play. >> yeah, we'll get you later, jon. on the frae we're looking at 880. unusual slowing southbound. look at that coming off the 92 interchange. there's construction. that crew has not cleared as you're passing by union landing. now causing a problem as you're coming over towards the 92 interchange. so far no word of crews moving just yet. it is 6:01 now. we have new details in the investigation into the shooting death of a vallejo police officer. he was shot and killed after chasing a bank robbery suspect through the city. christi smilt joins me live where a memorial is certainly growing. >> good morning. this stunned not just the police department but really the city of vallejo. this officer was well known. we're in front of the police

department this morning. a woman came up. she laid down yet another flower here in front of the doors. there's a sign up this morn. the lobby is closed due to an emergency. officer worked here for 19 years. he was a father, a marine, a coach, very well liked. police spotted the getaway car and followed it. hen he used his patrol car to stop the getaway car. the suspect got out and ran. at the time he was working by himself. when other officers arrived they heard three to four shots and found the officer down in a backyard. he was 45 years old. friends say he was the type of guy who took in two children when their parents died. parents who were friends of his.

>> they were tragically killed in a motorcycle accident last year. they left behind two children. they were very close friends with the couple. for a short period of time these children were living with him. he had done additions to his house to accommodate them. >> now police say that capoot did not fire his gun, and the neighborhood is back open this morning. yesterday police arrested a man in the neighborhood. before they called off the search for additional suspects. police say they're not looking for anyone else at this time. they also tell us they're going to have an update on the case a little bit later this morning. back to you. >> someone who dedicated his life to helping others. >> new this morning, a massive fire burning out of control in reno nevada. at least three homes burning in the southwest part of the city.

police waking them up and telling them you must evacuate your home. so far there are no reports of injuries. at t one point police were asking people to stop calling 911 unless it was an emergency not connected to the fire because the lines were just flooded. now to an nbc bay area exclusive. police made an arrest in the shooting death of an occupy oakland camper in frank ogawa plaza. only today in the bay has footage to show you. this cell phone video shows a man police say is a suspect in a killing of 25-year-old foster. last night oakland investigators began questioning the man in the video. police say it's still unclear if he's the one who pulled the trigger. but they hope to make arrests some time soon. flash mobs in support of the occupy movement will try to disrupt downtown san francisco.

two groups are calling for hundreds of people to dance in downtown san francisco in noon and oakland two and a half hours later. the national organization of women and anti-war group code pink are cosponsors of the flash mobs. plans are also in the works to reoccupy oakland in a different spot. occupy protesters and community members will hold a press conference to announce the excitement. it's a half mile away from the previous camp. protesters are also planning a mass day of action to be held tomorrow. they'll hold a rorally and marcd plant a new garden. it is 6:05 now. three san jose teachers accuse of attacking middle schoolers face 15 to 31 years in prison. think accused gang members in 2009 when they attacked two trick or treaters outside a

strip mall. those suspects pleaded guilty yesterday. one victim was shot in the head. his friend was stabbed in the arm. security video capturing him running to a convenience store to get help for his friend. the boy, who was shot suffered permanent injuries. family and friends will gather this oakland to hold a memorial service for the people killed in the jonestown mass suicide. they will gather at the cemetery at a new memorial dedicated in may to the more than 900 people killed. more than half the victims are buried at the cemetery. member of the people's temple committed suicide. they were led by reverend jim jones. today's memorial is at 10:00. the future of california's school system seems uncertain at this point, especially with budget cuts expected to come in february. but for now it will be business as usual in classrooms. the state is telling school districts to budget as if there will be no cuts.

marla tellez is joining us live from san jose toics plain all. good morning, marla. >> jon, good morning. we know balancing our own budget can be tough. imagine if you're a school district facing more state education cuts, you're forced to get creative. take for instance this one here. this is franklin mckinley school district in san jose. it's taking out short-term loans to make it through the school year. this is according to san jose mercury news. this elementary school district is borrowing on the market. mid year is february 1st. it's estimated the state will cut $4 billion that officials say that will force almost all of the state's 1,000 districts to make more cuts. this breaks down to roughly $180

per student. now i mentioned potentially more furloughs, but as far as layoffs, a state law stops districts for laying off teachers ahead of mid-year cuts. so teaching positions are relatively stable at this point. but it's a new story here in san jose. it's comprised of 17 elementary schools. they may have to cut the school year by three days. it all depends on what governor jerry brown cuts in february. >> thank you very much. got to keep the umbrella handy. time to check in with christina loren. >> it is that time again, isn't it. now you can see we're getting a little bit of rainfall. as we zoom in, not much action. just an isolated cell to the north of san francisco.

throughout the day today we'll see more of the activity. might see a couple isolated thunderstorms. it's cold though, so the chance is very light. as we head throughout the afternoon, it's going to get colder. we have temperatures only expected in the mid to low 50s today. even in the warmest aareas of the bay. we'll get a nice dry break for the most part on saturday. and then more rain on the way for sunday. also sierra snow winter weather advisory has been issued. if you want to hit up any of the tahoe resorts that open today, make sure to bring the chains with you. as you can see here, 10:00 a.m. we stop the clock on the future cast. we'll see more steady rain at that time from 10:00 to 5:00. we continue the clock. look at saturday nice and dry for the most part. staying cool with all the cold air moving in. take a look at what's headed toward us. all the yellow and red in here.

this is heavy to moderate rain. we're not expecting a lot of this to move on shore. at the coast you could pick up a quarter inch to half an inch depending on the setup. that's what we're watching for you. overall accumulations are looking good. probably around a quarter inch to half an inch in the cities that pick up the most moisture. we're talk about what this means for the sierra, how much snow we're expecting and we're already looking at the thanksgiving forecast. first we're always thankful for the traffic report ls. >> now i have to tell folks sad news. it's slow for 880 just south of the san mateo bridge. first we might affect folks itself. maybe we can't get that shot. i'll show you on the maps if we could take that full screen. in we'll talk about slowing hat the bottom of your screen from 892 to the construction which has not yet cleared by the union landing shopping center. a couple lanes blocked there. chp is told that folks are cutting through construction zone. so watch that. it may send more folks bailing

welcome back, everyone. 6:14 now. sheriff deputies are looking into what they call a sexual battery in walnut creek. the contra costa sheriff's office says a man grabbed a woman. the man ran away when the woman turned around. it happened at 3:15 yesterday. deputies are looking for a white suspect about 35 years old. standing 510'10", waying about 0 pounds. more alleged victims in the penn still sex abuse cscandal. several lawyers saying they represent victims of former football coach jerry sandusky.

one attorney says he represents the two victims. one of them not include iing he says his client is victim number 11. >> my client was sexually assaulted by mr. sandusky in the eerl early '90s on the grounds of penn state university. >> alumni and students say they're trying to to do the right thing. so far they've raised more than $400,000 for victims. now another major college coach is accused of sexual abuse. long time coach bernie fein is on administrative leave at the university of syracuse. he met fein as a ball boy. he says he started molesting him in seventh grade. the victim claims the abuse happened at various places

and san francisco and even south bay getting steady rain. that could make for a rough drive home. keep that in mind. good thing is we get the friday light typically. stop the clock for you again at 5:00 a.m. saturday morning. a nice dry break. that continues for the most part all of saturday will be dry. we'll see a few residual showers and cool, cloudy conditions. nothing to keep you indoors. until sunday you see all the rain on the way. that makes its way onshore until 5:00 a.m., 6:00 a.m. then it will clear out quickly. you'll have opportunities to get outside. this is what we're really watching for. a lot of ski resorts open up in tahoe today. and we'll see fresh powder on the slopes. up to two feet of snow in the highest elevations through the next 72 hours. another round of rain moves in wednesday in thursday. that's a busy travel time for us. on thursday, thanksgiving day, on and off showers, 64 degrees. let's check your drive with mike. >> we heard about the construction.

i told you about the construction that is extended here southbound 880 around union landing. let me get out of your way. i want to show you the chopper shot. they have crews blocking a couple of lanes there. you see the steam coming off the roadway. the pavement work that they did overnight, it hasn't yet set up up, and as you know, you can't drive on pavement not set up. this will be extended until possiblily 8:00 a.m. this will be big slowing. let's take you back to the maps. that's right at the scene. southbound 80 off 692. that might make more folks cut over. you we get you a look to the south bay. travel down here looking very nice. just a little slowing 101 at 87 and 880 off 280. we're starting to see the increase of volume there. we'll end it with the south bay. i'll show you the bay bridge coming up. yes, it is the season for caring and giving, and each and every year the bay area comes together to provide much needed meals for the less fortunate.

california's high speed rail plan just ran into a big problem. in washington the house passed a transportation spending bill. it does not include high speed rail funding for the current fiscal year. that means california should not inspect the billions of dollars in federal aid. so far california received less than $4 billion for the rail plan. officials say the entire project could cost nearly $100 billion. >> you might want to route thanksgiving travel plans through san jose's international airport if you haven't already purchased your tickets. they say they will not only be the least busy of the bay area airports. it's the least busy of the country's 50 major airports. sfo will be the fourth busiest. they call it the loneliest airport. >> so sad.

scott mcgrew is here to tell us about it. >> a college graduate in san francisco or san jose faces ha much different job picture than a noncollege graduate in the east bay or even on the peninsula. new data shows not only is the east bay not growing economically, parts are retreating. the unemployment rate is going up in okay land, berkeley, hayward and fremont. frooe mobt hit particularly hard. here's the data from the group, clabtive economic showing san francisco and redwood city growing so slightly. one percentage employment. san jose, cupertino, sunnyvale roaring ahead. 2% gains in unemployment.

the answer here is the growth is coming from tech. you already figured that out. in san francisco yelp will fire for the initial public offering of stock. they recently won court victories. this fellow stands to make tens of millions of dollars in the ipo as founder. thursday's sale of shares of angie's list similar to yelp went very well. the price rose from $13 to $16 in change. in the first full day of trading today. and if you're thinking of investing, i've added things to the facebook page. >> we look forward to checking that out. >> right now it is 6:26. still to come the days for san francisco's occupy camp seems to be numbered. find out why protesters get ready for another raid. >> and the investigation into a shooting that killed a vallejo

>> it's not that great because folks are trying to get construction done before the weather comes in. they have to wait until the pavement cures. they cannot open the lanes until it happens. this will get better heading out of union city. >> it is 6:31. we start with sad news. this morning the flags at the vallejo police station flying at half staff in remember of an officer. a 19-year veteran of the force, james capoot was shot and killed chasing a suspect through vallejo. christie smith is live where a memorial is quickly gaining momentum. >> good morning, jon. more and more people are showing

up here, dropping off flowers this morning. some of them in tears. it's a very emotional day. one gentleman told me vallejo will miss jim. he was a heck of a guy. this started at the bank of america he used the car to stop the suspect's suv and then chased him on foot. they found him shot in a backyard. friends say he was the father of three, a coach, a marine who dedicated his life to service. he even took in two other children. i spoke with one woman who left flowers. she says she feels for his family as she just lost her 12-year-old son. >> i met him a few times before.

he has kids. it's hard for his wife and kids to imagine how to live every day without him. that's what i'm going through now. >> capoot was 45 years old. was once a vallejo police officer of the year in 2002. police did arrest one man. they haven't said much about him. they're telling us this morning that they're not looking for another suspect, at least this morning. they plan to have an update for us a little bit later. reporting live, i'm christie smith. back to you. >> truly a very, very sad story there. thank you very much. it is 6:33. occupy san francisco campers are expecting a raid on justin herman plaza at any time. the city declared that camp as well as the one in front of the federal reserve bank a public health nuisance.

final notices are post that had people need to leave the camp. they are posting a notice on their website that they expected the raid overnight, but it did not happen. day 27 and counting. the occupy protesters camped out on the wall desmite a warning from police, he will stay put. city officials wrote john okelly a letter saying he was trespassing. he plans to stay there for 99 days, though he admits he came down for a few minutes on saturday. the city says trespassing citations can cost up to $1,000 or result in six months in jail. there's no doubt the california school districts are bracing for an uncertain future, especially with budget cuts expected to come in february. for now it's all business as usual marla tellez is joining us live from san jose to explain how all of this is going to

the showers. then spreading to the south throughout the remainder of the day could make for a rough commute home. we stop the clock at 11:00 a.m. showers will continue until 5:00 p.m. then saturday stays nice and dry, which is big news for the safeway food drive. you can see what's on the way for sunday. you get a nice dry break for the second half of your sunday, lasting into monday. but speaking of the food drive, if you're headed out to santa clara, i know that's where i will be with jon kelley. we would love to meet you out there. make sure to bring your jacket. every little donation help this is time of year. and so we want to get you out there.

one crisis averted. another one looming. congress passed another temporary spending bill so the government will not shut down this weekend. but the debt super committee does not figure out how to cut $1.2 trillion from the nation's bottom line. tracie potts joins us live with the latest details.

good tracie. >> they move the budget issue forward yet again. but before the break the debt super committee by midnight wednesday has got to come up with some way to cut 1$1.2 trillion from the budget or it will happen anyway. the defense secretary says not acceptable. we have conflicting reports out of the committee about whether democrats have accepted the tax cuts or the taxes that republicans have put on the table. and so they're planning to work throughout the weekend on this. we're hearing that they may try to scale that down and come up with a smaller package that everyone can agree on. laura? >> very interesting. thank you, tracie.

welcome back, everybody. it is 6:45. we checked with meteorologist christina loren. it's like all good cub scouts come prepared. >> that's right. be prepared. don't say i didn't tell you. we do have showers on the way. i'm watching the radar. 're getting action right now. hard to tell from the live picture of san jose that there is a storm moving in as we speak. you can see just a few high clouds in the picture. mostly clear start. which means you're actually getting a nice drive hat this time when it comes to weather impacting your commute. not going to happen until later this morning. let's take it live to the radar. we have showers rolling in through san francisco. getting moisture passing

through. all of this action is isolated for the next few hours. things will get more active to the south. all the snow they're getting. we're talking maybe two feet of snow in the next 72 hours over tahoe. and a lot of ski resorts open up today. next 72 hours we'll see the coldest air of the season. make sure you have the winter coat ready to go. as of today i'm taking temperatures down by 10 to 15 degrees from yesterday's highs. and yesterday was a cool and cloudy day. periods of scattered showers throughout tonight. tomorrow a nice dry break. and we're keeping the winter weather advisory in place all the way through sunday. if you want to hit the fresh powder, make sure to get the chains with you. we're not expecting that much rain. in fact, not picking up yellows on this map of accumulations. just the deep green, an indication of maybe half an inch in the places that get the highest accumulations. fairfield, for example, concord.

bad news. let me show you what i'm talking about. accident at fremont boulevard. 880 has cleared with that accident. the shopping center, two lanes are blocked. now look at this right there. more folks over the san mateo bridge. just past the toll plaza we see a good steady volume moving nicely to peninsula with no major delays. we'll get you back to the map and show you the south bay. we have a little slowing southbound around guadalupe. and that's normal for this friday commute from san jose to 101. we'll end with a look at the bay

in lower manhattan. demonstrators call it a mass day of action. it ended with a march across the brooklyn bridge. we could soon find out if a teacher who hit and killed a young girl will in fact face charges. the district attorney's office has the case and will decide if felica white parker will be charged with killing her. people who live in the area say it's a dangerous intersection. they've not been arrested. the accident led to a public outcry that more needs to be done to make the intersection safer for kids. >> a natural gas line pipe that was 75 years old and runs through a palo alto neighborhood will not be strength tested. the pipeline installed in 1936 runs a half mile beneath charleston road between alma and middle street road.

the old pipe is scheduled to be replace in 2013. pg&e says it's not in its policy identified for replacement. pipeline is a big concern because it's close proximity to homes and schools. proposition 8 backers are allowed to defend their measure in federal courts, at least according to the supreme court, that is. the court unanimously ruling the sponsors of the ban on gay marriage can step in if state officials refuse to defend the measure. the opinion was passed on the ninth circuit court of appeals, looking at the constitutionality of prop 8. prop 8 supporters ask the court to overturn last year's decision by a u.s. district judge which struck down this measure. it is 6:53 right now. nbc bay area's proud to partner with safeway to help families in need this thanksgiving. bob redell joins us live from pleasa pleasanton this morning with details on how it can make a
