convicted of killing oscar grant is expected to testify in a civil try involving another bart rider. christie smith is live in san francisco where johannes mehserle is accused of beating a bart rider weeks before the oscar grant shooting. good morning, christie. >> good morning, jon. he hasn't worked for bart for about two years. but he's heading back to a bay area courtroom, this time in san francisco, to defend his action for when he was a bart police officer. this time it involves a federal civil rights case brought by a 43-year-old oakland man, kenneth carrethers. he says mehserle and four others attacked him in 2008, just weeks before he shot and killed unarmed passenger oscar grant at the fruitvale station. mehserle's defense said it was an accident. he served two years for involuntary manslaughter in the case. in the new suit the claims that mehserle used him to on the

ground and other officers piled on, kicked him, hit him and hog tied him. the defense says the actions were sparked by carrethers who made threatening motions towards the police officers. the incident occurred week before the shooting, but the jury won't be hearing testimony about the case this time. we are told, though, that mehserle is expected to testify, and the trial is expected to last about five days. reporting live in san francisco, i'm christie smith, jon and laura, back to you. the man accused of killing a san francisco police officer 40 years agos to court this morning. ronald bridgefort is expected to plead guilty for shooting at officers who tried to arrest him for credit card fraud. he pleaded no contest but disappeared before he could be sentenced. he turned himself in after

spending 40 years in hiding. he's accused of the shooting death of a san francisco officer in 1971. in that case he denies involvement. just days after they were evicted. occupy oakland protesters have set up a new camp. dozens of tents are pitched on the lawn of a foreclosed home. one says the new camp is in response to the current economic climate and is meant to send a message to big banks. the protesters received permission to camp from the woman who owned the home before it was foreclosed on. walnut creek police giving us a look at the man that they think vandalized two banks in their cities. someone wrote the word foreclosure over the bank of america and chase banks over the weekend. police say the person hit multiple times since november 11th. officers are looking for this man caught on surveillance video tagging a bank building after 3:00 yesterday morning. he's described as white, between

19 and 24 years old with brown hair. if you know who this is, you're asked to call walnut creek police. if you plan on hitting the road this thanksgiving holiday, you are not alone, the new report says you can expect to see more holiday travelers than in years past. marla tellez joins us live from fremont with more on the story. >> laura, good morning. right now gas prices are about 50 cents higher than they were one year ago. but a new survey shows this is not stopping people from traveling, tr driving this thanksgiving. the latest survey shows almost 5.5 million californians plan to travel 50 miles or more wednesday through sunday. that's about a 4% increase from last year's holiday weekend. it's about the same increase

nationally. when it comes to carver sus plane, more people are planning to hop in the car. 4% of californians who plan to travel by car this year over last. compare that to a 2% increase for those who say they plan to fly. i talked to several people this morning. all are driving somewhere thursday. like carlos from newark, who is clocking about 320 miles round trip. >> are you driving anywhere? >> going to sacramento. >> gas prices don't stop you from doing that? >> no, but we really don't have a choice. want to spend time with both sides. what can you do? >> if you're filling up in oakland, you can pay $3.76 and in san jose $3.75 on average. most people plan to hit the rose on wednesday. if you're one of the people if you don't leave early you can

6:12 right now. the epicenter of the occupy movement moved from oakland to uc davis. the pepper spray attack by university protesters have the attention of the nation. brian hfrom our sister station joins us with more on the story. >> reporter: good morning to you. the pepper spray incident all over violation of a no camping ordnance. the students are welcome back out there camping on the quad. take a look at this video from this morning. i would estimate close to 50 tents have sprung up in this tent city on the campus. all over this protesting tuition fees here at uc davis where students say they're certainly not able to afford education these days. so last nights the students sat in on an emergency recession to call for a former investigation on the general's office, and demanding a complete review of the police procedures.

the area as well. that could be a problem for visibility. we'll track that. >> more than a year after being convicted of killing oscar grant grant, former bart officer johannes mehserle is back in court. this time on different charges. christie smith joins us live from san francisco where he's accused of falsely arresting a bart officer. >> good morning to you. johannes mehserle is headed back to a bay area courtroom to defend himself for his a,s when he was a police officer. he hapt worked there since 2009. this time for an incident that occurred weeks before the shooting death of unarmed passenger oscar grant at the fruitvale bart station. the jury will likely hear little to nothing about the case involving oscar grant. instead, the focus is a federal civil rights case by 43-year-old

kenneth carrethers of oakland. he argues mehserle and four other police officers attacked him on the call see yum bart station after he criticized them as useless. he was apparently upset his car was broken into twice. he said he used a leg sweep to bring him down and the officers piled on. but the defense is expected to paint a much different picture, that the actions against carrethers were justified and started when he was making threatening motions towards the police officers. mehserle and four other officers are named in the suit. mehserle was found guilty of involuntary manslaughter in the shooting of officer grant but said it was an accident. it sparked a series of bart reforms.

jon and laura, back to you. thank you, christi. as the community mourns, a prayer vigil is expected for a police officer killed in the line of duty. police will gather at the missionary baptist church at 6:00 this evening to remember officer james capoot. he was shot and killed chasing a bank robbery suspect. over the weekend hundreds gathered for a separate vigil to remember the father of five. capoot was very active in the community and was the coach of the women's basketball team at vallejo high school. police caught a man responsible for dozens of robberies around the bay area. ricky sanders was arrested earlier this month. he's being held without bail. sanders is accused of more than three dozen robberies from san francisco to san jose, including one in october at a pet smart

store. several teamed up to catch him. it is 6:33. police thinking they know what caused a fiery crash in san francisco. we showed you this video yesterday. police say the driver of the car was on fire, drunk when the car crashed around 1:30 yesterday morning. witnesses rushed to the car to smash in the window. they pulled the driver out before the fire became too explosive. police say without their heroics the driver may have died. high gas prices and a slumping economy will not stop bay area drivers from traveling this holiday. marla tellez joins us live with a look at the reasons behind the trip. good morning, marla. good morning, laura. travel has been down the past three thanksgivings, but according to aaa, this is not the case this year.

people just ignoring the high gas prices and saying we're going to travel this year. now this is true in both california and nationwide. the latest aaa survey shows 5.5 million californians plan to travel 50 miles or more now through sunday. that's a 40% increase from last year's holiday weekend. 34% plan to hit the roads. that's 3% more than last year. everyone says they're driving to see family this year. even though gas prices are higher. >> do you factor in gas prices? >> no. i don't care anyway. the price is going to go up.

>> if you're planning to fly, here's a perk. oakland international is giving away parking on thanksgiving. it's free for travelers who park on thursday. this is the oakland airport. most people are planning to hit the road on wednesday. that is the nation's busiest travel day. community service in san jose will continue to hand out food to needy family this is morning. a number stood in line yesterday to receive turkeys and 60-pound boxes of food. they need more help to feed all the families in need. it lost more than half a million dollars in government funding and the demand for help is dproeing. about 57,000 people in the south bay are looking for help this year. up from an average of 35,000 in recent years. it is 6:36, time to check the forecast with meteorologist

debt? tracie potts joins us live with what is next. good morning, tracie. >> good morning, laura. super committee members were unable to come up with 1 trillion cuts to the 15 trillion. last spring, last summer congress couldn't do it. where are we now? they closed the doors. they've given up, the committee. and now it's back to the same congress to figure out if they can prevent the automatic cuts from kicking in in just over a year from now. half of them will affect the pentagon. the defense secretary saying this is tearing a seam in the national defense. we have the same group trying to come up with an alternative. president obama will veto any attempt to roll back the automatic cuts without some sort of alternative in place. on top of that, before the end of this year, they're trying to figure out if they can extend the payroll tax cut that workers saw this year and prevent a big cut in payments for medicare.

thanksgiving week. so we expect the unusual pattern. that's a pleasure at the toll plaza, guys. >> all right, mike. thank you very much. the former bart police officer convicted in the oscar grant sooting heads back to court this morning. christie smith is live in san francisco where johannes mehserle is being sued for excessive use of force on another bart rider goochltd morning, christi. >> reporter: good morning, jon. johannes mehserle is expected to take the stand. this time on accusations that he roughed up a man at a bart station, just weeks before the shooting of unarmed passenger. kenneth carrethers is seeking damage after an incident at the coliseum station in 2008. he was apparently upset with officers after a car was broken into more than once. he argues that mehserle grabbed him and did a leg sweep to knock

him down. other officers pumplged and kicked him before hog tying him. mehserle said that he grabbed his wrist and was doing this to try to keep from hitting the officer. he only did the leg sweep after several requests for this man to stop resisting. mehserle served two years for involuntary manslaughter in the shooting of oscar grant, an unarmed passenger, but has said it was an accident. the jury is very unlikely to hear a tbt grant case. we are told that this trial will likely last five days. reporting live in san francisco, christie smith, jon and laura, back to you. the man accused of killing a san francisco police officer 40 years ago will be back in court today. ronald brijport will plead guilty to shooting at south san francisco officers who tried to arrest him for credit card fraud in 196. he originally pleaded no

contest, but disappeared before he could be sentenced. bridgeforth turned himself in after spending 40 years on the run. he's also accused of killing a san francisco police officer in 1971. but in that case he denies any involvement. the quiet college city of davis suddenly becoming the latest flash point for the occupy movement. protesters are not showing signs of showing down. 2,000 gathered there showing their frustration after recent tuition fee hikes and the pepper spray incident last friday where a dozen were maced after refusing to leave. protesters saying they're more determined to stand their groun ground. >> these are young adults. if they have the nerve to be out here. i stood for my country once. i'll do it once, and i'll do it again.
