shooting. and here's a live look at 880 in oakland. mike will explain what the signals are. this is "today in the bay." >> good morning, everybody. it's 5:00. thanks for being with us on this tuesday. i'm marla tellez. laura garcia-cannon is off today. >> good morning, everyone. i'm jon kelley. time to check in with christina loren to shake off the frost. >> good thing. we do what we can. the second half of your day, a lot of sunshine, mild conditions. the 60s. this morning it is bitter cold. 30 in santa rosa. we drop off more so in the next hour. as we head through the noon forecast, temperatures are going to jump to the 50s.

and as you make your way home from work, still nice and comfortable. we get to your extended forecast right now. we wan to check your drive. how do we look? >> once we get the frost scraped you have, off an accident eastbound. the accident activity is just about cleared. no slowing through the castro valley over to 880. indeed, marla. there's construction going on. the earlier shot for oakland is coming up. >> it was supposed to be one day only. bob redell is live in oakland now. the latest for us. bob, good morning. >> reporter: good morning to you. most protesters have packed it up and called it a day. they declared victory and announced an end to their shut down of the port of oakland.

that means that the port should return to full operation. later this morning when the next shift of dockworkers are scheduled to show up at 8:00 a.m. and before 4:00 this morning a couple of hundred occupiers who were blocking the apl terminal we're at received word that their tactics paid off. that the 130 long shoremen scheduled to show up at 3:00 a.m. were going to be staying home because of the blockade. protesters discussed the entire shutdown indefinitely. they decided against it. they felt docking the day's pay was already enough and they made their point. >> when working people come together there's power. that's the message. >> this movement is only three months old. think about what it's going to be when it's three years old. >> what do you say to the truck drivers? >> you should check hout the letter that 40 truck drivers up and down the west coast wrote to

us, which is a thank you letter. >> there are also truck drivers a couple of whom we spoke with yesterday who are upset at the shutdown because they weren't going to be table to deliver their goods or do their job, which meant they would lose 250 to $300 in wages for the day. so he was not on board with that. and unlike the support they had during the november 2nd shutdown from the leadership of the long shoreman unit. leadership this time distanced themselves. in hawaii that started yesterday about 24 hours. >> and so the movement continues. in san jose a get out of jail free card of sorts. occupiers who defined city leaders and police for weeks

while camping out at city hall will have the opportunity to avoid legal trouble. the city of san jose is offering to drop all of them if they agree not to set up tents for the next two years. there are reports that three occupiers have signed the deal. this morning the man hunt continues for a gunman who started firing at a fast food restaurant in pinole. witnesses heard three or four shots before people started running. the victim was flown to the hospital. this is crazy. even after the shooting for two hours a line of cars snaked around the crime scene toward the drive-thru window until cops shut it down. concord city leaders will decide whether or not to fork over $400,000 to replace copper

wiring after the the city's biggest metal heist. thieves stole 25,000 feet of copper wire from at least sick parks and one tennis court. today the city council will decide whether or not to spend $425,000 to replace the copper wiring and create vandal resistant electrical pool boxes. the city hopes the insurance will cover about $200,000 of tha that. >> bay bridge wants to hear from you. they'll hold an open house to talk about potential designs for the new path way. the open house will be at the san francisco transportation boardroom starting at 5:30. >> how do you spend your time when you're at the the airport? you go online. jon falls asleep. maybe check in on social media

sites. facebook says that's what many of us do. it's been named one of the world's most social airports. business and tech recorder scott budman is live at sfo with more on that. you have your cell phone. i'm sure people are checking in behind you. >> reporter: very scientific study. people behind me with their cell phones and tablets checking in to say, here i am. i'm on the airport. i'm on my way somewhere else. this is a busy holiday travel time and facebook is taking note. they are keeping track of how many people are checking in via cell phones and laptops on services like foursquare, twitter and facebook to people can tell their loved ones and followers where they are. facebook compiled a list of the top airports for people getting social. san francisco here. sfo, number four in the entire world. a few statistics for you, the top six spots taken up by

domestic airports, airports like denver, atlanta, chicago, number one by the way for social check-ins, los angeles international. facebook says check-ins are up 20 times the normal volume on the 18th of december. on christmas day there's la built of a blip. then people check in for new year's travel. airports are starting to take advantage of this. including here in san francisco. they will give you a little deal. maybe some cash. maybe some cash off a flight. it's similar to check-ins at places like starbucks and the gap and mcdonald's where if you check-in and tell your phone, i'm here getting a hamburger or cup of coffee or taking a flight, they'll reward you can cash. not only at airports but individual airlines are starting to get into the act. so travel with one of these.

it may save you money for being social. i'm scott budman, nbc bay area news. >> good incentive there. thanks. it is 5:08. santa clara city lawmakers are meeting to approve key parts of the 49ers attempt to move south. right now san francisco is deciding it's not going to fight anymore. they have reached out to ed lee to keep the team in san francisco at a new stadium in hunter's point. the mayor says unless the city comes up with $400 million, there's really no point in trying to keep the team. they will review the stadium plan at a meeting tonight at 7:00 at city hall. south bay could lure another pro team. san jose is one of several bay area cities vying to be the new home of the golden state warriors. the team also talking with san francisco. it's entirely possible the team

will decide to extend the lease after the oracle arena there in oakland. >> good morning if you're ready to head out the door. grab an extra scarf or gloves. it's chilly out. >> the puffy coat. the goggles. just kidding. but we do have a concern. it's cold enough in the knot bay. foggy enough to where it could slow you down significantly. take it easy out. there temperatures are cold. 32 in napa. 32 in novato. visibility is dropping off as well. down to a quarter mile in novato. you're at eight miles in san mateo. high pressure is going to be able to build in for about 24 hours before the next area of low pressure is slated to bring us more rain moves in. you can see the core of low

pressure that brought us the showers yesterday now diving into southern california. for us we'll see a nice mild afternoon. but we have another weather maker on the way. a core of low pressure now trekking closer and closer to the the california coastline. we're not expecting first showers even up in the north bay until we hit late thursday. today it ends up like this. temperatures in the 50s at noon. i think low 50s and you'll round out the day in the upper 50s. let's check your drive with mike. >> we'll take you out to the update in castro valley. that's onto northbound 238. east 14th street. all activity is completely cleared off the roadway. but there's some damage to a pole on the side of the road. i'll let you know if it affects the morning commute. live look at oakland past the coliseum.

seven games. and the team is practicing tonight. it will take a hiatus until friday because it's finals week. >> what about the rumor stanford will play notre dame in china in 2013. team spokesman says yes, maybe it's possible. the freezing mark across the board. but it is cold. and we're near record. temperatures much cooler than 24 hours ago when we had a full deck ahead. clear skies overnight make way to a very cold morning. and the moisture that we picked up from the area of low pressure that brought us the showers hanging around, keeping things nice and moist at the surface. so novato you're down to a quarter mile. for the morning patchy fog and frost areas of fog through tonight yet again. then tuesday keep the jacket handy. we should stay nice and mild through the second half of your day. high pressure is in control for the next 24 hours. mild conditions. each afternoon we get rid of the fog. i'm forecasting clearing by 11:00 a.m. in the greater bay area. even in the north bay. temperatures throughout the week stay mild, on the cool side.

the board. stocks dropped on a profit warning that says sales will be impacted by supply shortages. investors are thinking that the deal that they struck may not be that pods. we saw asia fall overnight. europe was a touch higher. and we'll get business inventory. the dow dropped yesterday 162 points to 12,021. the nasdaq lost 34 points to 2612. and some good news for you procrastinators. i happen to be one. a new survey by the national retail federation finds most online stores are extending their drop date to have your gifts delivered by christmas. nearly 90% set the date at december 20th. don't wait longer than that. most retailers say free shipping offering ends. no ifs, ands or buts on the

inland. >> the drive is a little better at the bay bridge toll plaza. the stall has cleared from the toll plaza itself. this is headlights westbound interstate 80. your east shore freeway, photographer steve is perched on the university avenue overcrossing. you see the volume building a bit. no major delays. no incidents. so you have a lot of company for folks driving along the east shore freeway right now. >> we're not the only ones who get up bright and early. dockworkers for the port of oakland being turned away by occupy protesters. that's where bob redell is live in oakland with an update. i guess the question now is when do you suppose the ports will be back in business? >> reporter: well, the idea is hypothetically should be back up in full operation at 8:00 a.m. this morning. that's when the next shift of workers is scheduled to show up.

they did learn they succeeded at shutting down another ship. about 130 dockworkers were supposed to show up. that was called off because there were a couple hundred protesters blocking the entrance. and with that the protesters declared victory calling an end to the stoppage of the port of oakland. the next shift isn't due until 8:00 a.m. they thought about disrupting that shift and continuing this indefinitely. they decided against this after speaking with dockworkers. >> i don't think they would be a good relationship to spend another day. they gave up a day's pay, you know. another day wouldn't have been good. >> this all started roughly 24 hours ago yesterday morning when

they succeeded in blocking the morning shift. then they succeeded in blocking one of the evening shifts. it's not clear if they shut down all operations at the port. we know they disrupted some of them. at the peak there were roughly 1,000 protesters out here. this action was condemned by mayor jean quan of oakland. the leadership of the union which had seen the support of this action on november 2nd when they did something similar seemed to distance themselves this time around. one of them moments ago in the sound bite who were in support of yesterday and today's actions. here in oakland, bob redell, jon, marla. >> bob, appreciate the update. thank you very muff. ucsf is making safety changes to the shuttle after an accident killed the ucsf doctor on his way to work. the university will add seat belts to all the shuttles as well as safety signs and hot line numbers on the outside.

people can file complaints or concerns about shuttle safety. ucsf doctor kevin mack was killed and four others hurt when a shuttle in route to the hospital collided with a tractor trailer in hayes valley in july. witnesses say the shuttle ran a red light. >> this morning they are on hand to try to help students cope in the wake of a sex scandal on campus. math and science teacher andrew katrell is charged with having sex with an underage former student in clayton. prosecutors say that student was under the age of 16. the district's superintendent says the crisis team is available to talk with students and staff. right now the teacher is being held on $975,000 bail. >> the number of police officers killed in the line of duty is spiking this year. the national law enforcement officers memorial fund says 166 officers have died this year,

compared to 146 last year. the memorial fund says 2011 could be the first year gun related deaths outnumber traffic and other related deaths on the job. there's a warning for internet hackers. the state is adding muscle to combat cyber crimes. attorney general harris will be in san jose to announce the creation of a new unit within the california department of justice. the task force charged with investigating cyber crimes and other crimes involving technology. high-tech crimes cost the world nearly $400 billion each and every year. 5:35. people are getting social at the airport. they are logging in to connect. we want to check in with business and tech reporter scott budman at sfo. i know you have your cell phone with you. people are checking in behind you? >> reporter: yeah, good morning.

people are not just flying and not just traveling here at the airports, they are letting people know the sites like twitter and facebook and foursquare that they are here and they want to be the mayor of sfo. checking in all over the place has been big business for a lot of companies. starbucks has gotten into the act. mcdonald's, the gap, all sorts of places. now airports are getting in on the act. checking in at airports all over the world so often that facebook decided to make a list of the top. let's go to the top five. we have a couple here in california. los angeles international airport. the most social airport. facebook says that's where people are checking in the most. here in san francisco, number four. dallas, ft. worth rounding out the top five. in fact, number seven is kingsfield smith airport in

down to a quarter mile or less. particularly novato. overall we're looking good for the second half of your day. it's cold tout there this morning. 30 in santa rosa. 32 at freezing in novato. 36, a few degrees above freezing in concord. and two degrees above freezing in livermore. as we head throughout the next few hours we continue to drop off. so we're okay in terms of visibility. we have moisture that rolls through. you can see high pressure is moving in. that's why we have clear conditions all the way through the bay area. throughout the next couple of days another round of rain is on the the way. s the the next weather maker that will dive in late tomorrow.

commercials, you're going to like this. congress passed a law called the calm act. commercial advertising loudness mitigation. this time last year. this week, thursday is the deadline for the sec to come up with rules to determine how to get that done. broadcasters, cable operators, big and small, will be required to bring down the volume on those commercials, make sure it matches the programs that you're watching. how to do that, that's what they're working out in a meeting at is fcc today. cable operators in particular say they're getting program from all different sources, millions of commercials. they can't be responsible for the volume of every single one. a couple in particular told the scc they boost the volume

because some go in so low. they want to make sure they can still do that, boost the volume of the entire channel. so they've got some things to work out. they'll give the majority of them a year to comply. some may get a little bit longer than that. over the next 12 months you may start to hear a difference. >> can't wait. thank you very much. a big vote in washington this morning that could mean a thousand dollar difference for your wallet. the house is expected to vote and pass the gop payroll tax cut extension. president obama, though, says he would veto any payroll cut bit that has add-ones. the senate voted to defeat the regulation. >> 5:34 now. a new field poll giving jerry brown's tax proposal strong support.

6% of adults support his plan to increase the sales tax by a half cent and raise taxes on high-income earners starting with individual who is make more than $250,000 per year. brown says his proposal could raise nearly $7 billion for the state. american airlines will be in court this morning just weeks after filing for bankruptcy. today's hearing in new york will be the first since the company declared bankruptcy. the new ceo says expensive labor costs force to board to make the tough decision so the company can move forward. analysts say it will emerge stronger in a process that will take a year or longer. >> they get to the bankruptcy plan process. >> america is the only major airline that did not file for bankruptcy protection after the september 11th attacks.

this morning a small pennsylvania town center stage for the scandal that captured a nation. jerry sandusky will be leaving court now earlier than expected. michelle franzen is live in state college, pennsylvania. michelle, right now we're hearing sandusky has waived his preliminary hearing so he's not going to face the accusers after all. >> reporter: that's exactly right. this a surprise move as the hearing was set to get under way, a judge said all rise. and jerry sandusky ask he waive his right to a preliminary hearing. up until this point the defense attorney said they would go through with the hearing giving them an opportunity to see what they had and to cross examine his alleged accusers. ten were named in a grand jury report that was issued a month ago. about eight of them along with other witnesses were said to

u -- were going to testify today. that will not happen now. instead, jerry sandusky has left the courthouse. he'll have his arraignment for january 7th. several press conferences are under way. the prosecution spoke a short time ago saying they plan to move forward with the case. of course, with the arraignment. but waiving the rights to the preliminary hearing certainly spares the alleged victims from having to testify and face cross-examination at this time. you can see the media frenzy around this small town. it's about 15 minutes outside of penn state. the focus, the center of this case now as this plays out. again, jerry sandusky in a surprise move, waiving his right to a preliminary hearing. >> michelle franzen, thank you

dog walking rules in san francisco could be changing. supervisor scott weine wants to limit the number of pooches that dog walkers can walk at the same time. right now the maximum number of dogs is eight. the walkers argue you can't make money if there's a restriction. if approved the ruled would take effect in october of next year.
