good morning, everyone. i'm jon kelley. >> and i'm laura garcia kelly. let's check the forecast with christina loren. >> we have drizzly fog out there. we are 12 to 24 hours away from this front moving into the bay area. it will hang around and then another storm on its heels. we'll tell you what it means for today. keep the umbrella handy. >> yikes. roadwork. highway 116 is currently closed at highway 101. i know for our friends driving towards san francisco. >> we'll check back with you. thank you, mike. >> the first walkout in the history of the cal state university system and it's happening today.

>> professors, lecturers, coaches and counselors are planning a strike at two different campuses. >> in an hour and a half is when the general will strike start here. what they'll be protesting, the lecturers. the professors. the teachers. the counselors. they'll protest that the tsu system hasn't paid pay raises already agreed upon. pay raises they are supposed to receive for the 2008 and 2009 school years. they said they simply can't afford to and pay the state for slashing funding to the school system.

sacramento is in such a big hole financially. they say they do not have the money and if they are to pay them out they have to reduce classes for students more. just yesterday the board voted to raise tuition. that's an increase of under $500. that illustrates the financial bind that they're in. there are 23 campuses in the system. but the union for the faculty, the california faculty association decided to focus on these two campuses. we understand they could be traveling to participate. classes will be in session unless your instructor told you

otherwise. bob redell, jon and laura? >> we'll check back with you throughout the morning. california state budget is in trouble. new report from the legislative analyst office shows the state's projected revenue for the year is more than $3 billion short of what lawmakers predicted it would be. that could trigger automatic budget cuts. the official report is due out next month. today is nothing short of a crucial day in the ongoing legal battle over same-sex marriage here in california. the state supreme court is expected to decide if supporters can continue to defend their ban on gay marriage. both the governor and the attorney general refuse to defend the ban. now it's up to the court decide if prop 8 backers have the legal

standing to intervene. a federal judge already declared the voter-approved ban unconstitutional. if the supreme court decisions to sponsor it cannot defend the state law on their own. >> we're learning more about the gunman killed in a confrontation with police at uc berkeley. also a self described computer nerd. on tuesday he was shot and later died after he allegedly pointed a handgun at campus officers. >> >> officers were giving him commands. he definitely didn't do so. >> we need to think about the support system for students who

are under a lot of stress. >> travis just started his first semester. he was attended classes where the confrontation took place. >> san francisco's mayor says occupiers need to clean up their act. mayor ed lee told activists the camp is a health and safety hazard. police say the occupiers have to follow the rules or they will be kicked out. some protesters are trying to clean up. >> we are cleaning up because one of the reasonings for shooting people is saying it's unsanitary. police are arresting nearly # 5 protesters. fire departmentally nobody was hurt. san francisco police say protesters try to take one officer's gun. today marks the two-month

anniversary of occupy wall street. they call for a national day of action. they plan gatherings at new york stock exchange and more than a dozen subway hubs around the city. the death ov a 4-year-old boy sparks an investigation at children's hospital in oakland. he had complex breathing problems. everything went well, but when he was taken to recovery room he went into cardiac arrest. he did not respond to aggressive efforts. >> the hospital is now conducting its own investigation into what happened. >> we have a better picture of a man suspecting of kidnapping a girl in los gatos.

the suspect is described as a hispanic man in his mid 40s. clean shaven. about 5'6" with a stocky build. he was last seen in a small four-dour station wagon. police believe the suspect tried to abduct a 17-year-old girl. if you have any information call police. >> a bay area entrepreneur getting a big time honor in washington today. the founder of my first yoga outreach program for kids. it all started as a small studio but quickly grew to include dozens of schools with books and a mobile app.

it's 4:38. >> it's far too early for that. good morning to you. we're looking good so far. we have reduced visibility. you can tell the pattern is changing right when you walk out the front door. it's pretty early to have visibility reduced to half a mile in livermore. we're not expecting much, though. here's the bulk of this moisture now pushing into the northern most portion of the state. lightning is firing off. unstable air mass. isolated thunderstorms later today. we're not expecting much in terms of rainfall. maybe oon isolated shower at 3:00 p.m. west of santa rosa. we stop the clock at 9:00 p.m. a little cell north of san jose. then we start to get more action.

welcome back, everybody. on a thursday. we give you a live look at san jose. all is calm. misty and cold. christina loren here to tell you about that. the man wanted in connection with a shooting incident at the white house is expected to be in federal court this morning. 21-year-old oscar ortega hernandez was arrested at a hotel in pennsylvania yesterday afternoon. he's now in the kcustody of secret service. he fired shots near the white house last friday. two bullets with were found close to building. >> newt gingrich is rising in the polls, and with his success comes new criticism. critics are raising questions about his time working as a consultant for freddie mac in the years leading up to the

nation's big housing crisis. he hasn't said how much money he made but it's believed to be $1.68 million. his work may turn away a lot of republican voters. gingrich says he offered his advice as a historian. we're set to get the latest jobless claims in an hour from now. futures are down. for more on that let's turn to jackie live at cnbc headquarters. >> futures are in the red after stocks were knocked down yesterday afternoon following a report warning that u.s. banks could take a big hit if europe debt crisis spreads. that's not entirely new news. but investors are on edge over any headlines across the pond. france and spain sold bonds at high yields. it's much more expensive for them. in the u.s. we'll get data on

you have three-quarters of a mile in napa. my eyes really come over to the tri valley region. as we head throughout the day, all the cold air and rain showers arrive. by 11:00 p.m. that's when we get down to the south bay. you have to wait a little while. you see activity in the south bay. this is computer generated. i can tell you we are going to see a little bit more shower activity than this is representing. but really not much of anything. so 9:00 a.m. it starts to get active. that will continue to ramp up late friday to early saturday. saturday night into sunday things really start to change. we have a juicy system on the way. we could be measuring the rain

surrounded the plaza. students don't seem too concerned. we've been following the story all morning long. we'll bring you an update in a half hour. our private health records could be in the hands of the wrong people. one stolen computer has millions of people on alert. this is about the security breach. this ichb cluds names and addresses for more than 3 million clients of sutter medical. health records for another million patients were also on the computer, which was stolen from one of the foundations and zach m sacramento offices. the information on the stolen computer had not yet been incrypted. a family wants to know how they loved one disappeared and was found dead hours later. roma was last seen 5:15 saturday night leaving a salon.
