good morning everyone. the time now is 4:30. i'm jon kelley. >> i'm laura garcia-cannon. lots to get to this morning. another chilly one out there. here is meteorologist christina loren. >> it is cold out there this morning, just about as cold as it was at this time yesterday morning. so 45 in san francisco, 28 novato, 38 in santa rosa. a spare-the-air alert for the inland valleys. you want to make sure you do not burn up there. you could get fined this morning. filtering sunshine today. a really good looking afternoon like we saw yesterday. so we'll talk about that coming up, 4:31. mike has a serious crash already this morning. >> that's right, christina. chp reports a deadly accident 580 through livermore. it's eastbound, so noncommute. so no slowing at the scene eastbound approaching north livermore avenue. the coroner has been called to stooenl. more details on that accident

coming up. we are following developing news out of occupy san francisco this morning. >> san francisco police raided the encampment at justin herman plaza forcing occupiers to leave. "today in the bay's" christie smith joins us live with the lae et. >> reporter: good morning to you. crews from the department of public works in san francisco are cleaning out the encampment at justin herman plaza. we've been seeing them take out gar badge. earlier police came in and dismantled the tents. there was a lingering questioning here of the and when san francisco police would finally move in. overnight occupy sf got its answer. it was after 1:00 a.m. when police moved in. we just spoke with the police chief. what he's telling us is they gave a verbal warning to the occupiers here at justin herman plaza. he said there were about 100 people there and more than 100 tents. the chief says about 50 people packed up and left on their own and some of them circled back

around market street towards the camp. he says more than 50 people were arrested and someone threw a metal chair at two officers, one had his riot gear on and is okay. we just asked the chief why tonight? >> well, the mayor has been really thoughtfully and patiently negotiating with occupy leadership, and as of about yesterday director nuru who has been the point person for the day today contact was getting no return e-mails. department heads went over and looked at the site in the mission. it appeared all communication had broken off. after the aggressive attack on the officers and other city workers last thursday, it appeared the group deteriorated and had not only become a health hazard inside, but was becoming a public safety hazard on the outside. so the decision was made to clean it up. >> i'm still waiting to speak

with some occupiers this morning on whether they had any injuries. again, department of public works is out here, and i'm told they're collecting -- separating the trash from people's personal items. if people do have things that they want to reclaim, they can do that a little later on because everything will be taken over to public works. the chief also says they have homeless services out here helping people who might need it. so he says at this point this is going to be going on until the entire area is cleaned up. that's the latest from here reporting live in san francisco, i'm christie smith. i'll send it back to you guys in san jose. a very dangerous and scary situation for the popular tv show "mythbusters." a cannon misfired and sent a cannon ball right into people's homes. producers were experimenting with a home made cannon.

"mythbusters" frequently uses the alameda county bomb range to test out experiments. show producers contacting homeowners to set up a meeting with their insurance carriers. a cheerleading coach at a south bay high school is expected in court this morning. 23-year-old anthony lozo remains in santa clara county jail following his arrest on sunday. he's a cheer coach at andrew hill high school and also at san jose's mg athletics practice

gym. prosecutors claim it happened during cheer practice. police are asking any other possible victims to call silicon valley crime stoppers. 4:35 right now. lawyers for a state lawmaker accused of shoplifting will discuss the case in the courtroom today. the individual at the center of the case will not be there. state assembly woman mary high ashy was excused from today's hearing. accused of stealing more than $2400 of merchandise from niemann marcus in san francisco. she's pled not guilty to felly grand them charges. prosecutors have asked that she be required to appear at all future hearings. a con artist is targeting elderly victims. we have a sketch of the want man. investigators say he poses as a bank manager, calling victims by phone and meets them outside their bank. he tells victims he's investigating employee theft and convinces them to withdraw

thousands of dollars. at least one person is out $11,000. if you recognize the man in this sketch at all, you're asked to call san francisco police. thieves are stealing from taxpayers by targeting traffic lights for their precious metal inside. in vallejo thieves have stolen copper wire so many times, the city resorted to putting up signs explaining why signals are out since may. 77 location haves been hit. the price tag for it all, about $200,000. but the thefts aren't just happening in vallejo. b.a.r.t. also has seen a huge spike in copper crime. the agency says crooks are pulling the metal right off the tracks, and the damage is rapidly approaching 100 grand. other bay area cities also grappling with the expensive crime spree. behind bars and still committing crimes. inmates at the elmwood correctional facility near the great mall in milpitas accused of using their jail bank accounts to skim thousands from stolen credit cards.

the scam started in april and ran through august. one inmate recruited at least a dozen people inside and outside the jail to help pull the scam off. in all they stole more than $17,000. the inmates were able to pull off the scheme with the use of a smuggled cell phone. the ringleader was in jail for counterfeiting credit cards. if convicted of these new charges he faces an extra 25 years in jail. a fire in san jose led to the discovery of a possible marijuana grow house. the fire was reported a little after 3:00 yesterday afternoon on tunis avenue. firefighters found four rooms full of firefighter plants. police say the home was probably used to grow marijuana. no one was home at the time and there were no reports of injuries. 4:38 right now. another check of the forecast on this wednesday morning. here is meteorologist christina loren. >> good morning. not quite as cold as we were this time yesterday morning, but just about as cold. we don't have frost advisories

or freeze warnings in place. temperatures are chilly. make sure you grab a jacket. we even have the 20s in a couple cities, gilroy and novato this morning, at 28 degrees. meanwhile, 39 in san jose, 46 in oakland which is a rather cool start for you there. at 31 degrees this morning in santa rosa. as we head throughout the next couple hours, we'll continue to drop off. you know the drill. just before sunrise, the coldest part of the day. we have a share the air alert in place for the inland valleys, if interior valleys. that means it's illegal to burn that fire wood up there this morning. elsewhere moderate air quality. because we have high pressure compressing everything, forcing it right to the surface, you will see a pretty good layer of haze. we have more cloud cover out there this morning as well. keeping things more mild only by a couple degrees. the jet stream is well off to our north. that's going to take the storm track into canada and the pacific northwest as we head through the next few days. nice clear start again. patchy frost, dry, clear and

cold conditions will make way to a nice and mild afternoon with temperatures in the 60s. it works out like this today, just about the same as yesterday. 62 in san jose, 60 in fremont. a little rain in that extended forecast which we'll get to in a few minutes. at 4:39, any improvement in livermore, mike? >> the traffic isn't really affected. there's been no change on that as far as chp's report goes. this is eastbound 580. westbound an easy 13-minute drive. eastbound underneath the spring town overpass there, about 2:30 in the morning, chp got a call about a car on the shoulder. chp arrived. after about a half hour they called the core roaner in. they're still waiting for the coroner to the do the investigation. we have three cruisers on scene and the coroner investigation will be a distraction heading eastbound past the exit. we'll track this throughout the morning. the south bay, no major slowing for the northbound commute directions. we already know the crews on 880

happy wednesday everybody. nice shot of a cruise ship documenting in san francisco. if you happen to hear somebody humming the theme from "love boat," it's probably from here on today in the bay. the time is 4:34 vrnlths newt gingrich surged ahead in the race from the gop nochl nation. now his opponents are turning up the heat. several big polls show gingrich leading by double digits in iowa and nationwide. other candidates accused him of ethics violations and being too much of a washington insider. gingrich says that's a good thing. >> i am the only speaker in your lifetime who balanced the budget

for four consecutive years. >> mitt romney now tied for second. he picked up an endorsement yesterday from former vice president dan quayle. romney also said he will not attend a debate hosted by donald trump later this month. former illinois governor rod blagojevich is scheduled to speak at his sentencing hearing today. the judge is also expected to announce blagojevich's punishment. in court tuesday the judge said it was clear that blagojevich was the ringleader of the scheme to sell president barack obama's former senate seat. prosecutors are asking for a 15 to 20-year sentence. today marks the 70th anniversary of the japanese attack on pearl harbor. ceremonies are planned around the nation to commemorate the 1941 attack on the u.s. naval base. more than 2,000 american servicemen died during the bombing raid which drew the u.s. into world war ii. in alameda a special ceremony will be held on board the u.s.s. hornet. a navy veteran who was at pearl

harbor when the attack occurred will speak at the event. it starts at 1:00 p.m. it was a decent day for the dow yesterday. can it possibly cape pace today? brian shactman is live at cnbc world headquarters. >> it's not up to us, but up to europe. futures right now are slightly higher following a second day where the markets were mostly up, but they failed to hold on to early gains. they closed off the worst levels of the session. investors still focused on europe. reports say leaders are talking about creating two separate bailout funds to contain the raej on's debt crisis. tim geithner is on day two of his tour meeting with nicolas sarkozy in paris ahead of friday's eu summit. the dow was up 52 points on tuesday to 12,150. the nasdaq was down six to

2,649. citigroup cutting 4500 jobs over the next several months, so far announcing fewer lay-offs than their rivals. these cuts are more than what was expected. city securities and banking divisions will likely account for about 20% of the job losses. verizon may be ready to take on netflix. reports are that it plans to launch a service sometime next year to stream older movies and tv shows online. it would be offered outside of markets where verizon currently offers vios tv and broadband service. netflix has been taking it on the chin, of course. their stock after they raised prices. back to you. brian, thank you very much. a rough 2010 for netflix. >> it's been a cold week here in the bay area. want to check the forecast with meteorologist christina loren. >> you know, but california weather, you got to love it here in the bay area. it's cold to start, but then we get gorgeous, sunny afternoon.

the difference between yesterday and today, temperatures about the same. but we've got a little more haze out there. air quality is suffering under this big dome of high pressure that will make for a nice sunny afternoon. you can see old glory blowing in the breeze in san francisco. we have a little more breeze. as a result, not quite as cold, but just about as cold. fairfield at 31 degrees. you're below freezing in many cities right now. santa rosa is under freezing. you have 28 in gilroy right now. coldest spots are gilroy and novato. as we head through the morning hours, we'll continue to drop off. livermore will hit about 30 degrees before all is said and done. you're not going to notice much of a difference when you walk out this morning. you'll likely notice a difference later today when it comes to the haze. filtered sunshine for the second half of your day. the worst air quality is in the evening hours once all those cars hit the highways. right now if you're heading out and about you're getting the best air quality. we'll see the spare-the-air

welcome back everyone. another cold started to the morning. a live look outside at the golden gate bridge. 4:53 right now. california's population grew at a slower rate this year. a new report from the department of finance showed the state's population growing by .7% between july of last year and july of this year. experts say more people left the state this year likely because of unemployment remaining very high. the birth rate also slowing down in the state hitting the lowest level since back in 1936. all of the nine bay area counties experienced some growth. santa clara county was the fastest growing. san francisco came in second. 4:54 right now t. santa clara city council must sign an $850 million loan to help fund a new stadium in order to move the 49ers to the south bay. council crunched the numbers for the first time in public last night. the plan is to use stadium revenue to pay off that loan. revenue the 49ers say is already pouring in.
