sprinkles today, at least not in san jose. thank you for joining us on this sunday morning. i'm kris sanchez along with meteorologist rob mayeda. if you are going up to get a christmas tree in the santa cruz mountains, you might feel the sprinkles. maybe some drizzle. 24 hours ago we thought we were going toet more showers,g but it is giving a little more moisture which has brought our temperatures up a few degrees. still mid-30s and novato, 40s elsewhere around the rest of the bay area.gr you can see from the south bay up toward the peninsula and the east bay we're seeing partly cloudy skies. a little patchy fog around novato. if you look closely offshore, you can see the spin of the clouds there. a lot of the action will miss the bay area today. as we go hour by hour, the cloudsilck p bbarolo block out some of the sun at times for the afternoon, so as we pass lunchtime, low 50s for most of the bay area and just a slight chance of showers. the best bet is from santa cruz southward. we'll see a better chance of rain showing up in your seven-day forecast.

we'll let you know when the next better chance of rain is coming up in the next few minutes. we start with a developing story for you this morning. california highway patrol officers are still looking for two people after this crash in richmond overnight. a driver crashed into a light pole with two transformers on it around 2:40 this morning. as chp officers tried to stop the driver on interstate 580, that car reached speeds above 100 miles an hour and tried to kp exit at regatta boulevard. several people exited and ran from the car but one woman stayed behind. that crash knocked out power to 400 homes and businesses. pg&e is trying to get the power back on. initially 2700 people were in the dark. pg&e hopes to have all the power restored around 10:30 this morning. also new this morning, san francisco police cleared protesters from outside the federal reserve building this morning. the raid started around 4:00

this morning. sfpd says 55 people were arrested forr illegal lodging. police say they started to give protesters hourly notices they needed to leave or they would be arrested. those notices started 24 hours before this morning's raid. occupy protest irz will try to shut down the port of oakland tomorrow. this is part of a larger protest up and down the west coast. oakland could be the only exception. there's one main entrance and one main exit. unlike the protest that shut down the port in november, this one does not have the support of the longshoreman. nearly a dozen people were injured after a fire that started and 5:30 yesterday evening on ellis street near jones. firefighters contained it in about an hour's time. nine people had to be treated for burns and smoke inhalation

and more than 200 people are displaced even this morning. investigators are still looking into the cause of that fire. an oakland man is dead, shot while she was in bed. a bullet went right through the ball of his home around 3:30. the 36-year-old father of three was found wounded and unresponse if by his children who woke up to the gunfire. his wife, who was at work at the time, does not understand why anyone would target them. >> my husband never have problem with nobody. >> we all need to do something about it because you never know, next time might be my time or your time. we need to resolve this. >> police have not released details but anyone with information is asked to call the pd. police are looking for a thief who is persistent if not very successful. about 10:00 the suspect rode a

bike up to a woman walking on waverly street. he indicated he had a weapon but rode away empty-handed. 20 minutes later a man tried to grab an ipod from a 14-year-old boy who held on and he then ran away. then a neighbor saw the suspect go into an open garage and steal a bike. the suspect description is the same in all three of these cases. a thin hispanic male in his 40s about 5'6" tall, unshaven, possibly with a mustache riding a gray 21-speed mountain bike. since 2007 there have been six million foreclosures in the u.s., another five million are at risk of foreclosure in the near future, but a cal graduate and former 49 are is helping several families, including one from antioch, where the foreclosure rate is one of the highest in the nation. kimberly tere has their story. >> reporter: it will be a very merry christmas for one antioch

family who was able to keep their home despite losing it in foreclosure. darren gates and his wife along with their four kids lost their home in july of 2009 when they could no longer keep up with their mortgage payments. the company bought the gates' home at auction and offered it back to them with a lease-to-own option. the gates were able to stay in their home while paying toward the repurchase of the house at current market value. on monday the family closed escrow paying half of what they originally paid for their home. >> we were prepared to leave and just sort of battle through the consequences of losing the house and suffer through the credit and renting and getting back on our feet. but this turned out to be even a more viable option and it was the best thing that was available to us at the time so we were thrilled to found out about that. >> now, waypoint homes and doug

people in the resort town of acapulco stayed outside several hours after the quake. so far, no reports of major damage. manuel noriega is heading back to panama this morning to face further punishment. the 77-year-old former dictator left a prison in paris overnight. he moved to that in 2000 after serving 17 years in a u.s. prison. he faces two 20-year sentences in panama for the deaths of two political opponents in the 1980s. u.s. forces captured him in a 1989 military invasion ordered by then president george h.w. bush in part because of his link to drug traffickers. he was convicted in the u.s. of accepting bribes to allow shipments of cocaine found for the u.s. through panama. newt gingrich is trying to build his momentum at the latest debate but things did not go well for the other candidates last night. nbc's brian mooar has the latest.

good morning to you. i want to take you back out live to the financial district in san francisco where a raid on the occupy movement happened there. san francisco police say no one was injured, none of the demonstrators. no police officers either. they say 55 people were arrested for illegal lodging. we'll have more on that coming up in a bit. now let's check in with rob mayeda for a look at that forecast, because some of my

neighbors are still putting up their lights and decorations. >> today might be a good day for it. you'll be warming yourself up this morning. it's a little chilly outside. we've got some 30s and 40s. no 20s on the map like yesterday. we've got a little moisture and low clouds inland but 32 in novato, 38 napa, 47 san francisco, 46 san jose, 36 around gilroy. winds more onshore today. south wind at 5 and southwest wind, pushing in more of that marine air so temperatures not quite as cold this morning. but with the cloud cover our highs will be running fairly cool. you can see the air quality has returned thanks to the return of the sea breeze. our inland spots still moderate. of course it would help to get some rain and stronger wind to mix the atmosphere up and give us better air quality but today we're not going to see much rain. we will get clouds at times. cool temperatures as the clouds reflect back some of that sunlight.

upper 40s to mid-50s. just a slight chance of showers on the south coast. the best chance of rain will be thursday. right now partly cloudy skies, kind of overcast conditions around the bay area. you can see some clouds around the peninsula and the north bay with the radar view looking dry. we do have more clouds offshore. as the system drops down the coast, a lot of energy will slide right towards southern california. the system taking shape here, aiming in on santa barbara county with the bay area sitting on the outer fringe. watch what happens in the futurecast as we put it into motion. as we head towards the afternoon and lunchtime, we've got clouds but no green showing up on the futurecast. a lot of that moisture will head into central and southern california. as we get into tomorrow morning, likely patchy fog will be the only thing slowing your monday morning commute. here you go on the northern california view. you can see the showers offshore. again, this system looks like for the most part it will miss the bay area, but our temperatures will run fairly cool as we make our way into the

afternoon. highs around the bay area, 55 degrees around san francisco. inland, though, out to the tri-valley will very likely see highs only in the low 50s today, so a cool sunday afternoon with partly cloudy skies. as you head off to the north bay, you'll see numbers in the low 50s as well. 54 for sacramento and 42 around truckee. so your seven-day forecast looks like we'll maybe see some showers. i think if we'll see any it will be in the santa cruz mountains with light showers at times. tomorrow some fog for the morning and then thursday, that looks to be the best bet for seeing some showers and must-needed sierra snow because we're starting to fall behind with this dry start in december. we are also finding out more this morning about a man who shot -- who was shot by police after he was shooting at passing cars on a hollywood street. 26-year-old tyler brem is not identified as the shooter, though friends and neighbors say they think that it is him. they say that a recent breakup

pushed him over the edge. his girlfriend told nbc news that she had been dating him more than four years and broke up recently and moved out of the apartment. one neighbor says she thinks brem wanted to die. >> he wasn't a bad guy, he just got fed up and just said screw it. i don't know, when you walk down the street shooting at people. that's probably when you expect that you are going to die, like he was most probably asking for it. >> now, police say brem shot at several vehicles, injuring three people. one of those people was critically injured. tens of thousands of russians turned out for a protest challenging prime minister vladimir putin. here's a look at a quiet moscow this morning. protesters say they're disgusted with what they call a fixed election last sunday. experts predict that these protests could mark the

beginning of a change in the country's political culture. and new this morning, iran says it will not return a u.s. surveillance drone. the cia drone crashed in iran last sunday. earlier today a iranian military leader called the violation of the country's airspace and called it a hostile act and warned of a bigger response. u.s. officials acknowledge losing that drone. well, here's something you don't hear too often, a hunter finds himself at the wrong end of his own gun and was shot by his dog. yesterday two friends along with a pet bulldog were out on the road heading out for an earl morning hunting trip in florida. they hit a bump in the road and the dog accidentally hit a rifle firing off a round at his owner. police are still scratching their heads. >> the dog got excited. he was sitting in the middle, got excited and somehow knocked the side of the rifle causing it to fire a round into mr. brown's

leg. >> the dog's owner is being treated at a local hospital and is in stable condition. police are reminding hunters to unload their firearms while they are on the road. a bizarre end to a car chase. last night in whittier police got a call someone had hijacked a stretch hummer limousine. smoke was pouring out of the limo during the chase but then things get even stranger. the limo turns into a neighborhood and the carjacker bales out naked. he continues on running with his hands up for a short distance before a police dog subdues him. that suspect was taken to the hospital for treatment. in australia this morning, thousands of gallons of fuel go up in flames. surveillance video at a gas station shows the fire surrounding a tanker truck which was delivering fuel at the time. fortunately -- rather, unfortunately, the driver suffered major injuries. he was taken to the hospital and is in critical condition. there were reports of lightning in the area, but the cause of

welcome back at 7:23. the raiders hope they can stop history today. they take on the undefeated packers in green bay this afternoon and a win doesn't just end the packers' attempt at perfection. the raiders are in second place in the afc west behind the broncos. the teams have identical records but the broncos hold the tie-breaker. today's game kicks off at 4:15. and the nine's don't have to worry about making the playoffs, they already clinched their division and a spot in the postseason but right now they are on track to clinch a first-round bye in the playoffs. their 10-2 record is the best

rolling. last night the st. louis blues held them scoreless. sharks lose 1-0. espn reports a national league mvp ryan braun tested positive for a banned stub stance. he tested positive for high levels of testosterone during a test. he is appealing to avoid a 50-game suspension. braun helped to lead the milwaukee brewers to the national league central title and into the national league championship series. they lost to the eventual world champs, the st. louis cardinals. and now an altercation, and this is the last thing you want to see. >> and suspensions are expected after this brawl brought a college basketball game to an early end. officials called this game between xavier and cincinnati with a little more than nine seconds left. xavier beat its cross-city rival yesterday. both schools and their conferences say they will review video of this brawl and punishments could be handed out as early as tomorrow.

the effects of a wild police chase in richmond this morning. >> stay there, stay there. >> don't move. >> don't move. that's the police yelling at a woman to stand still after the crash off the regatta boulevard exit off 580 knocked live wires to the ground. chp tells us she was one of four people inside that crash when it crashed around 2:40 this morning. the chase started a few minutes before on interstate 580 when a chp officer tried to stop the driver. police detained that woman and another man and are looking for two more people. pg&e, by the way, says about 400 people are still in the dark right now. they hope to restore power around 10:30 this morning. also new this morning, san francisco police cleared protesters from outside the federal reserve building. the raid started around 4:00 this morning. sfpd arrested 55 people for illegal lodging. no officers or demonstrators were injured.

bullets passed through this door before striking her father asleep in the front room inside their oakland home. >> i was like dad, dad, are you okay? he was just making noises and he wasn't responding. i was like dad, dad. >> reporter: 46-year-old thorn heath didn't respond to annie or her 13-year-old brother who was also at home. the father of three died in their living room. >> when my mother call me, i pick up the phone and she said my husband got shot. i don't know how. >> reporter: married for 20 years, his wife who was at work at the type of the drive-by, says she doesn't know why their house was targeted. >> my husband never have problem with somebody. >> reporter: but this isn't the first time their oakland home than has been riddled with bullets. >> the third time. >> it's very odd because this block isn't gang-related.

>> reporter: carol's god son was killed on city streets. >> we all need to do something about it. you never know, next time might be my time or your time. we need to resolve this. >> reporter: for now, this family says there is little resolution. >> i don't know, because it's like random. >> and that was nbc bay area's elise kirschner reporting from oakland. across the bay nearly a dozen people are injured after a fire in san francisco. it started around 5:30 yesterday evening on ellis street near jones. firefighters contained it in just about an hour. crews say nine people had to be treated for burns and smoke inhalation and more than 200 people are displaced this morning. investigators are still looking into the cause of that fire. customers inside a vallejo safeway narrowly escaped injury when a pickup truck crashed through the front of the store. police say the driver was an elderly man and was reportedly attempting to park his car but hit the gas instead of the

break. here's video of crews removing the truck yesterday. the truck came through the front of the building, accelerated and destroyed several checkout stands. amazingly, though, no one was hurt. >> fortunately at this moment of the day we just had several customers leave after they shopped. at that moment there was nobody in the front lobby. we were very, very lucky nobody was hurt. >> that accident happened around 8:00. the store was able to open of some cleanup. stanford university's lucille packard children's hospital and stanford hospital officials are surveying the damage from a flood yesterday afternoon. a water main break flooded the ground floors of both hospitals, though no patients were affected at packard children's. some were moved from their rooms at stanford hospital. no estimate yet on how much damage that water caused. much more ahead on "today in the bay." still to come, governor jerry brown wants your vote to raise

looking live in san francisco this morning where you can see still a police presence in the financial district where there was a raid that started at 4:00 this morning. 55 occupy protesters were rounded up. they were ordered out because of illegal lodging and some of them remain watching the scene, but the officers are there trying to keep things unoccupied, so to speak. we'll keep an eye on this one, update you as necessary. cnbc's sue herera has a look at the upcoming week in the world of business. >> reporter: the federal reserve and opec will both hold important one-day meetings this week. the fed will discuss key interest rates and any further stimulus measures it may be considering while opec ministers

defend his record by joking with rick perry. >> 10,000 bucks? $10,000 bet? >> i'm not in the betting business. >> okay. >> recent polls suggest gingrich is the alternative choice to romney for republicans as the candidates head to the iowa caucuses in january. it would have been better to bet one bet, not 10,000. five months into the fiscal year, the state controller has announced new numbers on revenue collection and state spending. are the two in sync as the governor and state legislature hoped? i think we've been talking long enough that we know the answer is no. nbc bay area political analyst larry gerston is here. we've been talking about this, quarterly misprojections. >> no great big surprise on one side, a surprise on the other. that's why we get to the good news/bad news thing. the good news is that in fact we got revenues above projections, thanks to part to strong economic growth, right here in

silicon valley, kris. so we were $1.5 billion shy of expectations, now we're only a billion dollars shy of expectations, so that's the good news. there is a good news side to this story. >> it's hard to believe that that is considered good news. let's talk about what is really the bad news here. >> this is the part where we get into the data and learn things. what we learned is the bad news outweighs the good news. it turns out expenditures, the money we're spending for different things are greater, $2 billion greater than planned. you put the two together, $1 billion less than we expected, $2 billion more spending, you've got a $3 billion gap. well, that's not good because these are the kinds of numbers that will trigger the governor to go ahead and make those mandatory cuts that we've been talking about on k through 12 education, higher education, social services programs for the folks caught in their homes, things like that, so it's not

going to be good in that sense. we can expect those in a couple of weeks. >> it's easy to understand with the slump in the revenue that there are lingering effects of a recession here in california, but how do we explain the surge. if we know we don't have the money, why do our expenses keep going up. >> you know, that's what bothered me when i saw the controller's statement on this. friday i called the controller's office. here's what i learned, about $700 million of those extra expenditures were planned. okay, they're going up earlier than people expected but they're already budgeted so that's not a great big worry. but it's the next bunch of money and that's another nearly $700 million that's going out for all kinds of medical assistance programs. for kids, for the old folks, for the poor, you name it. that's money that they did not plan to spend as much. why? because they were hoping for a waiver from the federal government. california gets itself into trouble every year over this.

we think we can do it this way. we don't have to worry about what other folks are doing, they'll make exceptions for us and every time we got bitten back because the federal government says, no, you can't do it that way, so the expenditures now are higher than we ever hoped and that's what's caused the problem and that's what's going to really hurt. >> that's part of the problem is we say hope and hope is a very nice thing, but when you're talking about a state budget, you can't bank on hope. >> exactly. so there's a takeaway here. and maybe two takeaways in a sense. how do we avoid getting stuck in this problem year after year. first, shame on you. why is that? they should have never passed a budget that called for $4 billion extra that were going to come from somewhere and of course it's never come. they took the easy way out of a mess an now we're all paying for it so we all deserve to be slapped. second, elected officials in this state have a history.

by the way, it's bipartisan. there's a history of attempts to circumvent the rules for federal program. we naively assume that california will be the exception to the rule, that the feds will relax the rules. once in a while they do, as they have with automobiles and police. but in fact most of the time they don't and so in the end we wind up adjusting this budget in the middle of the year. suddenly we are spending billions more than we ever thought. we should know better. >> so i want to quickly get your opinion on the gop debates last night. certainly all the candidates seemed to hone in on newt gingrich and tear him apart, but it was that bet that is making headlines. he was trying to joke, i'll bet you $10,000. it makes him seem a little touch that he can afford to lose $10,000. >> and not blink. i think it tells you something about romney's state of mind, how he's grown up as a person, as an adult, how he operates his life and where he thinks

good sunday morning to you. there's a pretty view of the golden gate bridge. we have a few mid and high level clouds out there but no fog. a pretty easy drive or maybe a bike ride heading up towards marin county. not quite as cold. there's more moisture in the air which helps retain some of the heat of the overnight hours. you can see it's cold in novato and napa but most of the bay area, livermore, concord towards fairfield waking up to the low 40s. a little return of a sea breeze has helped to bring in more of that marine air and we'll continue to see onshore winds as we go through the day today. novato, you saw the temperatures and a little patchy fog there too. really we're mainly fog-free. we're seeing high clouds spilling over the coast. mixed clouds we'll call it around the afternoon. highs upper 40s to low 50s. meantime the rest of the bay area should see highs in the mid-50s and it does look pretty

dry. at least a drier forecast than we thought 24 hours ago. as you can see on the satellite view, here are the patches we're seeing. low clouds in and around novato. as we take you further offshore, we've got a system that is starting to get its act together but instead of swinging west to east it is diving south down the coast and eventually will spill towards southern california, so a lot of the moisture and the rain now we think is going to move mainly south of san luis obispo county to the south of the bay area. so we've got some clouds out there for the morning but look for the little pockets of green showing up here in the futurecast. really it's just over my shoulder here rolling down the coast. you can see how all the action really for the most part misses the bay area. around the santa cruz mountains maybe a few light showers later today but that's about it. patchy fog will be the main concern getting into monday morning putting the accumulations for rainfall totals into motion here. notice what's showing up just a little bit in the santa cruz mountains and really everything

south of lake tahoe too so we're not seeing much in the way of any snow. we could use snow in the high country. this system won't be doing it. today we'll see numbers mostly in the low to mid-50s. san jose 44 degrees. 55 san francisco. looking at a few more clouds this afternoon and you see temperatures across the north bay low 50s as we wrap up the weekend. so seven-day forecast looks like patchy fog. we may have more spare the air days due to the fact we're not going to have much wind. then look out for friday. we could really see gusty offshore winds again to wrap up the week so a pretty dry forecast, especially for this time of year. in news looking forward into the week, former penn state coach jerry sandusky will make his first court appearance on 52 counts of child molestation. sandusky will face his alleged victims for the first time in a preliminary hearing on tuesday. several are expected to testify. sandusky is accused of raping or molesting ten boys since the

1990s. hundreds of people are expected to fill the courtroom in central pennsylvania. all other judges have cancelled or moved their hearings or proceedings from the courthouse for that day. we want to recap our top story this morning. california highway patrol officers still looking for two people after a crash in richmond that took out power overnight. a driver crashed into a light pole with two transformers on it around 2:40 this morning as chp tried to stop the driver on interstate 580, the car reached speeds above 100 miles an hour as it tried to exit regatta boulevard. several people ran from the car. one woman stayed behind. she is now in custody along with one another person. the crash knocked out power to over 400 homes and businesses. pg&e says they should have power back by 10:30 or so. we to thank you so much for make you part of our morning. sunday night "football night in america" the giants versus the
