>> it is sad. this stunned the entire city of vallejo. he was father, a marine, a coach. flowers are here. there was a sign on the lobby door saying it's closed due to an emergency. this is where james worked for 19 years. r he was shot and killed yesterday responding to ab bank robbery. police have spotted the getaway car and followed it. he used his patrol car to stop the car. the suspect ran. he was working by himself. other officers arrived and heard three or four shots down in a backyard. he was 45 years old.

after previous tests found a low blood alcohol level. she and her friends drank soda mixed with vodka. the parents say the bottle was not theirs and may have belonged to a previous tenant. now to a story only on nbc bay area. police arrested a man suspected of killing an occupy oakland camper in frank ogawa campus. cell phone obtained exclusively shows a man police say is a suspect in the killing. he's now being we questioned by police. last week 25-year-old foster was shot and killed at the occupy oakland camp. foster was trying to get back on his feet. >> it's a new story. it's not something abstract that you see. you see so much potential. >> police aren't sure if the

than they arrested is the gunman. they're looking for other potential suspects. >> plans are in the work to reoccupy oakland. they will hold a press conference today to announce the new site of their encampment. they're planning to camp at a park on 19th and telegraph. it's about half a mile away tr the previous camp at frank ogawa plaza. protesters also plan a day of action to be held tomorrow. they'll hold a rally and plant a new garden. occupy san jose had a huge turnout as they marched on city hall. >> last night hundreds of people protesting on the streets of san jose. several union groups were part of the protest. they gathered on the steps of mlk library before peaceful march to city hall.

no reports so far of any arrests or problems. pg&e natural gas pipeline that is 75 years old and runs through a palo alto neighborhood will not be strent tested. the pipeline installed in 1936 runs a half mile between alma street and middle field road. pg&e says it's not the policy to test pipeline segments identified for replacement. the pipeline is a big concern in the neighborhood. automatic budget cuts for the state of california could kick in at the start of the new year. even if it happens school districts will be safe for now. many school districts ignore lawmakers rosey revenue projections, planning finances with enough cushion to absorb a possible spending cut. oakland unified, alameda unified as well as several other bay

area school districts were among those who opted for the approach. for those who planned ahead, they don't prompt bankruptcies or a shorter school year. here's news that smells so good. the transit agency adding new vinyl seat covers for 200 train cars. they decide to spend nearly $2 million to make a ride cleaner and better for riders. they'll install the first round of new seats starting next spring. bart is also pushing ahead with a proposal to run buses through midnight when strain service shuts down. they hope to begin some time next year. it's refreshing. just like the forecast. >> it's really nice out there. we'll get clean air through the weekend. that's what happened when rain

showers move over the bay area. we're getting a little bit of action but not a lot. the bulk of the moisture is sitting north. the showers slide south throughout the morning. a little bit of isolated activity in the east bay. see more of this at 7:00, 8:00, 9:00. this afternoon and evening spotty showers continue. we have a lot of rain on the way to the weekend. we'll get to the forecast in a moment. but running much warmer than we were at this time yesterday. we were in the mid-50s in some city ls. 54 in oakland. 52 in san francisco. 47 in sunnyvale due to clouds overhead. we'll tell you what to expect later on today when we climb five degrees in some cities. we want to get you on your way to work with mike inouye: >> we'll take you to the south bay for another accident on the roadways. southbound 85 at camden avenue. an accident is just off there at the offramp. the debris is reported all

across the roadway as well. but no major slowing for highway 85. on 680 we have another accident that should be moving quickly to the shoulder. no major injuries for this one. we still have a deadly accident in the east bay, eastbound. highway 24 and lafayette. three lanes are still currently blocked. five cruisers on scene. an accident happened between three cars. one person died as a result of this accident. the coroner has yet to get on scene to make the confirmation and file a report. chf tells us one fatality reported after the accident. sad situation. traffic is now slowing. it's so light. thank you, mike. 4:40 now. six abandoned puppies are recovering after they were found hungry and infested with flees. the six puppying were found in royal oaks just eat of

of molesting a child who worked at the team. the allegations center around bernie fine who has been at the school for 30 years. he met him when he was a ball boy. the man is now 39 years old but said he started molesting him when he was in seventh grade. he said the alleged abuse happened in various places. the university put him on administrative leave while the investigation continues. congress is avoiding a government shutdown by approving a temporary spending bill. the supercommittee has yet to come up with a plan to slash 1.2 trillion from the nation's bottom line. >> our debt yesterday will be a giant wakeup call to the congress that it's time to rip off the band-aid and do what needs to be done.

>> there needs to be a balance. it needs to be fair. >> the super committee cannot reach a deal, automatic cuts will kick in, including $600 billion from the pentagon. congress has already approved. now one of the spending programs on the chopping block is president obama's high speed rail funding. this week they agree to a measure to eliminate the funding. the first phase is already funded. it doesn't mean the funding won't come back in years to come. stocks seemed poised for an uptick at the start of trading. for more on that, let's turn to jackie deangeles.

>> futures are pointing to a positive stock market open this morning. even though stocks and commodities were hammered yesterday as investors eye debt concerns out of europe. thaw makes it more expensive for the government to borrow money. the nasdaq lost 51 points, closing at 2588. heinz is due out with quarterly openings this morning. they are expected to earn revenue on $2.9 billion. they're facing higher commodity cost ls and slower sales. despite that, some analysts say the makers of the potatoes and classic pasta sauce will outperform them. that's because they come from emerging markets. and now that amazon launched the kindle fire there's talk that it's building a phone.
