very good morning everyone. it is 4:30 right now. i'm jon kelley. >> i'm lg laura garcia-cannon. >> we'll see changes over the course of the next two hours. dense fog across the board this morning. you'll find the deep pockets of fog at least for the next couple hours. dense fog advisory, though, is only posted until 7:00 a.m. because we are expecting very gusty winds to start to pump through bay area and clear the cloud cover out. we'll be tracking that all morning long. we've got major wind coming in. we'll tell you which cities will be the windiest. it's early out there, but mike is already busy. >> we have a sig alert just declared. accident southbound 11 past the waldo tunnel was at one point blocking all lanes. they just cleared one lane, very slow heading out of the waldo tunnel. foggy across the golden gate bridge as we just showed you.

this accident blocking three out of four lanes. we'll track this as we get updates from chp and they arrive on scene. back to you. the public today will have their chance to say their good-byes to a veteran vallejo police officer. >> memorial services for jim capoot, the father of five was a mentor to fellow officers as well as doz ensz of high school students. christie smith joins us live with more. >> reporter: good morning, laura. the field is already set up here this morning. there are chairs out. there is a stage out this morning at vallejo high school was jim capoot was known and loved. estimates are up to 4,000 people will be out here later today to pay their respects to the fallen vallejo police officer killed in the line of duty on november 17th while pursuing a bank robbery suspect. among those attending the day, governor jerry brown and vallejo's police chief will be

here and possibly state attorney general carmelo harris. the service is expected to last about 90 minutes. with such a large outpouring of support expected, there will be street closures beginning at 8:00 this morning. threes a free shuttle bus running from the vallejo fairgrounds. capoot served 19 years with the vallejo police department, a former coach of the girl's basketball team at vallejo high. service also be held while school is in session. the students are not specifically being asked to attend, but some are expected to try and come anyway. the service starts this morning at 11:00 a.m. reporting live from vallejo, i'm christie smith. back to you guys in san jose. >> a big loss for that community. thank you very much. also today a memorial service will be held for the danville marine killed in

afghanistan. marine lance corporal josh yeah corral will be honored at the east bay fellowship church at 12:30. the 19-year-old was killed earlier this month in combat operations in the helmand province. the 1-year-old boy shot in a gunfight in oakland is giving his family reason for hope this morning. >> he did squeeze his mom's hand today and made her feel a lot better. >> he is little hiram lawrence, he turns 2 next month. right now his family praying he'll be able to pull through. he was in the arms of his father when the gun fright broke out in a liquor store parking lot. oakland mayor jean quan visited the family at the hospital. she say it is violence needs to stop. >> we need to say that's enough, that we can't allow the children of our city to be senseless victims of senseless violence.

>> at this point police have not arrested any suspects. occupy l.a. is gone from city hall this morning. police raided the 2 mchbd encampment overnight. all but around 200 of the protesters left before that raid to avoid being arrested. city officials say they wanted to keep the process as peaceful as possible and offered to open a homeless shelter for people using the park as a place to sleep. no word on how many people were actually arrested. in the meantime occupy sf protesters say they are not going anywhere. the "chronicle" reports protesters voted last night to reject the city's proposal to move their encampment from justin herman plaza to a fenced in lot belonging the the school district. occupiers say the city is just trying to get them out of sight, out of mind. it is 4:35 right now. members of the occupy cal

movement are behind a lawsuit right now against leaders at uc berkeley t. group of plaintiffs includes 18 cal students who claim police violated their first and fourth amendment rights during occupy cal demonstrations back on november 9th. chancellor robert burnlg know is among the defendants named in the lawsuit. the school has not yet commented publicly on the court filing. the walmart shooting on black friday remains unsolved at this point. we are getting a better look at the shooting as it unfolded in san leandro. surveillance video shows activity near the top of your screen there. police say three suspects approached shoppers in the parking lot before 2:00 a.m. on friday. a 21-year-old man was shot. the gunmen in the attempted robbery is believed to be 29-year-old detwan watson of oakland, considered armed and dangerous. the fourth suspect left the scene dieing an older model

burgundy buick riviera. a suspect is being held without pale. east palo alto the taking steps to make a dangerous intersection aefr. anybody ors say it is not enough. the intersection of bay road and gloria way is where a 6-year-old girl was killed two month ago. last night the city council approved plans to paint warnings on the pavement and install flashing l.e.d. lights, but no stop sign. neighbors are still not happy. >> an actual stop sign, i think people actually have to stop because it's the law. flashing light thing, people don't realize, okay, slow down, proceed, no. >> the transportation commission will be holding a special meeting next week to have a plan ready for the city council by december 20th. meteorologist christina loren is telling us it's going to be windy outside all day today. a wind advisory warning of gusts up to 50 to 70 miles per hour in places like the east bay hills. people there trying to prepare for this. pg&e crews were out yesterday trimming back branches that could break off and then cause

power outages if they fall on the lines. they'll also have crews ready to respond today to any power outages that are suffered. >> we'll check in with christina right now. you say the winds will be pretty high. >> they really are. right now we have calm winds out there which is one of the ingredients for dense fog development. this morning we're socked in all across the board. the winds are picking up. the dense fog advisory is slated to expire at 7:00 a.m. as we head throughout the day, we'll see the skies clear much earlier than yesterday with all the wind coming through. the winds will be pumping from land to sea. as a result they'll warm up on the way. so our afternoon highs will be about three or four degrees warmer from where we ended up yesterday. calm winds up through the north bay. marin county really socked in. once the winds pick up in the next hour or two, you're going to see some major improvements. we get realtime weather to look forward to this morning. we have a good looking weekend forecast. always think about the weekend come wednesday. right now mike already busy.

>> christina, we have that sig alert. the update southbound 101 at the waldo tunnel. we're down to one lane, maybe even less, meaning a full traffic break at the waldo tunnel. the earlier accident, we've seen the traffic flow change in the last 15 minutes as they move cars to the shoulder. word from chp is traffic breaks will continue for at least the next few minutes. that's what's messing up the sensors across the golden gate bridge. the fog won't help the situation. it's almost impossible to see the roadway from the toll plaza. we're down to below 50 feet in many spots including right here approaching the toll plaza. so far we've seen no headlights. perhaps the traffic light affecting the flow all the way into the city. we're looking here at construction. that will make it an issue as you travel through the construction zones this morning. this one through alamo because the bright lights lighting up the construction area will also kind of mess around with the fog. it will be really bright through those areas. >> 4:39 right now.

welcome back everybody on this foggy wednesday. it may not feel too windy right now as you can't see too much. christina loren says to expect winds to pick up later today, but continue driving safely in that fog that. is the bay bridge toll plaza. smooth traffic, it is 4:43. gop candidate herman cain is giving hints this morning he may not stay in the race. cain told his aides he's reassessing his campaign based on allegations of sexual harassment and now an affair. cain has repeatedly denied any

wrongdoing, but appears allegations are taking their toll. some political analysts and voters think he's finished. >> if you want to be president, you have to be up front and honest. at this juncture it's really an open question if he has those characteristics. >> sometimes when there's smoke and there's lots of smoke, maybe there is a little fire brewing. >> on tuesday cain skipped a party with top journalists in new york. his iowa ad campaign is also on hold. supporters of the ad have backed out. his campaign manager says cain misspoke and meant to say he is reassessing his strategy. penn state students will told a town hall meeting to talk about the sex abuse scandal that rocked the university. the forum is the first of three meetings designed to give students a chance to talk about the issues related to the scandal. jerry sandusky, the former assistant football coach is accused of sexually abusing several young boys. university is under

investigation for how it handled the allegations that eventually led to that arrest. one of the nation's most famous christmas tree also be lit tonight. a live look at rockefeller center in new york city. the tree will be lit in a big ceremony tonight. the 74-foot norway spruce will be covered in lights and on display through the holidays. you can actually see the lighting ceremony here on nbc starting at 8:00 p.m. >> always a great time of year. the parent company of american airlines declares bankruptcy. you might be wondering what does that mean for air travelers. cnbc's jackie deangelis has more on that story. first, jackie, good morning. how are things looking in the market this morning? >> good morning t. futures have actually turned positive after a missed close yesterday. investors got good and bad news on the economy. a bigger than expected drop in home prices but a surprising jump in consumer confidence. the leaders agreed to boost the

size of their bailout fund but not as much as people expected to be able to handle a possible major downturn in both italy and spain. today we'll get data on private sector jobs, productivity and labor costs, manufacturing, pending home sales and the beige book will be out that tracks economic conditions throughout the country. we saw the dow rise 32 points on tuesday, closing at 11 clou 555. the nasdaq lost 11 points closing at 2515. meantime facebook agreed to a 20-year privacy settlement with the federal trade commission. the pact requiring the social network to ask users for permission before changing the way their personal information is shared. the settlement stems from changes that facebook made to its privacy settings in 2009, making parts of users profiles like name, pictures, friendless public by default. a judge has approved amr's request to keep running business as usual, hours after the parent of american airlines filed for bankruptcy. this includes letting company pay its 88,000 employees,

maintain its relationships with fuel suppliers an keep its frequent flier club in place. amr is under a mountain of debt with the highest labor costs in the country. passengers won't notice much of a difference, but could see fewer flights in the future. back to you. >> jackie, thank you very much. let's get a look at the forecast right now with meteorologist christina loren. >> major changes over the next couple hours. good morning. we have wind on the way, but foggy start. make sure you're alert before you hit the highway. your visibilities, less than a quarter mile in some spots. what i can tell you right now is this is the worst drive of the morning when it comes to your weather conditions. as we head throughout the next two hours, we'll progressively clear out. we've got winds moving in. let me show you what's happening. short wave trough has to come through first. you can see what's left pushing through santa rosa. the next couple hours this will continue to push to the south. once it's out, high pressure moves into the great basin

rapidly. it will drive those offshore winds. right now our winds are starting to pick up a little bit out of the southeast, three miles per hour in concord. you can see where the trough has come through. fairfield, that's where our winds are shifting. as we head throughout the next couple hours, that will continue to be the case. we'll lose the fog very quickly. your futurecast actually shows that. we stopped the clock at 7:00 a.m., almost completely clear over the greater bay area. by mid morning clear skies, then the winds pick up. this is what we're expecting as we head throughout if day. the worst wind gusts will be between 50 and 70 miles per hour. we're talking about mount diablo. the highest elevations will see the worst of it. interior valley, santa clara valley, breezy to windy conditions. a few isolated power outages due to downed trees. we're watching for that all day long. temperatures today will be a touch warmer, 64 degrees in morgan hill, hit about 63 degrees in gilroy up in the north bay. temperatures finally out of the

50s and low 60s. it looks like this. 62 in stinson beach, 58 degrees in half moon bay. half moon bay you'll get some sunshine. offshore flow clears that coastline better than anything else when it comes to our weather elements around here. 65 in santa rosa today. a comfortable 64 in novato. seven day outlook, rain in the forecast, but not until next tuesday. isolated chance for that in the north bay. we've got two breezy days to get through. then things start to get more on the quiet side. we have a nice weekend coming up. cold nights. saturday and sunday afternoon comfortable temperatures. 60s inland. back to you guys. the patent war between apple and samsung is starting to heat up again. this morning an australian court says samsung can start selling the galaxy tablet computer again in that country. apple has previously been granted an injunction back in october because they claimed

it's way too similar to the ipad. apple has blocked samsung from selling tablets in germany and a case in the netherlands may force samsung to modify its smart phones. yes, some say it is the most wonderful time of the year. but we're wondering is it? >> i was hoping you were going to sing that. a new survey from consumer reports shows most people dread something about the holiday season. 90% of those surveyed said they dread something about the holidays, topping the list of 68%, crowds and long lines. 37% worry about gaining all that weight from eating all those holiday goodies. also the top ten, traveling, seeing certain relatives and seasonal music. are you ready for this one? be nice to people. that one i don't agree with. >> santa wouldn't be happy to hear that. it is 4:50. san francisco will ban toys from

unhealthy kids meals this beak. some restaurants figured out how to get around it. what mcdonald's is planning on do. is california's high speed rail project a waste of money? why the analyst doesn't think the project will ever get built. the golden gate bridge and the waldo tunnel, two areas of big focus this morning. look at that. the fog is one reason. the sig alert is another. i'll give you an update on both coming up.

welcome back. this is probably one of my favorite shots, the big control center. there you go, gabrielle waving. it takes such a crew to put on this show. we really appreciate it. 4:53 right now. the state's top analysts say starting construction on california's high-speed rail project could be a waste of billions of dollars. a legislative analyst's office releasing a report yesterday saying it's highly uncertain at this point the full project will ever be built at all. the state plans to start construction in the central valley sometime next year by spending $6 billion in tax funds. but the long-term plans rely on congress to provide more than half of that funding, something the report says is unlikely to happen. congress has already killed all high-speed rail funding for two straight years. san jose's largest post office is open again this morning after police stepped in and blew up a suspicious package outside the building last night. it's still unclear at this point if a crime was actually

committed. a post office customer called police claiming a man wearing a gas mask stuffed a package into the parking lot. the fire department helped evacuate the post office lobby. an explosive expert wearing heavy protective gear was scene carrying the package before it was destroyed. the suspicious man was usually seen in an unusual workout fashion jogging in body armor a few blocks away. >> 4:55 right now. several san francisco mcdonald franchisers figured out a way to dodge the city's unhealthy eating law. when the law takes effect on thursday, owners say they will comply and not give out toys. with high fat high sodium meals. that doesn't mean you can't get a toy. the restaurants say for an extra dime you can have the happy meal's toy and the money collected will help build a new ronald mcdonald house at the new ucsf hospital. ronald mcdonald houses provide
