hit the road this holiday week, you're not going to hit the road. why more people are planning to travel despite sky high gas prices coming up. this is tuesday, november 22nd, this is "today in the bay." good morning to you. thanks for joining us on this tuesday morning. it's 5:00. i'm laura garcia-cannon. >> good morning, everybody. i'm jon kelley. tyke to check in with christina loren to find out what's happening outside. >> it's cold out there. but we'll see a nice afternoon. another day where dressing in layers is ideal. temperatures are running cool from fairfield to livermore. 44 in santa rosa. we are expecting fog as well. today looks good. tomorrow the rain arrives.

5:00 a.m. first. let's check your drive with mike. we have clearing in a few minutes. still not cleared with the construction northbound 680 to rutger, there's construction crew there. more road work in both directions. so expect that, but the light volume keeps 680 moving, guys. >> thanks, mike. >> more than a year after being convicted of killing oscar grant, former bart officer johannes mehserle finds himself back in court on different charges. the former bart officer is accused of using excessive force and falsely arresting a bart rider. good morning, christie. >> good morning to you. that former police officer was in court yesterday. he's expected back again today. during this trial he is expected to take the stand and defend his action in the new case.

jurors have already been asked if they can spate what's going on in this new case with the oscar grant case, and they've already been told that they won't hear much about oscar grant at all. now this civil rights lawsuit is brought by kenneth carrethers, who says in 2008 he and four other officers attacked him after he criticized police. apparently his car had been broken into and he didn't like the response he got. he says mehserle used the leg to sweep him to the ground and the four other officers piled on and kicked and hit and even hog tied him. but the defense has said that carrethers started it by making threatening actions to this police officers. you may recall mehserle served two years for the shooting death of unarmed passenger oscar grant. that was new year's of 2009. he will be back here today. we're told that the trial is

expected to last about five days. reporting live in san francisco, i'm christie smith. jon and laura, back to you. >> christi, thank you for the update. walnut creek police have released new images of the man they say vandalized two banks in their city. someone scrawled the world foreclosure over the bank of america and chase banks over the weekend. police say the person has been seen multiple times since november 11th. officers are looking for this man tagging a bank building just after 3:00. he's described as white, between 19 and 24 years old with brown hair. if you know who this is, call walnut creek police. a very emotional prayer vigil is planned today for the veteran vallejo police officer killed in the line of duty. police are gathering at 6:00 to remember officer james capoot. he was shot and killed after he

was chasing bank robbery suspect. over the weekend hundreds gathered for a separate vigil to remember the father of five. he is active in the community and was the coach of the women's basketball team at vallejo high school. police think they know what caused a fiery crash in san francisco. we showed you video yesterday. police say the driver of the car on fire was drunk when it crashed around 1:30 yesterday morning. he was booked on suspicious of dui. witnessed rushed to the car, smash the windows and pull the driver out before it became too big, engulfing the car. without their heroics the driver may have died. just days after they were evicted from the park and frank ogawa plaza, protesters have set up a new camp. dozens of tents pitched on the lawn of a foreclosed home. one protester says the new camp is in response to the current economic climate and is meant to

send a message to big banks. the protesters received permission to camp from the woman who owned the home before it was foreclosed on. >> it is 5:04 now. if you're planning on traveling this thanksgiving, you're not alone. more californians will be out and about, especially on the road. marla tellez joins us live this morning with a look at what is driving people to hit the road. >> good morning, it is not gas prices. gas prices are 50 cents higher than last year at this time a new study says it's pretty simple. it's a desire to go see your family members. whether by car or plane despite the down economy and the high gas prices. the latest survey shows almost 5.5 million californians plan to travel 50 miles or more wednesday through sunday.

that's about the same increase nationally. here's what it looks like broken down carver sus plane. more people will hop in the car. about a 4% increase for californian who is plan to travel this year over last. compare that to a 2% increase of those who say they planned to fly this turkey day weekend. we spoke to a young gentleman who worked at this shell station. he says his customers aren't afraid to drive. >> a lot of people are excited. they want to hit the roads. everyone is traveling. no one is staying home. >> well, here's a quick peek at gas prices in the bay area right now. it's 54 cents higher than this time last year.

here you'll pay $3.69 for a gallon of regular. i'm marla tellez, laura, jon? >> let's car pool. >> san francisco leaders are talking about taking the plastic bag ban to another level vm. they're hoping to push consumers to go with reusable bags. they talk about expanding the ban to retail stores and restaurants. they would also charge for paper bags that are provided. a plastic bag group plans to take legal action if the proposal passes. we could know before spring training for the a's will be allowed to move to san jose. bud selig is expected to talk about the territorial rights. according to a mercury news

column, the blue ribbon panel apparently met with ace executives two weeks ago to talk about the ballpark plan. he speculates that they could come up at the owner's meeting in january. >> kind of like thanksgiving menus everywhere. this weather forecast is like a mixed bag buffet, right? >> yes, a mixed bag buffet that you pay a lot of money to enjoy. one of the reasons we all live in the bay area is we get boufl weather, even this time of year. bay area potent storm moving through the east. right now for us we don't have a potent storm. we could see up wards of a quarter inch. maybe half an inch before all is said and done. here is the front. today we're sandwiched between systems here. you can see the clouds up and around the ridge of high pressure. it will keep us dry today.

what is happening with their students. we'll keep you posted on this uprising in egypt throughout the show. penguins rescued from an oil spill off the coast of new zealand are back in the wild. more than 50 penguins were released yesterday. about 300 were rescued after oil leaked. about 50 tons of oil spilled from the ship. etch penguin was tagged and will be monitored. >> after "march of the penguins" and "happy feet", they're like little heros. >> are we going to be free of the rain thanksgiving? >> i think most of the rain will come down while we sleep. we don't have to get up early on thanksgiving. we have the day off. unless you're like laura garcia-cannon. plan on getting in the kitchen and slaving over the hot stove.

i, of course, am not that breed of woman. 40 degrees in livermore. i do admire you, laura. 46 in novato. kind of cold this morning. we may see a few isolated showers trying to get into the bay area. high pressure trying to block. that it's headed east. so it's going to get active around here. we set your future cast in motion. by 12:00 p.m. on thanksgiving, most of the rain will have sub sized. we could get up to three-quarters of an inch. but most areas in the bay will pick up half an inch, a quarter inch. that's a lot of rain. temperatures today on the mild side. enjoy the sunshine while it lasts.

territory, indicating a lower open on wall street this morning. this is after markets fell sharply on the ongoing debt worried in the united states and europe. investors reacted to the failure of the super committee to strike a deal to cut the deficit. there's some concern that they could cut the nation's credit rating. but this doesn't affect their current outlook. also how much the economy grew this summer 66789 swoels this month's fed meeting as well. this is back in negative territory for the year. the nasdaq losing 49 points to 2523. and if door busters aren't enough to get you in the door on black friday. retailers are ready to use what seems to work every time. and that's free stuff. old navy is giving away kodak cameras. sears is offering free collectible christmas ornaments

space today. seven acres will be filled with water this morning. it's all part of the project to restore wetlands along the city shorelines. the new wetlands are located on the north end of candle stick point recreation area near yosemite avenue. it was previously a landfill with several businesses. the area was transformed into wetlands to create a cleaner environment for the neighborhood and for the wildlife. the wildlife expected at 9:00 a.m. this morning. >> coming up, what san francisco is asking residents to do to keep the city services running. plus, why there may not be crab on the table at this year's thanksgiving dinner. >> and what if the pepper spraying policeman had an advice column?

welcome back, everyone. crab will not be on the menu for thanksgiving for many folks. crab fishermen say that will not go out before thursday. part is due to an incoming storm. another huge part is there's no price set with seafood who wholesalers. they are offering $2. until there's a deal, fishermen will not ship out. they say prices have not kept up with the cost of living and doing all that business. san francisco has a new website aimed at helping save city services at risk due to budget cuts. the website will allow donors to give money to certain city programs in need. the programs listed include the arts, neighborhood beautify kags

homeless services and recreation and parks. they will also accept donations in the event of a serious emergency or disaster in the city of san francisco. turns out it's more like four in change. it's a small world. if you want a message to president obama, you can find a friend of a friend of a friend who knew him. he said there were six people in the chain. recent research by social scientists in italy using facebook show these days the numbers are closer to four. between four and five. though his classic definition of a friend and the people we friend on facebook are different. lots of people have buddies on facebook that they barely know. social networking sites have been huge for social scientists.

for excessive use of force on another bart rider. good morning, christie. >> reporter: good morning to you. that's right. the former bart police officer johannes mehserle is back to a bay area courtroom once again to defend his actions when he was a bart police officer. but this is an entirely different case from the one involving oscar grant. jurors were told yesterday they will hear little to nothing about the original case. this involved kenneth carrethers who is seeking the damage against mehserle and four other police officers in an accident at the coliseum station. this is a week before he shot and killed oscar grant at the fruitvale bart station. mehserle served two years for involuntary manslaughter. carrethers is arguing that mehserle grabbed him and swept him to the ground and four others piled on and hit and kicked him and hog tied him.

the defense will present a different account of that, though. that he shouted threats before advancing with a clinched fist at them. i want to mention the four other officers still work for bart. we are told the trial is expected to take five days. jon and laura, back to you. >> thank you, christi. san mateo police officer has caught a man responsible for dozen of violent holdups in the bay area. he was arrested earlier this month and being held without bail. sanders accused of more than three dozen robberies from san francisco to san jose, including one in october at a petsmart store. a clerk was shot and wounded. the candle light vigil will be held tonight for the bay area

marine killed in afghanistan. 19-year-old joshua karel was killed on friday. dozens lined the street to show sfort for the grieving family. his father made a brief statement thanking them for support. tonight's vigil will start at 6:00 p.m. cal-tran released new information on testing of the bay bridge towers. they previously declined to release the information. but it supports previous claims that strtures are safe. a former data technician is accused of falsifying safety documents. they say the structures were tested more extensively than cal-tran previously disclosed. this has to be one of our

trillion in automatic budget cuts. the defense secretary saying this could put a team in our nation's defense. we got in here before the automat tests kick in. if democrats and republicans can agree on another $1.2 trillion to cut, then president obama says he'll okay rolling back the automatic cuts. >> we'll closely be following this one. >> all eight candidates are expected to be in the nation's capitol to face off on foreign policy and national security. this will air on cnn. presidential candidate michele bachmann made a late night appearance on the late show with jimmy fallon. she was asked to describe her candidates in one word. >> obama.

3:00 p.m. on thursday, starting at 8:00 p.m. we have thick fog developing in the central valley. you are getting a leg up on halloween travel today. take it easy in southern california along the 5. really thick fog. we have a fog advisory in place. 62 degrees today in gilroy. temperatures staying on the mild side, and we will see more sunshine. 58 in redwood city. we'll have the seven day outlook in a moment. now let's check your drive with mike. now we'll take you to the south bay. the last of the construction is cleared through the roadway. that continues up the lower bay shore for 101 and 280 both looking good up the peninsula.

southbound 101, holding up on the shoulder. so there's going to be a crew there. that will be an issue for the commute. i'll track it and let you know if it will cause any delays. but so far an easy thrive through the north bay. antioch, we have volume increasing. 22 is registering. we still have a smooth drive. we have slowing out at the bay point. that will be more slowing for 242. we'll get a live look to see how things are shaping up for oakland. a good volume of traffic, but you're at the limit. thank you, mike. the quiet college city of the davis becoming the latest point for the occupy movement. protests at uc davis are not showing signs of slowing down.

nearly 2,000 people gathered on monday to show their frustration. this after recent tuition hikes and a pepper spray incident where a dozen people were pepper sprayed after refusing to leave. it was all caught on video. protesters say they're more determined to stand their groun ground. >> i stood for my country once. i'll do it again and again and again. >> uc davis chancellor apologized for the pepper spray incident. but protesters continue to call for her resignation. the man accused of killing a san francisco police officer 40 years ago returns to court to face charges. he's expected to plead guilty to shooting at south san francisco officer who is tried to arrest him for credit card fraud way back in 1968.

he originally pleaded no contest. he turned himself in after spending 40 years on the run. he's also accused in the shooting death of a san francisco officer in 1971. in that case he denied any involvement. it is 5:49 now. a new study is out this morning in contra costa county, not good. more than half the kids in one city are overweight or obese. health officials are blaming sugar sweetened drinks like soda. they say most teenagers drink at least one soda a day. >> childhood obesity is important not just because of the children. this becomes a chronic disease. they grow up. they develop diabetes. they develop cardiovascular disease and they die before they should. >> pablo is talking about
