first let's check the drive with mike. >> christina, things look a little mixed up in oakland for the morning commute and likely the weekend. the construction reopened 880 northbound. look at the tail lagts north of the coliseum. folks are shifting all the way over to the left side of your zreen. that's screen. now caltran it sounded like they were unaware of the shift. there's the shift. expect some slowing at the coliseum for the time being. and i'll try to get official word on what is going on for tonight and tomorrow as well. we'll see what's going on. >> we'll check back with you. perfect, thanks. >> it is 5:01 now. holding onto hope. that's what the family of the toddler hit by a stray bullet says tair doing for the baby this morning. they're holding on the hope. the latest test showing 23-month-old may be brain dead. christie smith is live in oakland where the family has a very hard decision to make.

whether or not to take their baby boy off life support. >> good morning to you. more than once the family stood out here in front of children's hospital in oakland with a pastor by their side asking for more time, another test, anything to give their baby a chance to survive. but now it's looking like they may have reached the end. what's happening is an attorney for lawrence's family is saying that they will take the little boy off life support today. this after tests showed that the 23-month-old has no brain activity and the tests were part of a process to declare him legally dead. several others were hurt in that shoolting. police have detained five people on unrelated charges. this morning on facebook for hiram and twitter, there's

really an outpouring of support going on. people saying they're hoping and praying he pulls through. i'm christie smith, jon and laura, back to you. >> completely heart wrenching. thank you for the update. >> it is 5:03 now. police in the peninsula are looking for a man who robbed a check cashing store in an atem to rob a second one. a man with a gun robbed check and go store on monday. on tuesday a man fitting the same description attempted to rob a california check cashing on norfolk street. both crimes were committed by the same person. he is a black male in his late teens to early 20s about 5'5" with an average build. no one was hurt in the incident. anyone with information about the investigation is asked to

call san mateo police. >> the east bay spca offering a $5,000 reward now for help catching the people who are out killing ducks and killing geese. seven birds were found shot to death this past saturday. this after eight ducks and geese met a similar fate at willow pass park. if caught the culprit could face felon animal cruelty charges and up to three years in jail. so far authorities have absolutely no leads. >> a $57,000 payout and open office door. those are the settlement terms in a lawsuit against berkeley high school counselor accused of sexual harassment. a 16-year-old girl says anthony smith touched her and made inappropriate comments. her family sued the school district. as part of a settlement, berkeley unified will pay more than $57,000 to the students. smith is allowed to continue working on campus, but must leave the office door open and his blipds rolled up.

the former technician accused of skimming cocaine from a san francisco crime will be back in court this morning. deborah madden expected to attend two hearings. one to set the bond and condition of her release and the other to set the trial date. the former crime lab tech pleading not guilty earlier this week to the federal charge. she admits to stealing small amounts of cocaine in 2009. but state prosecutors did not file charges due to lack of evidence. the new federal charges do not apply to the case. several new firefighters are about to join the department thanks to a new federal grant. damien trujillo joins us live. this is has been closed for more than a year. good morning, damien. >> it's still a a shell of a station. sign of the times. the economic times here in san

jose. but they are getting new in firefighters to help out in the front lines. along with the closure of this station. san jose had to lay off 49 firefighters. they were mostly new recruits. the department brought 22 of them back. the other firefighters found jobs elsewhere. now the department is able to hire more firefighters, nine today. the ceremony will begin at 3:00 at the training center. these are firefighters who transferred from other departments and had completed their modified economy. the new teams will be ready to hit the rigs and fight fires beginning on sunday. that means staffing levels will soon be back to what we had in san jose two years ago. some argued that's still not enough to meet the demands of a city the size of san jose. 18 more firefighters will go through a similar academy beginning in february. so thins are beginning to get back to normal.

the hope is with attrition these firefighters will be able to stay on permanently. i'm damien trujillo, today in the bay. >> the federal appeals court does not look like it will side with supporters of proposition 8 in the latest appeals effort. the court heard about about whether the judge struck him down because he was gay. proponents say the judge should have disclosed a potential conflict of interest because he may have wanted to marry some day. two members of the appeals panel appeared skeptical about argument. one asking, so, a man married -- a married man, that is, could never hear a divorce case? well, the courts will issue a written ruling in a later date. the judges also hearld arguments over whether a video tape of the prop 8 trial should be made public. they appear to be in favor of keeping the trial tape sealed. it is 5:07 right now, oakland

will hold a special meeting to make an announcement about baseball. the city has not said what the announcement will entail, but it may have something to do with oakland's bid to keep the a's in town. indications from the winter meet gds are the league is getting closer to voting on the a's move to san jose. >> cool and crisp in the morning. today it's more of the same, christina. it has been or that it could be this month. typically we get a lot of rain in month of december in the bay area. it's been dry so far. looking dry into the extended period. i think we'll see drizzle over the course of the weekend to monday. we'll see the marine layer get deep over the weekend. enough for drizzle at the coast. we have unhealthy air quality in your inland valley. other we have good air quality. an improvement on the peninsula.

they are hanging on every word. leaders for 23 countries agreed to introduce stricter budge rules in hope of containing the debt crisis. british prime minister david cameron putting a fly in the ointment and saying there's no way the uk will join the european union. shocks fell sharply on thursday after the head of the central bank says he has no plans for a large scale stimulus. the dow dropped almost 200 toints to 11,998. the nasdaq lost 52 to 2596. also secretary of transportation ray lahood is telling regulators, saying regulators did not suppress information about fires involving the chevy volt. there are reports of the battery pack catching on fire days after crash tests that first surfaced in july. the government did not disclose the problem until last month.

welcome back, everyone. 5:23 now. barry bonds wants a softball. but feds are playing hardball. they are asking to sentence the home run king to 15 to 21 months in prison. earlier this week he asked for leniency suggesting house arrest instead of prison. bonds was convicted of obstruct justice during the investigation. the 47-year-old is scheduled to be sentenced on december 16th. >> right now we have an update to breaking news that we brought you yesterday morning. the crime sweep in gilroy netting a total of 31 arrests. police say the suspects were using kids to sell guns, deal drugs, and do all the gang's dirty work. the suspects could get enhanced sentences for using children to commit the crimes. the sweep, the result of a

seven-month investigation in gilroy and san jose. a death row prisoner in arkansas is getting a new trial because of twitter. another case of a juror being too social. >> the judge in the case specifically said do not tweet about the trial. so when juror number two did tweet. he just talked about how he felt about the trial, thinking that was somehow different. erickson was convicted, sentenced to death, but flow the arkansas state supreme court has overturned the sentence, ordered a new trial because the tweet, and i know you're cure i don't say. here's a tweet from juror number two. we define the great line. i believe that may be a haiku. secretary of state hillary clinton scolding several silicon valley companies for providing censorship technology to dictators and tie rapts. she didn't name names but several hardware and software companies have been in the news for selling technology to places

lay off 49 firefighters. mostly they were new recruits. thanks to this federal grant called the safe regret, the city was able to bring back 22 firefighters over the summer. today the firefighter will hold a badging ceremony for nine men and women who transferred from other cities. the new hires just completed a modified academy with san jose. they'll fight fires beginning on sunday. per capita the union argues the department is still understaffed, even with the new hires. no doubt today is a good start in getting the city back to some form of normalcy. the new firefighters arrive at a time when the rift between the city and the department could not be wider. the fight is over pension reform. now the safer grant b is good for two years. but the department hopes through attrition the 49 new firefighters will be able to stay on permanently.

yeah, we have to take it down if a hollywood movie studio objected. under current law it would not be our responsibility to catch this sort of thing in the first place. but under the proposed law, that would change. companies saying they can't possiblily police their own site. there are hours of video uploaded to the site every minute. it would prohibit financial services like papal from working with a website accused of piracy. so someone uploads a song, you don't realize it and then you don't exist on google. people who make these say something has to be done. there are laws on the books now, but you have to look on youtube and see the princess bride and realize the laws are not working well. i should point out that we do have a dog in the fight. our parent company, universal studios owns a movie studio.

let's get a look at the forecast with christina loren. >> we have a really good looking forecast. both days good for outdoor activities especially on saturday. and we love you so much, we're giving you the moon this morning. as we head through midnight through 5:00 tomorrow, spectacular lunar eclipse. bob redell is out there. you have a nice clear shot of the moon for your inland cities. not so much the case in santa rosa. the onshore flow is clearing out your air quality. 35 degrees in sunny veil. we'll see a comfortable day today, especially inland.

street on june 9th. hernandez was attacked for no reason. 11 months later officers are not made any arrests in the case. tonight's vigil will be held at 6:00 p.m. on the 500 block of howard street. the man accused of killing a police officer will be in court this morning. a judge will hear the case against henry albert smith. also a hearing on whether a gag order in the case will extent to law enforcement agencies. earlier a gag order was issued for lawyers in the case. he was shot and killed while chasing smith after a bank robbery. this weekend the cal meritime
