spin. it's friday. i'm jon kelley. let's check in with christina loren who has very good news about the weather for under the circumstances discuss. >> finally get a break from the weather. we had the intense fog. then the intense wind event moved in. this morning we have calm winds from santa cruz, gilroy and sunnyvale. the north bay mountains. take a look at napa sustained at 30 miles per hour. the winds are bringing your temperatures up this morning. so we get 64 to start out because of the winds pumping through right now. this is one of the warmest days we've had in a while. the weekend looks good for outdoor plans. one day is better than the other. let's get you out the front door. >> an unpleasant good morning. we've been seeing the lights build. and that's starting to recede a

tad bid southbound. we have a big slow patch because of an accident. only sticking out to the fast lane. that's what happens any time something happens. we have southbound side recovering. we'll track that very carefully. >> we'll check back with you. thank you very much. it is 6:02. the fiscal emergency is off. libraries and community centers might get to stay open after all this the south bay. the looming budget was slash bid more than half after a second review of pension costs for the city. unions will hold a news conference challenging city leaders. how do you find $40 million? >>. >> that's what wii trying to figure out. i've seen remarks on facebook about the mayor by police officers. how did all of this happen in the city of san jose.

at this point it sounds like bad math. an actuary or analyst who crunches the numbers for the police and retirement board back in june. he said the city's pension cost would increase by $160 million next fiscal year. now that same analyst says that estimate was too high. and instead of projected $80 million budget deficit next year, san jose's deficit is less than $40 million. the police and fire unions are not happy. >> i am angry. yeah. i've been angry for a wile. i have a mayor who will destroy the city that i love. >> the numbers aren't a surprise. they what we knew all along. the same numbers we used when we had a proposal a couple of months ago sochlt they're not a

surprise. they feel it's fair for both sides. as long as the language is agreeable. a lot of discussion between the union in san jose and city hall. a big rift there seems to be increasing by the day. we have yet to hear back from city leaders to hear what their take is on the finding of this new money. >> thank you very much. police tracking a murder suspect across the country. police arrested 20-year-old norris carol in kentucky last week. police say cell phone video obtained exclusively by nbc bay area helped them track down the shooter. he's been charged with shooting 25-year-old foster just last month. three other suspects have been charged with asaul.

well, a new occupy camp has popped up on the san francisco stat campus. students pitching seven tents at the plaza last night according to the san francisco chronicle. they marched to the plaza after a meeting with the university president. the students asked him to sign a letter demanding that csu roll back tuition to 2009 levels. he doesn't understand the student's anger. but the hikes are the only way to keep them open since the state slashed funding. a safety warning for people on the peninsula. this morning police are searching for a man masquerading as one of their own. he is driving a navy car with flashing blue light. he stopped a woman. the man asked her for license, registration and car keys.

and also asked if she had anything illegal or edible in the car. the woman called police after walking home. high winds are being blamed for the fuelling of fire that destroyed two homes and damaged a third in livermore. the fire broke out yesterday afternoon at a home in the 600 block of andrew street near park. strong winds propelled the flames towards neighboring homes. damage is estimated at over $400,000. the cause of this fire remains under investigation. want to check in with marla tellez. she's live in a san jose neighborhood where people are waking up to a lot of noise this morning as they're attempting to clean up quite a mess. good morning. >> they've made so mush progress as you as you can tell. it's rather quiet now. the woodchiper has been turned

off. this crew has done their job. they've done it well. you can see the tree that snapped. it's about 50 feet tall. we have video to show you. it snapped. it fell right on top of this jeep cherokee. if you're the owner of this jeep, you're certainly not happy this morning. it's been chopped up and oon to be hauled away. this is north 17th at julien in downtown san jose. the south bay took quite a be beating because of the high winds. we came across several neighborhoods where trees are down, power lines down. 2,000 people in the south bay are currently without power. pg&e is dealing with a major transmission problem. take ha listen. it is highly unlikely that the transmission outage will be complete id by tomorrow. therefore, all schools in the

san lorenzo valley unified school district will be closed on friday, december 2nd. >> you just heard from the superintendent letting parents know there's no school for kids there because of widespread outages in santa cruz county. still 25,000 homes are in the dark this morning. back here live in san jose, if you're in the area, be aware that north 17th remains closed between joule yen and washington this morning. the crews are making significant process. it should be open in the next hour. laura? >> the wind reeking a lot of havoc for a lot of folks. although the kid are happy. >> back in the midwest when snow would come. no school! meteorologist christina loren says it will be a nice and warm weekend. >> it will be quiet as well.

we had severe weather all week long. all the way from gilroy to oakland. we have calm winds for the first time in 48 hours in the city of oakland. we had a gust in excess of 40 miles per hour. very strong winds. we'll see strong wind through the north bay and east bay hills. you might get hit by a strong gust over the open water bridges as well. i want to point something out here. really cool weather happening as we speak. we have calm winds in gilroy. 35 degrees in gilroy. the places that are getting wind are staying nice and mild. almost all of us will end up in the 70s. pretty darn close to it. even in san francisco, i'm forecasting 57 degrees. 59 in oakland and san jose. breezy through the valleys today. winds will be relaxed throughout

welcome back, everyone. a live look outside at the golden gate bridge. traffic is picking up just a little bit for this friday. december 2nd. 6:14. >> okay. we are expecting big news in the case surrounding the murder of a bay area nursing student. her accused killer is expected in court today. christie smith is live in hayward with the next step in the case of giselle esteban. >> reporter: good morning. happy friday. giselle esteban is still being held at the santa rita jail without bail. she's due back in court at hayward at 9:00 this morning. the woman accused of killing nursing student michelle le already made several court appearances in hayward. she could finally enter a plea this morning in her last court appearance the 27-year-old said she wanted to replace her court-appointed attorney who had

been representing her for about a month. but a judge ruled against that. esteban is accused of killing nursing student michelle le, who disappeared from kaiser medical center in hayward in may. her body was found near pleasanton in september. the two had attended high school together in san diego. meantime, le's family saw a huge outpouring of support while they searched for her. they sent for their own group to help other missing families find their loved ones. esteban is pregnant and legal experts have said that this could make the case take quite a while, while it continues to wind its way through the course. that's the latest from here. reporting live in hayward, i'm christie smith. back to you guys in san jose. >> thanks so much. let's check the forecast with christina loren. >> those wunds. finally. finally they're dropping off in many cities across the board.

and you'll find gusty winds over the open water bridges as well, taking a live look at the bay bridge. there's probably as third as much as a shake as this time yesterday. that's a good indication that even over the higher elevations we're starting to get a little bit of a break. you could get caught by a gusty wind from time to time. breezy valleys. we start to see the winds decrease to 5 miles per hour. . they're at 15 right now. gusty for the hills the first part of the day. we see a significant drop off throughout the mid-morning hours. so by 10:00 a.m. what's happening out there? why the wind. we have an area of high pressure situated over the great basin. an area of low pressure sitting just to the south. the two are work against each other. you see the clockwise flow here of high pressure working against the counter clockwise flow of low pressure. that forces the gusty winds.

temperatures are much more on the mild side than calm winds and clear skies. tonight we all see the calm wind and clear skies as the area of low pressure retreats to the east. that means it's going to be a very, very cold night. temperatures in the low to mid-30s up in the north bay. look at this, though. you're at 64 degrees this morning in napa. still getting a pretty strong northeasterly wind. 62 in oakland. sh should drop off as winds calm down. 44 in sunnyvale. 52 in san jose. by noon, 73. at noon in santa rosa. already bypassing your average high for this time of year up in santa rosa at noon. you'll round out the day with temperatures near 75 degrees in places like fairfield, livermore, 71. and 71 here in the south bay sochlt a gornlous day. we'll drop off as we head into your weekend. and we'll see a little bit more fog roll in. because we haven't had significant rainfall lately. we're not expecting the fog to

be that thick. it should clear out for the second half of your sunday. 62 inland. 60 in san francisco. let's check your drive on a friday. is it light, or is it heavy sf. >> good morning. it depends where you are. we're going to sfoort with the maps through the south bay and we're looking at highway 101 through 87. typical pattern for the south bay. the rest of the drive is looking clear here. a note for folks overnight starting tonight, saturday night and sunday morning we have weekend road work. closing 101 between capital express way and the 280-680 interchange. this will affect our friends who do the overnight shifts. there will be detours at king and story road. i'll put details on facebook. livermore for a nice easy standard drive. easy drive into livermore. slowing around north livermore avenue and extending to the dublin interchange. let's see how things are shaping up at the coliseum.

we're still looking for them to clear the accident. it looks like things are slowing even more as you're approaching hagenburger on the southbound side. a tow truck may have arrived. back to you. >> we've been talking about the winds. very dangerous and strong winds in the san jose forest. knocking a tree into a elderly woman's home. it fell straight into her lap as she was sitting on the family sofa. her son was also at home. there was nothing much he could do until fire crews arrived. >> i was scared out of my mind. i didn't know what to do. i just had to wait for fire crews to do what they can do, you know. >> that is freaky. rescue workers worked slowly to get the elderly worker out of the house alive.

so much damage as wind gusts close to 100 miles per hour caused a lot of damage in southern california. it also fueled brush fires that damaged three mobile homes and knocked out power to 75,000 customers at one time. several power lines fell. the downed lines actually sparked the fire. firefighters moved in quickly to keep the flames from spreading into massive wildfires. at one point the city of pasadena declared an emergency. in the meantime in utah, hurricane-forced winds toppled big rigs on the highway, forcing police to close interstate 15 near salt lake city. luckily no one was injured there. look at that. >> very dangerous and scary stuff. it is 6:20 right now. coming up, raider or llando mcclan. i'm sorry -- that picture.

look at the traffic picking up. it's 6:2. we'll check in with mike. >> this morning a raiders likebacker accused of firing a gun near a man's head as he pleaded for his life. this is a picture of orlando mcclain smiling as he was led away in handcuffs. they got into a fight when he pulled out a gun and threatened him with it. if convicted mcclan faces jail time or hard labor as well as fines. he also faces penalties from the nfl. but mcclan wiin will be playings weekend. 49ers won't try to cash in on this season's success, starting next season. announcing last night the team will fot increase ticket prices for the 2012 season. the 9ers have the second best

record behind only the undefeated green bay packers. they clinched their first winning season since 2002. 6:24 now. cashing in on campus brains. in 2010 stanford brought in more than $65.5 million from licensing the innovation. those include google's improved hyper tech searching and dna cloning technology. uc berkeley had more than $104 million in licensing income largely from a hepatitis "b" vaccine and a growth hormone. >> also today a major blow to samsung's holiday sales. an australian court says the company cannot sell the tablet for at least another week. samsung right now locked in a legal battle with apple over patent. the latest court ruling is a clear win for apple. in its attempt to stop sales of the main rival to the ipad. apple is accusing them of

ripping off the design. samsung is launching a counter suit against apple. >> it is 6:25. this morning a deadly air bag problem is forcing honda to recall hundreds of thousands of cars. honda is recalling 304,000 cars worldwide, including models like accord, civic, odyssey, pilot and crv. the recalled cars were all made in 2001 and 2002. honda says air bagscan inflate with too much pressure in a crash, sending met tan and plastic pieces flying. honda says 20 accidents have been related to the problems so far, including two deaths in the u.s. in 2009. indeed. it's beginning to feel a lot like christmas. cities all over the bay area getting into the holiday spirit today. holding annual tree lightings. oakland's jack listen square will get a tree lighting at 5:00 p.m. there will be snow flurries --

i'm laur ya garcia-cannon. >> good morning. i'm jon kelley. we check back in with christina loren for a nice looking weekend forecast. >> every time i check, minute by minute, it keeps getting better because the wind are calming down as we speak. let's look at the latest. right now san francisco is finally reporting calm winds. same for oakland. you have calm winds in sunnyvale, san jose and santa cruz. the strongest sustained wind speeds are up in the north bay. south of the golden gate bridge really starting to drop off and get a break. now we are going to see a really nice day today and a pretty good looking weekend. let's check your drive with mike inouye. >> first let's look at the bay bridge toll plaza, which has a hefty backup now made worse because they slowed the metering lights. they mooved over to show the backup over the 880 crossing. so we'll look at 880 out of oakland here southbound. we still have u one lane closed.

fiscal year. now the analyst says that estimate was too high. instead of a projected $80 million deficit next year. san jose is less than $40 million. maybe $25 million. san jose has new money. now the police say the fire unions are demanding no service cuts next fiscal year. >> i've been angry for a while. i've got a mayor that in essence is going to destroy the department that i love and put 2 years of my life into. it's a painful process to watch. >> well, the numbers aren't a surprise. they're the numbers we used when we submitted an aggressive pension proposal just a couple of months ago. so they're not a surprise. >> even though canceling the fiscal emergency is good news, the city manager says the current pension costs cannot be sustained in the long run. so no doubt, pension reform is

headed to the ballot. the unions say they do want pension reform on the ballot. it has to be appropriate without any statements. it's going to be tough between firefighters, police and san jose city hall. i'm damien trujillo, "today in the bay." >> a tough night that continues. a case against a man accuse shooting and killing a police officer will remain under wraps. a judge issued a gag order in the case. that means lawyers for both sides cannot talk publicly about the case. 37-year-old henry smith jr. accused of shooting officer james capoot after a bank robbery and a chase. smith pleading not guilty. on december 9th the judge is expected to consider issuing a gag order for the police as well involved in that case. >> the mayor of san francisco says time and patience are wearing thin with occupy protesters camped out at justin herman plaza. last night things got heated as police stood guard around the

camp. at one point protesters tried to remove metal barricades put in place around the camp by officers. mayor ed lee says he's getting close to deciding to clear out the tent city, if protesters do not agree to move into a city sanction site in the mission district. lee has not given the time line for how long he will give protesters time to decide on the move. it is 6:35. high winds whipping all over the bay area overnight. tens of thousands of homes in the dark without power. marla tellez is live in san jose with more on the damage and the the problems that wind. mother nature left behind. >> the good news is the damage in san jose is just about cleaned up. they just reopened north 17th at julien. this tree had fallen on top of

this jeep cherokee completely blocking the street at one point. the crews just packed up. they've been out here for two and a half hours working to chop up the tree and haul it away. a few neighbors here cannot believe the damage. they me they didn't sleep because of the howling wind. >> it sounded like a hurricane. i was amazed by all the stuff flying. >> this isn't typical? >> no, not at all. >> we found branches and limbs throughout several streets. the latest numbers show just about 700 homes are in the dark in the south bay. that accounts for most of the outages in the bay area. but it is much different in the

santa cruz mountain where is 24,000 customers are powerless still. because of this, school has been canceled for the unified school district. of course, that is in santa cruz county. a colleague of ours says that she has been powerless since 1:00 a.m. yesterday morning. the good news, again, it's safe to say the worst is over. the cleanup remains. jon? >> hopefully she'll grab us a little firewood. >> a lot of kindling out there. >> exactly. >> i don't know if we'll need it this weekend. temperatures going to be nice. >> if you are warm-blooded and like to be warm, you might be able to give your heater a breakthrough the afternoon. we're going to see a nice day with temperatures above the seasonal averages by 5 to 10 degrees because they starting

welcome back, everyone. we're getting a closer look at the monthly jobless numbers just released this morning. tracie potts joins us live from washington. both sides, republicans and democrats, will use this new information. >> well, they do. we got a big surprise with the jobless numbers. it's quite a bit lez than economists predicted. they thought it would stay flat. we saw 120,000 jobs created, plus another 72,000 they didn't originally count. more positive news than was expected. here on capitol hill, this could have impact on growth next year. democrats and republicans can't agree on how to pay for it. they voted on both sides plans last night. both sides fail.

that be closed overnight. starting tonight i'll put details on the facebook page. we'll send it back to you. >> talk about your rough wake-up call. power outages, trees down, mayhem everywhere. all the result of strong winds whipping across the bay area overnight. marla tellez is live in san jose with a look at the cleanup. good morning, marla. >> good morning, jon. i have a smile because it's calm again, and the cleanup crew just left 20 minutes ago. they were hard at work for pretty much all of the morning. they were dealing with this right here. this tree. it just toppled over. it could not handle the heavy winds. this is in downtown san jose on north 17th and julien. those sustained winds brought the tree downright on top of this jeep cherokee. it had been blocking north 17

for most of the morning. not anymore, of course, as it has been chopped up and hauled away. other downtown neighborhoods were hit as well. trees and branches brought down power lines. crews are making significant process. we started the morning off with 2,000 south bay customers in the dark. that number is now down to just under 700. and for those in the santa cruz mountains, though, they are still powerless there. a total of 24,000 homes are without power there because of a major transmission outage. some of them have been without power since wednesday. northbound 17th has been reopened now that the tree has been chopped up and hauled away. it's calm now. as christina says, it should stay this way. jon? >> marla, thank you very much for the report. >> this morning, the family of an attorney killed during an evening jog is hoping a reward

will encourage witnesses to come forward. police say this white truck struck and killed 63-year-old don casper while he jogged in forestville in august. they are now offering $50,000 for information leading to the arrest and conviction of the driver. he was an active republican who worked on establishing work rules and benefits for city employees. this morning a new tip could strengthen the case against a man accused of ramming a car into a san francisco war hero. yesterday police found the rented black mazda near west point and middle point roads in the bay view neighborhoods. it does have some front end damage. 22-year-old eduardo is charged

back of the big dmik data of the day. that was the november monthly jobs report. we saw payrolls up, coming in lower than expectations of 125,000. now the october number was also revived up to 100,000 from 80,000 as well. the unemployment rate is revised down to 8 .6%. most were expecting it to hold steady at 9%. 8.6% is the lowest level since 2009. the german chancellor vowed today to suspend the euro. excuse me -- she vowed to defend the euro in terms of the mark. she said it wouldn't have been a better solution. the says europeans are facing a long and hard marathon to get back on track to restore credibility. she said resolving the debt
