bay bridge? quite a difference from all the fog. it's thursday, december 1st. good morning, everyone. i'm jon kelley. >> and i'm laura garcia-cannon. >> we have sustained winds at 13 miles per hour. san jose sustained at 23 miles per hour. weak wind gus up to 90 miles an hour yesterday. how do we look on the roadways. how >> we have a tree that is down on 152 in watsonville. this is the only highway

affected by down trees. it does illustrate what you're talking about. be prepared for branchs to be closed along the roadway. also reports of wires down in the area. bart could become the first transportation agency in the entire country to ban cell phone blackouts. >> they came under fire for the handling of protests at several stations back in august. christie smith joins us with an update. >> good morning to you. when this happened bart was already on the radar of bay area protesters. then this upset people who felt like it was a violation of their free speech rights. that's when bart decided to shut off cell phone service to downtown san francisco stations. today it looks like they will severely limit these type of cell phone blackouts, except for

times of extraordinary threat. back in august bart cut off cell phone service to try to stop protesters who were out there against a shooting by bart police. bart says it has a train service to protect passengers. that act angered people even more and set off protesters. again, under this new policy, bart is saying that it would only do these type of things, limit service, when there is strong evidence of imminent threat of illegal activity that would threaten passengers or workers. dangerous or more dangerous things. using a cell phone to detonate explosives. the board meets at 9:00 here in oakland. that's when they're expected to make their decision. reporting live in oakland, i'm christie smith. jon and laura, back to you. an update on a bomb scare.

apparently it was a big misunderstanding. the largest post office was evacuated after someone called police saying he saw a man wearing a gas mask and body armor run up to a mailbox, stuff a package in and run away. that man didn't mean to scare anyone. he's a dedicated jobb ed jogger. he's wearing a cardio mask that simulates high altitude training. the body armor was a weighted vest. his friends recognized his description on the news and then called him. >> part of me is like, is this really serious? and then when someone of my friends said, hello! post 9/11. all the razeness that comes with that. yeah. >> police told him don't do it again. he says he won't. a man is behind bars accused of running down a man with his

suv. he's been charged with attempted murder, mayhem and assault with a didly weapon. police say he argued with albert bartall at a restaurant and afterward deliberately ran him down at a gas station. bartal is still in critical condition at sf general with severe head drama. a memorial service will be held for a san jose soldier killed in afghanistan. the national guards man died in the line of duty back on november 16th. walsh was expected to finish his tour of duty shortly before christmas. a public memorial between 9:00 a.m. and 9:00 p.m. at the oakland funeral home in san jose. the father of a 1-year-old boy shot in a parking lot spoke

the nora virus. more than 300 residents got sick two weeks ago. six had to be hospitalized, but they'll be okay. the virus spreads when people don't wash their hands. a bonnie and clyde type duo might be targeting the stanford campus. police are looking for a man and woman responsible for a home invasion. take a look. police say the man and woman forced their way into a grad student housing complex on tuesday night. they tied up the man inside and stole a number of items, including cash and a laptop computer. the robbers were gone by the time police arrived. >> the 3012 america's yaugt race. today we learn how it will affect the city and the bay.

the planning commission still needs to certify the report before any development projects can swail stort. community members will have the opportunity to appeal to the board of supervisors if the report is certified. sfo's new terminal two gets a gold star for going green. it's the first in the country to earn a lead gold certification. it certifies energy-efficient buildings that conserve resources. terminal two reopened after extensive rin novations to the building, which was originally built in 1954. san francisco city leaders from the epa and u.s. green building counsel will be at terminal two to celebrate the certification. finally we can see clearly again with the fog out it have way. but meteorologist christina loren saying being aware of the wind.

is. >> you probably heard blustery winds all night long. 71 miles per hour. so we're talking hurricane forced wind gusts here in the bay area. hayward, livermore and san jose all have after gust as well. our sustained wind speeds are still strong. and the same for livermore. this morning my best advice to you is travel cautiously. watch out for loose debris on the highway. if you have loose objects that could become projectiles, tie those down. this is no wind to midwest with. now a lot of these trees have weakened. we could see more downed trees and power lines throughout the day today.

we'll check in with christina loren. rent in the south bay is skyrocketing. experts say brace yourself. they will climb higher next year. according to realfax.com the average rent in santa clara county is up 13% compared to last year. in cupertino, rent has jumped 18%. the arch price for a one-bedroom apartment there is a little more than $1800. some people say that's not necessarily a bad thing. >> the facts that represents are rising is really a good thing. more jobs come into the area. more people come into the area. those peep spend money. in santa clara county the rate is a mere 4%. congress is dealing with a big time tax issue of its own.

this year payroll taxes dropped 2%. president obama says that is allowed to expire it would be a huge blow to the economy. congress is scheduled to vote this week. ready to rally? for more on that and news before the bell, let's turn to that with jackie live at cnbc headquarters. good morning, jackie. >> good morning to you. the futures are hovering around the flat line after being lowered after the monster rally that saw the dough post the best day since 2009. it was triggered by the fed and other central banks to lower the cost of short-term loans that

banks that could have been hit hard by the debt crisis. they were also impacted by positive u.s. economic data on jobs and manufacturing. we'll see more of that data come out as well. the dough jumped 490 points on wednesday to close at 12,545. the nasdaq higher by 104 to 2620. retailers will report november sales today, which include the black friday weekend. total sales are forecast to rise 3.3%. it's a tough comparison with what we saw last year. sales rose 5.5%. many stores offered huge discounts to boost the sales. wal-mart is launching the first social networking app. it uses facebook day to recommend gifts on a consumer's interest. it's available on wal-mart's face book page. >> plus i like the name, shoppy

flames are ripping through an apartment complex in san francisco. parts of the roof of the building have collapsed at 24th and bartlett. firefighters have been battling the blaze since 4 clrn 30. no reports and no word on injuries or the cause of the fire. it's been 30 years since the if first reported case of aids. 20 years ago they opened the national memorial grove in golden gate park. at noon today medical pioneers will be honored in the grove. ea vigil is set for 6:30
