right around the exit. we have a three car accident that resulted in the death of at least one person there. we don't know if this will reopen. no slowing yet. light volume. at least it's a light commute. >> well this morning the flag at the vallejo police station is flying at half mass in remembrance of a fallen officer. he was shot and killed chasing a bank robber suspect through vallejo. christie smith is live where a memorial is now growing for the 19-year veteran of the force. >> good morning. this has stunned the police force but also the entire city. james worked here for 19 years. everyone knows him and they liked him. there is a note saying the lobby

is closed due to an emergency after the 45-year-old officer was shot and killed during a foot chase after a bank robbery yesterday late afternoon. police shotted the getaway car and they followed it. the chase ended on janice street when capu used his car to stop the getaway suv. he was working by himself at the time and took off after the suspect on foot as other officers arrived. they say they heard shots fired, and ultimately found him down in a backyard. he was the type of guy who took in friends. >> killed in a motorcycle accident, i believe last year. they left behind two children. they were very close friends with the couple. for a short period of time these children were living with him. he had done additions to

accommodate him in the house. >> police did arrest one man yesterday, but they're not releasing a dot of details about him. they're telling us right now they're not rooking for anyone else. he had a long history of service as a marine, a chp officer. he also worked as a high school coach. he was officer of the year. he was the fourth officer in vallejo to die in the line of duty. christie smith, jon and laura, back to you. >> such a sad story, christi. thank you for the update. family and friends will gather to hold a memorial service for the people killed in the jonestown mass suicide. they will be at evergreen cemetery where a memorial to more than t 900 people killed was dedicated in may. more than half of the victims are buried at that cemetery. on november 18th, 1978 members

of the fran's people's temple committed suicide led by reverend jim jones. today's memorial is at 10:00. it is 5:03. p peninsula tem who dead nated a pair of pipe bombs on high school campus aimed at killing his former teachers must now pay. he's ordered to pay the district more than $120,000 in damages and last wages. this august of 2009 the 19-year-old went in with a chain saw, 10-inch samurai sword and ten homemade pipe bomb ls. this is part of a plan to kill his former teachers and as many students as he possiblily could. during his trial he was doiged with schizophrenia. he's currently at napa state hospital. suspected serial killer suspected back in a courtroom this morning. a judge will hear motions filed by the prosecution.

in this case he is representing himself. meanwhile police are trying to determine if a 24-year-old cold case is linked to him. earlier this year -- earlier this month they announced similarities between naso's alleged murders and a jane doe killed in the city in 1997. the future of california's school system seems uncertain. but for now it's business as usual. the state is telling school districts to budget as if there will be no cuts. >> laura, good morning. we all know what it's like to balance budgets for the state's 1,000 school districts, they're having to get creative to make it through the school year.

they are having to take out short-term loans. this school district is borrowing on the markets, planning more contingency furloughs and will cut the school year short by three days this year. it's estimated the state will cut $10 billion then. that will force almost all districts to cut more. this breaks down to $180 per student. there's a state law that stops districts from laying off teachers in anticipation of mid-year cuts so they can breathe a sigh of relief. the jobs are stable at this point. most school districts will not str to cut their school year short this year. however, here in san jose they

might have to by three days. it all depend on what governor jerry brown does in february. i'm marla tellez, laura? california's high speed rail plan is not derailed yet but it's hit a roadblock. that means california will not get billions of dollars in federal aid for the project, something the state was depending on. california released $4 billion so far. the entire project is expected to cost $100 billion. a legal battle between conservation groups continues in san francisco today. the group wants sharp park golf course to stop mow mowing the lawns. they say it could hurt the rare california red laked frog.

they want to this ban them from raining the ponds. it could dry out eggs laid by the fogs. a judge are rule today on the request. zai 27 and counting. the occupy protesters camped on top of city hall says despite a warning from police, he's not going anywhere. city officials wrote him a letter telling him he was trespassing and he needs to leave. kelly promised to stay up there for 99 days. he admits he did come down for a few minutes on saturday. the city says trespassing citations can cost up to $1,000 or result in six months in jail. let's check the forecast with christina loren. >> good morning to you. we have rain on the way. nothing significant just yet. so this is what we're looking at

right now. a few isolated showers in livermore. overall, just the clouds coming in at this point. throughout the next couple of hours we'll see more of this action. you're at 50 in novato. that's 14 degrees warmer than 24 hours ago. that's because of the clouds coming in. throughout the afternoon we only climb in temperature by 5 to 8 degrees. not much spread when it comes the your temperatures. we could see some fog develop in the north bay over the knicks co next couple of hours. we is tet the future cast in motion. action starts to ramp up between k9d a.m. and 2:00 p.m. ch first, let's check your drive with mike inouye.

>> in the south bay we have the accident in the clearing stages now. southbound at camden avenue. let's take you to the maps and show you what we're talking about. the crews may be cleared, including the fire truck, which was the biggest distraction there. that's at the bottom of your screen. the top of your screen, 680, the earlier accident completely cleared from the roadway. no major slowing or incidents blocking the roadways for the south bay commute. we'll look at the toll plaza. your commute getting to the toll plaza, no slowing. easy drive right now. we're preparing for the effectses of rain but so far no big deal. dozens of south bay foster children are about to get new homes and families. it's part of national adoption day. santa clara county will expedite the adoptions of as many as 30 kids this morning. judges and court staff volunteer

towards the walnut creek interchange. pleasant hill road is a scene of the three-car accident. one person was thrown from the car. that is presumably the person who died. we're waiting on the tow truck and the coroner. big distraction because that divider is only about hip high. you can see what's going on on the freeway. over here no slowing towards the altamont pass. we'll show you what things are like on the peninsula. visibility is not a problem in the peninsula itself. no slowing, guys. so send it back to you. it's 5:17. an illinois man filed a class action suit against southwest airlines. saying they owe him 45 alcoholic drink tickets. adam says the airline changed

its drink coupon policy. he received $5 drink coupons with no expiration date for flying business select. but southwest changed the policy last year, only allowing people to kuz the coupons for the day of the travel on them. levitt says that's a breach of contract, and he's suing. got to go check for my own tickets. for the rest of your news before the bell. we turn to jackie deangeles live at cnbc. good morning, jackie. >> good morning, laura. stocks and commodities were hammered yesterday as investors were eyeing debt concerns. spanish bonds continue to sell at high yields, which makes it more expensive for the government to borrow money. europe was lower this morning as well. we saw the dow fall 134 points yesterday. the nasdaq lost 51. closing at 2588.

kodak is reportedly looking to sell the online photo sharing business. sources are telling the wall street journal they have approached rivals, private equity firms and retailers to buy kodak they are looking for hundreds of millions dollars for the service in an effort to raise money to fund the turnaroun turnaround. >> it is official. ed lee is the next mayor of san francisco. the elections office confirming that. and ross is the next sheriff. prop h would have asked the san francisco school district to change the way they assign them.

bay area workers could have another way to get home. the follow-up to a story we brought you yesterday. they are pushing ahead to run between stations when train service shuts down. sigh viral seats are the way to go. about 15% of the train's fleet will have a brand new look. bart will replace the familiar fabric seats with vinyl seat covers. in about 100 trains. they took a poll last summer. the majority of them preferred vinyl seats. they say vinyl is easier to clean than fabric. >> we gt to take you on bart,

prop 8 backers allowed to defend their measure in supreme court. the court unanimously ruled the sponsors of the ban on gay marriage can step in if state officials refuse to defend the measure. the opinion was passed onto the ninth circuit court of appeals looking at the constitutionality of proposition 8. prop 8 supporters are asking the court to overturn last year's decision by u.s. district judge. which struck down the measure. travelers flying out of sfo this thanksgiving holiday could be taking home a prize. maybe like an early christmas gift. sfo twitter followers to win an ipad and other prizes. here's the deal, contestants who fly in and out from november 21st to 23rd can participate in the contest. they will search for clues in the airport to help a turkey named pardon catch a plane to escape being thanksgiving dinner. the airport says the contest is to help people get into that thanksgiving spirit. 5:24 right now.

more events this morning. the bay area is going to a split recovery. some gaining. some losing. scott mcgrew joining us with more. >> split not geographically but by education, too. one college graduate faces a much different job picture than a noncollege graduate this the east bay or the peninsula. here you see fremont, which lost so many jobs with the closing of the muni plant. not only is the east bay not growing economically, parts are retreating. the unemployment rate going up. okay, here's the data from clabtive economic showing san francisco and redwood city growing by about 1 percentage point. san jose, cupertino and sunnyvale rolling ahead. and vallejo is the hardest hit.

in san francisco yelp will fire for a public offering to stock. yelp recently won court victories over small businesses that are accused of strong arm tactics. jeremy stands to make tens of millions of dollars as the founder of yelp. thursday's shares on angie's list went very well. a price went from $13 to $16 in change. we'll keep our eye on the company today in the first full day of trading. if you're thinking of investing in yelp. i've added a link to the facebook page. they have yet to keep a profit. >> but no recommendations. either way. still to come. occupy oakland looking to reclaim the space. details on the weekend action coming up. >> and i'm bob redell.

we'll check the livermore drive in a few minutes. i want to give you the update for highway 24. suddenly the sig alert and lanes are completely cleared. eastbound 24. we had an earlier deadly accident and investigation. made quick work of it after the tow truck got on scene and the coroner filed the report. now all lanes should be cleared in both directions. expect just mild slowing off the interchange for a few minutes, and we'll check on the livermore issue with a potential for slowing coming up. >> thank you very much, mike. it's 5:31 right now. the bay area is remembering a man commit to his family and country. christie smith is live at the valleyo police department with a a memorial is growing for a 19-year veteran of the force. >> gootd morning to you. there's a real sense of sadness to you and support. offering support to the police department. there's a sign up here this

morning, though, saying the lobby is closed due to an emergency. this is where james capu worked for 19 years. he was well known and well liked. an officer, a father, a marine, a coach who was shot and killed trying to pursue a bank robbery suspect yesterday afternoon. police spotted a getaway car leaving the bank of america at the springtown center. they followed to janice treat. and capu used his car to stop the getaway car. he got out and chased the suspect on foot as other officers arrived they say they heard shots and found him down in a backyard. friends say, he was the type of guy who took in children, in addition to his own after their parents died. a guy that everyone says was real easy to care about. >> i still got chills up and down my back right now. it's pretty hard. just knowing that he loved kids. >> capu was 45 years old. he also coached the women's

basketball team at vallejo high school and was officer of the year in 2000. police did arrest one man. they haven't said much about him and told us this morning they're not looking for anyone else. they plan to update us about the case later on this morning. i want to mention that the flags here at the vallejo police department are at half staff this morning. reporting live in vallejo, christie smith, jof and laura, back to you. we could soon find out if a teacher who hit and killed a young girl will face charges. the district attorney's office has the case and will decide if felicia white parker will be charged for the killing of torres. people who live in the area say it's a dangerous intersection.

the accident led to public outcry saying they need to do more to make the intersection safer for kids. >> now to a story you'll only see an nbc bay area. police are questioning a man they think is connected to a murder outside of occupy oakland. the incident was captured on cell phone sid owe. officers say they have the man in custody. he's a suspect in the murder of 25-year-old foster. police say they're not sure if he is the one who pulled the trigger. they hope to make more arrests very soon. plans are in the works to reoccupy oakland now in a different spot. occupy protesters and community members will hold a press conference today to announce the new site of their encampment. they're planning to camp at a park on 19th and telegraph. about half a mile away from the previous camp at frank ogawa plaza. protesters are planning a mass day of action to be held tomorrow. they'll hold a rally and march and plant a new garden in the frank ogawa plaza.

as we head throughout the day, though, your temperatures won't be able to climb that much with limited sunshine in the forecast. we don't have a lot of fog ourt there just yet. great visibility this morning at the surface. 52 in san francisco. kind of mild. 54 in oakland. 47 in sunnyvale. throughout the next couple of hours you're getting the best drive of the morning. people slow down whenever it rains a little bit. keep that in mind. you might be all right off leaving early. some of the coldest air of the season so far. snow levels falling. maybe flurries at 2,000 feet. really early in the season. that would be saturday, where we see the coldest air arrive. periods of scattered showers through sunday. snow winter weather advisory. a lot of resorts open up today. first let's check your deprive with mike inouye. >> we'll take you to highway 4.

come monday. kicking the can down the road a little bit, the funding for this budget year to december 16th. meanwhile, the super committee has a wednesday midnight deadline to come up with something that congress can vote on by the end of the year. but there are conflicting stories about whether democrats have accepted the $300 billion in taxes that republicans put on the table. at first republicans said no new taxes. now they've come off that a bit and offered some. different stories on whether or not democrats are moving forward with this. if they don't come up with something, at least at the congressional budget office can look at by monday, we could be looking at automatic cuts most could affect the pentagon. no one really wants to see that. republicans are already working on a way to try to roll it back.

jon? >> never simple. always right up to the deadline. >> first penn state. now syracuse. accused of molesting a boy who works for the time. bernie fine is now on administrative leave. syracuse police started the investigation. a 39-year-old man says he met fine as a ball boy. he says fein started molesting him in the seventh grade. victim claims the abuse happened at various places including the 198 final four in new orleans. in the meantime, signs that more victims may come guard in the penn state child sex abuse scandal. lawyers say more potential victims of former assistant football coach jerry sandusky are starting out and starting to share their stories of abuse. some date back to 1970s. sandusky says he is incident and did not abuse anyone. the mysterious death of

hollywood actress nataliewood now getting another look all the sudden. the planks police department will release new details in the case today. wood drowned back in 1981 while boating off the coast of southern california. the coroner at the time ruling her death an accident. but some have speculated the drowning may be linked to her husband actor robert wagner. a little known fact that many people weren't aware of, actor christopher watkin was also on the boat during time of her drowning. i want to check the forecast with meteorologist christina loren. keep the umbrella handy. keep it handy today and tomorrow. you'll probably really need it until sunday. this morning just getting very, very light isolated activity. you can see eureka, though, we'll see some of the moisture maintain the organization as the system comes in.

now throughout the day today it's going to be cold. hi temperatures in the 50s across the bay. we had a little bit of shower activity pass through now. a little bit more aktivity offshore. that shows it is starting to get ha little bit more active. 45 in santa cruz. 47 at sunnyvale. i want to set this in motion for you and stop the clock at 5:00 a.m. on monday. that's after the heavy rain comes through on sunday in addition to whatever we accumulate today. looking more like a kwart inch in most cities. but you will notice the east bay will get quite a bit of action.

found dead at a slumber party. they sent out for a third toxicology report after previous tests found had low plood alcohol levels. she and her friends drank soda mixed with vodka. stha say the bottle was not theirs and may have belonged to a previous tenant. an autopsy was inconclusive about how she died. >> the county sheriff eefs office is now looking for a man who sexually assaulted a 25-year-old woman in unincorporated walnut creek. it all happened wednesday afternoon. just nortd ov the bart station. investigators say the woman felt the suspect grag her from behind. as she turned around she realized it was the man following her. the suspect described as white, 35 years old. standing 5:10 and weighing
