in the south bay. san jose police say an officer shot and killed a man in self defense overnight. so far it's unclear why police targeted the man or if the man was armed. the ambulance rushed the suspect to a nearby hospital where he died early this morning. >> 5:02 now. is baseball's home run king headed to prison? that's the big question today as a judge prepares to sentence barry bonds. bob redell is live in san francisco with a look at what the judge is considering. this is a big story, good morning. >> good morning we know what she'll decide in six hours. when u.s. district judge is going to sentence barry bonds here in federal court in san

francisco for his obstruction of justice before a grand jury investigating steroids in baseball. now the prosecution is asking for 15 months in jail. the federal probation is asking for house arrest. barry bonds' attorney says they would go along with probation, not house arrest. our legal analyst doesn't see jail time. he thinks house arrest is more likely, given this is bonds' only conviction and that he has done a lot for the community. he has set a precedent by sending other people who were convicted, who have lied and giving them house arrest so that is his best bet. she's already established that precedent. >> now our legal analyst sees one wild card, and that would be

his personal trainer who spent more than a year in jail for refusing to testify against the slugger. feeling maybe he put his friend on the line. that would be the only wild card in his opinion. >> big story. we'll be watching it. a toddler killed by a stray bull let in oakland will be remembered today. hiram lawrence would have turned 2 on december 28th. the boy was in his father's arms when gunmen started shooting at a crowd last month. organizers say too manydown

change have died because of gun violence in oakland. 3-year-old carlos was hit by a stray bullet in a drive-by shooting in august. >> 5:05. still no sign of a convicted sex offender wanted in the violent rape of an east bay woman. steven paul clark is still on the the loose in san diego. he is considered armed and dangerou dangerous. >> he is on the run after he bound, raped and gagged a woman in oakley. he hopped a fence and ran away. this morning after 2,000 gallons of diesel fuel spilled, people became very ill.

now people downstream of the creek are getting sick. much of the 1600 gallons of fuel that poured out of a malfunctioning generator was pumped to strawberry creek, which flows into the san francisco bay. environmentalists are concerned about fish and wildlife that live in and around the creek. >> this morning oakland is taking steps to crack down on them. they will vote on new rules to keep protesters from shutting down port business. protesters blocked access twice in recent months. the most recent cost the port $4 million in lost business. the last occupy tent city standing this the bay area could be shut down soon. berkeley city leaders are fed up with violence, drugs and fillth.

more citations are on the way. at least 23 crimes have been reported since october 23rd, including a massive fight and allegations of dpesic abuse and a suspected thief found at the site armed with a machete, hammer and bb gun. another company is going public. business and tech reporter scott mcgrew joins us now. zinga is expected to make a strong debut. >> some say it will be the biggest public offering since google. he will ring the opening bell this morning in new york city. some time there after. prices at $10 yesterday. that's for insiders and barngers.

the salvation army is planning to distribute boxes of foods and personal care items of thousands of natives in the bay area. they still need your help. the salvation army says requests are certainly up. >> good morning to you. donations are certainly needed. they have to get them out the door. they have to get them distributed to the families on tuesday. they have about maybe three-quarters of that full. jon, can you talk about what kinds of things you need people to bring in? >> we try to provide a christmas

meal in a bok. we need things like stuffing and food and vegetables. things to really make a fun christmas meal for the families. we're in need of canned fruit and vegetables. >> we were talking about this earlier. people were, i guess, identified earlier, i guess in august, that need this food. what kinds of people are you seeing coming in? >> there's all types of demographics. certainly a different level of family coming in. people last year were donors to the food banks. so they're just now unemployed, recently laid off, but they need a little bit of help this christmas. >> and you need this by today so you can get everything boxed up and out the door by tuesday. they're going to be here accepting donations as well you can go to any salvation army

pattern, spare the air dry days are very likely. 58 and 65 around santa rosa. a quick check of your seven-day forecast shows things will be dry. they have updates on the s san mateo bridge. >> here's video from a few minutes ago across the westbound direction with taillights for the bottom of your screen you see flashing lights. they did not do a full traffic break. that will quickly make its way through traffic all the way across. we'll see it pull over to the flat section. that was a few minutes ago.

good morning. welcome back. meteorologist rob mayeda in for christina to talk about chilly temperatures. >> it's cold. temperatures at least in a few areas in the low 30s. let's show you some of the numbers. a few spots in the 40s. we have a little bit of wind. look at san jose. oakland and hayward near the edge of the water in the east bay we're seeing 30s for you. 40s around san francisco and the story is the wind. northeast winds bringing in more mild temperatures.

but that's the exception to the rule. also we have patchy fog up around santa rosa. visibility dropping to a quarter mile. we have a frosty start for most of the gay area. above 1,000 feet it's a little breezy. you see a dry afternoon. upper 50s to low 60s. we have the system that brought us showers yesterday scooting through southern california. not just this friday. let's take you to next friday and head up to the start of the christmas day weekend. that's the seven-day forecast. hour by hour, 8:00, it's chilly and breezy around the hill tops. 5 at livermore. 58 in san francisco. your forecast shows the pattern we're seeing starting today is

going to take us through the middle part of next week. >> all right. it's official. next wednesday. the south bay officially in the northbound direction moving smoothly. these speed sensors are the typical northbound route. we have southbound 101 at blossom hill. still have accident activity after an early morning accident. we still have minor slowing at the scene. only one lane closed opposite your main commute. we're tracking that on the chp report. this we were tracking construction and a full closure. but southbound 101 has reopened passing by marsh down to willow. you have one or two lanes closed at 5:30. we'll look at oakland across the bay. a live look shows how things are shaping up northbound. no major issues. the southbound lied with all the headlights.

new reports the u.s. cannot wrangle enough cattle to need the national demand. let's turn to jackie delawaange >> the futures are higher on the heels of a positive close across the board in u.s. markets on thursday. they ended higher on an up ward revision. so merry christmas indeed. meantime, the ford ranger pickup is meeting the end of the road in the u.s. after 30 years of battling japanese imports. they will stop u.s. production. it is the smallest in ford's fleet. the company began making the 2012 focus electric this week.

it expects to earn 100 mile per gallon rating on that one. and where is the beef? japan is expected to lift restrictions on beef imports, that could be a $1 billion boom for the beef industry. meeting the demand means more cows and ramping up production is expected to put a strain on beef providers. that's it for us at cnbc. it's zynga day. we'll take a look at that and nasty things said on twitter coming up.

announced trigger cuts to force the $238 million for bussing starting next month. that makes california the first state to completely eliminate funding for school buses. the largest school district has filed suit. the head of san francisco's zynga will ring the opening bell on the nasdaq and launch the first day of trading for that company. you know him for more than a decade now. you may remember tribes at the turn of the century. he'll turn his latest company zynga, named after his dog, into a public traded company earlier today. last night the company priced shares for zynga at $10 a piece. that's the initial public offerin

>> well, good morning to you, laura. at 11:00 this morning u.s. district judge susan ilsten will be in the federal court behind me to hand down her sentence to barry bonds for obstruction justice before a grand jury investigating steroids in baseball. now the prosecution is asking for jail time. they would like to see him go to jail for 15 months. the federal probation department is recommending something much less. barry bonds and his attorneys are asking for probation without the house arrest. he thinks house arrest is more likely. and also there's precedence for the judge. she didn't send two other athletes convicted of lying to jail. however, there's this wild card. >> i think you always want to

hi, i'm nancy. how are you? i've heard so much about you. i'm doing very well. >> that's good. >> you're just as handsome as you're sister said you are. >> that's so good to see him. catch the interview monday night on bay area. starting monday, pg&e will restore full gas pressure to three of the pipelines on the peninsula. the california public utilities commission is giving the go ahead so customers will have enough gas to heat their homes during the winter. they reduced pipeline pressure by 20% after the deadly san bruno explosion in december of 2010. all lines should be in full capacity by tuesday. the news comes as the victims get ready to face a judge in san

francisco. just days ago pg&e admitted it is liable for the explosion which means it will cover the expenses of victims' injuries. the civil trial is expected to start in july. anch a new study is criticizing food at children's hospital in oakland. they examinened the food at 14 children's hospitals across california and how it was being marketed. they were given the lowest score. only 7% of the entrees for sale were healthy. they also criticized them for putting high call row items near cash register to encourage impulse buying. food banks and shelters across the country are reporting a spike in demand as a tough economic times push more people to charities. salvation army says requests are up and donations have dropped.

they decided to pass the $1 trillion spending bill with a couple of changes of issue that had really been a hang up for democrats and republicans. democrats agreed to delay some energy efficiency rules. republicans put off restrictions on people visiting and sending money back to cuba, two issues that seemed to hold this up. the payroll tax, the extra 2% that could come out of your check as of january, that they hope to extend the tax break another two months and extend unemployment benefits, and, of course, ask many californians. so we could be looking at yet another showdown in february. two two top ten state leaders are in court for failing to report child abuse.

hen and gary schultz face one count o lying under oath and one count of failing to report. prosecutors say the men knew that he was molesting boys and did nothing to stop it. attorneys say the men are innocent. the men who witness it. assistant coach mike mcqueary is testifying this morning. >> he is the most controversial sheriff in the west. and now the feds are accusing arizona sheriff joe arpaio of unfairly targeting latinos for arrest. they just released results of the three year investigation into his practices. the feds say they culture discrimination against latinos.

>> the federal law banning same-sex marriage will be challenged today in the san francisco courtroom. a federal employee is challenging the constitutionality of the defense of marriage act, also known as doma. ninth circuit court of appeals lawyer sued the government after her wife was denied health insurance coverage. >> 5:45. a bay area company is asking the government to make one of the drugs the first approved medication to prevent the spread of hiv. the scientists say it's drug sharply reduces the risk of hiv infection if those who don't have aids virus, but who engage in risky practices that lead to the disease. the drug has been used for years

over the weekend, saturday night and sunday night there will be a foreclosure. they're demolishing the overpass. looking to the south bay with a smooth drive, we head southbound to the 101 accident at blossom hill. that accident activity has cleared. all lanes have reopened now. we see how things are shaping up outside the golden gate bridge. some moisture in the air. fog is not so much of an issue now. all the way from highway 12 down to the city here. just a few cars in the tash lanes. we won't see the metering lights for at least half an hour. >> we have an update on developing news from san jose.
