smith is live in oakland with what's in store at today's nationwide demonstrations. good morning, christie. >> reporter: good morning, jon. the fight against foreclosures and loans that can't be sustained for some homeowners is not going away. in fact, it's heating up. this is a national day of action for occupy our homes. here with me this morning is beth from ace. can you talk about what it is that we're going to see going on in oakland? there are quite a few things happening. >> today in oakland we will be marchg from snow park to to aback to help the family get their loaned modified. this will be members of the community group, other community groups as well as members of the occupy movement. >> at noon here at the courthouse steps, where every day banks sell foreclosed houses

at bargain prices while they refuse to modify a family's home. this afternoon we'll support a west oakland family who was evicted several months ago to move back into their home and reoccupy the home. >> do you offer any guidance or counseling or direction on whether it's feasible to stay or go or what's best for them really? >> our main advice is if you will do nothing, you will be evicted. >> that's the latest here reporting live in oakland. back to you guys in san jose. >> okay, christie, thank you very much. an occupy camp has administrators at one east bay high school worried. officials at berkeley saying the growing camp at civic center park is making it hard to supervise the school's 3,000

students. the park is just across the street from the school. the school sends a letter to parents about the issue. >> uc davis is creating a task force to investigate that recent pepper spraying of student protesters that skauzed a big stir out there. mark udoff appointed 12 uc davis students, faculty, alumni and staff to oversee the investigation. they were all asked to assign blame. the task force will recommend new ways to handle demonstrators on campus. a car thief is in custody thanks to the help of the car's owner. they caught him yesterday after giving chase. the man spotted his car on the

road and called police. then he followed the car, running into it. the man confronted the alleged thief who fired a handgun into the air while running away. the suspected thief faces numerous charges including autothouauto, theft and parole violation. a vote to declare a fiscal emergency in san jose will not happen as planned. chuck reid deciding to put off the vote after reports released indicated pension cost in 2012 will drom drop by $22 million. that's a huge difference from a report in july that said pension costs would rise $33 million. san jose is not out of the woods just yesterday. reed still wants to ask voters to reform the city pension system. >> it is 5:05. a huge step forward for santa clara's plans. they will discuss financial plans and how fast a new stadium

will be built. bob redell is live in santa clara with more. good morning, bob. >> good morning, laura. the city will hold public meetings later today and on thursday so that you at home can learn how santa clara plans to finance this billion-dollar plus 68,500 seat new stadium to be located next to it. the city secured $850 million in loans from three banks. the largest loan a city has ever taken out for an nfl stadium. money that would be repaid in part through ha new hotel tax and redevelopment funds. the city council is expected to approve the deal later today with construction beginning next year. the first game in the new stadium in 2014 or 2015.

an improved vision for moving the team to a new location. the niners repeated they are committed to santa clara. the mayor feels his onlt shot would be if the raiders were to share a stadium can niners. that's a notion the nfl seems to push among teams. mayor lee does say that time is running out. it is 5:07. san francisco's board of supervisors taking another shot at extanding the city's plastic bag band. the board putting off a vote on the issue last month so it could study the economic impact of the plan. some supervisors worried it would place a burden on low-income residents.

there's already a plastic bag ban in place for supermarkets. and a vote today on an offer to for taxes. the sheriff-elect introduced the plan to offer a $10,000 tax break per ex-felon hired to prevent crime. mayor ed lee will likely veto the proposal. opponents say it gives ex-felons priori priority over many people struggling to find a job. the weather may be chilling, but homers are asked not to light up their fireplaces. there's no official spare the air alert but they would like to ask homeowners to voluntarily stop burning wood. the forecast for today calls for

stagnant weather. the spare the air season runs through february. very frosty outside. meteorologist christina loren is here to tell us what it will be like the rest of the day. >> if you parked outside in the north bay, prepare to use the credit card to get the frost of your windshield. temperatures below freezing for the past few hours. we'll see the temperatures rebound. full sunshine. high pressure is in control. but it will take until 9:00 a.m. before that frost is really able to dissipate. temperatures above freezing by 8:00 a.m. in most cities. also forecasting a record if oakland this morning. i think you'll hit about 37 degrees. the old record is 38. this is where we are now. 39 in hayward. 32 in kon record and fairfield. 31 in livermore. in santa rosa, you got 31 degrees. everywhere in the north bay,

below or at freezing. and the coldest point of the day is sun prize. the furthest point from when our heat source, the sun, was warming us up. only 47 degrees as you break for lunch in concord. full sunshine and high pressure will make for temperature this is the 60s yet again. repeat performance of yesterday. if you park in the sun, you'll get a nice treat. headed out to work, mike knows what could slow you down. we still have a few lanes blocked in either direction. that should be picked up over the next 45 minutes. completely clearing by the thim this changes. actually, the numbers just left the screen on the bottom.

it is crisp and cool and cold. >> this afternoon just about as warm as yesterday. we'll hover in the upper 50s and low 60s throughout the extended period. no major swings in terms of your temperatures. and no rain in the forecast, even at this point, as we head into december. typically a wet month for us. still bone dry throughout the next seven or eight days. you can stee the biggest difference between yesterday and today are the winds have calmed down. the calming wind in fairfield has temperatures 20 degrees cooler this morning than where we were at this time yesterday. so you're 22 degrees cooler in fairfield. 14 cooler than this hour in novato. san hjose, you're ten degrees cooler. i'm sure you already know it's cold in the north bay interior valleys. if you left a plant that's sensitive, could be damaged by frost, bring that in until 8:00

a.m. that will warm up the frost we turn to dew. frost advisories until 9:00 a.m. this is why. temperatures have fallen towards the freezing mark and below in places like santa rosa over the course of the past few hours. so when you see temperatures at freezing for three or more hours, typically a hard freeze can set in places where you get additional moisture. place where is the sprinklers get left on. you'll have 54 in santa rosa. as you break for lunch and then we round out the day in the '60s. a repeat performance from what we saw yesterday. i want to remind you one more time because of air quality issues we ask you do not burn the firewood this morning. probably better idea to turn on the heater. throughout the next couple of days, high pressure stays in control of the weather pattern, keeping temperatures nice and comfortable. it looks like all we have to deal with is fog. let's find out about the roads right now with mike.

drive heading from oakland to san francisco. >> if you purchase tickets you could be in for a refund. we turn to brian shactman with cnbc headquarters. >> good morning. first stock futures are slightly positive this morning. investor focus again on europe and the debt crisis. u.s. markets cut their gains in half after reports surfaced that s&p 500 may downgrade the ratings of aaa companies like france and germany. leaders have to deliver a convincing agreement to resolve the crisis at a summit on friday. asian markets fell overnight. europe is modestly lower at this hour. we don't have a lot of data in the u.s. so we're focused on what's going on in europe yet again. we had the dough up as much as 157 yesterday. it finished up, but only to 1297.

now to ticketmaster. those who bought ticketmaster tickets over the past decade may be entitled to cash back. that's a result of a class action lawsuit filed back in 2003 that was just settled this past fall over processing fees that customers were charged. ticketmaster is e-mailing people who are eligible for a credit. it's 1.50 for tickets bought between 2009 and 2011. it's still something. you can only use two credits at a time and only at certain venues. if you want to own and nfl team but don't have millions or billions, the green bay packers are selling 250,000 shares of stock today at $250 a pop. money will go toward renovating the field. i need to caution you. as an investment it's worthless. it's not traded on exchange. the packers don't pay a dividend for any cheese head fans. and they are super bowl champs. the shares are probably priceless. >> wow.

>> to purchase that you must be a psychotic packer fan. a former contra costa sheriff deputy and private investigator facing a civil lawsuit. a livermore wine maker filed suit after he was caught in a dirty dui squecheme. they are accused of a string of phony dui arrests. his estranged wife hired butd butler to get him drunk and then arrest him. he found out when the men were arrested. the lawsuit names contra costa county, the sheriff's department and the town of danville. 5:21 now. a north bay dog may be getting a second chance at life. the animal center has agreed to send cash, a mastiff pit bull mix to a facility that rehabilitates dog. the man sued the shelter because it would not let him adopt cash.

workers on strike for an east bay company that made sweet treats since 1925. talks between the american licorice company plan in union city and the 175 employees just have broken down. wage increases and the the health care costs are the main sticking point. in the past the company gave smaller pay raises in exchange for paying all medical cost. but now american licorice company wants its employees to pay for their own health care plan which could run in the thousands. this morning there's still no decision on a controversial plan to build a new sports come plek. last night dozens gathered in to

i'm jon kelley. time to check in with christina loren. certainly tonight. it's going to be a cold one. this morning the coldest air we had situationed over the bay area since last winter. your temperatures are very cold in gilroy. you're at 26 degrees. 31 in livermore. 31 in santa rosa. 31 in napa. we're about 22 degrees cooler than this time yesterday because we had the winds coming through some cities. so we head throughout the morning hours. your temperatures are be on the cold side. we have your seven day forecast in just moments. tuesday with mike inouye. >> we'll show you first the bay bridge toll plaza where i saw early backup a few minutes ago just before the break. the other backup has stuck around. this is westbound highway 4. it's just jammed up all the way.

we typically see slowing, but not this severe. no incidents in the area. i'm going to make sure the sensors are right. that's a lot of slowing. occupiers on their national day of action. christie smith is live with more on where you'll be seeing protests today. good morning, christi. >> good morning to you. one of the protests will happen here on the county courthouse steps. i've been speaking with a group involved with this. they say they chose this location because this is where foreclosure auctions take place midday. they say they want to draw attention to it and try to help homeowners struggling to keep their homes and get a loan modification. it's a collection of difbt community groups coming together on this day of action.

they'll work with homeowners and how one family plans to reoccupy their home. they say it's about trying to get the attention to where the homeowner had little success on their own. and it's coming together with the occupy wall street movement. >> we are helping people go to the bank. we've gotten load modifications and principle reductions so that people could afford their modified loan. they have events planned all day beginning at 10:00 this morning with homeowners sharing the specific stories. they're also going to head to a bank. they say say they were going to demonstrate. one woman was in danger of having her home foreclosed on and auctioned very soon. they say she's since gotten a loan modification an plans to stay put for now.

ed lee will announce plans to move business away from the waterfront to make way for the massive construction projects. they make way for dozens of businesses. including a famous cabaret show to lay out plans to move elsewhere. the america's cup will be held in 2012 and 2013. it is expected to generate $1 billion for the city. california's proposed high speed rail project could be derailed by the same people who supported it. a recent field poll shows 64% of californians want a do-over and they want another vote. only 31% would support the high speed rail project. it is coming as the rail authority in charge is doubling the estimated cost.

a ban of a provocative bay area company. business and tech reporter scott mcgrew is in the newsroom. this is a sudden turnaround, right? >> it really is. last night at 6:00 scott budman told you about a fight between paypal and another company. after years of allowing paypal to charge the members money, they were suddenly banned from paypal. this is ironic considering the head was one of the very early employees at paypal. this morning paypal has reversed itself and said they can keep using the service. it cost $12 a month. i checked the site. now this was purely for research. they have yet to add paypal functionali tity back to the si. you will be able to use paypal once again to look at topless girls. >> business and tech reporter scott mcgrew.

this morning president obama says the pressure is on. the president is calling on republicans to come to the bargaining table before payroll taxes go up 2%. tracie potts is life in the capitol this morning. what's the hold up? >> democrats and republicans have two completely different ideas about to pay the $180 billion to extend the payroll tax cut into next year. democrats want the tax on millionaires. they scaled back. they revealed details scaling back the amount of that tax. republicans, the leadership seems to be willing to at least take a look and compromise. but some republican members say they don't see the need to tax millionaires at all because it could threaten jobs. today president obama is hoping to put the pressure on. he's delivering a speech in kansas, a small town in kansas. the same place president

obama's old senate seat. prosecutors are asking for a 15 to 20 year sentence. today is just a hearing. the judge will sentence blagojevich tomorrow. amanda knox is now writing a book about the entire ordeal. knox lawyering up before beginning negotiations with a variety of book publicers. not sharing details about how far along she is in the book process or if she's written anything so far. the announcement just days after knox's ex-boyfriend and co-defendant announced a book deal of his own. back in 2009 knox was of course quitted of killing and sexually assaulting their roommate in italy. that conviction was overturned this year. it is 5:45. i've been talking about cooler temperatures out there. want to check in with meteorologist christina loren. >> it is so cold up the there.

at 9:00 a.m. this morning we are expecting all temperatures to come above the freezing mark. right now you are still dropping off. i'll show you where the temperatures are in one moment. the biggest moment between yesterday and today is we lost the wind. you need clear skies and calm winds for the frost to develop. that's the case this morning. we're forecasting temperature records in places like san jose. you'll tie a record. oakland, you'll hit about 37 degrees this morning. san francisco, all you have to do is drop to 40. that's a new record. and santa rosa, 26 degrees is the old record. the forecast is 25 degrees this morning. take a look at novato. wind just dropped off there. you dropped to 28 degrees. as a result. you're at 31 in napa. 31 in livermore. in san jose, we're in the upper 30s this morning. it's cold out there. i tried to let my pug out this
