lay-offs until after the election. a look outside hp pavilion. it should be a nice day, it's wednesday, november 16, "today in the bay." good morning to you. thanks so much for joining us. it is 6:00 right now. i'm laura garcia-cannon. >> good morning everyone. i'm jon kelley. time to check in with christina loren for the pre sunrise forecast. sunrise this morning about 6:48. grab your jacket. we have reduced visibilities up in the north bay. the main weather story is the mean winter storm getting ready to slam the bay area as we head through late tomorrow night through your weekend. we will time that out and tell you how much rain we're expecting. mike inouye, if they're heading out right now, anything that could slow them down? >> we had something, but it's better now. this is good. peninsula, highway 101, the

accident around poplar has cleared those two lanes. all lanes okay as you're heading towards the san mateo bridge. both directions of highway 101 and 280 not a problem. the east bay is showing slowdowns, i'll show that coming up. a big move by san francisco police overnight changes the face of the occupy sf encampment along market street. "today in the bay's" bob redell live now with what is going on and the reaction from the protesters. good morning, bob. good morning to you, jon. protesters weren't surprised by this action by police overnight. mayor ed lee of san francisco has tolerated the protesters camping out at justin herman and in front of the federal reserve. he had grown tired of what had grown out in front over here in front of 1 market street, a mini camp in front of the two other sites. it went overboard. protesters said they moved there because they were running out of

space. the mayor saying this is a violation of the understanding between both sides. around 1:30 this morning, officers surrounded the protesters in front of 1 market street, removed 15 tents and arrested seven people who refused to leave. those people were cited and released for camping. police officers tell us they received many complaints from people who say it was too hard to get by the tents, that the sidewalk was getting crowded out. police say they were left with no choice but to take it down by force. >> they were asked repeatedly to take the tents down, to move along. those things were ignored. so tonight we came in and made several arrests and have booked those tents into property. >> for health and safety issues, we need to expand. we're severely overcrowded at justin herman plaza. tensions have been high and just health and safety is a big concern for us. so we needed to expand anyway.

>> if there is agreement between the city and the protesters, they do agree that justin herman has become a health and safety issue. the mayor is expressing concern in recent days about reports of par vo, that's a dog disease, turning up at justin herman. it's also very crowded. as you can see, a lot of tents out there, by some estimates around 200. there is going to be an meeting today, the occupy sf spokesperson telling us this morning, with the mayor at 10:00 a.m. it will be in just a few hours. this was a preplanned meeting. they would like to bring up with the mayor the thought of expanding to the civic center. jon, laura. >> bob redell in san francisco, we will keep our eye on this as it unfolds. thank you very much. days after police ripped up their tents, made arrests and kicked them out of sproul plaza. occupy cal protesters are back, this time with support. "today in the bay's" christie smith joins us live from berkeley with the latest. >> reporter: good morning to

you. the demonstrators are up this morning, walking around, talking. they have their tents out this morning, at least a dozen, maybe more. some of them have sleeping bags out here. they are sleeping, waking up -- now last week this led to a big clash with police. students are saying what's going on here proves that they can reoccupy the campus and there are about as many tents as there are officers out here from both the university and the alameda county sheriff's department, plus demonstrators from occupy oakland who had their encampment raided this week at frank ogawa plaza. the demonstrators say they were excited to hear former labor secretary robert reich at sproul last night and decided early on to try to set up an encampment again. officers tell me that some tents have come down overnight, some students saying they'll keep only what they can defend in case police move in. one berkeley told me that the fight for affordable tuition and financial equality has no better

home than uc berkeley. >> if we can't assemble here, if we can't assemble at the ground zero of the free speech movement, i don't know where we can. they say at zuccotti park they can't, oakland they can't. if we can't do it here, i can't imagine where it's safe. >> reporter: last night the crowd at uc berkeley swelled to thousands with some demonstrators pleading to allow the tents to stay and they would evaluate in the morning what they were going to development they tell me they're certainly not giving up at all. i want to mention there are two inquiries into police tactics of the incident last week. what they've been told, though, is that the tents and camping here are not lawful. now, a couple of the demonstrators are assembling down there and they've just grabbed their sleeping bags because they're saying they saw a number of police officers on bancroft, and they assume they

mibl moving this way. folks up this morning. but we haven't seen the police move in on them at all. we'll keep an eye on it and check back in in a little bit. that's the story at uc berkeley. i'm christie smith. jon and laura, back to you. cal campus police don't think the man shot in a computer lab has any connection to the occupy protests. the man is actually recovering after surgery this morning. a woman called police after she saw the man she says flash a gun in an elevator at the haas school of business yesterday. later that man allegedly pulled out a gun inside the lab. police shot him after they say he displayed it in a threatening manner. we'll get more on the story at a news conference at 8:30 this morning. we'll bring you more at 11:00. meantime in the north bay students will join their counterparts and begin a 24-hour campout to protest budget cuts. they'll pitch their tents at

stephenson lawn at sonoma state university. students wanting to raise awareness on what they say are cuts to recent programs and courses as well as a 9% fee increase. the campout will start at 9:00 this morning. the uc regents meeting that was supposed to start today in san francisco, it's not hamg. the regents canceling the meeting after someone made threats of violence. they were supposed to be held today and tomorrow at ucsf's mission bay campus. a legal blow for a former oakland police officer who says his reputation was tarnished. a u.s. district judge threw out a federal lawsuit by former sergeant der win longmeyer. he argued oakland pd and the california department of justice launched bias investigations over him overall gagss he compromised the bailey murder case. questions rose over ties with

yousef bay iv. the district judge ruled evidence showed longmeyer had an affiliation with the bakery and its members which was suf firnt cause to start the internal investigation. the controversy surrounding the bankruptcy at lay-offs at solyndra continues to grow. it looks like the timing of the company's first lay-offs were influenced by politics. business and tech reporter scott mcgrew is live in the newsroom with more on this developing story. good morning, scott. >> good morning. this dates back to last year. we remember the massive lay-off and bankruptcy earlier this fall in at solyndra. let me remind you of the earlier lay-off this time last year, november 3rd, 2010. that's when solyndra laid off for the first time exactly one day after the 2010 midterm elections. the republican-led committee investigating solyndra and its loans says that's darn suspicious. it says it has e-mails from solyndra's biggest investor, argonaut equities that says the department of energy did ask

solyndra to hold off on the lay-offs. in the memo the doe doesn't say specifically to hold off until after the congressional elections. it never explains why november 3rd was picked as a date. the department of energy secretary stephen chu will be testifying tomorrow before the house energy and commerce committee. i have no doubt that will be one of the very first questions they put to him, why november 3rd. back to you. let's check in with meteorologist christina loren. don't wash the car just yet. >> in fact, you probably won't want to watch that car until you take off for your thanksgiving travel. today is the last day with full-on sunshine. warmest day of the week. livermore, ten miles of visibility. looking good everyone except in the north bay where visibilities have been coming in and out all morning long. about a half mile in napa and dense pockets of fog reported

the secrete service says a bullet hit the white house window. bulletproof glass stopped the bullet. they found another round of ammunition near the outside of the white house. the discoveries come just two days after a shooting occurred near the white house on friday or a few days, i should say. agents have not linked the bullets found yesterday to that shooting however. president obama and the first lady were in california at that time. we're now officially one week from the deadline set for the debt super committee in washington to try to come up with more than $1 trillion in budget cuts. of course, it's the same old story. democrats want to bring in more revenue, that could mean tax hikes. republicans, on the other hand, want to cut tax rates and cut back some social services. if there is no deal, $1.2 trillion in automatic budget cuts will kick in.

flow, beautiful, beautiful start this morning. temperatures radio on the cool side this morning, we have dense pockets of fog, not in san francisco, livermore or oakland. you'll find the pockets in the north bay, in your agricultural areas, napa valley down to quarter mile in santa rosa. about a half mile of visibility in napa. you want to take it easy up there. you want to dress in layers today. temperatures are running cool this morning. we'll see a lot of sunshine and warmth later today. near 70 degrees almost all across the board. 50 in oakland, 49 in san mateo. temperatures are all over the place. as we break for lunch, we are expecting the mid to upper 60s in some cities. 65 in livermore, rounding the day at 69 degrees. 66 in los gatos and 68 in redwood city. everything changes about 36 hours out from our first showers in the north bay, the showers will continue tomorrow night and then the activity really ramps up early friday morning, lasting all the way through saturday.

we'll get a nice dre' break for the second half of your saturday. but sunday looking like another washout. low pressure moves in not only bringing in that rain, but bringing in very cold air. temperatures in the 50s as we head through probably saturday, sunday, all the way through monday. and i like to point out, you know, a lot of people are trying to get out of town next week. big holiday travel week. you'll be able to do so with some pretty nice weather. looks like the showers will subside just in time late monday, nice clear sky. sun and clouds for tuesday. we'll talk about the showers, and what it means for your ski resorts, many opening on friday. let's find out how your drive looks with mike. typical pattern for northbound 101 slow to 680 and also north around guadeloupe, both directions. a new accident in the southbound direction, 101 towards the 280/680 interchange as well. lower bayshore moves nicely.

speed sensorses for 101 showing close to the limit as you're traveling through menlo park. lower visibility christina has been talking about for the north bay, that might be contributing to the speeds coming down towards 50 for highway 12 down to 37. your commute direction for 101. let's move from san rafael in through the city. oakland, 880 as the volume picks up past the coliseum. you're at the limit from the nimitz from san leandro toward the toll plaza where it's getting crowded. an unwanted surprise for a south bay property owner after he finds out one of the homes he was renting out was being used to illegally grow marijuana. marla tellez joins us with more including on how police discovered the pot. >> reporter: good morning, laura. this story involves two burglary suspects, a lot of marijuana and a home own who are says he knew nothing about this. here we are on gorano drive.

this is the home essentially turned into a pot grower's heaven. san jose police were responding to a break-in at this home yesterday afternoon. they showed up to find two guys attempting to burglarize it. they arrested those guys and hauled them away. when police entered the home, they found an extremely sophisticated pot growing operation complete with a special lighting and ventilation system. all in all officers seized at least 100 marijuana plants. the owner says he's been renting it out for three years and every month the rent is paid on time, no problems with the renter. he says saying he's shocked is an understatement. >> i'm livid, and i feel completely violated and i feel like i want to sue somebody. i'm just beyond pissed. i've never been this upset before. >> reporter: neighbors are upset, too, but relieved about the arrest saying recently there has been a rash of break-ins in

their otherwise family friendly neighborhood. >> it is very carry because, you know, any time anybody breaks into your house, it's such a huge violation. literally there's so many people we know that have gone through this. this is actually nice that they got carted off today. >> i put in a call to san jose police this morning to find out about the renteder. they sayality this point they're still looking for him. in the meantime a neighbor came out. i talked to her. she said the renter would come home once a day. coincidentally he did not come home yesterday. live in san jose, i'm marla tellez. laura, jon? >> i would imagine he might stay away for a while. thank you, laura. san jose lowers speed limits around schools. not everybody is happy about the move. speaking of san jose, waiting for the sun to come up this morning over hp pavilion. change in the weather

welcome back everyone. 6:23 right now. south bay commuters will have to drive even slower in the school zones. san jose city counsel voted on tuesday to adopt a 15-mile-per-hour speed limit close to all city schools. backers of the plan say it will save lives, but there's a catch.

schools would have to pay the city thousands of dollars to post the new speed limit signs. some council members question the move saying more should be focussed on major roads where the majority of accidents occur. voters in west contra costa county passed a partial tax to save doctors medical center in san pablo. the hospital needed cash to deal with its operating deficit. measure j passed yesterday. according to unofficial results, $47 a year parcel tax will bring in about $5 million a year. doctor's medical center is the only medical center between berkeley and vallejo. a divorcing couple being forced to exchange facebook passwords. the man's attorney got his wife to give up the password during the process. he then downloaded all of her messages as evidence. the judge decided that should be

a two-way street. now the couple will exchange all social networking passwords including ones for dating websites, match.com and eharmony. >> that one can be an ugly adventure. when it comes to google, scott mcgrew says stay local. >> stay loyal. >> sorry. >> google offering to allow you opt out of a system collecting your name's wi-fi router. i say keep the name in the system because it's not hurting anything. google cars drive around the bay areas and record the name of the wi-fi signal. why? to help make the maps on your phone work better. if you're in a parking lot and your phone detects a wi-fi signal from, say, panera bread, store no. 123, it will cross-check that and figure out you're in milpitas. it doesn't cost to collect this data and does no harm to the

wi-fi signal. if you do want to opt out with this new offer from google, check out our fis book page and i'll show you how to do it. the engineers at linkedin have a clever way for you to access information about people in your world. you take a photograph of a person's business card, and it's automatically added to your phone's address book, and the person's entire resume and social network is downloaded from linkedin as well. that means a business card turns into pages and pages of information. >> you get the entire history of -- way beyond what's in that card. i think that's a starting point of reinventing the business card, by really starting to tell you the person behind the card, the who, the what, the where of that person. the app is called card munch available form free but only on iphone. that, by the way, is interesting. the company says it does plan to roll out on other phones. linkedin thinks the few tower of business phones is the iphone which is a fairly new concept. it used to be blackberry was the

right now the thickest fog is in the north bay. we have light patchy fog along the peninsula, expecting that to clear up by about 9:00 a.m. we have rain on the way. we'll tell you how it arrives. mike inouye, how are we looking on the morning drive? >> getting crowded out there. in san jose, a new accident at capital avenue. it's counter commute. look at the one to the south. southbound 101 at 280, that's also counter commute, but causing a slowdown in the commute direction because of the distraction. the east bay has a build of its own. 6:31 right now. just into our newsroom this morning, the fbi may have caught one of the most wanted terrorists, a bay area man accused of bombing local companies. danielle andreas san mateo in september of 2003, he allegedly

bombed the shekly corporation. he disappeared in 2006. san diego was born in berkeley, grew up in san rafael, the first american to be put on the fbi's most wanted terrorist list. the boston division of the fbi will hold a news conference this morning to talk about the case. we will have the very latest details during our newscast at 11:00 and a full report at 5:00 and 6:00 as well. you can always find information on nbcbayarea.com. police are taking down several occupy sf tents. they make a handful of arrests over the night. "today in the bay's" bob redell joins us live from san francisco on why they made that move. >> reporter: what happened in recent days, occupy sf'ers responded their camp site onto the sidewalk in front of 1 market street. you can see police are still there to make sure they don't try to return. protesters say they needed to expand because they're out

growing justin herman to your left where they have 200 tents. that's where they've been for several weeks, and also the sidewalk in front of the federal plaza. the city says moving in front of 1 market street was too much. around 1:30, police officers in riot gear took down this mini camp, removing 15 tents and arresting seven protesters, citing and relosing them for camping. one protester showed us bruises on her arms and legs she says she received when she claims policeman handled her during the overnight sweep. occupy sf'ers weren't surprised. they said they knew it was coming. police had been warning them to please leave. frankly the officers became frustrated with this new camp because it was making it hard for people to get by on the sidewalk. the city says they had an understanding with the protesters they would tolerate their presence outside justin herman and federal reserve, but by expanding it was a violation of the rules.

>> i understand what they're saying, but at the same time they don't understand where we're coming from. the only way we can get them to do that is by making a statement by doing that. because we have tried and we have tried and they're not listening. there's only one way to get them to open their ears and that's by showing it, by taking action because obviously words aren't working. >> reporter: apparently there will be words between occupy sf protesters and mayor ed lee. one of the spokes people for the protesters say they planned a meeting with the mayor and he agreed to it at 10:00 this morning. we know mayor ed lee has grown frustrated with the health and sanitation issues at justin herman plaza. there are reports of par vo coming up, that's a dog disease. the protesters say they want to expand, try to expand to 1 market street. now they ear talking about trying to take over the civic center plaza in front of city hall. live on market street, bob redell. more from the occupy movement, this one in cal and it

is gaining strength. thousands of demonstrators on the cal campus with their tents despite the university dismantling them just last week. "today in the bay's" christie smith is live in berkeley with the latest. >> reporter: good morning, jon. a lot of the demonstrators are up and walking around. they gathered on the far side of the steps there because there was a rumor running through here that police might be moving in on him. one officer just told me, look, after 12 hours, some alameda county sheriff's deputies moved out to gone home. it was early yesterday when demonstrators decided to reoccupy cal and tried to pitch therapy tents again. one officer told me overnight a number of these tents actually went down, some people going home. at least a dozen of them are still out here this morning. one demonstrator pleaded with police to at least allow the tents for now and they would try to re-evaluate in the morning. last week, of course, police moved in and tore the tents down, moved in on students.

there are now two separate inquiries into police use of force tactics from that. this morning, though, one student said they're going to decide more about what's next soon. but in his opinion, they're not leaving. >> i don't think we're going to bend to administration pressure. i don't think we're going to say that's fine, we demand our first amendment rights. we're here to say. the fact that 5:00 in the morning there are 150 people here says something about the movement. >> reporter: there's morning there's a group of demonstrators running around blowing bubbles trying to chat up police and sheriff's deputies. it stayed mostly peaceful. there are a number of demonstrators here from occupy oakland who had their encampment raided at frank ogawa plaza this week. what's happening is officers have told the group it's unlawful to camp and have tents out here. but at this point everyone has pretty much kept their distance. that's the story from here. reporting live at uc berkeley,

i'm christie smith. jon and laura, back to you. 6:36 right now. the construction of the new bay bridge tower is drawing attention, but not the kind transportation leaders want. a state oversight committee announced yesterday it has requested a formal review of the foundation of the new bay bridge tower. the request comes after sacramento bpublished sunday raised testing about the concrete that helps support the tower. a technician and his supervisor were fired. it reports that that technician lied about test results. meteorologist christina loren is back to tell us, it's going to be sunny outside but a little crisp. >> a little crisp to start you out. we actually do have some fog. it's not that thick. you can see at the very top, the tip top, the red light flashing here on the transamerica pyramid. i'm thinking by about 9:00 a.m.,

nutritional standards that actually they had asked for in some cases may be too expensive and too burdensome on local school districts like those there in the bay area. so now there's a rules committee meeting today and a vote scheduled this week to determine whether or not these new rules can go forward or whether there needs to be more study on things like salt reduction and whole wheat foods which is what republicans are calling for. some food advocates here in d.c. say it's a shame. these rules need to be in place. but others like the frozen food industry say look, potatoes, healthy, fiber, vitamins, potassium. we're waiting to see whether or not these rules will be in place. may not be as critical in california because california is one of 20 states that's already set new trishl standards for school lunch higher than what the federal government has. >> california leading the way. >> the good news is chocolate

when we see this live shot. chilly in some spots. 39 in santa rosa. as we head throughout the afternoon, we'll lose the fog quickly. sun will shine through. that's going to make for uniform conditions from the coast to your inland cities today. high pressure at its maximum. mild conditions, a little patchy fog to get through. later today we'll see full-on sunshine, the last day of full sunshine. everything changes as we head through tomorrow. so enjoy the 69-degree temperature we have in san jose, 66 in los gatos and hit about 69 degrees up in santa rosa, wine country. once you get rid of that fog, it's goings to be a beautiful day up there. 4:00 p.m., things start to change in wine country. the first showers arrive. the showers will spread to the south overnight. not expecting a lot of action tomorrow night. most of the action will take place over the course of tomorrow, lasting through about 6:00 p.m. the good news is the rain should subside for your evening commute on friday. low pressure keeping things on the cool side.

northbound 85, also starting to show the slowdown as well. livermore, slower drive, 22 minutes out of the altamont pass. slow past the newly opened interchange with isabel for 580, towards 15 miles per hour at times. just blips here and there. then clear by the time we get to the dublin interchange so far. look at the drive towards the bay bridge and the toll plaza. slow drive down the eastshore freeway, speeds into the 40s. your approach for 24 and the caldecott, looking all right. a live look at the golden gate bridge. even though the traffic moves slowly through the area. the low clouds in the north bay and low visibility through novato and napa that christina has been talking about. that could be an issue for the drive as well. 6:49 right now. while you were sleeping, san francisco police made a big move on the occupy sf encampment. "today in the bay's" bob redell is live on market street with what's happening.

>> reporter: they're not happy. what happened overnight around 1:30, police targeted campers parked out in front of 1 market street. they moved here several days ago because they say they were running out of space over at justin herman plaza where you have a couple hundred tents set up. this has been the main area for the occupy sf movement. that's an area the city has tolerated. also tolerated campers being outside of the fastball. when they started moving in front of 1 market street which is in front of both locations, that's when the city thought enough was enough. around 1:30 this morning, police officers outfitted in riot gear came in, surrounded the area. they asked the people in there to leave. they ended up taking away 15 tents and arresting seven people, citing and releasing them for camping. the issue with protesters is they say they're running out of space at justin herman and becoming a health and sanitation issue.

that's something the city does agree with them on because there's been reports of par vo. that's a dog disease coming up there. this is getting too crowded and the port-o-potties can't handle that sort of crowd. later today at 10:00 a.m., the protesters say they have a meeting scheduled with mayor ed lee of san francisco. this was something planned in advances. they want to bring up if notion of possibly expanding. if they can't have 1 market street, they're now talking about taking over the civic center plaza in front of city hall. >> interesting to see where it goes from here. thank you, bob. occupy oakland may be slowing down, but occupy cal is building up strength. thousands of demonstrators on the cal campus this morning with their tents despite the university dismantling them last week. last night the movement got another jolt and legitimacy from a high-ranking cal professor, a former white house power player. so far police have not moved in to evict the protesters. student protesters say they have no plans on leaving sproul

plaza. cal campus police don't think a man they shot in a computer lab has any connection to the occupy protests. that man recovering after surgery this morning. a woman called police after she saw the man flash the gun in an elevator at the haas school of business yesterday. later that man pulled out the gun inside the lab. police shot him after he, quote, displayed it in tlat ening manner. we'll get more details during the news conference today at 8:30 this morning. we'll have the latest for you on nbc bay area this morning at 11:00 a.m. 6:52 right now. the suspected gang members accused of killing a teenage girl in a morgan hill drive by shooting are expected in court today. they're set to enter pleas at 2:00. the four men and a teenage boy are charged for the killing of 14-year-old tara romero. she and friends were waiting for a ride near an apartment complex when a car drove by and the people inside opened fire. romero's three friends were

injured. they seemed like very good tenants. they maintained the house, didn't cause much trouble and always paid their rent on time. now we're finding out why they didn't have any problems making those payments. the home was being used as a massive marijuana grow house. "today in the bay's" marla tellez is live in san jose with the strange story. >> reporter: good morning. behind me here this is the unsuspecting home in south san jose on gorato drive. the homeowner says he's been renting this place for three years, never had any problems with the renter until yesterday. here is how the strange story unfolded. san jose police were responding to a break-in at this home yesterday afternoon. they showed up to find two burglary suspects in the driveway. they arrested those guys and that's where it gets interesting. police entered the home to find an extremely sophisticated highly elaborate pot growing operation. each room outfitted with a special lighting and ventilation

system. all in all officers hauled away at least 100 marijuana plants. the owner of the home says he's shocked and livid, saying all along he thought he was dealing with a responsible renter. he got his rent through direct deposit each month and never had any reason to question his tenant. at this point san jose police tell me they are looking for this renter. a neighbor tells me the renter would come home once a day. yesterday he never showed up. jon? >> marla tellez, thank you very much for the report. 6:54 right now. a campbell woman can thank text messaging for recovering her stolen car and a thief who had a big change of heart. monica salazar left her car running in front of her apartment. temptation was too great for the thief. he jumped in and took off. salazar left her cell phone in the car and the next day her sister texted the phone asking the thief to give the car back. then the unthinkable happened.

next month. santa clara city council continues to move forward with preparations for the new 49ers stadium. the city approved $10 million to get the groundwork done for the future stadium. work would start in january and include clearing the area next to great america and rerouting underground utility lines. the 49ers will pay $6 million of the $10 million needed. now to more on that growing scandal at penn state. pennsylvania's governor approved a $3 million state grant to accused child molester jerry sandusky's charity as recently as july. governor tom corbett signed off on the grant despite knowing about the investigation. in fact, corbett was state attorney general when his office launched the investigation that resulted in 40 charges against sandusky related to child abuse. that $3 million would have paid for a new center for troubled children. the money was never distributed and the grant is now on hold.
