weekend. thanks for waking up with us. the good news is today we'll see the sun return. how long will it last? we have more showers on the way. they're going to coincide right in time with your holiday plans. so we tell you when they arrive. this morning give yourself time. otherwise we're looking good in terms of weather. >> it's a little crowded across the bay bridge because a lane or two is blocked by an accident that has yet to clear at the treasure island interchange. it's not showing up at the sensors. i'll show you that in the next live report. >> thank you, mike. the former bart officer who faces scrutiny is in court again this morning. he's being accused of using excessive force on a bart rider.

marla tellez is live with more on the civil trial. >> reporter: good morning. this time around mehserle is not the only defendant in the case. they are to stand trial for an alleged beating that happened here at the oakland coliseum bart station. here's the kicker. this happened six weeks before the controversial shooting death of officer grant. it was november of 2008 that kenneth carrethers of oakland says mehserle drop kicked after hearing him say bart officers are lazy. at that point four other officers piled on top of him and began punching and kicking him. lawyers say mehserle detained him after he refused to comply and after he raised a fist at mehserle raised a fist at him and threatened him. he filed the civil suit two

months after mehserle shot and killed oscar grant. today jury selection begins. he was just release from jail after one year into his two-year sentence. this morning i put in calls to both attorneys on both sides of the case. carrethers' attorney is not available for comment until 8:30. i'm marla tellez. jon? >> thank you very much. it is 6:03 now. this morning investigators are working to track down the vandals who left their mark over the weekend. no damage on who left their mark. christie smith joins us now with the latest.

good morning to you, laura. the word foreclosed was written across the door at the bank of america building in washable point. it's also smeared across two atms this morning. walnut creek police tell us they got the report late yesterday afternoon a a boa on oak grove road here in walnut creek was hit. there were also fliers glued to the door that have since been peeled off. the chase in the same strip mall where we're at this morning was also hit. no obvious signs of that this morning. but also the u.s. bank in concord on creighton road in a similar way. but who is responsible is still clear. obviously many groups have been expressing their concern with what they're seeing as financial inequality. i do have calls into the walnut

creek police department to see what the status of their investigation is. as soon as i hear from them, i'll bring that information to you. reporting live in walnut creek. i'm christie smith. back to you in san jose. it is 6:04 now. there are no occupy camps in oakland this morning. police clearing the oakland snow park earlier today, leaving the city without any encampments. dozenses of officers swept in after midnight to remove the few tents still pitched. reporters say it was quick and peaceful. they were allowed to temporarily stay following a raid at the encampment of frank ogawa plaza last week. the protesters are working on another plan this morning. they're now calling for a strike at all west coast ports. this is video from a recent strike at the port of oakland. occupy oakland says the west coast port shutdown is set to happen the 12th. the plan is to disrupt

operations on a large scale. they say the strike is in response to coordinated attacks on the occupations and workers across the nation. today uc davis chancellor will meet with student protesters to talk about the use of pepper spray by campus police. this is video from friday. two officers are on paid administrative leave. you see video showing them spraying students as they are sitting down. the university is not identifying the officers. we'll have more on the live report coming up from davis this morning in ten minutes. new this morning, there is word from a cairo morgue that 35 people are now dead from protests in egypt. most of the deaths are from the area's tahrir square. today is the third straight day of violence. young activists demanding they

hand over power to the people. injuries include gunshot wounds and beatings to the head. it is 6:06 now. family and friends are remembering danville ma joshua corel this morning. the 2010 high school grad was just a year into his service when he died. his family is in delaware to claim his body. that service is planned after thanksgiving. he is the second member of the military from the bay area killed in the past week. on wednesday 21-year-old sean walsh of san jose was killed in eastern afghanistan. walsh was a member of the army national guard. >> the grandmother accused of kidnapping her granddaughter is expected to face charges this morning. erika is expected to be arraigned at 8:30 in martinez. police say she broke into her son's home back in may and took

her granddaughter from her bassinet. she returned and tried to act as if the little girl was her own. 6:07 now. time to check in with meteorologist christina loren with a look at the forecast. good monday morning to you. the ski resorts, many of them were able to open up with fresh powder in sierra nevada. and throughout the end of the week, we'll get more fresh powder over lake tahoe. this morning it's rather chilly. but we're not looking toward the hard freeze. just patchy frost. temperatures are above freezing. 37 in novato. still cold enough for some surfaces to freeze. we have a lot of moisture through the bay area. watch out for that. take it easy this morning. this won't be able to hang around long. late wednesday into thursday.

welcome back, everyone. the tech world is booming. we've seen several bay area companies going public over the past few months. soon we'll see stocks start to sell. bob redell is live in santa clara to explain how luxury retailers are hoping to cash in on their success. >> because of the mandatory lockout periods ready to expire

on those who had options converting them. good morning to you, laura. what you have here is people in the luxury high end business saying they're expecting to see a bump in business, which wouldn't be a big sur prize. porsche expects to sell more cars. another luxury car dealer says the reason they opened a new location is because they see growth in the high end market. other experts say there is good reason to be optimistic. linked in, the career networking website that went public in may is coming out of the mandatory lockout period, which means employees can cash in the stock options. company announced many employees have already done so. that recently there was shares worth over half billion. that were sold. that was 7.5 million shares at roughly $71 a share. a chunk of the change is expected to flow into the

we have cold conditions out there, but it's not so cold that we're talking widespread frost: tomorrow morning temperatures can cool off more so with a clear sky in the forecast. and that's when we'll talk about the frost. this morning fog is more of a factor. give yourself ample time in the north bay. visibilities are reduced to three-quarters of a mile. or pockets of less than a quarter mile. drizzle is also a factor because of the thick fog. you know the deal, whenever it rains high pressure compresses the moisture through the inland valleys. so we are expecting the fog through the first part of the day. for the greater bay area between 9:00 and 10:00 we'll get a nice amount of clearing. high pressure is keeping things nice and mild. temperatures mostly ending up in the 60s in the south bay. you'll hit 60 in san jose. the upper 60s still not too bad. a lot of sunshine coming in. if you park in the sun when you get in your car it will be nice and toasty.

it's always 10 to 15 degrees warmer in your car than the surrounding air. we have a lot more rain on the way. kind of a dicey time when it comes to holiday plans. we're talking about the busiest travel day of the year on wednesday. 3:00 p.m., looks like that's when the main event arrives in the north bay. showers continue to spread south by 6:00 p.m. that's when the greater bay area will get moisture. so leave early. not to sound cliche. it's going to help you out in beating that rain shower. it looks like we got heavy rain on the way as ll. by wednesday, a little bit of evening rain on thursday. friday, saturday, and sunday looking pretty good. noa lot of people because of black friday are going to be out there early. a little bit of rain is going to keep them in mind. you want to keep in mind it's going to be cold. most showers have subsided by that time. >> pretty well. we're looking at the south bay with northbound sensors right behind 65. if i squeeze past it you can see

slowing northbound. we kicked off the slowing at 101 just at the 680 interchange. better news heading south. highway 152. the alert is canceled. the roadway is reopened as you come past the gardens. there are wires down on the side of the road. the maintenance crew will arrive later in the day. highway 129 will clear you of the area f you can get through on 152 now. we're looking at 580. this is registering 50 miles per hour. we have a 20 minute drive out of the altamont pass. a new accident causing slowing. it's moving to the shoulder. it's a distraction for all the folks in the area. we begin with oakland. our final shot for this hit. we see a nice smooth drive at the limit from here to the toll plaza. back to you guys. uc president is very blunt in his assessment saying he's appalled by the images of police officers pepper spraying

students at close range. and the school's chancellor will meet with students today. mike is live to tell us more. >> the fallout is continuing to grow. almost to the point where you have to ask who is next, if anybody? all of it is stemming from this. take a look again. this is friday when campus police used pepper spray to spray students peacefully protesting. this weekend two campus police officers were put onned a majorityive leave. now the police chief is put on administrative leave. the president of the entire system said he was appalled by what he's seeing and has concerns about the free speech rights being infringed upon here.

he is calling for the assessment of the system. there's an online petition drive pushing for her resignation. that's already topped more than 50,000 clicks online. the chancellor expected to meet with students on the quad at noon today. it will be interesting to see how she is reacting to the students calling for her resignation. now back to you. thank you very much, mike. we could learn more about an alleged terror plot foiled in new york city. this is what police say the suspect was trying to pull off before his arrest on saturday. new york city pli release the video to show the effects of the bombs built by the 27-year-old. he planned to blow up government buildings for u.s. troops returning home. investigators say he is a u.s. citizen who learned to make bombs on the internet. he considered changing his name

to osama out of spoupport for osama bin laden. >> the official deadline is wednesday for the super committee to agree on a plan to cut the national budget by more than $1.2 trillion. at this point it does not look like it will happen. committee members making the rounds on sunday talk shows. both republicans and democrats accusing the other side of not compromising. the failure to reach a deal will trigger across the board cuts and various domestic programs starting in 2014. the last public meeting was three weeks ago, november 1st. 6:20 now. coming up a group of california billion irs say they have a plan to get billions of dollars back to school. details are next. shed i at shwhnked in aresil wl be under a lot of pressure coming up. welcome back, everybody, on this monday morning. bright and early. that is san jose. hp pavilion. traffic smooth. that's what we like early. mo mike will tell us about the official prort coming up. a group of california billionaires pitching a plan to overhaul the state tax system. the think long committee includes billion irs like google chairman eric schmidt and political insiders like arnold schwarzenegger. the committee says the proposal

would provide $5 billion more for public schools every year and billions for public universities and local governments. the plan includes eliminating income tax for teams making less than $45,000 a year. it would create a new tax on services not taxed now, like legal work or accounting. the group will try to get the proposal on the 2012 ballot. stanford broke its own record for number of new road scholars. 5 of 32 road scholars are stanford students. each student will receive scholarships for up to teleyears. the rose scholar was created in 1902 with hopes of bringing together the brightest minds to study at one place. another notable new road scholar is the son of woody allen and mia farough.

now you're smooth through berkeley. but the east shore freeway has an issue on the maps. we have a stall in one of your lanes. that's causing a backup from hercules as well. >> thank you very much. it is 6:30 right now. a trial will take place for the former bart police officer who was convicted of fatally shooting bart rider oscar grant. this time he's being sued for using excessive force on another rider. marla tellez is live at the bart station with more. good morning, marla. >> laura, good morning. mehserle shot and killed oscar grant almost three years ago. he's now accused in a beating that allegedly happened here at the oakland coliseum bart station just weeks before the controversial shooting. kenneth carrethers is the plaintiff in the case. he says mehserle punched, kicked

and hog tied him after overhearing him comment that bart officers are lazy. lawyers for bart say the officer's behavior was not out of lean, saying carrethers threatened to hurt him. he filed the civil suit two months after mehserle shot and kited officer grant. negotiations have been unsuccessful. mehserle is expected to be at the trial every day. he's also expected to testify in the trial. in june he was released from jail after being sentenced for manslaughter. i'm marla tellez. lau laura. >> police are investigating. a rash after vandalism at east buy banks over the weekend.

christie smith joins us live with the messages they left behind. >> reporter: good morning. it's not permanent or serious damage like a broken window. more of a message here across the front door of the bank of america building in walnut creek. foreclosed. it's written in washable paint. it's also on the atms out here. both of them. this is at the bank of america. walnut creek police with notified about this late afternoon and at least four fliers were also pasted on the door. they were peeled off this morning. the same bank was targeted two weeks ago. the chase bank was also hit in a similar fashion. we're not seeing signs of that this morning. and the u.s. bank in concord also hit. again in a similar fashion over the weekend. exactly who is behind this is

unclear. as you know it's been in the news. banks have been a top target with those upset at what they see as financial inequality. i have calls into walnut creek police to see if they have leads on a suspect. so far haven't heard back from them. if i do i'll bring that information to you. i'll send it back to you guys in san jose. >> thank you very much, christie. in san jose the occupy movement is mobile. occupy san jose protesters parked in front of the city manager's home in the rose garden late last night. they've waved signs and were chanting as well. they tried to protest at the city attorney's house but weren't sure if the address was correct. they blame him for refusing to give him a permit to camp at the

city hall. the protesters are calling on students to come to school in pajamas to hold a mass sleepout and pajama party. it was an incident-free removal by police. the man who snatched a picasso sketch from an art gallery will learn his fate this morning. he pleaded guilty on the 27th. he's expected to spend 16 months in jail. then he'll be extradited to new york. meanwhile, they will hold a ceremony because they have the sketch back to rehang the sketch. lugo stole the painting in july. it is 6:35. time to check the forecast with christina loren. >> good morning to you. taking a live beautiful look downtown san jose this morning. looking really good. it's cold out there, though.
