at uc berkeley are at the center of two big stories this morning. first we'll learn more about the man campus police shot after he was found waving a gun inside the business school. the second, occupy protesters put up tents on campus in defiance of school administrators. nbc bay area's christie smith live in berkeley with more on both stories this morning. good morning. >> reporter: good morning. demonstrators here are waiting for answers on that just like everyone else. we're supposed to hear about that at a press conference at 8:30 this morning. but right now they've got their own situation. last week there was a clash with police, and right now, the demonstrators are back.

they've got at least 12 to 15 tents out here this morning, despite the university saying that encampments are illegal. there are police out here this morning from uc and alameda sheriff's department as well. i spoke with some of those officers. they said they most recently spent time at occupy oakland. in fact, there are demonstrators from occupy oakland this morning. we shot new video of the encampment a couple minutes ago. occupy cal demonstrators voted to put up the tents again last night. this is a second attempt. again, last week police moved in and tore them down. there are two inquiries going down about police tactics and the use of force. i spoke with one officer this morning. he says they keep giving out verbal warnings that catching is illegal and the tents must come down. he says quite a few people actually did leave. they left overnight, and the number of tents in his opinion has actually gone down. he says for now they're keeping their distance.

and overall, it has been mostly peaceful. that's what we have from here, just a lot of folks walking around, talking about it, these folks walking around blowing bubbles at officers who are out here this morning. the folks that i have spoken with, both demonstrators and police say at this point everything has remained mostly peaceful. but exactly what's going to happen next, of course, we'll have to keep an eye on that for you. reporting live at uc berkeley, christie smith, back to you guys in san jose. >> only in the bay area. >> doesn't get much more peaceful than bubbles. occupy protesters at college campuses across the bay area will keep a very close eye on a decision trustees are expected to make today. cal state expected to hike tuition by 9% if the state doesn't set aside additional money for the school system. that would bring the yearly tuition bill to nearly $6,000. tuition was just upped by 23% just this year after csu's

funding was slashed by $650 million. some san jose state university students not happy with the possibility of another tuition hike. they say it's time to take action and will hold a walkout today to further protest the hikes. students will rally at the statues in front of clark hall from noon to 3:00 today. students at sonoma state holding a 24-hour campout to protest budget cuts. they will pitch their tents on the stephenson lawn and students are angry about recent cuts to programs and courses as well as the proposed phi increase. the camp starts at 9:00 this morning. uc regents canceled this week's meeting in san francisco afraid of possible violence and vandalism. the regents were supposed to vote on a possible fee hike because of budget cuts. university police told them earlier this week that pieceful protests could have become violent so the meeting was canceled. it was supposed to take place today and tomorrow at mission

bay. the gav lynn junior men's college basketball team will play a home opener without a few key players. three players were in a major car accident just two weeks ago in millbrae. gains suffered multiple skull fractures and is still right now in the hospital. johnson fractured his leg and the driver, herd, has several broken bones. tip-off set for tonight against merced college. it is 5:07 right now. aa legal blow for an oakland police officer said his reputation was tarnished over the chauncey investigation. long meyer argued oakland pd and the c. department of justice said he compromised the bailey murder case. questions rose over his ties yusuf bey the fourth who ordered the killing of bailey.

the judge says evidence showed long meyer had an affiliation with the bakery and its members which was sufficient cause for an internal investigation. voters in west contra costa county passed voted to save doctors medical center. measure j passed according to unofficial results. the $47 a year parcel tax will bring in about $5 million a year. it's the only full service emergency department between berkeley and vallejo. >> christina loren. >> good morning to you. we have good looking weather for today which makes any outdoor activity a lot more pleasant than it will be as we head through late tomorrow, friday and saturday. cold wet weather arrives in the bay area and will hang around through your monday. a lot of people trying to get out of town next week, thanksgiving week, big travel week. as we head through monday and tuesday. the good news is we'll start to clear out.

weather pattern we're expecting to ramp up late tomorrow night lasting through early monday should start to wind down just in time for your holiday travel. so that's what it looks like right now. we're going to have to get through about three or four days, a very cold and wet weather in the bay area. it coincides with the timing of your weekend. 571 degrees in oakland, 50 degrees in san francisco. a little on the chilly side in places like napa. still running three to five degrees warmer than we were this time yesterday. high pressure at its maximum for today moving right over us. that's going to keep your temperatures in the upper 60s, even mid 60s in places like san francisco, bumped you up to about 65 today. 68 in redwood city and 68 in santa cruz which is not too bad when it comes to hitting the beach, even if you want to sit on the shore and watch the waves. pretty nice weather for that today, things will start to change as we head through tomorrow night, the first showers arrive in the north bay. very, very cold system. moisture amounts, talking about accumulations upwards of a quarter inch which is pretty substantial for us. that's for friday.

we saw the dow rise 17 points on tuesday to 2,096. nasdaq up 28 points to 2686. the salvation army is going digital, jon. bell ringers will accept debit and credit donations. the salvation army is testing a mobile payment system where you can swipe your card with a device attached to a smart phone. the digital donations are going to be set up in several cities including san francisco, dallas and new york. so look for them. jon, back to you. >> thank you very much. the city of santa clara continues to move forward with preparations for the new 49ers stadium. the city approved $10 million to get the groundwork done for the future stadium. work would start in january and includes clearing the area next to great america and rerouting underground utility lines. 49ers will pay $6 million of the $10 million that is actually needed. meantime, millbrae has decided to begin negotiations to out source its law enforce.

to the san mateo county sheriff's office. the decision comes to money. it would cost $400,000 to keep the police department while outsourcing would save nearly $500,000 a year. summer camps in yosemite a little longer. they want the city to sign a 20-year-lease commitment this year t. city says san jose doesn't have enough money to run the summer program so it should sell it. instead mayor chuck reed is asking for a five-year lease commitment with a right to have another operator step in the necessary. it is now 5:19. coming up, a south bay city taking on a big health problem by adding something to the water. we'll explain. a week after the election, a judge already tossing out a legal challenge to one of the bay area measures that was passed.

welcome back. that is a live look at san jose christmas in the park. you see the big christmas tree right there? kind of dark right there. never fear. come november 25th at the opening ceremonies, the lights will come on and all the christmas glory with it. the time right now is 5:22. palo alto city council are moving forward. a judge throughout a challenge to measure d from local firefighters. the measure passed last week, stripping palo alto police and firefighters of their right to take pay and benefit dispute to outside arbitrators. the judge made the ruling yesterday t. union now has 20 days to appeal. sometime soon the city of san jose will get fluoride in its water. the santa clara water district decided to add it to all its water. until now all parts of the city had florn nated water.

the project will cost between $4 million and $9 million. google will let you opt out of a database that records your name of your home's wi-fi signal. business and technology reporter scott mcgrew says don't. >> that's my modest proposal. don't opt out. keep your home's wi-fi name in the google system because it's not hurting anything. google cars drive around bay area neighborhoods. one of the things they do is record the name of your wi-fi signal. why? well, to make the maps on your phone work better. if you're in a parking lot and your phone detects a wi-fi signal coming from, say, the panera bread store 123, it cross-check that is with google and figures out you must be in milpitas. it wasn't cost anyone anything and it does no harm to your wi-fi signal. i say let it continue. you f you do want to opt out, check our facebook and i'll show

the big trouble with solyndra is it had more than one lay-off. it had a lay-off back in 2010 on november 3rd. why do you care about that? it's because that is a single day after the 2010 midterm elections, and that sounds real suspicious to the republican-led committee investigating solyndra and its loans. it says in e-mails from solyndra's biggest investor, argonaut equity, it was the department of energy that asked sol lynn that to hold off a day. in the memo, the doe doesn't say wait until after the elections. it doesn't explain why november 3rd was picked as the date. stephen chu will testify tomorrow before the house commerce committee. that will no doubt be one of the first questions put too him. back to you. >> scott, thank you very much. a very strange twist this morning. two suspects have been arrested for breaking into a san jose home, but the owner of the

property is upset the renter was using the home to illegally grow marijuana. "today in the bay's" marla tellez is live in san jose with an update. a pretty elaborate setup, wasn't it, marla? >> reporter: to say the least. good morning, laura. this is one of the extremely bizarre stories. we're on gorato drive in san jose. it appears to be a nice neighborhood. right over here the owner of this home, he says he's been renting it out for three years. never had any sort of problems with the renter until yesterday. san jose police were responding to a break-in at this home. they showed up to find two burglary suspects in the driveway. they arrested those guys, hauled them off. that's where it gets interesting. police entered the home to find an extremely sophisticated pot-growing operation. we're talking each room outfitted with special lighting and ventilation systems. all in all officers seized at

least 100 marijuana plants. the owner of the home says he is shocked and livid, saying all along he had no idea. he thought he was dealing with a responsible renter. >> our neighbors have told us that they never see anybody over there, which is kind of suspicious. but we always got our rent check direct deposited into our account every month, never a problem. i haven't heard from this guy since the day he signed his lease. >> neighbors are upset as well. but relieved about the arrest saying recently there has been a rash of break-ins in their otherwise family-friendly neighborhood. >> hopefully this is the end. so many homes have been broken in in this neighborhood. it's a nice neighborhood. this is such a quiet street. it's sad. >> reporter: now, i have put in a call to san jose police this morning to ask about the renter, and at this point they are still looking for this guy. it's a wonder if he's going to show up and come home.

when he does, i'm sure he'll be in for a shock as well. live in san jose, marla tellez. >> find agnew home very soon. 6:32 right now. as i mentioned earlier, overnight police moved in on occupy sf. want to check in with nbc bay area's bob redell who is live on market street with what is happening right now. >> reporter: good morning, laura. sfpd moved in on a small portion of their encampment, one set up outside of 1 market street where you can see officers are still holding ground to make sure protesters don't try to return. protesters moved in with their tents over the past several days. they said they needed to expand because they're outgrowing justin herman to the left where they've already got roughly 200 tents set up. that's the main part of their occupy sf campsite and also the area down on the other side in front of the federal reserve where they have perhaps around 45, 50 tents. this place in front of market

street, 1 market street was kind of a bridge camp. the sit at this time said that was too much. around 1:30 this morning, sf police officers in riot gear took down this mini camp, litting and releasing seven protesters. one protester showed us bruises on her arms and legs that she says she received when policeman handled her during the sweep. occupy sfers say they were not surprised, they knew it was coming. police had been warning them they were frustrated with the new camp because it was hard for people to get by on the sidewalk. the city also felt and still does they had an understanding with protesters that they would tolerate their presence in justin herman and the fastball, but not in front of 1 market street. by expanding, this was a violation of those rules. >> i understand what they're saying, but at the same time, they don't understand where we're coming from. and the only way that we can get them to do that is by making a statement by doing that.

we have tried and we have tried and they're not listening. there's only one way to get them to open their ears, that's by showing it, taking action because obviously words aren't working. >> reporter: there will be words between the protesters and the mayor of san francisco later this morning. one of the spokes people for occupy sf says they already had a preplanned meeting with mayor ed lee of san francisco at 10:00 this morning. we know the mayor has been concerned about the sanitary conditions inside justin herman as are the protesters themselves. there's reports of par vo, a dog disease, coming up here. the protesters are telling us it's getting too crowded. that's the reason they were trying to expand. they would like to expand now to the civic center plaza outside of city hall. that's their aim according to the spokesperson that we were just speaking with this morning. jon, laura? >> bob redell from san francisco. thank you. we have a warning this morning for south bay parents. a woman is ripping gold necklaces right off of school

kids' necks. the first robbery happened on october 18th at kennedy elementary school. washington elementary was hit after that and then grant elementary. the victims range from 5 to 8 years old. investigators say the woman pretends to be a family friend. in two cases she physically removed the girl's necklaces and then replaced them with costume jewelry. police say lunch monitors are being brought in to be extra vigilant about the strangers on school campuses. growing concern this morning over uc berkeley alert system after an armed suspect is shot by campus police. faculty and students are questioning the university's warn me communication system after a man reportedly threatened people with handgun at the haas school of business yesterday. the man was shot by police and taken to highlands hospital. his condition is unknown. police who signed up for the warn me program were supposed to get a text message, voice mail or e-mail in an energy

situation. some say they only received messages saying everything was under control. others say they got the message late or not at all. >> we got no instructions on what to do or,000 handle the situation. >> the one from haas wasn't so much notifying people but telling them that everything is good, but we're canceling everything. so be calm. the meeting about the shooting will take place at 8:30 this morning at the bank of america room at the haas school of business. it's the first campus shooting since the 1980s. meteorologist will come back and tell us we'll experience a mini minor heat wave today. >> at the smallest, smallest scale. we'll get a little bit of a heat wave. tomorrow doesn't look all that bad either, at least for areas south of the golden gate bridge. for the first part of the day, we will see some sunshine. that fog is going to roll back in as we head through tonight. we're expecting more widespread

"today in the bay's" tracie potts joins us live from washington where where negotiations are and if they're still going on. good morning. >> reporter: good morning, laura. remember the debt super committee was supposed to come up with a deal after they couldn't come up with one last summer. guess what? they're stuck again. no compromise but no stalemate either. they're still working on this with a deadline of one week away to come up with something congress can vote on, trying to find $1.2 trillion in budget cuts. the arguments are essentially what we saw last spring and summer.

democrats want to see more money coming into the government to pay for what we're spending. republicans say that's a code word for higher taxes. they want to lower tax rates and lower spending, what we're putting out by cutting into medicare and medicaid, two popular programs, but the biggest growing parts of our budget. that's where they are right now. the committee itself hasn't met in a couple weeks, but lots of slids and democrat and republican leaders meeting as well. republican leadership on the house side says, look, if they come up with something that works for both sides, we'll get it past the house. the problem is time. one week for the committee and only three full weeks of work left not counting the holidays for congress as a whole. >> a lot to do as well. thank you very much. this morning there's a statewide recall after a child in the bay area was sickened with e. coli. five children got sick after consuming organic pasture's raw milk problem.

one from contra costa county. included in the recall, raw butter and raw cream. organic pastures is based in fresno county. the state department of food and agriculture says only about 3% of people consume raw milk products in a week. the nba lockout moves from off the court to the federal court. locked out federal players filed class action anti-trust lawsuits against the league yesterday. that moves the talks from the negotiating table to federal court. the players attorneys say the nba lockout violates antitrust laws by refusing to allow players to work. today is day 139 of the lockout. games through december 15th have already been canceled. it's 5:44 right now. the apollo 11 astronauts will be honored on capitol hill with a congressional gold meddle. it is the highest honor congress

can give out. neil armstrong, buzz aldrin, michael collins and john glenn, the first astronauts to receive the award because they're the first americans to orbit the earth. the ceremony will take place today at the u.s. capitol in washington. time to check the forecast with meteorologist christina loren. >> a nice clear start out there. if you wanted to take a look up into space, you have a clear shot of the stars all the way from san jose up the peninsula. then we start to drop off in visibility from san francisco up through marin county this morning. we're expecting those visibilities to continue to fall as we head through the next couple hours. whatever fog we do see develop isn't going to last long. i think by about 9:00 a.m. yet again we'll see the sunshine early. that will warm you up into the mid 60s even in the city by the bay. gorgeous start. you can see clear conditions on the bay bridge at least for now. we'll let you know when that changes. temperatures are running cool, 37 in novato. about three or four degrees warmer than at this time

yesterday. as you break for lunch, comfortable conditions in places like livermore, 65 at noon, rounding out the day at about 69 degrees in the tri-valley. 65 for oakland and 69 in santa rosa. everything changes as we head through tomorrow. onshore flow starts to increase as we wake up tomorrow morning, expecting widespread fog all across the bay area. by 4:00 p.m., our first showers arrive in the north bay. not going to see a lot of activity tomorrow night. it's friday morning into saturday when the bulk of the moisture from the first system arrives. so 6:00 a.m., starting to get dicy on your morning drive all the way through 11:00 a.m. steady rainfall over the bay area. then we've got another round of showers to get through as we head through late saturday into sunday. sunday looking like a complete washout, trem ps will only be in the 50s. schb day outlook tells the story. today's highs, comfortable conditions, about 69 degrees in places like san jose and livermore. by the end of the week, 55 degrees. that's what you can count on inland. temperatures really coming down.

tower. the request comes after an investigation published sunday raised testing and design questions about the concrete and steel piles that help support the bridge tower. a technician who tested some of the piles and his supervisor were fired. it reports that the technician lied about some test results. another blow for embattled may juror jean quan, oakland voters defeating her parcel tax. measure i would have brought in millions through an $80 property tax increase on single family homes. 62% of voters rejected that measure. measure h which would have given the city council the power to choose a city attorney was also defeated. so was measure j, which would have changed the deadline for fully funding a police and fire retirement plan for employees hired before 1976. it is 5:49 right now. if giants are trying to lock up tim lincecum to a long-term deal. the ace may say no.
