very good morning everyone. the time is 4:30. i'm jon kelley. >> i'm laura garcia-cannon. let's check the forecast with meteorologist christina loren. >> a big travel day today. we have a lot of shower activity on the radar, but nothing heavy just yet. expecting our main event to take shape in the second half of the day today and into tonight. no flight delays across any major airport so far. we did have delays out of sfo yesterday due to low ceilings, fog. more of that in the forecast for this morning. we'll watch out for that. a pretty nice day before the rain showers arrive. forecast coming up 4:31. first let's get you out the front door with mike. in the north bay, probably really chilly. don't go to this fire to warm up, a car fire, a small one. no injuries reported. a light volume of traffic throughout the area. no major problems for your commute. we'll track this as well as the

rest of your bay area roads. back to you guys. pepper spray should only be used as a defensive weapon. that was the ruling handed down by a federal appeals court after a clash between police and northwest logging protesters more than ten years ago. that ruling may come into play as there's an investigation into last friday's pepper spray incident. police using the chemical on at least a dozen seemingly passive protesters there. in addition to that court ruling, a state commission which advises police agencies says pepper spray can have debilitating consequences and should only be used defensively. in a town hall meeting last night, uc president mark you dof said he's hired a private consulting firm to investigate what happened. uc davis chancellor linda katehi also spoke to the proud. >> we need to work closer, i need to work with you more to

understand your needs, to get your ideas, there are wonderful ideas from the students and try to work together to move forward. >> katehi does admit she ordered police to remove the students' occupy camp but denies she knew about the use of pepper spray. she's asked that the students arrested have hair charges dropped and medical expenses paid. on the battlefield he was a solder. at home, he was a son, brother and friend. a danville community is coming together to remember joshua corral. he died in afghanistan on friday. friends and neighbors held a vigil remembering his leadership and passion for life. >> the life of the party. he was a great guy. he was a big inspiration. when he talks about the military, people believe him because he's a very likable guy. >> friends say when corral

decided to join the marines right out of high school, he encouraged ten of his friends to join with him. while he may never know the impact he had on so many lives, those who knew him say he will never be forgotten. it is 4:33 right now, pg&e's controversial smart meter technology has stirred up debate for months now. now the utility commission considering letting people opt out, but it comes with a price tag. the california public utilities commission will vote on the pg&e proposal in january. those who no longer want smart meters on their homes can opt out with a $90 fee with a $15 month charge there after. some residents say the smart meter caused them to pay more on their bills anyway. i thought it was supposed to be more accurate, that at least they would drop a little bit knowing they would be more accurate, but it's not accurate. it's gone up and it's increased.

>> pg&e's controversial meter there, they say that it stands by its smart meters releasing this statement, while those customers who chose to opt out will lose the benefits of smart meter technology, we recognize some of our customers will have a preference on available alternatives and we will work with them once a final decision is reached. as families hit the grocery store for last-minute thanksgiving dishes, food banks gearing up to put food on thousands more tables this holiday season. the san francisco and marin food banks will hand out more than a million pounds of groceries tomorrow. 33,000 chickens, 97,000 pounds of yams, 1700 cases of cranberry sauce and a whole lot more. the food bank hoping to provide thanksgiving mails for 36 thousand households. that's an increase of nearly 14,000 families since the recession hit everybody hard. thanksgiving comes early this year to the needy in san

jose. the community homeless alliance ministry will be serving a thanksgiving meal and distributing blankets to those in need. this starts tonight at 5:30 at the ame church located in san jose. it's 4:35. we'll check the forecast with meteorologist christina loren. >> busy travel day today. no airport delays out of sfo or oakland, even san jose at this point. we could see some out of san francisco, notorious for flight delays. there is thick fog already starting the develop. that could become a factor. what you can see from this live radar satellite compilation, we have clouds moving in. the main event has not yet arrived. all the moisture will move in through tonight. we'll have to wait for it for a little while. the good news is most of the it will come down while you're sleeping. for the second half of your thanksgiving holiday, we'll get a nice dry break. right now let's check the travel

drive with mike inouye. >> good morning, christina. we'll take you to the south bay for road work finishing up, northbound 280 to northbound 880, that transition ramp has a crew scheduled to be there for another 20 minutes or some we have 880 at alameda. that's the longest standing construction, scheduled until possibly 10:00 a.m. yesterday they picked it up at 6:00. hopefully these folks get off early for thanksgiving as well. past the coliseum, no brakes, an easy flow of traffic, at the limit between the coliseum and the bay bridge toll plaza. across the golden gate bridge, a nice clear view. watch out for the patches of fog rolling in. so far an easy drive out of the north bay. have you heard this one. sexist statements on baby clothes? a popular children's clothing brand based in the bay area is stirring up controversy over a

line of clothing that some parents say is sending the wrong message. the girl's shirt says "pretty like mommy" and "smart like dad." >> smart can last you forever. pretty only goes so far. >> i think it's been an issue for decades about the messages we send to our children. >> there's a letter writing campaign about what they call harmful gender stereotypes. we tried to contact jichl bore rhee about the complaints, but so far no response. >> simple solution, shirts for the young ladies that say "smart and pretty" like mommy. stanford giving you an opportunity to take classes. why is this important? because it's for free. why the university is bringing back a popular program with a global following. no buyers for solyndra. why no one seems interested in the defunct solar company.

welcome back everyone. a live look outside hp pavilion where the sharks are hosting the black hawks tonight. >> getting it on. >> hitting the bay ice. 4:41 right now. there's a new front-runner emerging in the gop race. newt gingrich delivering a new dynamic to last night's debate. gingrich surging to the lead in the polls, 24%. mitt romney at 20%. herman cain down to 17. the candidates sparring on foreign policy in washington, d.c. they talked about immigration. gingrich saying he believes long-time documented immigrants should stay. >> the party who says it's the party of the family is going to adopt an immigration policy which destroys families that have been here a quarter century. >> the debate coming six weeks before the all-important iowa caucuses begin. solyndra putting itself up

for auction, but not a single taker. officials saying the bankrupt company has received only one bid for the entire company. let's just say it was not a good one. the company considering splitting up its assets in hopes of attracting suitable buyers to take over the operations. the company looking at separate shun auctions for his machinery, real estate and intellectual property. representatives blaming it on the economy, not the controversy surrounding the company's failure. a god den goose of silicon valley stocks is sliding. netflix fell another 5.4% tuesday to $70 per share. within the last year netflix was trading as high as $304 a share. netflix certainly isn't alone. for more on that and news before the bell let's turn to jackie deangelis live at cnbc world headquarters. good morning. >> good morning, laura. futures sharply lower this

morning, this on the back of weak manufacturing data in china and europe. chinese manufacturing activity fell to its lowest level in 32 months. this is raising concerns, of course, that the world's second largest economy may be slowing down. we saw the asian markets falling overnight and seeing europe mixed at the moment. u.s. markets fell yesterday after reports show the economy grew less than expected over the summer. we'll get data out today on unemployment, personal income and spending, demand for durable goods and consumer sentiment as well. we saw the dow lose 53 points yesterday closing at 11,493. the nasdaq slipped two points to 2521. meantime unemployment fell in 75% of the u.s. states last month. this is a positive sign that many parts of the country are seeing modest job growth. rates fell in 36 states, rose in five, stayed unchanged in nine. that's the best showing since april. california has the nation's second highest unemployment rate at 11.7%.

employers added jobs in 39 states, led by illinois which created 30,000 jobs last month. california, of course, added 25,000 jobs. the u.s. postal service is raising prices on its most profitable services. we're talking about express and priority mail as it's trying to stave off bankruptcy. the new flat rate for overnight express shipping is $39.95 for packages weighing up to 70 pounds. $18.95 for letters. priority mail rates will go up about 3%. the new prices will take effect on january 22nd. watch for that. back to you guys. >> see if it will help them turn around. thank you very much, jackie. trying to decide if that is pumpkin pie or cinnamon rolls baking in the kitchen this morning. >> it's my perfume this morning. >> that might be it. christina loren to talk about the forecast.

>> as long as it's not another bun in the oven over there. we do have clouds moving in. no rain just yet. that's on the way later tonight. if you're trying to get a leg up on your holiday travel plans, 4:45 a.m., if you're heading into southern california, you're going to get the best drive in terms of weather. as we head throughout the day today from southern california through central and northern california, the rain is on the way. but not till later tonight. for us we're sandwiched between systems, high pressure breaking down and headed off to the east and the showers are coming in. this is going to be a quick-moving system. lit pack a good punch and head out of here as we head through the second half of tomorrow. right now, mostly cloudy from san jose, san francisco and san jose. no rain to report at this time. new rain arrives this morning. you can see the front is pretty moisture-rich. you see the yellow and orange. that's a lot of rain. maybe upwards of half inch.

>> reporter: good morning, jon. we didn't have a bad time at all getting into sfo this morning. of course, it was just after 4:00 in the morning when we pulled in. but traffic looking pretty good this morning. people don't seem to be having a bad time at all. the good news, though, is it used to be the wednesday before thanksgiving was the really big travel day. now it's actually the friday before is the busy day. so last friday was when you may have had trouble with 140,000 passengers expected to pass through sfo today. sunday, of course, very busy day, too. sfo has seen some slow but steady growth, a nearly 5% increase in travelers this year over last. in a ten-day stretch, of course, this will all end sunday. they're expecting that to be a real busy one, too. oakland international expecting about 3% more travelers this holiday over last. san jose, expecting about the

same. certainly expect the crowds. the only hiccup might come a little later tonight and into tomorrow with rain moving in. i had a chance to check before i came out here, the good news is that every single flight i saw this morning when i had a chance to look said "on time." i'll keep on eye on it for you. that's the latest from here. i'll send it back to you guys in san jose. >> thank you very much, christie. sadly, this could be a lonely thanksgiving for senior citizens in a nursing home in marin county. it remains right now under quarantine. the country villa novato health care center is dealing with an outbreak of norovirus. family and friends are being told to stay away while their loved ones remain indoors. about a third of the center's residents are sick. officials are monitoring the situation and will only reopen on thanksgiving if they feel it's safe. the city of san jose is on

the verge of declaring a financial emergency. that could effect city workers' pensions. city leaders unveiling a plan to try to deal with the financial crisis in the city. next month the city council will vote on whether to declare a fiscal emergency and schedule a special election on pension reform. city leaders say if they don't cut pensions, they'll have to cut back on the number of police and firefighters they have currently, certain they they is unacceptable. now you can be a cardinal. if you didn't have the grades or money to get in, no worry. stanford opening its virtual doors for free. last fall stanford experimented with free education and put the popular computer science courses online. there was an overwhelming response globally. stanford will offer seven computers courses along with two entrepreneurship classes online. registration is free and it takes a few minutes.
