morning. we haven't had any major rainfall out there taking place right now. highways are slick in many spots across the bay. fog is so thick the that it's generating drizzle. they arrive at 5:01. first let's talk about your drive. >> before the sun dries everything out, still have slick roads. over here at gilroy gardens heading away u, they're cutting they tree up a right now. a disabled vehicle is moving to the shoulder. i got word of another vehicle on the bay bridge. >> we'll check back with you. thanks, mike. this morning police are trying to track down the vandals who hit three banks over

weekend. they peel some of the signs left here. four of them on the front door. bank of america. there is also paint on at least one of the atms out here this morning. this is the bank of america on oak grove road on walnut creek. the same bank was hit two weeks ago in a similar fashion. the chase bank was hit in a similar way. we didn't see any damage there. and also police say a u.s. bank in concord was hit as well. we have calls to the police department to try to find out

when the graffiti was written. some of it was found late afternoon. clearly they have written the word foreclosed out here this morning. that's the latest from here. reporting live in walnut creek. back to you in san jose. occupy oakland was raided overnight. no encapments for the first time since late october. dozens of officers entering the park after midnight. reports say it was quick and it was peaceful. protesters were allowed to temporarily stay at frank ago what plaza last week. they may be down. but they're not out. protesters working on another plan to strike at all west coast ports. we have video from a recent strike at the port of oakland.

the west coast port shut down set to hatch monday, december 12th. the plan is to disrupt operations on a large scale. they say the strike is in response to coordinated attacks on the occupations and attacks on workers across the nation. in san jose the occupy movement is mobile. occupy san jose protesters parked in front of city manager's home in the rose garden late last night. we have video of the group on saturday in front of mayor lee's driveway. last night they waved signs, chanted "power to the people." they blame her for refusing to give them the right to camp at san jose city hall. it is 5:04 right now, the former bart officer will be in court this morning. this time around he's being sued for excessive use of force on

another bart rider. marla tellez is live at the oakland coliseum station with more on this story. good morning, marla. >> reporter: jon, good morning, this time around mezerli is not the only defendant in the case. mezerli and four other bart officers are accused in the alleged beating that happened right here in oakland. this is just six weeks before the controversial shooting death of officer grant. it was in november of 2008 that kenneth caruthers of oakland. he heard e mim say the officers were lazy. four other officers piled on top of him and began punching and kicking him. he was taken to the hospital and

treated for his injuries. they filed the civil suit two months after he shot and killed oscar grant at the fruitvale bart station. the negotiations have been unsuccessful. today jury selection begins. opening statements could happen as early as tomorrow. now mezerli is expected to testify in the trial. keep in mind he was just released from jail five months ago after serving one year of a two-year sentence for the shooting death of oscar grant. this morning i have reached out two attorneys on both sides of the state. caruther's attorney is not available for comment until 8:30 this morning. i'm marla tellez. remembering danville marine joshua carel this morning. the 2010 san ramon grad was just

a year into his service when he died. the bay city news service says he's in delaware to claim his body. he was the sec member killed in the past week. . on wednesday 21-year-old sean walsh was killed in eastern afghanistan. he was the member of the national guard. >> an investigation is under way after a pedestrian was hit. a person was walking in the same direction before noon today. they did not stop him from hitting the pedestrian. early reports are the victim made no effort to move before being hit. the victim's name is not yet released. the grandmother accused of kidnapping her granddaughter is expected to face charges this morning. she'll be arraigned at 8:30.

is planning to greet the world's elite when they gather for the annual world's economic forum in january. they're calling on activists to stage an occupy event from igloos set up in the ski resort. they say the same of the protest will be to draw attention to the undemocratic nature of the forum, which is attended by many heads of state and industry. and living social is going national for the holidays. the daily deals site is best known for offering coupons for local businesses. it's unveiling two sets of deals today involving larger national chains. living social will offer special deals on black friday and unveil more on cyber monday. that's it for me here at cnbc. laura, back to you. there's now a way to help struggling teens.

it's a nonprofit called collegeset.org that launches tomorrow. it will allow individual donors to make direct contributions to college savings accounts for low income teenagers. the goal is to set up 1,000 savings accounts. 500 for bay area students right here. donors who put in $500 into a student's account would get the account. stanford university is known for the high academic standards. this is proof of how great a university it is. it's broken its own record with five students or recent graduates chosen for this year's road scholars. each student will receive scholarships for up to three years to study at the university of oxford in england. the road scholar was created in 1902 with the hopes to bringing together the brightest minds to study at one place. in case you're wondering harvard university boasts the most

and it's a little bit early for this amount of slowing. 15 or 16-minute drive. the bulk of that in north greenville. >> thank you very much, mike. emotions will no doubt be high in oakland as a court hear willing take place for the former bart police officer who is a central figure in the grant shooting. marla tellez is live with an update. >> reporter: good morning. mehserle shot and killed oscar grant at the station almost three years ago. now he's accused this a beating that allegedly happened here at the oakland coliseum bart station just weeks before the controversial shooting. now kenneth, carrethers is the plaintiff. he says mehserle and four other officers punched, kicked and hog tied him after overhearing him comment that the officers are

lazy. he said the offer's behavior was not out of line, saying carrethers threatened to hurt them. why is this coming to light now? carrethers filed the suit two months after he shot and killed grant, negotiations to reach a settlement have been unsuccessful. today the jury selection begins. mehserle is expected to be at the trial every day. he's also expected to testify. in june mehserle was released from jail. that was in november of last year in 2010. he served one year of a two-year sentence. i'm marla tellez. jon? >> thank you very much for the update. new this morning, three men are being called heros for rescuing a man out of his cab just seconds before it exploded. take a look at this video. the cab droiiver ran into a lig

post around 1:30 this morning. three men saw that crash. they ran to get him out. he may have been unconscious. despite gas leaking from the car, the men persisted to use a street sign to break open the car window. they were able to free the driver just seconds before the car burr into flames. >> they ran over into the middle of the street, and while i was on 911. and i just thought it was incredible. the flames were bigger and bigger and bigger why they try to get this guy. >> amazing. the cab driver is being treated at san francisco general hospital. >> the man accused of shooting and killing a veteran vallejo police officer is expected in court today. 37-year-old henry albert smith jr. of fairfield will face charges in the killing as well as a bank robbery. smith accused of killing jim cap

outpouring of love and support. words cannot describe how much jim will be missed. a funeral will be held on november 30th. the man who snatched a picasso sketch from an art gallery will learn his fate. 31-year-old mark lugo will be sentenced this morning. he is expected to spend 16 months in jail and then be extradited to new york to face separate theft charges there. in the meantime the gallery has the sketch back. it will hold a ceremony to rehang the sketch. >> we heard plenty about tech ipos. bob redell with more on how this affecting businesses in and outside the tech world.

good morning. for example, portions of steven's creek tell the associated press that they're expected to sell more cars over this. the reason they just opened location is because they see growth. experts say there are good reasons to be optimistic. it's come out of the mandatory lockup period which means employeescan cash in their stock options. workers and investors sold shares worth over half a billion dollars. that's quite a chunk of change. that's the expectation. one realtor who deals in mansions says they're more confident they can sell the homes in the $# million to $10

finished building a bomb. officials say he acted alone. today we'll hear from a special committee investigating the child sex abuse case at penn state university for the first time. the group is an investigative committee formed by the university's trustees. this is surrounds the scandal involving penn state defensive coordinator jerry sandusky. he is accused of sexually abusing eight young boys he met through a charity he founded. 49ers don't have a lot of time to enjoy their latest win. they play thursday in baltimore. san francisco coming off an extremely solid showing yesterday. they outplayed arizona on every level. the 49ers are now 9-1. they have won eight straight

take a look at the video. this is on friday when students peacefully protesting on campus were pepper sprayed by campus police. the president of the entire uc system has now called for a statewide review of campus police tactics. tons of this video here. this weekend we were told two of the officers were placed on administrative leave. just this morning around 4:30 this morning, demonstrators made us aware the campus police chief has now been placed on administrative leave. the chancellor called on the attorney to investigate the use of force tactics here. also speaking of the chancellor, there are growing calls for her to resign. they called for her resignation because of failed leadership.

there was a lot of traffic on the floor of the international auto show in san francisco. we have a look from the modern luxury and exotic cars. i think that's what i want to take home to the latest alternative fuel and hybrid vehicles. the two-day event featuring the 2012 model vehicles from 38 manufactureses. this is the largest show of any kind held in northern california. >> this is the first opportunity they have to see and compare the 2012 models side by side. if they're in the market for a new car, you can narrow choices by coming down here and looking at all the cars.
